SECTION B – SUPPLIES OR SERVICES & PRICES / COSTS

1. Contract Definition

The Northwestern Division Regional $75M Section 8(a) Small Business Set-Aside Pre-placed Remedial Action Contract (PRAC) is an Indefinite Delivery / Indefinite Quantity (ID/IQ) Multiple Award Task Order Contract (MATOC) issued as part of the U.S. Army Corps of Engineers (USACE), Northwestern Division (NWD) Multiple Environmental Government Acquisition (MEGA) Strategy.

This ID/IQ MATOC PRAC has been issued under NAICS Code 562910, in support of existing and future USACE customers of the five Districts (Seattle, Walla Walla, Portland, Kansas City, and Omaha) within the Northwestern Division of the Army Corps of Engineers (USACE), which has a geographic footprint covering the following states:

Washington, Oregon, Idaho, Montana, North Dakota, South Dakota, Minnesota, Wisconsin, Wyoming, Nebraska, Iowa, Colorado, Kansas, and Missouri. In addition, this MATOC includes missions for the Environmental Protection Agency (EPA), Region 2 in the states of New York and New Jersey. Firm fixed price and/or cost reimbursement Task Orders may be written against the ID/IQ contracts.

All Task Orders to be awarded under this MATOC will be competed in accordance with (IAW) FAR 16.505(b)(1), Fair Opportunity, and DFARS 216.505-70, Ordering Under Multiple Award Contracts, unless one of the exceptions to fair opportunity at FAR 16.505(b)(2)(i) applies. IAW FAR 16.505(b)(1) and DFARS 216.505-70 Task Order selection will be tailored to specific project requirements and awarded IAW pre-established factors and evaluation criteria. Factors may consist of, but not be limited to, the following:

1. Company Experience

2. Performance Confidence

3. Cost/Price

The Government’s target is to award five (5) contracts under this solicitation; however, if the Contracting Officer determines during the source selection process that fewer or more than five (5) contracts should be awarded, based upon the selection criteria, the Source Selection Authority has the discretion of adjusting that number, or awarding none at all.

Please ensure that NAICS code 562910 is incorporated in your current Contract Registration at the System for Award Management (SAM), https://www.sam.gov/portal/public/SAM/

Failure to have this NAICS code current in SAM may result in not being considered for the award.

***NOTE***

When contacting the SAM Help Desk with issues relating to registering for a CAGE Code, please DO NOT ask for CAGE Code help, instead ask for help with SAM Registration which will end in a better result and assistance with the SAM Help desk.

2. Eligibility

The contract will be awarded only to qualified Section 8(a) small business offerors who are eligible under the requirements of this solicitation.

3. Total Amount of Contract

The total amount of the MATOC with shared capacity among all Contractors awarded contracts under this solicitation shall not exceed $75 million. There is no limit of the number of Task Orders that may be executed against this contract. The cumulative total of all Task Orders issued under the MATOC shall not exceed the total contract capacity amount of $75 million.

4. Guaranteed Contract Amount

The minimum guarantee for the IDIQ is $2,500. Task Order 0001 will be issued under each contract awarded as a result of this solicitation. The Task Order will satisfy the minimum guarantee of the contract terms and conditions.

Task Order 0001 will have a period of performance for 3 years. If additional Task Orders are awarded under the contract, Task Order 0001 will be de-obligated and closed at no additional cost or liability to either party.

5. Performance Period

Contracts will have a basic ordering period (three (3) years) plus one option period (two (2) years), or until the $75 million contract limit is reached, whichever comes first. This Solicitation also includes FAR 52.217-8, which if necessary, allows the Government to extend the term of the Contract an additional six (6) months. The total length of the contract ordering period, including the exercise of all option periods, will not exceed five years and six months from date of contract award.

6. Pricing

6.1 Firm-Fixed Price (FFP) Task Orders.

FFP Task Orders will be for services performed at prices expressly provided for therein and based on the rates proposed by the offeror in the tables below. Profit will be reflected in individual Task Orders issued. The price for each firm-fixed price Task Order shall be based on the hourly rates for labor disciplines proposed by the offeror in the “Hourly Labor Rates, Firm Fixed Price” table shown below, and the offeror’s proposed markups for the other direct costs in the tables below. All hourly rates shall include Overhead, General/Administrative, Labor Burden Fringes, and any other markups that are included in the offeror’s fully burdened rate. All hourly rates shall be exclusive of profit. If a discipline is not listed in the Hourly Labor Rates table and is required for a specific Task Order, that labor rate will be determined before award of that Task Order.

The offeror shall submit its proposed rates for all disciplines and years listed in Table 1 below. The rates proposed will be legally binding and will be the maximum rates that the offeror will use for all firm-fixed price Task Orders.

Lower rates may be offered at the Task Order level, if deemed appropriate by the offeror. Offerors shall provide one rate per labor discipline, including those provided by subcontractors. The offeror may not have all personnel on staff. Therefore, if those personnel are subcontracted, their rates shall be provided in the tables as well. The rates provided per labor discipline shall be fully burdened rates, exclusive of profit.

The offeror shall only provide the Overhead and G&A rates for the prime, even if the labor disciplines will be performed by the prime or a subcontractor, depending on the Task Order. The subcontractor would be subject to honoring the labor rates stated for the subject labor discipline.

NOTE: If during the Contract Period of Performance, the Contractor’s original subcontracted personnel are no longer available to the Prime, the Prime shall find a subcontractor that has at a minimum, the same qualifications as the previous subcontracted personnel. The Prime shall be responsible for negotiating the labor rates for those personnel that have been provided in this Solicitation. Those rates provided in Section B, Table 1 are the maximum that will be paid by the Government for any replacement personnel.

In Table 2 (Rates/Markups) below, offerors shall show the breakout of all rates and markups that are incorporated into the fully burdened rates proposed by the offeror in Table 1.

Maximum rates shall be governed by the date of the Task Order requirement. Task Orders will use the prices for the 12-month period effective on the date the Task Order is issued. Modifications to Task Orders will reflect the rates of the "current 12-month" bid schedule. For example, if the rate schedule changes over on 1 November of each year, and a Task Order is issued on 1 Sep 2018 for 12 months work, the maximum rates will be the rates that were effective on 1 Nov 2017. Under the same assumptions, if a modification to this Task Order is required in December 2018, labor rates effective on 1 Nov 2018 will apply.

4.2.3 for further details.

6.3 Profit/Fee on Firm Fixed Price and Cost Reimbursable Task Orders

Offerors shall propose a maximum profit rate (for firm fixed price work) and a maximum fixed fee rate (for the project-specific cost reimbursable work) in Table 3. The proposed maximum profit rate will be legally binding and will be the maximum profit rate the offeror will be allowed to propose for all firm fixed price work performed under this contract. The proposed maximum fixed fee rate will be legally binding and will be the maximum fixed fee rate the offeror will be allowed to propose for all cost reimbursable work performed under the Task Order. Lower rates may be proposed on subsequent Task Orders/Modifications. Profit and fee will be negotiated on an individual Task Order and modification basis.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT YOUR EVALUATION OF THE

CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the Contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the Contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the Contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the Contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that Contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the Contractor has not yet identified corrective actions. The Contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the Contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the Contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the Contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.

PRAC SAMPLE PROJECT SCOPE OF WORK – FIRM FIXED PRICE

AND BID SCHEDULE FOR SCENARIO 1

1. INTRODUCTION:

1.1 General – This sample project is intended to enable the government to evaluate an offeror’s price proposal for an in-situ treatment program and to evaluate the offeror’s understanding of the work. The price proposal will be evaluated for price reasonableness.

1.2 Contract Type. Assume a Firm-Fixed-Price Task Order to perform the activities described in this Sample Scope of Work.

2. LOCATION

The Superfund Site (Site) is located in an industrial area in the town of Dover, Morris County, New Jersey.

3. SITE HISTORY

In the 1960’s a water supply well was drilled and is one of the town’s primary water supply wells. Chlorinated VOCs were discovered in the 1980’s through an initial investigation. Throughout the 2000’s, soil was excavated from various source areas in the vicinity of the water supply well. In 2010, 9,900 pounds of sodium permanganate was introduced via 33 injection points to address groundwater contamination in the known source area. During follow up sampling, it was identified that contamination remained and reinjection in 10 of the existing injection points is required.

4. SITE CHARACTERIZATION

4.1 Physical Setting and Climate:

The site is located in an industrial community, approximately 1.5 miles east of potable water production wells. The wells serve a local community of approximately 22,000 people.

4.2 Soil Conditions:

The Site lies within the Rockaway River Valley which is composed of stratified sands, gravel and silt. The shallow aquifer is primarily composed of medium to coarse sands with gravel and cobbles and ranges from 8 to 10 feet thick.

The shallow groundwater flows south toward the Rockaway River. Shallow aquifer lies directly on top of bedrock in the southern portion of the source area.

4.3 Groundwater:

The shallow aquifer beneath the source area ranges from 8 to 10-ft thick with the top of the groundwater located approximately 10 feet below ground surface. The aerial extent of the remaining area to be treated is approximately 50 feet by 75 feet.

5. REMEDIAL ACTION SCOPE OF WORK

The objective of this phase of the sample project is to reduce the residual volatile organic compound (VOC) source material in the remaining groundwater source area in order to enable naturally occurring attenuation processes to more rapidly reduce VOC concentrations in groundwater. The effort under this sample project scope of work consists of injecting chemical oxidant into 10 existing injection points (completed to 20 feet below ground surface) to remediate groundwater contamination’s remaining source area, and includes:

Documenting the means and methods being proposed for completion of the work under each item in the proposal (bid) schedule below; this information shall not exceed 5 pages total. Include any assumptions that are in addition to the government-provided parameters of this project.

Catalyzed hydrogen peroxide (CHP) injections (35,000 pounds/3,712 gallons [gal]) of 34 percent peroxide), injected at a maximum concentration of 11.3 percent hydrogen peroxide solution. Assume an injection rate of 5 gallons per minute (gpm). Assume a maximum injection pressure of 60 pounds per square inch (psi).

Sodium permanganate injections (3,300 pounds/286 gal of 40 percent sodium permanganate diluted to 2,860 gal of 4 percent solution). Assume an injection rate of 3 gpm. Assume a maximum injection pressure of 60 psi.

Process monitoring (performed during the injections).

Prepare an Interim Remedial Action (Closeout Report). Assume the cost to prepare this report (draft and final versions) is $75,000 (fully burdened).

A summary of the proposed oxidant masses is provided in the table below.

SECTION J, ATTACHMENT - 2b

PRAC SAMPLE PROJECT SCOPE OF WORK – COST PLUS FIXED FEE

AND

BID SCHEDULE FOR SCENARIO 2

1. INTRODUCTION:

1.1 General – This sample project is intended to enable the government to evaluate an offeror’s cost proposal to perform the work and to also gage an offeror’s understanding of the work. The cost proposal associated with this sample project will be analyzed for cost realism leading to a probable cost determination for this cost-plus-fixed-fee project.

1.2 Contract Type. Assume a Cost-Plus-Fixed-Fee Task Order to perform the activities described in this Sample Scope of Work.

2. LOCATION:

The Superfund Site (Site) is located in a light industrial area in South Plainfield, New Jersey.

3. SITE HISTORY:

From 1936 to 1962, a facility manufacturing electronic parts and components including capacitors operated at the site. During site operations, the company released/buried material contaminated with polychlorinated biphenyls (PCBs), which resulted in contamination of site soils. The only contaminant above action levels at the site is PCBs.

The remedy associated with this sample project is excavation and offsite disposal. Due to the large area impacted by this contaminated fill material, the site was divided into a number of areas to better manage the remediation. Each of the areas is being remediated in a designated phase. This project covers one phase of the work.

4. SITE CONDITIONS:

4.1 Physical Setting and Climate: The area of the site included in this phase of remediation consists of a park located adjacent to a light industrial area of the city. The park consists of a level and open grass area. Access to a major interstate highway is approximately 7 miles from the site.

4.2 Soil Conditions: Soil to be excavated consists of a variety of materials, from silty sand, to sand. The unit weight of the soil is 1.6 tons/bank cubic yard (bcy). The total amount of soil to be excavated is 65,300 bcy. The amount of soil requiring offsite disposal is 26,700 bcy. The soil that does not require offsite disposal will be used onsite as backfill.

The top one foot of the contaminated interval requiring disposal is above the TSCA threshold of 50mg/kg for PCB contamination in soil and EPA has approved this material to be disposed of at a Subtitle C facility. The underlying two feet of the contaminated interval requiring offsite disposal can be disposed of at a Subtitle D facility.

The pre-design investigation (PDI) indicates that 34,10033,700 bcy can be used onsite as backfill. This volume includes clean overburden and soils excavated in order to bench the excavation to ensure excavation stability. The remainder of backfill will be imported from offsite.

4.3 Groundwater: Groundwater in the area targeted for excavation is encountered at approximately 10 feet below the ground surface.

5. SITE CHARACTERIZATION:

Site characterization indicates the limits of contaminated soil are bounded by a rectangular area of approximate dimensions as follows: 300 feet by 800 feet. Contaminated soil above action levels occurs within this area in the 4 to

7-foot depth interval with the top 4 feet of overburden and benching soils around the perimeter being below cleanup criteria.

6. REMEDIAL ACTION SCOPE OF WORK:

The general scope of work includes excavation of contaminated soil; sampling and analysis of soil to ensure remedial action objectives have been attained; transportation and offsite disposal of all excavated waste; restoration of the park to pre-excavation conditions; and preparing as built drawings and a Remedial Action Report; and other activities necessary for complete and proper remediation of the site. The Project duration is from November 1, 2017 to July 30, 2018.

Waste Handling/Disposal: All waste material will be segregated on site, sampled, and transported off-site for disposal at a disposal facility permitted to accept the waste.

A brief Work Plan (2 to 5 pages) that documents means and methods being proposed for completion of the work is to be submitted with the cost proposal. The Work Plan shall document the offeror’s assumptions including equipment to be used and production rates assumed. The proposal (bid) schedule shall be completed in its entirety.

Also, a detailed breakdown shall be included for each proposal line item. The breakdown shall include labor, equipment, materials, subcontract information, and any other information as necessary for the government to understand the basis of the Contractor’s proposal.

Below is a compilation of assumptions and technical requirements for the offeror to consider in development of their cost proposal. Costs have been provided for several subcontract type items the offeror should use in developing their estimate. The reason these costs are provided is to reduce the number of quotes offerors need to obtain for a project that is hypothetical and to limit the number of variables in the cost realism evaluation.

6.1 Development of Pre-Work Submittals – assumed cost: $75,000 (fully burdened).

6.2 Confirmatory sampling required at base of excavation with one sample from each 30’ x 30’ area at the base of the excavation and one sample per 100-ft along the sidewalls of the excavation across the depth interval of 4 to 7 ft.

bgs. Confirmatory samples shall be analyzed at an offsite laboratory by EPA for PCBs only.

6.3 Assume 1-1/2 to 1 slope for benching of excavation.

6.4 Assume no laboratory costs – all laboratory analysis including sampling of borrow material, will be performed by an EPA laboratory at no cost to the project.

6.5 The topsoil overlying the excavation area shall be scraped off, stockpiled, and re-used as topsoil during backfill operations. Additional backfill shall be obtained from an off-site borrow source. The top 6-inches of topsoil will be reused during site restoration. The quantity of this topsoil that shall be placed and rolled by the contractor prior to seeding is 4900 bcy.

6.6 All backfill and topsoil shall be tested for volatile organic compounds (VOCs), semi-volatile organic compounds (SVOCs), target analyte list (TAL) Metals, Pesticides and PCBs at a rate of one sample per 2000 BCY or fraction thereof, prior to being delivered to the site. Except for topsoil, backfill shall be placed in 12-inch loose lifts and compacted to 90% standard proctor (ASTM D 698) density with + 3 percent of optimum moisture content. In-place density shall be verified using either ASTM D 1556 or ASTM D 2922. In place density shall be measured at a frequency of 1 sample per lift. Delivered price does not include analysis to certify clean or placement, compaction, and compaction testing.

Excavated soil that is segregated and does not exhibit VOCs, SVOCs, TAL Metals, Pesticides and PCBs above regulatory limits shall be reused as backfill.
