(FAR 52.212-3)

b. All work shall be in accordance with the drawings and specifications or instructions attached hereto and made a part thereof, or to be furnished hereafter by the Contracting Officer or Contracting Officer Representative (COR) and subject, in every detail, to his supervision, direction, and instructions.

1.2 WORK COVERED BY THE CONTRACT DOCUMENTS

1.2.1 Project Description

The work to be performed under this project consists of providing all materials, plant, labor, equipment and services (except those furnished by the Government) to perform maintenance dredging of New York Harbor, Sandy Hook Channel , with placement of the material at the Sea Bright Offshore Borrow Area (SBOBA), and stockpile placement at designated stockpile placement site(s) within the National Park Service (NPS) Sandy Hook Gateway National Recreation Area (NPS - Sandy Hook). Dredged material shall only be placed within the approximately 93-acre placement area in SBOBA with coordinates as identified on the contract plans, and at the designated stockpile site(s) within NPS - Sandy Hook. The contractor will be solely responsible for coordination and compliance with the transportation, offloading, and placement site(s) requirements. See Section 35 20 23.10 18 entitled "SBOBA DREDGED MATERIAL TRANSPORT AND PLACEMENT MONITORING" for more SBOBA information.

The contractor will be required to construct a containment structure(s) for stockpile placement at the designated placement site(s). See Section 31 24 00.00 18 entitled "STOCKPILE PLACEMENT" for more stockpile placement information.

The maintenance for this project consists of dredging approximately 124,075 CY of basic work material based on the before dredge survey performed in September 2024. For more details, see "ESTIMATED QUANTITIES" in Section 00 30 00 "ADMINISTRATIVE REQUIREMENTS" of these

SECTION 01 11 00 Page 2

Specifications. The dredge material has been determined to be composed of sand and gravel.

A summary of the Dredging Areas is shown in the table below:

DREDGING AREAS TOTAL ESTIMATED

QUANTITY (CY)

BASIC WORK - DREDGING AREA A: (-35' MLLW + 2' OD) 124,075

OPTION - DREDGING AREA B: (-35' MLLW + 2' OD) 30,080

OPTION - DREDGING AREA C: (-35' MLLW + 2' OD) 64,565

SHOULD OPTION - STOCKPILE PLACEMENT BE EXERCISED, AN APPROXIMATE TOTAL OF

15,000 CY FROM ANY AWARDED DREDGING AREA SHALL BE PLACED AT THE DESIGNATED

STOCKPILE PLACEMENT SITE(S). ANY MATERIAL UNABLE TO BE PLACED AT THE

DESIGNATED STOCKPILE PLACEMENT SITE(S) SHALL BE PLACED AT SBOBA, AS

DIRECTED BY THE CONTRACTING OFFICER AND/OR CONTRACTING OFFICER'S

REPRESENTATIVE. See Section 31 24 00.00 18 entitled "STOCKPILE PLACEMENT" for more stockpile placement information.

Contract time for completion is based on a minimum average production rate of 8,000 cubic yards (CY) per day for dredging, transportation, and placement at the SBOBA. Should the total quantity of material exceed the estimated quantities within the Solicitation Contract Form, additional time will be allowed at the rate of one (1) calendar day for each 8,000 cubic yards in excess of the established limit. Should Option - Stockpile Placement be exercised, additional time of twenty-one (21) calendar days for mobilization and demobilization; and additional calendar days at the rate of 2,500 cubic yards per one (1) calendar day for stockpile placement shall be granted. The time stated for completion shall include final clean up.

The contractor must bid on all items of the bid schedule. The following CLINs require dredging of the New York Harbor, Sandy Hook Channel, New Jersey, Federal Navigation Project, with subsequent transportation and placement of the dredged material at the SBOBA and stockpile placement at the designated stockpile placement site(s) at NPS - Sandy Hook:

CLIN 0002 (BASIC WORK - DREDGING AREA A) - requires dredging to the plane of -35 feet MLLW plus 2 foot allowable overdepth.

CLIN 0005 (OPTION - STOCKPILE PLACEMENT) - requires 15,000 CY of dredged material from any awarded dredging area to be placed at the designated stockpile placement site(s).

CLIN 0006 (OPTION - DREDGING AREA B) - requires dredging to the plane of -35 feet MLLW plus 2 foot allowable overdepth.

CLIN 0007 (OPTION - DREDGING AREA C) - requires dredging to the plane of -35 feet MLLW plus 2 foot allowable overdepth.

Exercise of the options are at the discretion of the Government. CLIN 0005

SECTION 01 11 00 Page 3 may be exercised within twenty-five (25) calendar days of receipt by the Contractor of the Notice of Proceed. CLIN 0006 and CLIN 0007 may be exercised within thirty-five (35) calendar days of receipt by the Contractor of the Notice of Proceed. Additional information on the options are listed below:

a. If exercised, CLIN 0006 and 0007 shall be exercised in the order listed above. CLIN 0007 shall not be executed without the execution of CLIN 0006. The minimum average production rate for the options remains the same at 8,000 CY per day for dredging, transportation, and placement at SBOBA.

b. Exercise of CLIN 0005 is contingent to the USACE and NPS approval of the Pre-Construction submittal, "Stockpile Placement Work Plan".

CLIN 0005 will require the execution of Stockpile Placement Mobilization and Demobilization; and Stockpile Placement Transportation, and Placement of Dredged Material. If exercised, the minimum average production rate for transportation, and placement to the designated stockpile placement site(s) shall be 2,500 CY per day.

c. CLIN 0005AB represents the price difference (positive and negative) between CLIN 0002 (BASIC WORK - DREDGING AREA A), with placement of the dredged material at the SBOBA, and CLIN 0005AB (OPTION - STOCKPILE PLACEMENT DREDGING), with stockpile placement of the dredged material.

For example, if stockpile placement would be a higher cost than placement at the SBOBA, then the price per CY for CLIN 0005AB would be positive to reflect the increased cost. If stockpile placement would be a lower cost than placement at the SBOBA, then the price per CY for CLIN 0005AB would be negative to reflect the reduced cost. If there is no difference in prices between SBOBA placement and stockpile placement, then the price per CY for CLIN 0005AB would be zero.

Based on the before dredge survey performed in September 2024, the maximum quantity available to be dredged is 124,075 CY from the contract areas in the basic work contract area, and 94,645 CY from the option areas of the New York Harbor, Sandy Hook Channel, New Jersey, Federal Navigation Project. For a detailed breakdown of quantity available to be dredged, see paragraph 1.9 "ESTIMATED QUANTITIES" in Section 01 30 00 of the Specifications.

Scow monitoring is required for this project. The contractor is required to comply with Section 35 20 29 entitled "SBOBA DREDGED MATERIAL TRANSPORT AND PLACEMENT MONITORING", of these specifications.

Stockpile placement shall occur at NPS designated stockpile placement site(s). Lot K at NPS - Sandy Hook shall be the primary placement site.

Lot J at NPS - Sandy Hook shall be the backup placement site. Designated stockpile placement site(s) are at the discretion of NPS and are subject to change. Any material unable to be placed at the stockpile placement site(s) due to capacity limits shall be placed at SBOBA. See Section 31 24 00.00 18 entitled "STOCKPILE PLACEMENT" for more stockpile placement information.

Sampling and testing was conducted by the Government in 2017, and the grain size test results are included in the specifications in Section 00 90 01 as Attachment J . The complete sampling and testing results can be found as attachments to this solicitation on SAM.gov.

The New Jersey Department of Environmental Protection (NJDEP) State Water

SECTION 01 11 00 Page 4

Quality Certificate (WQC) for the maintenance dredging of New York Harbor, Sandy Hook Channel, New Jersey, Federal Navigation Project is attached in Section 01 90 02 of this solicitation. The contractor must comply with all conditions of the NJDEP WQC.

U.S. Fish and Wildlife Service (USFWS) issued a Programmatic Biological Opinion on October 2017 entitled "Biological Option on The Effects of Recurrent Maintenance Dredging of The Sandy Hook Channel, Monmouth County, New Jersey on Four Federally Listed Species" (PBO).

1. The issued PBO contains dredge window restrictions for the Sandy Hook Federal Navigation Channel. No dredging of beach or any subtidal area within 300 feet of the MLLW lines shall be performed from 1 March 31 August of each year to protect Piping Plovers.

2. No installation or removal of security fencing, pipeling, or any other temporary structures on the beach shall be performed from 1 March to 31 August of each year to protect Piping Plovers.

3. Should dredging occur between 1 September and 30 November , the Corps will arrange for a survey of all beach within the impact area for the presence of seabeach amaranth plants no more than 14 days before the start of each dredging action. The Corps will mark any plants occurring inside the impact area, but outside of the sand removal area, with string-and-post fencing and appropriate signage.

Project personnel and vehicles shall not disturb seabeach amaranth plants within the fencing .

4. Due to the recent observance of the Northeastern Beach Tiger Beetles, a pre-dredge northeastern beach tiger beetles survey must be conducted between mid-September and mid-October during fair weather.

If any adult or larvae northeastern beach tiger beetles are discovered during the survey, the beetles must be translocated to a USACE, USFWS, and NPS-approved location outside of the dredging footprint. A post-translocation species survey shall be conducted after translocation to ensure no endangered species remain in the dredging foorprint.

As per CLIN 0004 (NORTHEASTERN BEACH TIGER BEETLES SURVEY AND TRANSLOCATION EFFORTS), the contractor shall coordinate with USFWS, NPS and USACE to provide a qualified and approved northeastern beach tiger beetle expert to conduct the pre-dredge species survey, translocation efforts, and a post-translocation species survey. Translocation efforts shall not proceed without the agreement of the USFWS, USACE, and NPS. Dredging shall not commence until USFWS has concurred with the completion of the northeastern beach tiger beetles conservation measure .

5. The Contractor must avoid areas with invasive vegetation as practicable. Avoidance areas shall be provided prior to the start of stockpile placement mobilization. Control measures to minimize the spread of invasive vegetation may be required. Any beach footprint of disturbance must be restored to pre-project conditions.

The contractor must erect two (2) orange construction fencing, supported by metal T posts, around the work area that is along the shoreline in order to keep the public from accessing the work area. The contractor is required to abide by any additional fencing requirements as directed by the Contracting Officer and/or Contracting Officer's Representative.

SECTION 01 11 00 Page 5

Signage shall be placed in accordance to the National Park Service (NPS) Special Use Permit (SUP). See 00 90 02 for NPS SUP requirements.

Security: The Contractor is not required to provide site control services to secure beach access points. National Park Service (NPS) shall have Law Enforcement Rangers on premise for 24-hour coverage. The Contractor is required to monitor the fenced work area for public safety. Any unauthorized person entering the fenced work area must be told to exit the closed area via the onboard PA system on the dredge. If violators do not comply, the Contractor must pause dredging work and contact the NPS Dispatch at 718-354-4711. Work cannot resume until violators have exited the fenced work area. The Contractor shall review the requirements set forth in the NPS SUP and ensure all conditions of the SUP shall be followed. The SUP for this maintenance dredging cycle of Sandy Hook Channel can be found in Section 00 90 02.

Signage and fencing shall remain active on site until scarping and overall disturbance of the beach at the dredging area has stabilized and general safety of the area at the dredging location is held to be acceptable.

Prior to the expiration of the NPS SUP or at the direction of the USACE and NPS, all signage, fencing, and appurtenances shall be removed from the Project Area.

The contractor is required to maintain the fencing and signage throughout the duration of the project until the beach at the dredging area is held acceptable by USACE and NPS. If at any time fencing and/or signage have been displaced due to weather and/or unforeseenable conditions, the contractor must rectify the issue within five (5) hours of receipt of notice of the displacement.

The Contractor shall furnish a 4x4 vehicle or UTV to utilize for fencing and signage installation, as well as transporting USACE personnel for beach inspections. The vehicle must be able to accommodate at least two

(2) USACE personnel. The Contractor shall be responsible for the vehicle throughout the duration of this project and abide by any requirements and restrictions as stated in the SUP.

Due to the inability for a hopper dredge to safely complete the work during a previous dredging cycle, it is recommended that a hopper dredge not be used to complete the anticipated work.

The work is anticipated to be performed within the approximate time period of September 2025 - January 2026. Dredging shall begin in October 2025 and cannot commence until USFWS has concurred with the northeastern beach tiger beetles conservation measure. Landside mobilization for stockpile placement cannot commence until late October 2025. The earliest allowable start date shall be provided by NPS during the Pre-Construction Conference.

1.3 PERFORMANCE OF WORK BY THE CONTRACTOR

The Contractor shall perform on the site, and with its own organization and equipment, work equivalent to at least forty (40) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performance of the work, the Contractor requests a reduction and the Contracting Officer and/or his Representative determines that the reduction would be to the advantage of the Government.
