About this file
This document contains an amendment to a solicitation for maintenance dredging of Cheesequake Creek in New Jersey. The U.S. Army Corps of Engineers, New York District, is seeking to dredge approximately 9,000 cubic yards of material from the creek to a depth of -5 feet MLLW plus 2 feet overdepth. Dredged material will be processed and transported to an approved upland placement site. Work must be performed using a mechanical dredge with an environmental bucket and multiple scows and tugs for dredging, dewatering, and unloading operations. The apparent low bidder must provide permits within 35 days and commence work within 5 days of notice to proceed, maintaining a production rate of 1,000 cubic yards per day. Work is anticipated from July to October 2020 and is estimated to cost between $1,000,000 to $5,000,000, with liquidated damages of $2,020 per day for delays. The amendment provides responses to bidder questions and adds an attachment on regulatory approvals.

SUMMARY OF CHANGES
SECTION 00 73 00 - SUPPLEMENTARY CONDITIONS
The following have been added by full text:
AMENDMENT 0002
SPECIFICATIONS:
1. The following specificaton has been revised, but not reissued: SECTION 00 90 01, Attachment L has been added: Cheesequake Creek Federal Consistency Determination (FC), and Water Quality Certification (WQC).
BIDDER’S QUESTIONS AND GOVERNMENT REPLY:
Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Bidders “for information only” and do not revise the solicitation, plans or specifications.
QUESTION 1: The specifications require a completion period of 30 days in order to lessen the impact to recreational boaters. Our dredging equipment is portable and will not take up the entire channel, allowing boats a means of passage continuously. The project can be completed at a lower cost if allowed more time to offload and transport the material to disposal. Can the completion period be extended to 60 days from notice to proceed?
GOVERNMENT RESPONSE: Responses to the sources sought indicate there are companies that can complete the work in the performance period listed in the specifications. Due to constraints within the project schedule and sources sought responses the completion period will not be extended.
QUESTION 2: The specifications mention that the solicitation is based on a production rate of 1,000 CY per day. This is a tremendous amount of material to transport in one day and will be more expensive than hauling over a more realistic, longer time period. Can the production rate requirement be lowered to 300 CY per day to reduce project costs?
GOVERNMENT RESPONSE: Other dredging projects in the area have met a similar or higher production rate. Due to the responses to sources sought and the successful completion of projects with similar parameters the production rate will remain at 1,000 CY/day.
W912DS20B0009
QUESTION 3: The specifications state the project is anticipated to start in July, August, September or October 2020. The COVID crisis has pushed a lot of our work into the summer.
Could a more specific estimated timeframe be stated?
GOVERNMENT RESPONSE: The current project schedule indicates the work is estimated to begin late July or Early August.
QUESTION 4: Is the beach to the North of Rte 35, to the East of the channel, available as an offload/dewatering area? Is the bulkhead/dock underneath Rte 35 to the South available as an offload/dewatering area?
GOVERNMENT RESPONSE: Coordination for all offloading, dewatering, and processing locations are the responsibility of the Contractor. Local municipality and/or state agency coordination may be required.
