About this file
This document provides responses to requests for information (RFIs) regarding a solicitation for the Fishing Creek South Jetty Rehab and Maintenance Dredging project in Calvert County, Maryland. The scope of work includes rehabilitating approximately 1,000 feet of the southern jetty to a height of 6 feet below the mean lower low water line using 1.5 to 3 ton capstone. An access channel up to 75 feet wide and 10 feet deep also needs to be dredged to access the jetty. Approximately 22,000 cubic yards of material will be hydraulically dredged from the Fishing Creek federal navigation channel and transported via pipeline to an existing nearby upland placement site. The three existing weir boxes at the placement site will be replaced. Contract award is anticipated within three weeks of the bid opening, with notice to proceed issued three weeks after award. The agency will review submittals within seven to fourteen days of receipt. Only the time of year restrictions specified in the project specifications, not those listed in the water quality certification, apply to dredging work.

SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE (SF 30)
The following have been added by full text:
RFI 01:
Per Specification 35 20 23 2.14.1 “The corps is in the process of making the application for approval of the sediment control plan as presented in the plans and specifications.” The paragraph further states it is the responsibility of the contractor to abide by these plans. It was our assumption based on the site walk that these documents would be provide prior to bid. With the receipt of Amendment 002 we have seen that the MDE documents associated with this amendment do not contain MDE E&S documents or grading documents that would be necessary for any repairs or earthwork needed to be completed in the containment site. Please advise as to the extent of scope the contractor is to price regarding E&S permits, grading permits, and any other pertinent MDE permits necessary to perform this scope.
Response 01:
No Sediment Erosion Control permit is needed for this project. No additional permits from MDE are required aside from the already provided WQC. The contractor will not need to submit for additional permits.
RFI 02:
Based on above RFI, if it is the government’s intent to have the contractor submit for these permits, please confirm that the contractor should enlist the support of a licensed Civil/Environmental engineer for submission to MDE if required. Additionally, please advise on the assumed timeline for MDE review and approval since based on recent experience MDE approval can take as long as the current Period of Performance for this contract.
Response 02:
Please see “ANSWER 01”.
RFI 03:
Please advise if the requirements highlighted in the WQC MDE document provided in Amendment 002 have been added to the scope of work/requirements for this project.
Response 03:
Yes, the requirements stated in the WQC from MDE are now added to the requirements for this project aside from Time of Year Restrictions (please see ANSWER 04).
RFI 04:
Please advise how the dredging restrictions highlighted in the WQC in Amendment 002 impact the overall Period of Performance and schedule of this project. Based on our review the WQC and the Specifications are in conflict in that the contract documents do not limit time of year in which dredging can perform, however, the WQC document clearly stipulates timeframes during the year in which dredging is not allowed. Please advise.
Response 04:
Only the Time of Year Restrictions in Section 35 20 23 Paragraph 1.2 of the specifications are to be followed for this project. All other conditions of the WQC are to be followed aside from the Time of Year Restrictions.
RFI 05:
After further review the documents and additional site visits it appears as if the limits of the new jetty conflict with the existing T-Wall. Please advise to the extent of the project’s requirements regarding this conflict.
Response 05:
As stated on Sheet C-102 of the contract plans, “Contractor shall field verify exact locations of existing features.” Sheet C-103 states, “Toe of capstone and extents of geotextile are subject to change following receipt and acceptance of pre-construction surveys due to the dynamic conditions of the site.” The final extents of the geotextile and the capstone will be adjusted in an engineering revision based on the pre-construction survey information. The proposed limits of the new jetty will be in close proximity to the existing wooden breakwater. Note 8 on Sheet C- 001 states, ‘’existing site features damaged during construction shall be restored to original conditions at no additional cost to the government.”
RFI 06:
During the site walk it was indicated that further details regarding the weir boxes was provided in the drawings and specifications. After further review of the documents, there is very little information regarding the existing weir boxes and very little specific information regarding the new weir boxes, piping, and the scope to be provide for this facet of the contract. Please provide additional information regarding weir box construction and weir box piping scope.
Response 06:
Weir boxes are to be designed by the contractor and necessary plans are to be submitted to USACE for engineering review and approval.
RFI 07:
When fast does the USACE expect to award the contract by as well as issue the NTP?
Response 07:
Contract Award will be issued approximately three (3) weeks after the Bid Opening. The Notice to Proceed (NTP) will be issued approximately three (3) weeks after the Contract Award.
RFI 08:
How quickly will the USACE review all the paperwork and submittals?
Response 08:
USACE will review any submittals within 7-14 days of receipt.
RFI 09:
What Time of Year Restrictions are we to follow, the ones in the spec or the ones in the WQC?
This will impact how we bid the project. Based on information provided it seems like the Time of Year restrictions were placed on all dredging and not as it was listed in the specification. Therefore it seems like the dredging for the entire site is limited to only be allowed from 16 June to 14 November. Please confirm! Because of the time it will take to award and finalize contracts, time for submittals for the weir drawings, perform the weir and pipework, perform major mobilization and setup, then start dredging it almost makes it impossible to get 22,000 to 28,000 CY the dredging done before the TOY start on 15 November. Which in turn would push the job to the following year to be constructed since the dredging may not be able to get done in time.
Response 09:
Please see previous response to Time of Year Restrictions. The only time of year restrictions that should be followed are located in Section 35 20 23 Paragraph 1.2.
