Questions regarding Solicitation W912DR18Q0046, Greenbrook Flood Control Project, Title Services

Q1) Are vouchers required or does the agency use on-line payment platform?

A1) Invoices must be received before any payment can be made. We pay using an electronic funds transfer (EFT.) See specifications 5(a) and (b).

Q2) Timeframe from submit to payment?

A2) The timeframe from submitting invoices to receiving payment is 30 days.

Q3) May we invoice the seller for document prep and recording fees?

A3) No. All cost are paid by the Government and should be included in the bid. See specification numbers 18, 22 and 24.

Q4) Please provide information about Federal Searches. Not familiar with these new regulations.

A4) Please review the “Regulations of the Attorney General Governing the Review and Approval of Title for Federal Land Acquisitions (2016),” Part 3.4. The pages are attached. Please refer to specification number 8.

Q5) What title agency/ agencies have been involved in this project previously?

A5) We can only provide you with a contract number that was recently awarded since its public information and similar to the requirements of this contract. The contract number is W912DR18P0023. Any additional information should be requested via a FOIA request at foia-nab@usace.army.mil.

Q6) We are a Certified Small Business Enterprise – is that sufficient to qualify our company to bid?

A6) We are seeking a small business to perform this service. If you are not sure if your company qualifies as a small business please visit the Small Business Association’s website at www.sba.gov. In order to bid you must have an active SAM registration.

Also, please see number 10 in the solicitation.

Q7) In the Statement of Work, paragraph 5. (c), the last sentence addresses “court judgments”. What type of actions can be expected that would result in “Court Judgments”?

A7) Liens, bankruptcies, foreclosures and/or monetary judgment amounts. These are examples of court judgments that may be found under this solicitation.

Q8) In the Statement of Work, paragraph 5 (d), the paragraph addresses curative actions. Can you please confirm that all curative work with the exception of partial releases of mortgages will be drafted by the Corps?

A8) No. Drafts should be prepared by the contractor and coordinated with the Corps. Please refer to specification number 5d for additional clarification.

Q9) Can you please confirm that the Contractor’s responsibility regarding curative work lies solely in the review of the Corps drafted documents or consultation with the Corps if the need arises.

A9) No. Corps drafted documents but yes to consultation with the Corps.

Contractor should provide curative documents after consultation with the Corps.

Q10) In the Statement of Work, paragraph 24, it states that the government will prepare the settlement statement and deed and the Contractor shall disburse funds and record the deed.

A10) Yes.

Q11) Will the government reimburse the contractor for the actual recording fees for each transaction?

A11) No. Costs should be included in the bid as part of the closing services.

Recording fees are part of closing services, which should be included in the bid.

Q12) If not, please advise how many pages each deed will entail including the legal description and any other pages that may be attached to the deed or please provide a sample recorded document.

A12) Most deeds will be approximately 6-7 pages, some will require more. Please refer to the answer for question 11.

Q13) On the Pricing Schedule, line item 0006 addresses obtaining partial releases of http://www.sba.gov/ mortgages. Typically lenders require an application fee to be paid upfront with the application. Is that part of the contractor’s fee or is the payment the responsibility of the seller?

A13) Responsibility of the Contractor and the fee should be included in the bid as part of the “obtaining partial releases” service. The seller is not responsible for the application fee.

Q14) Who pays the recording fee for the partial release – contractor or seller?

A14) Responsibility of the Contractor and the fees should be included in the bid as part of the “obtaining partial releases” service. The seller is not responsible for the recording fee.

Q15) The government estimates a quantity of 10 partial releases. In the event more than 10 are required can you please confirm that the government will modify the contract to include the actual number of partial releases as needed?

A15) Yes, the Government will modify the contract should there be more than 10 partial releases. Also see revised bid schedule.

Q16) With regard to the 2 CONRAIL ROWS appearing on the property list – These ROWS appear to be functioning tracks for the NJ Transit trains. What estate is being acquired by the USACE?

A16) Various easements (perpetual flood control and temporary work area easements).

Q17) Will they be extinguishing the rights of CONRAIL or acquiring easements?

A17) Acquiring easements.

Q18) As to the properties located in streets appearing on the property list – What estates are being acquired?

A18) Multiple (fee, temporary and perpetual). Please refer to the specifications.

Q19) Will they be requiring the vacation of streets by the municipality?

A19) In some cases, yes.

Q20) Will they require a search of all properties abutting the street?

A20) No.

Q21) The responses to questions 2a and 2b seem to conflict with one another and the Statement of Work (SOW). Please clarify who is responsible for curative work other than the partial releases - the Corps or the Contractor? We know the Contractor is responsible for partial releases.

A21) Please see answer to number 8.

Q22) In response to the government response to question 6b; If there is a requirement for vacations, the public rights will be extinguished, but what about the private rights of the owners adjoining the street - will they not require those as well? If requiring vacations, who will be responsible to prepare the necessary forms and present to the municipal board (as necessary)?

A22) Please see answers to numbers questions number 19 and 20.

Instructions to Offerors

See block 8. Quotes can be submitted via e-mail at aisha.r.boykin@usace.army.mil or via mail to U.S.

Army Corps of Engineers, Contracting Division, Simplified Acquisition Team , ATTN: Aisha Boykin, 2 Hopkins Plaza, 03-E-09, Baltimore, MD 21201-2530. Email submission is preferred. This is a lowest price, Firm Fixed Price (FFP) contract. The contract will be awarded to the lowest priced quote with relevant and satisfactory past performance as described below.

All line items must be priced. Quotes providing partial pricing shall be considered non-responsive.

REQUIREMENTS FOR QUOTING ON TITLE SERVICES:

1. OFFEROR SHALL PROVIDE A BID PER ITEM AS INDICATED ON THE BID SHEET, FOR EACH

SERVICE ITEM OF THE “PRICE SCHEDULE”.

PERCENTAGES (%) MAY NOT BE ACCEPTED.

2. FAILURE TO BID EACH ITEM AS ABOVE WILL RESULT IN QUOTE BEING CONSIDERED

NONRESPONSIVE AND INELIGBLE FOR AWARD.

Evaluation Criteria

1. Technical -

The offer will be evaluated to ensure all the items below are provided:

• Cover Letter on offeror’s letterhead. Letter shall summarize the pricing total and include offeror specific details such as Cage Code, Tax ID#, and DUNS #. Letter shall be signed by the representative managing the account.

• Capability Statement

• Two (2) Past Performance references for similar projects. Projects must have been completed within the previous three (3) years.

• Two (2) Past Performance Questionnaires

• Bid Schedule – Government template provided

The following adjectival ratings will be assigned to the Technical factor Acceptable: Offer clearly meets the minimum requirements of the solicitation.

Unacceptable: Offer does not clearly meet the minimum requirements of the solicitation.

2. Past Performance-

Any offeror who has demonstrated satisfactory past performance will be considered eligible for award. Any offeror who demonstrated unsatisfactory past performance will not be considered eligible for award. If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through mailto:aisha.r.boykin@usace.army.mil other sources, or if the offeror has no past performance record and cannot tie significant, relevant experience of key personnel proposed for this project to cited experience, past performance will be evaluated neither acceptable, unacceptable or neutral.

Submission Requirements: Past performance refers to the quality of recent project experience from the customer’s perspective. The Offeror shall arrange for the reference customer point of contact for two projects to fill out the Questionnaire and return directly to Aisha Boykin, Purchasing Agent, e-mail at aisha.boykin@usace.army.mil. The questionnaires must be forwarded directly by the references. The Government will not release the questionnaire forms to the Offeror at any time, in order for the Government to solicit candid, unbiased responses and comments. Two References from previously completed jobs must be submitted and include a point of contact and phone numbers. These references must be relevant to the work which will be performed in this contract. Relevant work is defined as title services. References must be recent within the past 3 years.

3. Price –

Price will be evaluated in accordance with FAR 15.402. The government may require additional pricing information to assist in determining the extent to which the price is fair and reasonableness and the pricing information shall be provide if requested. The Government will evaluate quotes for award purposes by adding the total of all CLIN prices to ensure that pricing is not unbalanced. Offeror must complete all line items to be considered for award. All line items must be priced. Quotes providing partial pricing shall be considered non-responsive.
