Solicitation W912DR18Q0046 Question/Response List #2
1. In the Statement of Work, paragraph 5. (c), the last sentence addresses “court judgments”. What type of actions can be expected that would result in “Court Judgments”?
Liens, bankruptcies, foreclosures and/or monetary judgment amounts.
2. In the Statement of Work, paragraph 5 (d), the paragraph addresses curative actions.
a. Can you please confirm that all curative work with the exception of partial releases of mortgages will be drafted by the Corps?
No. Drafts should be prepared by the contractor and coordinated with the Corps.
b. Can you please confirm that the Contractor’s responsibility regarding curative work lies solely in the review of the Corps drafted documents or consultation with the Corps if the need arises?
No. Corps drafted documents but yes to consultation with the Corps.
3. In the Statement of Work, paragraph 24, it states that the government will prepare the settlement statement and deed and the Contractor shall disburse funds and record the deed.
Yes.
a. Will the government reimburse the contractor for the actual recording fees for each transaction?
No. Costs should be included in the bid as part of the closing services.
b. If not, please advise how many pages each deed will entail including the legal description and any other pages that may be attached to the deed or please provide a sample recorded document.
Most deeds will be approximately 6-7 pages, some will require more.
4. On the Pricing Schedule, line item 0006 addresses obtaining partial releases of mortgages.
a. Typically lenders require an application fee to be paid upfront with the application. Is that part of the contractor’s fee or is the payment the responsibility of the seller?
Responsibility of the Contractor and the fee should be included in the bid as part of the “obtaining partial releases” service.
b. Who pays the recording fee for the partial release – contractor or seller?
Responsibility of the Contractor and the fees should be included in the bid as part of the “obtaining partial releases” service.
c. The government estimates a quantity of 10 partial releases. In the event more than 10 are required can you please confirm that the government will modify the contract to include the actual number of partial releases as needed?
Yes, the Government will modify the contract should there be more than 10 partial releases.
5. With regard to the 2 CONRAIL ROWS appearing on the property list – These ROWS appear to be functioning tracks for the NJ Transit trains.
a. What estate is being acquired by the USACE?
Various easements (perpetual flood control and temporary work area easements).
b. Will they be extinguishing the rights of CONRAIL or acquiring easements?
Acquiring easements.
6. As to the properties located in streets appearing on the property list –
a. What estates are being acquired?
Multiple (fee, temporary and perpetual).
b. Will they be requiring the vacation of streets by the municipality?
In some cases, yes.
c. Will they require a search of all properties abutting the street?
No.
