Prospective offerors may submit RFIs at any time; however, the cutoff date for RFIs is 28 July 2016 at 11:00 A.M. EST, unless the Contracting Officer determines an extension is necessary, to be performed by amendment. RFIs received after the cutoff date stated above may or may not be answered by the Government.

2. IMPORTANT NOTE***When submitting your RFIs, please provide the project name, location and solicitation number in the subject line of the email. ALL INQUIRIES MUST BE IN WRITING. Please submit RFIs as email body text or as an attached word document. RFIs received as other file formats may be not considered. Offerors are encouraged to submit RFIs as soon as they become available and not to wait until the cutoff dated to submit all at once.

RFI QUESTIONS & RESPONSES

Question 0001: We request that Bid Item 0006: Dredging – Brewerton Angle – 1 foot Additional Overdepth may be exercised within 15 calendar days of the contract award, instead of 60 days. With the current specification to award the item within 60 days of award, a situation could arise in which the Contractor has already begun work at Brewerton Angle under the direction to only dig 1 foot of Overdepth material.

Response: Please refer to changes in Price Schedule.

NOTES TO BIDDERS

Bidders must quote on all items including Optional Items. Failure to quote on all items may be cause for rejection of the bid. Optional Items may be exercised at any time within 60 calendar days after contract award. The Contracting Officer may exercise the Optional Items by written notice to the Contractor, postmarked within the period specified above. Bid Item 0006 may be awarded anytime within 60 calendar days after award and prior to the start of dredging in Brewerton Angle. The Government may exercise any, all or none of the listed Optional Items in any order. Additional Time for exercised optional items will be allowed as outlined in Section 35 20 23, Paragraph 1.2.

SECTION 00010 - SUPPLIES OR SERVICES AND PRICES

EVALUATION OF OPTIONS: Except when it is determined not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirements. Evaluation of options will not obligate the Government to exercise the option(s).

Any bid may be rejected if the prices for any line items or subline items are materially unbalanced.

An offer is mathematically unbalanced if it is based on prices which are significantly less than the cost for some contract line items and significantly overstated in relation to cost for others. An offer is materially unbalanced if it is mathematically unbalanced, and if –

1. There is a reasonable doubt that the offer would result in the lowest overall cost to the Government, even though it is the lowest evaluated offer; or

2. The offer is so grossly unbalanced that its acceptance would be tantamount to allowing an advance payment.

52.211-18 Variation in Estimated Quantity (Apr 1984)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
