18. The Scope of Work refers to Web Accessible Information Database and Management System (WAIDS). Is this a specific system that is currently being used or is it intended that the CxS can use and host any commercially available system that meets the requirements of the scope of work? If this is a system currently being used please provide additional information on the specific software and confirm that the CxS will have access to this but is not expected to host this.

A: It is anticipated that different customers may use different software systems. Therefore, if a specific system is required for a project, it will be specified in the Scope of Work for that task order.

19. Must all subs be able to receive a TSFCL and maintain TS clearances?

A: No. See answer to question 2. An active Top Secret Facility Site Clearance (TSFSC) is only required for the prime contractors, so sub-consultants may be submitted that do not possess the TSFSC. The key personnel that require the Top Secret Clearance must have that level to be counted as meeting the requirements per the synopsis. Others may be submitted in addition to the key personnel that do not possess them.

20. If a sub is owned by a foreign parent company, will they still be able to get a TS clearance and work on this contract?

A: It depends. If a mitigation plan can be approved, they might be granted a clearance.

21. If a sub performs testing that would be required by one of the construction contracts, will they be allowed to perform both the testing for the contractor and be part of this contract?

A: Probably not but an Organizational Conflict of Interest (OCI) would have to be determined at the time of the potential OCI.

22. Follow-up questions to your previous response to Question #10:

· What is meant by “at the time of the instant procurement”. Does this mean that USACE will consider any possible OCI at the selection of one of the AE design $49M IDIQ’s, or does this mean that USACE will consider any possible OCI at the time of a task/delivery order award to an AE holding one of the AE design $49M IDIQ’s?

A: “Instant procurement” means the issue at hand at that time and not a hypothetical situation. It means that if the Commissioning Contractor is one of the $49M AE SATOC holders, when a requirement comes in, it will have to be determined if a task order on the Commissioning IDIQ will be required and if so, would there be an OCI with any existing AE IDIQ holder. If so, they AE IDIQ holder may have an OCI and could not be awarded that task order.

· Would a Prime AE submitting to win one of the future AE design $49M IDIQ contracts be considered less positively if one of their subconsultant AE’s was also a subconsultant on the Commissioning (Cx) contract?

A: No.

· If a Prime AE were to be awarded an AE design $49M contract, would they not be considered for a specific task/delivery order if their subconsultant had been or is intended to be awarded a Cx task/delivery order related to the same specific task/delivery order? If yes, will there be opportunity for the Prime AE to show that that this subconsultant would not participate in a design project if Cx is anticipated and that there would be no OCI due to the team’s organization?

A: Each situation would have to be dealt with by the specific situation.

23. Please confirm the hand delivery location for the proposal submission due December 3, 2014 at 11:00am.

U.S. Army Corps of Engineers Real Property Services Field Office, ATTN: Carlen Capenos 300 Sentinel Drive, Suite 400 Annapolis-Junction MD 20701.

A: Confirmed. Please deliver to the above address to the attention of Carlen Capenos
