If, during performance of the contract, it becomes necessary for the contractor to substitute personnel for one of those whose qualifications were the basis for evaluation of the offer and award of the contract, the contractor shall submit to the Contracting Officer the same information that was required in the initial proposal regarding the proposed substitute employee. The Contracting Officer shall have the right to review the qualifications of the proposed substitute employee and to approve or disapprove his or her qualifications. 4. When an offeror submits its proposal in response to a Request For Proposals and that proposal contains any work, materials, methods or other type of betterment that provides an advantage to the Government that is above the minimum requirements contained in the RFP, the terms of the proposal will be the basis for evaluation and, if successful, will become the terms of the contract upon award. If a change in one of those terms is made to one that is less favorable to the Government than the one on which the award of the contract was based, a credit to the Government will be negotiated by the contractor. Only the Contracting Officer has the authority to negotiate a waiver of the terms of the contract.

7.0 BASIS FOR AWARD
The Government intends to select for award the single responsible Offeror whose proposal conforms to the solicitation that proposes a price that is fair and reasonable, and that provides the Best Value to the Government. The selection will be based on evaluation of the following evaluation factors: Corporate Experience, Technical Approach, Performance Confidence and Price.
The award will be made based on the best overall (i.e. best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the following evaluation factors: Corporate Experience, Technical Approach, Performance Confidence and Price.
The non-price factors are not of equal importance as shown in Table 3 below.
The Government reserves the right to enter into discussions. In the event that discussions are not necessary then we intend to award without discussions, to the responsible Offeror whose proposal conforms to the solicitation and is determined to be the best value.
The three Non-Price factors, when combined, are significantly more important than price.
Offerors receiving an Unacceptable rating on any individual factor will not be considered for award.
Offerors are cautioned that award may not be made to the lowest price offered.
8.0 SOURCE SELECTION PROCESS
All offers received in response to this solicitation will be evaluated in accordance with informal source selection procedures. The principal objective of this process is to select a responsible Offeror who submits the offer that is the Best Value to the Government.
The process is designed to ensure the impartial, equitable, and comprehensive evaluation of all technically acceptable, responsible proposals received in response to this particular solicitation.
Source Selection Team
The Source Selection Team (SST) is established as a separate organization and management chain of command whose only purpose is to accomplish the objective above. The organization consists of a Source Selection Authority (SSA) and a Source Selection Evaluation Board (SSEB). The organization is designed to ensure active ongoing involvement of appropriate contracting, technical, logistics, legal, price analysis, small business, and other functional staff management expertise.
Source Selection Procedure
The source selection procedures will begin with an initial review of proposals and continue with a technical and price evaluation conducted by the SSEB. The SSEB shall evaluate the proposals based solely on the evaluation criteria previously identified. The results of the SSEB evaluations will be presented to the SSA for decision of award.
To be considered Acceptable, each Offeror shall specifically address each of the evaluation factors. Sufficient detail shall be provided, citing specific data as may be required, such that the proposal may be adequately evaluated. The proposal must show clearly that the Offeror has an understanding of the work tasks required and has the capability and responsibility to accomplish the work.
The Government is not responsible for information overlooked during the evaluation which is not located in the appropriate proposal section. To ensure the evaluation credit is appropriately received for proposal material submitted, do not incorporate by reference documents not contained in the proposal. References to sections of the proposal shall be by specific paragraph number (and name, if applicable), page number, and section.
9.0 TECHNICAL RATING
The Source Selection Team (SST) will use a combined technical/risk rating system that includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. Assessment of technical risk, which is manifested by the identification of weakness(es), considers potential for disruption of schedule, increased costs, degradation of performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance.
Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed in Table 1 and the risk descriptions set forth in Table 2.
Table 1. Combined Technical/Risk Ratings
Color Rating Description
Blue
Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate
Yellow
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable
Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
Table 2. Technical Risk Rating Method Rating Description
Low
Proposal may contain weakness(es) which have little potential to cause disruption of schedule, increased cost or degradation of performance. Normal contractor effort and normal Government monitoring will likely be able to overcome any difficulties.
Moderate
Proposal contains a significant weakness or combination of weaknesses which may potentially cause disruption of schedule, increased cost or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.
High
Proposal contains a significant weakness or combination of weaknesses which is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.
Unacceptable
Proposal contains a material failure or a combination of significant weaknesses that increases the risk of unsuccessful performance to an unacceptable level.
Ratings will be assigned for each of the technical evaluation factors for each offeror. No overall rating will be assigned.
10.0 DEFINITIONS
Rating: The rating for the Technical factor will be expressed as an adjectival assessment of Outstanding, Good, Acceptable, Marginal, or Unacceptable.
Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
Strength: An aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.
Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.
11. DEBRIEFING OFFERORS
Offerors may request a debriefing in accordance with FAR 15.505 Pre-award Debriefing of Offerors, and FAR 15.506 Post-award Debriefing of Offerors.
12. TECHNICAL FACTORS TO BE EVALUATED
The Government will select a single offeror based on their overall merit after consideration of the evaluation factors described above. The relative weight given to the evaluation factors is described in the table below.

01CorpExp, FACTOR 1 – CORPORATE EXPERIENCE
Submission Requirements
Submit a portfolio of at least three example projects and no more than five example projects demonstrating the offeror’s recent, relevant corporate experience. If more than five projects are submitted, only the first five will be evaluated. The projects submitted shall be limited to no more than 3 pages each and any project information beyond the 15 page limit will not be evaluated.
Multiple Award Task Order Contracts (MATOCs) or any other type of task-order contracts that provide for the issuance of task orders for the performance of tasks will not be considered projects for the purposes of this evaluation. Only individual task orders issued under such contracts will be evaluated as projects. A phased project for a single customer with multiple inter-dependent facilities on a single site may be considered a project for the purposes of this evaluation. Project descriptions that do not clearly describe the offeror’s or team member’s experience, the scope of the project, or the periods of project performance will not be considered.
Provide the following information for each project:
a. Project Title
b. Location
c. Contract Number
d. Project Delivery Method: Indicate Design/Build; Design/Bid/Build;
CM@Risk; Integrated Design; Design Only; etc.
e. Role of Offeror: Indicate type and percentage of work performed by the offeror or offeror’s team member.
f. Total Dollar Amount: Indicate if for design only, construction only or both design and construction.
g. Construction Start and Completion Dates: Project construction must be identified as complete or substantially complete. If an Offeror presents a project that is substantially complete, the proposal must include an explanation of why that project should be considered.
h. Brief Description of Project: Address how the project experience is relevant to the HVAC repairs described in this solicitation. Include: the size and function of the building(s) where HVAC repairs/replacement was done; the size and type of HVAC equipment replaced; was the building(s) occupied during the HVAC replacement effort; and how commissioning of the new equipment was conducted (equipment only; whole systems recommissioned; was the building historic and the project subject to the Secretary of the Interior Standards and Guidelines for Rehabilitation of Historic Properties; etc.). Provide a narrative that provides details on each of the above topics in order for the board to evaluate the relevancy of each project.
i. Customer Primary Point of Contact: Name, relationship to project, agency/firm, phone number, and e-mail address. The Government may contact and interview project references. Reference information will not be revealed to other parties.
j. Procuring Activity Point of Contact: Name, relationship to project, agency/firm, phone number, and e-mail address. The Government may contact and interview project references. Reference information will not be revealed to other parties.
If the offeror represents the combining of two or more companies, state if the example project represents a joint venture of the listed parties.
EVALUATION CRITERIA.
The Government will evaluate the extent of recent, relevant corporate experience of the prime contractor and team members and will assign one combined technical and risk rating for this factor.
Minimum criteria: For a project to be considered relevant and evaluated, it must meet (a) and (b) of the following minimum criteria:
(a) Construction project with a value of $2.0 M or greater.
(b) Completed within the last 6 years as of the proposal submission date, except that 1 project may be substantially complete at the time of proposal submission. If an offeror presents a project which is substantially complete, the proposal must include an explanation why that project should be considered substantially complete. To be considered a project it shall be at least 90% complete.
The Government will evaluate the extent of experience for strengths and weaknesses in the following areas:
(criteria below are not listed in order of importance. The Government desires proposals that offer the best combination of experience considering all criteria):
