SECTION 01 00 00 - GENERAL REQUIREMENTS

DIVISION 01 – GENERAL REQUIREMENTS

DESCRIPTION OF WORK AND GENERAL REQUIREMENTS

1. GENERAL

The work covered in this section is outlined as a summary of work requirements common to all the work and the locations and items of work involved. Specific requirements for materials, processes, performance, quality, and installation are provided under the technical sections of these specifications.

1.1 DESCRIPTION OF WORK

STATEMENT OF WORK

HST HVAC-Mold Mitigation

1.2 Ceiling:

1.2.1 Install ceiling tiles, hangers, and grid. New grid will be configured to accept 2’ x 2’ ceiling tiles. No demolition will be required as demolition will be complete by the government.

1.2.2 The government will provide 2’ x 2’ drop in ceiling tiles. Tiles will be TILATWHT AcoustiTherm Ceiling Tile White 2’ x 2’. All tiles and grid will be white in color.

Contractor is permitted to reuse concrete anchors where feasible. It is probable that new anchors will need to be installed in some locations. Do not anchor in the flat center panels of pre-cast roof deck.

1.2.3 New HVAC mini-split cassettes will be installed by the government prior to the installation of the drop ceiling with the plenum flange set at the desired height of the new ceiling. Adjustments may need to be made by the contractor to the cassettes to ensure they are level with the new ceiling. The cassette hanger nut and jam nut will be utilized for these adjust.

1.2.4 All other ceiling and wall mounted fixtures including but not limited to lights, smoke detectors, motions sensors, exit lighting, etc. will be placed as per Drawings. Any fixtures that will not be re-installed will be removed by others.

1.2.5 This work will be completed in all areas that currently have ceiling tiles and some new areas. See Drawings.

1.2.6 Contractor shall supply all incidentals and grid kits or stand-alone grid system. The grid must be rated for commercial applications.

1.2.7 The government will furnish all lights and will ensure the contractor has the correct sizes of the lights so that the contractor can frame the ceiling grid to fit the lights. See Drawings.

1.3 Lighting:

1.3.1 The Government will provide and install all light fixtures. The contractor will install the grid in a manner to accept the new fixtures and verify fit with Government provided sample fixture of each type.

1.3.2 All DC Lighting shall be left in place but may need to be adjusted to compensate for wall or ceiling thicknesses if that area is furred out. The DC light is a light that is always on for instances where power is lost.

1.3.3 Powerhouse personnel will place a safe clearance on all lighting prior to any work being performed by the contractor. Contractor shall apply his lock and sign in on the safe clearance.

1.3.4 This work will be completed in all areas unless otherwise specified.

1.4 Wood Panel Walls:

1.4.1 Contractor will install gypsum board in all locations where wood paneling currently exists as well as area specified on Drawings. (Sound break XP Purple Drywall 5/8” will be provided by the government in 4’ x 10’ sheets). The gypsum board will be installed vertically to minimize any imperfections. In all locations the walls will be furred with 2 x 2 lumber. The contractor will provide all lumber required for the strips. Some areas may be solid concrete, and some may have gypsum board that has been in place beneath the paneling. This will be determined during a site visit. Junction boxes for switches, receptacles, data boxes, etc. will be placed in specified locations. See Drawings for approximate locations. The contractor will be required to install the sheetrock after the boxes have been installed. Green glue acoustical adhesive and drywall will be applied per manufacturer’s recommendations. The glue will be applied to both sides of all firring strips or studs. This adhesive will be provided by the government.

1.4.2 Screws can be used at the top and bottom of the strips and sheetrock to hold it in place but must be used at a minimum so that the glue can perform correctly. The contractor will provide all screws.

1.4.3 All seams will be taped, and joint compound will be applied according to manufacturer's specifications. The Government will provide these materials: 5/8" Soundbreak XP Gypsum Board 4' x 10' boards; Sheetrock Brand 4.5 gallon Pre-mixed all purpose Drywall Joint United States Compound; Sheetrock Brand 2.0625-in x 250' solid joint tape; BEADEX Brand 100 ft. Corner Bead; Green Glue Acoustic Glue 28 Ounce Tubes

1.4.4 Contractor will provide and apply a knock down drywall texture to the new gypsum board.

1.4.5 Drywall jam and frame extensions with bull nose trim and color matching caulk will be applied around existing door, window, and other frames regaining jam or trim extensions.

Bullnose and caulking materials will be provided by the contractor.

1.4.6 All corner bead will be installed per manufactures recommendations. All outside corners will be the rounded bullnose style. The contractor will provide these materials.

1.4.7 All drywall will be painted with paint approved by the government. The paint will be a semi-gloss industrial grade kitchen and bath style paint to be used in humid conditions.

The contractor will provide all paint and related incidentals.

1.4.8 The rubber base molding will be replaced with new. The color will be approved by the government. Materials will be provided by the contractor.

1.4.9 No major demolition will be required by the contractor.

1.4.10 This work will be completed in all areas unless otherwise specified.

1.4.11 The contractor will be responsible for placing all sheetrock throughout the plant. This includes moving it to the correct locations. 2 windows will be removed on elevation 708 so that the sheetrock can be mechanically lifted by the Contractor to that elevation. The government will have previously removed the windows during demolition. The drywall will be onsite.

1.5 Concrete/Block Walls

1.5.1 Any existing holes or voids will be patched with grout.

1.5.2 All rubber base molding will be replaced as described above.

1.6 Flooring and Wall Tile

1.6.1 For tile with grout:

1.6.2 Replace approximately 30 broken tiles with like tiles. The government will provide the roofing style clay tiles located in the lower lobby and stairway. These are on the floor only.

1.6.3 Grout damaged areas as needed.

1.6.4 Strip, wax, and seal floors according to tile manufacturer’s recommendations.

1.6.5 Carpet, 12x12 vinyl type Floor tiles and Concrete Floors:

1.6.6 Remove all old carpet, carpet tiles, vinyl tiles and adhesive.

1.6.7 Remove all adhesive to the existing concrete. The adhesive under the tile has been tested and contains asbestos. The contractor will remove any asbestos in accordance with federal and state regulations.

1.6.8 Asbestos removal plan should be submitted for review.

1.6.9 All floors except those with the clay tiles will be stripped to bare concrete that is under the existing floor. The concrete will be cleaned, scarified, polished, and sealed.

1.7

1.8 Doors and Frames

1.8.1 All steel door and door frames will be painted USACE brown.

1.8.2 All wooden doors will be repaired as needed and stained to match existing color.

1.8.3 Any existing holes and scratches will be filled with wood filler.

1.8.4 New rubber thresholds matching existing will be installed where existing thresholds are located. They will be brown in color.

1.8.5 All door hardware will be re-used.

1.9 Mold Prevention Treatment

1.9.1 The contractor will be responsible for applying mold killer / disinfectant prior to replacing any parts of the ceiling, walls, floors, ect. Mold killer will be used to accomplish this. It must be applied using a cold fogger and this process must be coordinated with government personnel within 3 days of application.

1.9.2 The contractor will secure the area to be treated so that equipment and personnel are protected. The control room is manned 24/7 and will need to be coordinated with the powerhouse POC.

1.10 Special Instructions:

1.11 Foyer

1.11.1 Install new floor mat designed and manufactured for building entry. Approximately 7’ x

5’6”.

1.11.2 Remove aluminum threshold at glass double doors. Repair any damaged tiles under the threshold and place door sweeps on the existing doors.

1.11.3 Clean and Paint the inside and outside of the exterior doors USACE brown.

1.11.4 Place new color matching aluminum plates over the door frame that currently has holes that have previously been drilled.

1.12 Reception Office

1.12.1 Remove Countertop and enclose window with 2 x 4 wood framing. 16” OC.

1.12.2 Remove the permanent cabinet.

1.12.3 Repair any tile damage under the area where the cabinet was located.

1.13 Lobby

1.13.1 No Special Instructions.

1.13.2 No other work will be completed in this restroom.

1.14 Stairway:

1.14.1 Clean, seal, and wax grout and tile on walls and stairs to original color.

1.14.2 3 new light fixtures will be installed in approved locations. They will be 2’ x 4’ drop in

LED fixtures. The lights will be installed by the government, but the contractor should frame out the grid to accept the lights.

1.14.3 Existing handrails will be removed by others. The contractor will reinstall handrail. The government will provide saved hardware. Make remnats of removed handrail smooth and install new hand reail IAW local code. Material, style and layout drawings should be submitted for the Government approval. Make old handrails mounts not visible in a visually appealing in a maaner approvd by the Government.

1.15 708 Hall 1

1.15.1 No Special Instructions

1.16 Conference Room 1

1.16.1 No Special Instructions

1.17 Office 1

1.17.1 Remove existing window and shelf and build 2 x 4 wall to fill in the void. Install insulation and wall coverings described above in this location.

1.18 708 Hall 2

1.18.1 Clean and re-install one return air vent located adjacent to the stairwell.

1.19 Visitor’s Office and Visitor’s Conference Room

1.19.1 New walls will be installed in this location along with new doors. Lumber will be 2 x 4, 16” OC and walls will be insulated and covered with gypsum board like all other walls throughout the project. The walls must extend 1’ above the existing ceiling. See Drawings for dimensions. The visitor office will have 1 each 3’ door and the visitor conference room will have a 6’ double swing door to match the door for the visitor office.

1.19.2 Contractor will supply new doors, hardware, and frames. These doors will be steel with one window.

1.26 Control Room

1.26.1 A new 2 x 4 wall will be installed between the hallway and control room where an existing glass wall had been removed by others. This wall will extend 1’ above the ceiling and will be insulated. Install government supplied double hung steel doors.

1.26.2 Special care will be taken to ensure no damage is done to the equipment in the control room. Coordination will need to take place in order to work around the 24/7 schedule of the control room.

1.26.3 Coordination will need to take place for Covid precautions at the time of work.

1.27 Electronics Shop

1.27.1 The room will not need any work performed on the walls. The ceiling will be replaced.

1.28 Relay Test Room

1.28.1 Paint walls and ceiling with similar paint described above.

1.28.2 Patch and paint the ceiling where vents have been removed.

1.29 Fatigue Management Room

1.29.1 Patch and paint the ceiling where vents have been removed.

1.30 Janitor Closet

1.30.1 Paint Door and Ceiling with similar paint described above.

1.31 708 Hall 6

1.31.1 Clean and re-install one return air vent located adjacent to the stairwell.

1.33 Contractor will provide and arrange for a dumpster to be on-site for waste and waste removal.

1.34 Coordination will need to take place in order to work around the 24/7 schedule of the control room.

1.35 Construction filter should be used where possible in order to protect equipment ie sheet rock dust out of HVAC systems

A site visit is recommended prior to providing a proposal.

1.38 WORK HOURS

The standard workday is 7:00am to 4:30pm Monday thru Friday, excluding Federal holidays.

Work hours may be adjusted with approval of the Contracting Officer Representative (COR) or Operations Project Manager at each lake project. Work will not be allowed on weekends unless approved in advance by the COR.

SITE VISITS

Contractors are encouraged to complete a site visit to the project location identified in solicitation prior to submitting a proposal. Refer to clause 52.236-27 Site Visit (Construction) (Feb 1995) in solicitation for details for site visit date. All estimates shown on Drawings must be verified by the contractor.

1.39 CONTRACTOR QUALITY CONTROL

1.39.1 General CQC Instructions

Contractor shall provide and maintain an effective Quality Control Program that complies with the “Inspection of Construction” clause of the contract. Contractor shall manage his operations in such a manner as to control the quality of all the work being performed to meet his obligations under the terms of the contract. Contractor shall present his plan for the system he proposes to use to affect this control at the Pre-Construction Conference.

When the plan is both plausible and in conformance with contract requirements, the Contracting Officer Representative, subject to satisfactory application and results during the construction phases, will issue a tentative approval in writing. Any changes to the approved plan, personnel, or procedures, desired by Contractor require the prior written approval of the Contracting Officer Representative.

No construction is to be started until the plan has been tentatively approved.

1.39.2 Quality Control Testing and Reporting

Contractor shall maintain a Quality Control organization to perform or have performed tests and inspections as required to ensure that the workmanship and materials are in accordance with the referenced Quality standards, contract drawings and specifications.

The Government will furnish, at the Pre-Construction Conference, the required format for the Contractor to use for the Daily Quality Control Report. Contractor may use their own Daily Quality Control Report form provided it possesses the minimum required features as shown in the Government provided format.

1.40 SUBMITTALS

Government approval is required for submittals. Allow 7 business days (Monday-Friday) for Government review of submittals prior to commencement of work specific to that submittal.

Rejected submittals must be resubmitted and approved. Approval of submittals does not indicate a complete check or relieve the contractor of any contractual requirements. Contractor shall not use submittals as alternate means for requests for information. A comprehensive list or submittal register defining all the required submittals will be provided in the contract documents. Submittals must be provided for all materials used except for what was specified in the SOW. This does not include any incidentals.

Format of Submittals

Contractor shall use ENG Form 4025-R, March 2012 that can be found here:

Transmittals shall be numbered. Revised submittals shall include designations to indicate original submittal number and revision number. One (1) copy of each submittal shall be submitted as noted.

1.40.1 Submittal Routing

Submittals shall be routed electronically or hard to copy to the USACE Points of Contact as specified in the contract document.

Preconstruction Submittals

Preconstruction submittals are required prior to or at the start of construction (work) or the next major phase of the construction on a multiphase contract. Preconstruction submittals shall include, but not be limited to, the following:

a. Baseline Construction Schedule/sequence of work

b. Contractor’s Quality Control (QC) Plan

c. Accident Prevention Plan (APP) including an Activity Hazard Analysis (AHA)

d. Certificate of Insurance

e. List of Contractor personnel

f. Drywall installation procedure

g. Detailed installation procedures for wall and ceiling mounted equipment.

h. Concrete finishing procedure

i. Grout and tile material specs

j. Grout and tile cleaning and finishing procedure

k. Mold prevention treatment plan

l. Asbestos removal plan. Handrail Replacement material and layout drawings.

1.40.2 Certificates

Submit Contractor’s electrical qualifications.

Test Reports

Test Reports may include, but not be limited to, the following:

a. Daily logs and checklists.

b. Monthly Exposure Reports

Closeout Submittals

Documentation to record compliance with technical or administrative requirements and special requirements necessary to properly close out the contract.

a. Operation & Maintenance Manual

b. Warranty letter after final acceptance

PERIOD OF PERFORMANCE

All work must be completed within the Period of Performance as specified in clause 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK of the contract documents.

MEASUREMENT AND QUANTITIES

The Contractor shall verify all measurements at the project site and shall be responsible for all dimensions and the proper installation of all materials and equipment specified.

PERMITS

The Contractor shall be responsible for obtaining any required permit.

SAFETY REQUIREMENTS

Protection from Hazards

During progress of work, the Contractor shall protect all personnel, whether Government or civilian, from all safety hazards caused by the construction operations.

1.40.3 U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH REQUIREMENTS

MANUAL, EM 385-1-1 (2014)

The Contractor shall be responsible for complying with the current edition and all changes posted on the web as of the effective date of this solicitation.

1.40.3.1 Accident Prevention Plan

Contractor shall prepare a site-specific Accident Prevention Plan (APP). Prepare the APP in accordance with the format and requirements of USACE EM 385-1-1. Cover all paragraph and subparagraph elements in USACE EM 385-1-1, Appendix A, "Minimum Basic Outline for Accident Prevention Plan". The APP shall be job-specific and address any unusual or unique aspects of the project or activity for which it is written.

1.40.3.2 Activity Hazard Analysis

USACE uses the Activity Hazard Analysis (AHA) as part of a total risk management process.

Contractors may use the AHAs or their own version [Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools]. These documents are considered equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA.

CONSTRUCTION SCHEDULE REQUIREMENTS

Pre-Construction Schedule Requirement

Prior to the start of work, prepare and submit to the COR a Baseline Construction Schedule for review. The approval of a Baseline Construction Schedule is a condition precedent to:

a. The Contractor starting work.

b. Processing Contractor's invoice(s) for construction activities/items of work.

c. Review of any schedule updates.

Submittal of the Baseline Construction Schedule, and subsequent schedule updates, is understood to be the Contractor's certification that the submitted schedule meets the requirements of the Contract Documents, represents the Contractor's plan on how the work will be accomplished, and accurately reflects the work that has been accomplished and how it was sequenced (as-built logic).

Schedule Constraints

Holiday Restrictions

No work on Federal Holidays- New Years, Martin Luther King Day, Presidents Day, Memorial Day, Fourth of July, Labor Day, Columbus Day, Thanksgiving Day, and Christmas Day.

Schedule Constraints by Work Activity

Contractor will include in work activity schedule the planned outage for final installation and connection of electrical equipment.

Any electrical outages The Contractor must give advance notice to Project Office Staff to minimize any data loss of computer programs that staff is working with.

WARRANTY

Warranty and Walk Thru- Everything described in this Scope of Work will be guaranteed for one year from the date of completion to be free of any problems, or break downs due to poor workmanship. After Final Acceptance of the work prior to final payment all equipment manuals, keys, as-built’s and warranty information will be turned over to the government. At eleven (11) months after final inspection a warranty Inspection will be scheduled by the Government to identify any warranty issues as related to the work included in this contract. The Contractor will be notified of date of Warranty Inspection with option to attend. All O&M Manuals will be provided after the project is complete.

SECURITY

1.40.4 In unoccupied facilities, the Contractor shall be responsible for the security of the facility, i.e., all exterior doors shall be locked, windows closed and locked, etc.

1.40.5 The Contractor shall not be on site without prior notification to the Corps of Engineers COR or otherwise designated person(s).

1.40.6 Contractor personnel shall have valid civilian ID's and Contractor vehicles shall have a valid registration.

1.41 ANTITERRORISM/OPERATION SECURITY REQUIREMENTS

1.41.1 All contractor and all associated sub-contractors’ employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy.

In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

1.41.2 The contractor and all associated sub-contractors shall receive a brief/training (provided by the COR and/or Lake Project Operations Project Manager) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

1.41.2.1 The Contractor must pre-screen candidates using the E-verify Program (http://www.dhs.gov/E- Verify) website to meet the established employment eligibility requirements. The vendor must ensure that the candidate has two valid forms of government issued identification to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the COR no later than 3 business days after the initial contract award.

1.41.3 All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

1.42 WORKSITE HOUSEKEEPING

1.42.1 The Contractor shall remove all trash and disposal material from the worksite before the end of each day; to the extent it is consistent with standard construction practices on Government work sites. The Contractor shall take all possible precautions to maintain the work site in a condition that will prevent damage or injury to person or property, Government or otherwise. The above precautions shall include protection from weather conditions. The Contractor shall be responsible for all damages caused by the negligent acts or omissions of his employees, sub-contractors, or agents during Contract performance.

1.42.2 Materials to be used within 1 week of delivery and scrap material to be used as work progresses shall not be required to be in screened area. However, all such items shall be placed in an orderly manner (i.e. dirt, rock, etc., in piles and stackable items such as pipe, brick, lumber, etc., stacked off the ground on pallets in an orderly manner). All scrap materials will be disposed of as necessary. The contractor will be required to provide any dumpsters needed to handle this. If any hazardous materials need disposed of they will be completed according to state, local, and federal laws.

1.43 RESPONSIBILITY FOR DAMAGE

1.43.1 Damage to Personal Property

The Contractor shall be solely responsible for all damage to Government and occupant personal property caused by the Contractors' personnel, subcontractors, his agents, or by the performance of his work.

1.43.2 Damage by Negligence

Damage resulting in gas leaks, electrical outages, loss of heat during cold weather, water leaks, unsecured facilities, weather damage, or oil/hazardous waste spills shall be responded to by the Contractor within 2 hours and repaired within one workday. If the Contractor fails to comply with these requirements, the Government reserves the right to repair the damage and charge the cost to the Contractor. Contractor shall protect all areas through which he will be transporting demolition debris or construction materials. Any damaged turf, sidewalks, roads, vegetation, site amenities, etc., shall be replaced or repaired by the Contractor prior to final Contract closeout.

1.44 DISPOSAL OF MATERIAL

All materials removed and not reused or designated as salvage material in this project shall become the property of the Contractor, unless otherwise specified, and shall be the Contractor's responsibility for lawful disposal.

1.44.1 All other wastes generated during Contractor operations shall be disposed of by the

Contractor at his/her expense.

1.44.2 Solid wastes (excluding clearing debris) shall be placed in containers which are emptied on a regular schedule. Handling, storage, and disposal shall be conducted to prevent contamination. Segregation measures shall be employed so that no hazardous or toxic waste will become co-mingled with solid waste. The Contractor shall transport solid waste off Government property and dispose of it in compliance with Federal, State, and local requirements for solid waste disposal. A Subtitle D RCRA permitted landfill shall be the minimum acceptable off-site solid waste disposal option. The Contractor shall verify that the selected transporters and disposal facilities have the necessary permits and licenses to operate. The Contractor shall comply with Federal, State, and local laws and regulations pertaining to the use of landfill areas.

1.44.3 Wastes classified as hazardous wastes under the Resource Conservation and Recovery Act shall be disposed of, unless otherwise specified in this contract. No hazardous waste shall be disposed of without prior review of the disposal documents, and the approval of the Contracting Officer and the Directorate of Public Works Environmental Coordinator, or his designated representative. The Contractor shall provide an original copy of the disposal document from the approved EPA or State permitted disposal facility for each shipment of hazardous waste generated in this project to the Contracting Officers Representative.

1.44.4 Unified Facilities Guide Specifications (UFGS) 01572, “Construction and Demolition

Waste Management,” indicates the Government policy is to “use all reasonable means to divert construction and demolition waste from landfills and incinerators and to facilitate their recycling and reuse.” The Contractor shall make all attempts to divert waste material from landfills in coordination of this guidance.

TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

1.44.5 This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with:

a. This provision specifies the procedure for section (d) of the CONTRACT CLAUSE 52.249-

10 titled "Default (Fixed Price Construction)". For the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

b. The following schedule of monthly anticipated adverse weather delays is based on National

Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities for the duration of the project.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORKDAYS BASED ON (5)

c. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the duration of the contract, the Contractor shall record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical path activities for 50 percent or more of the Contractor's scheduled workday.

d. Within ten days of the following month, the Contractor shall provide in writing a list of their proposed dates of the actual adverse weather delay days for each month. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph (b), above, the Contracting Officer will convert any qualifying delays to calendar days and issue a modification in accordance with the Contract Clause entitled "Default (Fixed Price Construction)". After the original contract completion date has passed, adverse weather that causes delay to the completion of the project will be granted day-for-day without deducting anticipated adverse weather delay days and will be converted from workdays to calendar days.

* Monthly anticipated weather delay days shall be adjusted proportionally if work is scheduled to be performed in a work week with greater than or less than a five-day work week. The following formula shall be used to adjust the monthly anticipated weather delays:

Adjusted monthly anticipated weather delays = A multiplied by (B divided by C); where A = The monthly anticipated adverse weather delay for a particular month based on a five-day work week. B = The actual average number of days work is scheduled to be performed in a work week during that month. C = The number five (5) e.g., If the monthly anticipated adverse weather delay for January based on a five day work week is 10 days, but the Contractor actually

* Monthly anticipated weather delay days shall also be adjusted proportionally for those situations involving a fractional part of a month. Some examples are the month Notice to Proceed is acknowledged and the month of the original contract completion date. The following formula shall be used to adjust the monthly anticipated weather delays:

Adjusted monthly anticipated weather delays = D multiplied by (E divided by F); where D = The monthly anticipated adverse weather delay for a particular month.

E = The number of calendar days during that fractional part of a particular month.

F = The number of calendar days in that month. e.g., The monthly anticipated adverse weather delay for the month is 9 days. The original contract completion date is on the twentieth (20th) day of a thirty (30) day months. The monthly anticipated adverse weather delay would be adjusted by applying the above formula as follows: 9 x (20/30) = 6 days.

ENVIRONMENTAL REQUIREMENTS

The Contractor shall minimize environmental pollution and damage that may occur as the result of construction operations. The environmental resources within the project boundaries and those affected outside the limits of permanent work shall be protected during the entire duration of this contract. The Contractor shall comply with all applicable environmental Federal, State, and local laws and regulations. The Contractor shall be responsible for any delays resulting from failure to comply with environmental laws and regulations. During Construction, the Contractor shall be responsible for identifying, implementing, and submitting for approval any additional requirements for environmental compliance.

PREWORK CONFERENCE/PERIODIC PROGRESS MEETINGS

The Contractor agrees to attend any post award conference convened by USACE in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings The Contracting Officer will apprise the Contractor of how the government views The Contractor's performance and The Contractor will apprise the Government of problems, if any, being experienced.

Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
