SECTION I - CONTRACT CLAUSES
The following have been modified:
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees 750 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SECTION L
1.0 General Information: See 52.215-1 Instructions to Offerors – Competitive Acquisistion.
1.1. There are no drawings associated with this Solicitation. Copies of the solicitation are available by INTERNET ACCESS ONLY. All solicitation documents and amendments thereto will be made available for viewing on the Federal Business Opportunities website (http://www.fbo.gov). It shall be the offeror’s responsibility to check the website for any amendments. Offerors should read the entire solicitation prior to submitting a proposal.
1.2. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. The offeror’s proposal should be legible, clear, concise and prepared simply and economically.
Offerors are discouraged from providing information not required by the Solicitation. There will be no public opening of the proposals received as a result of this solicitation. Failure to meet a requirement may result in an offer being ineligible for award.
1.3. The Contracting Officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the Contracting Officer's opinion, adequate price competition exists, no additional cost or pricing http://www.fbo.gov/ data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition, the Contracting Officer determines that adequate price competition no longer exists; offerors may be required to submit cost or pricing data to the extent necessary for the Contracting Officer to determine a fair and reasonable price.
1.4. Offerors must clearly identify any exceptions to the solicitation terms and conditions and provide complete accompanying rationale. Exceptions taken to terms and conditions of the solicitation, to any of its formal attachments, or to other parts of the solicitation shall be identified. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken.
Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost and specific requirements of the solicitation. This information shall be provided in the format and content of Table 1 listed below. Failure to comply with the terms and conditions of the solicitation may result in the offeror being removed from consideration for award.

1.5. Inquiries/Questions. Prospective Offerors shall submit contracting and technical inquiries via Bidder Inquiry in ProjNet at www.projnet.org/projnet.
1.5.1 To submit and review bid inquiry items, the offeror will need to be a current registered user. To self-register, go to the aforementioned web page and click “register.” Select “USACE” as the Agency.
Then, select “Contractor” as the Site. Then, enter the required information to complete the registration.
1.5.2 Once the user is registered, bidder inquiries can be accessed using the Quick Add key provided below.
1.5.3 Offerors will receive an acknowledgement of their questions via email, followed by an answer to their questions after it has been processed by our technical team.

1.6 If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer in writing.
1.7. The Government will not reimburse the offeror for any costs incurred in the preparation and submission of a proposal in response to this solicitation. Issuance of this solicitation is not to be construed as authority to proceed with any work or to incur any obligation chargeable to the Government.
2.0. Specific Instructions: Organization/Distribution/Number of Copies/Page Limits
2.1. Each offeror shall submit a proposal that consists of three (3) Volumes:
Volume I – Company Experience and Performance Confidence Volume II – Extent of Small Business Participation Volume III – Cost Information, Representations, Certifications, and Other Statements of Offerors
2.2 Binding and Labeling: Volumes I, II, and III may not be submitted together within the same binding (separate volume submissions are required). Each volume shall be submitted in a separate 3-ring loose leaf binder (not heat or spiral bound volumes) and shall be organized by factors.
Each Volume shall include, as a minimum, the following:
(a) Volume number on proposal cover.
(b) The prime, consortium, or joint venture’s name, address, telephone number, and e-mail address shall appear in the lower left corner of the proposal cover, title page and table of contents of any document/volume to be evaluated.
(c) Proposal volume cover format is at the offeror’s discretion so long as the information required by this paragraph and subsequent paragraphs are met.
(d) Table of contents and a cross-reference to the solicitation paragraphs.
(e) List of tables/figures.
(f) Volume number, factor and date submitted shall appear in the bottom right corner of each page (along with the revision number for the amended page, if necessary).
2.3. The offeror shall submit four (4) hard copies of each proposal volume and one (1) electronic copy of CD/DVD. The CD/DVD shall contain each proposal volume as a separate electronic file. The electronic copy of Volumes 1 and 2 shall be in Portable Document Format (PDF) compatible with Adobe Reader.
The electronic copy of Volume 3 shall consist of two (2) electronic files: Section B Table 1 and Section J Attachment 2 Bid Schedule Detail Worksheet using Microsoft Excel and one file in PDF for the text portion of Volume 3.
2.4. The offeror shall submit a complete proposal, with all requested information specified in this section of the solicitation by the due date specified in Block 9 of Standard Form 33. The proposal shall be delivered to:

Due to heightened security at Government installations, those offerors who have their proposals hand-carried shall contact Jo Ann McCue, Contract Specialist at (816) 389-3822 prior to delivering to the U.S. Army Corps of Engineers, Kansas City District, 601 East 12th Street, Kansas City, Missouri 64106-2896.
On the proposal due date, starting thirty (30) minutes prior to the specified time, a Contracting representative will be in the lobby to receive proposals. Containers (i.e. envelopes, packages, boxes) will be screened for security purposes.
NOTE: No parking on the street in front of the facility entrances will be allowed. Passenger vehicles will need to locate parking meters or parking garages before delivering proposals.
Delivery trucks must go to the receiving dock. The vehicle will be inspected and packages screened at the dock. After inspection and screening, the delivery person will be allowed into the building.
2.5. Time for acceptance by the Government of Proposals: All offerors submitting proposals in response to this solicitation agree that the Government shall have not less than 365 calendar days to accept any proposal, after the date indicated for receipt of proposals. ** NOTE – Please insert 365 days in block 12 of the SF 33 ** In the event the Government cannot award a contract within this 365-day period, any or all offerors may, at their option, extend the date for acceptance of their proposal.
2.6 Page Format Restrictions and Limitations:
2.6.1. Page Limitations: Page limitations shall include typewritten text pages, charts, graphs, figures, diagrams, and schematics, outlines and other similar information, aside from those items specifically stated as exempt from the page count. The contractor’s proposal for Volume I, Factor 1 shall not exceed seven (7) pages. The offeror shall use a sigle side of one sheet of paper for each project in Volume 1, Factor 1. Compliance with page count limits will be verified via the hardcopy. Pages that exceed this limitation will not be read or considered in the evaluation of the proposal.
2.6.2. Pages Counted: Each page submitted for Volume I, Factor 1 will be counted toward the page limitation. Separator tabs shall only be marked with section / subsection identifiers. Any other information placed on the separator tabs will not be reviewed. Double sided pages are considered as two pages.
2.6.3. Page Size: For Volume 1, Factor 1, the offeror shall use 11” x 17” size pages. For the remainder of the proposal, the offeror shall use 8.5” x 11” size pages. Pages shall be typewritten except for the reproduced sections of the solicitation document. The majority of the sheet should utilize a 10-12 point font. The font size shall be no less than 10 point. A smaller type may be used on footnotes, charts, graphs, figures, diagrams, and schematics to accommodate a “make to fit” software capability; however, all text shall be legible and easily read. Margins on all four edges of each sheet will be at least one-half (0.5) inch. Proprietary statements, security markings, and page numbers can fall within the defined margin area. Pages shall be numbered sequentially by volume.
2.6.4. Indexing: Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to delineate proposal sections by evaluation factor.
2.6.5. Format: The offeror shall submit all required hard copies and electronic copies of their proposal in the format shown below. Elaborate or lengthy presentations are not necessary and are not desired.

3.0 Volume I Contents – Company Experience and Performance Confidence Information:
3.1 Executive Summary. Volume I of the proposal shall include an Executive Summary which should include an introduction of the proposal team. The Executive Summary shall not exceed two (2) pages in length.
Proposals submitted in response to this solicitation shall consist of the contents required in the sub-paragraphs described below:
3.2. Volume I, Factor 1 – Company Experience
Provide up to seven (7) projects that demonstrate the offeror's (prime contractor or joint venture member) and its team subcontractors' experience in the last ten (10) years performing work relative to the evaluation criteria listed in Section M. Projects submitted must have been executed by the offeror or its team subcontractors. See Paragraph 3.4 below for additional information regarding documentation required for Joint Ventures and Teaming Agreements.
A project is defined as: HTRW Remedial Action (RA) projects performed at one site or at a single installation. An Indefinite Delivery Contract (IDC) is not a project. A project may contain multiple Contracts or Task Orders if they are from the same site or installation and they are for the same remediation effort such as multiple phases of one project.
3.2.1 The following information should be included in the presentation of previous experience.
1) Box A – Project #: Name and location of project. Include City, County, and State, or military installation name and State, as appropriate.
2) Box B – Name of the contractor that performed the work and role in this proposal (prime offeror, JV member, or team subcontractor).
3) Box C –Client Organization name and address. Also include the name and telephone number of the Client’s Point of Contact.
4) Box D – Contract number(s) under which company performed the work. Include the Task Order number for work done under an Indefinite Delivery Type Contract.
5) Box E – The type of contract under which the work was performed (Firm Fixed Price, Cost Reimbursable, Time and Materials).
6) Box F – The total contract obligation amount including all modifications, award date of original contract, and contract period of performance.
7) Box G – The percentage of the contract amount performed by the prime offeror, JV member, or team subcontractor identified in Box B.
8) Box H – Please include the following for the contract identified in Box D above:
A brief site description and an overview of the contractor’s work performed on the project as it relates to Remedial Action projects or equivalent Removal Actions and RCRA Actions that demonstrate work similar to CERCLA Remedial Action. Additionally, please indicate the dates that the work was performed for the work being described.
Describe the experience on the project that demonstrates the criteria in Section M. Describe the project characteristics including magnitude, complexity, challenges and accomplishments as it relates to the evaluation criteria. Present project constraints such as site restrictions, cost and schedule, customer and stakeholder requirements, and any other unique considerations as they relate to the Section M evaluation criteria.
3.3. Volume I, Factor 2 –Performance Confidence
3.3.1. Past Performance Questionnaires (PPQ)
For each of the projects submitted under Factor 1, Company Experience, the offeror should provide existing documentation of the owner’s opinion of the offeror’s performance by including a PPQ. If no existing PPQ exists for the project, or if new information is required in the offeror’s opinion, the offeror should provide a Past Performance Questionnaire (PPQ) to a representative of the owner that can provide the owner’s opinion of the offeror’s past performance for the project.
The PPQ form (Form PPQ-0) to be used is included in Section J, Attachment 1 of this solicitation.
A sample cover letter to accompany the PPQ and instructions for completing the PPQ are also included in Section J, Attachment 1. Ensure correct phone numbers and email addresses are provided for the owner’s point of contact.
Offerors and/or its team subcontractors should submit to the client for each project, the PPQ form and request that the form be completed and returned to the offeror before the date the proposal is due. If the client requests, PPQs may be submitted directly to the Contracting Division using the following e-mail address: Jo.A.McCue@usace.army.mil. The only information in the email subject line MUST be the solicitation number W912DQ-19-R-3006. If the submission is provided by mail, the envelope should be marked, “Confidential Proposal Information for Solicitation W912DQ-19-R-3006.” NOTE: All PPQs submitted directly to the Contract Specialist must be received No Later Than the date and time specified for receipt of proposals. Offerors should not incorporate by reference into their proposal PPQs previously submitted for other Solicitations. However, this does not precluded the Government from utilizing previously submitted PPQ information in the performance confidence evaluation.
Offerors should compile the PPQ for each project submitted under Factor 1 and should organize the information by project, and in the same order as the projects submitted in Factor 1. This will allow the reviewers to match the Past Performance information with the associated Factor 1 project. Only one PPQ should be submitted for each Factor 1 project and if more than one PPQ is received, only the first PPQ will be evaluated.
The offeror is responsible for ensuring that the completed PPQs are signed and submitted by the solicitation closing date and should follow up with clients to ensure timely submittal of the PPQs.
The Government may contact and interview the customer’s representative on the PPQ, and reserves the right to interview other individuals acting for the customer’s representative, if the customer’s representative is not available.
At no time during this process, nor during the debriefing, nor after award, will the names of the individuals providing reference information directly to the Government about an offeror’s past performance be revealed to the offerors or to any other party. If discussions are held, offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.306(b) (4). In this case, comments will be extracted and provided to the offeror.
3.3.2 CAGE Codes and DUNS Numbers
The offeror should provide the CAGE Codes and DUNS numbers for the prime Contractor and all teaming partners, i.e. design firms, key subcontractors, Joint Venture members, whose experience is being relied on for Factor 1. This information will be used by the Government to access past performance information in the Contractor Performance Assessment Reports System (CPARS).

3.4 Additional Information to be Provided in Volume I.
3.4.1 Joint Ventures. For any offeror that is submitting as a joint venture, a copy of the fully executed Joint Venture agreement shall be included in Volume I as a separate tab.
3.4.2 Teaming Agreements with Subcontractors. For any offeror that is relying on subcontractor experience or qualifications, a copy of the fully executed Teaming Agreement shall be included in Volume I as a separate tab.

4.2. Volume II, Tab 1 – Small Business Subcontracting Plan (Does not apply to offerors that are considered a small business concern)
Each Large Business Offeror shall provide a Small Business Subcontracting Plan that contains all the elements required by FAR clause 52.219-9. This plan shall be submitted separately from the Small Business Participation information required above, which applies to both large and small businesses. To the extent that the offeror has specifically identified small businesses in its proposal for Factor 3, those small businesses should also be reflected in the Small Business Subcontracting Plan to facilitate compliance with the clause 252.219-7003 Small Business Subcontracting Plan (DoD Contracts). The Small Business Subcontracting Plan will not be considered in determining whether a proposal represents the best value, but rather an acceptable Small Business Subcontracting Plan is a matter of the offeror’s responsibility and will be negotiated with each large business that submits a proposal that is considered to be the best value and that plan. The Small Business Subcontracting Plan will be incorporated into the base contract.
5.0 Volume III Contents – Cost Information, Representations, Certifications, and Other Statements of Offerors
5.1. Volume III, Factor 4, Cost/Price
5.1.1 The offeror shall complete Table 1 in Section B in its entirety, and submit with its proposal. The labor rates provided shall be inclusive of all direct costs and applicable indirect costs (direct labor, fringe expenses, overhead, general and administrative expenses, etc.). The maximum labor rates shall not include an allowance for profit. The offeror shall include any necessary information, such as payroll data, to support the proposed labor rates. The basis for annual escalation shall also be provided.
5.1.2 The offeror shall review the PRAC Sample Project Scope of Work for a Cost-Reimbursement Scenario and complete the associated Bid Schedule Detail Sheet (included in Section J, Attachment 2).
Utilizing the information provided, the offeror shall complete the Bid Schedule Detail Sheet to calculate a total sample project price. The offeror shall follow the instructions provided below. Additionally, the offeror shall provide a narrative of the Sample Project Approach as described below.
Sample Project Bid Item Descriptions are below that identifies what work is to be done under each item.
• BID ITEM NO. 1 – PRE-CONSTRUCTION SUBMITTALS.
o Fully burdened assumed cost is included in Bid Schedule detail sheet.
• BID ITEM NO. 2 – GENERAL CONDITIONS
o The offeror should assume that this bid item only includes costs that are on the bid schedule detail sheet; additional items may be needed or desirable, but the contractor should not add any other tasks or items other than what is on the bid schedule detail sheet.
o These items include: travel and per diem (assume lump sum of $200,000 – do not apply fixed fee). Assume surveying is not required.
• BID ITEM NO. 3 – MOBILIZATION AND DEMOBILIZATION
o Fully burdened assumed cost is included in Bid Schedule detail sheet
• BID ITEM NO. 4 – SOIL EXCAVATION
o Work shall include all labor, and equipment associated with excavation of soils and direct load soil for transportation to an offsite disposal facility of non-TSCA PCB-contaminated soil.
• BID ITEM NO.5 –TRANSPORTATION AND DISPOSAL OF NON-TSCA MATERIAL
(SUBTITLE D FACILITY)
o Work shall include all labor, and equipment associated with transportation and disposal of all non-TSCA material at an off-site facility approved to accept this waste stream. Use Transportation and Disposal (T&D) unit cost provided by the Government shown in section 6.3.
• BID ITEM NO. 6 –BACKFILL, PLACE, AND COMPACT (IMPORTED SOIL)
o Work shall include all labor, materials, and equipment associated with purchasing backfill from an off-site source and placing and compacting all imported backfill to the existing grade. Cost of clean backfill delivered to the site is provided in project description (see section 6.3). Delivered price includes analysis to certify clean and compaction testing. Work shall not include a post-construction civil survey.
• BID ITEM NO. 7 – SITE RESTORATION
o Fully burdened assumed cost is included in Bid Schedule detail sheet.
• BID ITEM NO. 8 – COMPLETION REPORT
o Fully burdened assumed cost is included in Bid Schedule detail sheet.
• BID ITEM NO. 9 – FIXED FEE - Proposed fixed fee for the sample project.
5.1.3 Instructions for the Sample Project Bid Schedule Detail Sheet
5.1.3.1 Assumptions and Requirements: Below is a compilation of assumptions and technical requirements for the offeror to consider in development of their cost proposal. Costs have been provided for several typically subcontracted items that the offeror should use in developing their estimate. The reason these costs are provided is to reduce the number of quotes offerors need to obtain for a project that is hypothetical and to limit the number of variables in the cost realism evaluation.
a) Development of Pre-Work Submittals – assumed cost: $75,000 (fully burdened). The offeror should not change this cost on the bid schedule detail sheet.
b) No confirmatory sampling, clean fill/borrow material sampling, landfill disposal sampling or compaction density sampling is required or should be assumed. Assume no laboratory, sampling, or validation costs. No perimeter/personnel air or dust monitoring is required.
c) Assume 1-1/2 to 1 slope for side slopes of excavation.
d) All backfill has already been tested and is acceptable for use on site. Backfill shall be placed in 12-inch loose lifts and compacted to 90% standard proctor (ASTM D 698) density with + 3 percent of optimum moisture content. Assume that in-place density testing is not required. Delivered price includes analysis to certify that material is clean and certify compaction testing requirements are met. Bank cubic yards in bid schedule detail sheet accounts for compaction (125,190 / .90 = 139,100 BCY). Tonnage of backfill to be delivered accounts for a unit weight of backfill material of 1.6 tons/bank cubic yard (139,100 BCY x 1.6 tons/BCY = 222,560 tons). No stockpiling of backfill is required.
Costs should only include the effort to place & compact the imported backfill that is delivered directly to the excavation site.
e) Waste Handling/Disposal: All soil waste material will be directly loaded from the excavation and transported off-site to a subtitle D disposal facility permitted to accept the waste. No stockpiling of excavated soil is required.
f) Site Restoration shall consist of final grading and hydro seeding the excavated area with a turf-type tall fescue. No topsoil is required. Assume the cost for site restoration is a total of $50,000 (fully burdened). The offeror should not change this cost on the bid schedule detail sheet.
g) A completion report shall be developed at the completion of the work. Assume the cost to develop this report is a total of $75,000 (fully burdened). The offeror should not change this cost on the bid schedule detail sheet.
h) Assume all required permits and site access have been obtained.
i) Assume no cost for storm water management.
j) Site Management: The following site management personnel are required onsite full time for the entire duration of the project field work: Site Superintendent, CQC supervisor, and Site Health and Safety Officer. A Project Manager is required for 25% of the project duration.
5.1.3.2 Estimated Costs: Estimated Costs for certain items to use in the Bid Schedule detail sheet (all costs shown are exclusive of fee):
• Pre-Work Submittals - $75,000 (fully burdened)
• Backfill delivered - $15/ton (subcontractor quote)
• Transportation/Disposal of waste to Subtitle D Landfill - $120/ton (subcontractor quote)
• Site Restoration - $50,000 (fully burdened)
• Completion Report - $75,000 (fully burdened)
5.1.3.3 Bid Schedule Detail Worksheet Instructions to bidders: Do not add line items to this cost estimate other than identifying equipment and personnel. This is only a sample project and not meant to be an actual site remediation job. Things that are "missing" from the sample project (such as but not limited to temporary facilities/job trailers, stockpile or staging areas with liners underneath, stormwater controls, dust control, perimeter air monitoring, etc) are intentionally left out of this sample project for the sake of simplification.
a) Although this is a cost reimburseable fixed fee project, the offeror shall utilize the fully burdened fixed price labor rates proposed in Table 1 of Section B to develop the unit costs. Enter your unit rates and costs for each bid item and the total project cost. In addition, the offeror shall utilize the attached wage determinations for all appropriate personnel proposed to execute the work.
b) Cost backup including labor, equipment, materials, subcontracts and incidental expenses, and any assumptions are to be provided in the Sample Project Approach. This basis of proposal information shall support the costs proposed for each line item in the schedule above and if vendor quotes or subcontractor bids were obtained, copies of the vendor quotes and subcontractor bids should be provided as part of the backup. Backup information should include detail by line item.
Subcontractor quotes should also include a breakout of labor hours, labor costs, equipment costs, & material costs. Subcontractor pricing may be used where subcontractors are quoting on a unit price basis.
c) Amounts in line items 1, 3, 7 and 8 are fully burdened price exclusive of fixed fee.
d) The offeror shall not charge fee on travel and perdiem, per this base contract.
e) All other costs/rates shall include all markups exclusive of fixed fee.
f) For line item 5, the calculation for the excavated soil weight is shown below. Do not submit a different calculated value:

5.2 Volume III, Tab 1 – Cover Letter, SF33, Solicitation, Offer, and Award (Section A)
The offeror shall provide the following information:
a. A cover letter containing
1) Solicitation Number
2) Name, address, email, telephone number, and fax number of the offeror
3) CAGE Code
4) DUNS Number
5) Names, Title, email, telephone number, and fax number of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this Solicitation.
6) Name, title, and signature of the person authorized to sign the proposal
7) Name, phone number, and email address of all individuals the firm would like to be notified of all subsequent Task Orders issued under this MATOC.
8) A statement specifying agreement with all terms, conditions, and provisions included in this
Solicitation.
b. The SF 33 duly executed with an original signature by an official authorized to bind the company.
Include the offeror’s CAGE and DUNS number in Block 15.
c. Acknowledgement of all amendments to the Solicitation in accordance with the instructions on the
Standard Form 30 (Amendment Form) and in block 14 of the SF 33 Form.
5.3 Volume III, Tab 2 – Representations, Certifications, and Other Statements of Offerors (Section K)
The offeror shall fill out in its entirety all of Section K that applies to the offeror including the System of Award Management (SAM) certification. The offeror’s responsibility will be reviewed in accordance with FAR Part 9.
5.4 Volume II, Tab 3 – Accounting/Audit/Earned Value Management System Information
a. Accounting System: offerors must have an adequate accounting system to receive a cost-reimbursable task order. All offerors shall provide a recent adequacy determination from either (1) a Federal Government Cognizant Audit Agency or (2) any commercially recognized auditing or accounting firm stating that the offeror's accounting system is adequate. The determination should include a completed Standard Form 1408 "Preaward Survey of Prospective Contractor Accounting System" signed in Blocks 3 and 4. The offeror must also confirm that the accounting system has not changed since the issuance of the determination. An offeror that does not have a recent accounting system adequacy determination should include with its proposal a completed "Preaward Survey of Prospective Contractor Accounting System Checklist"; a copy of the checklist is included in Section J, Attachment
7. The Contracting Officer will use this completed checklist to request a DCAA preaward survey of the offeror's accounting system.
b. The offeror shall submit for themselves statements identifying the most recent year for which final indirect cost rates have been determined by the offeror’s and team subcontractor’s cognizant Federal agency/auditor. Additionally, the offeror shall provide the status of any incurred cost audits for any year(s) for which final indirect cost rates have not been determined. The offeror shall provide a points of contact by name and telephone number for the agency official responsible for establishing final indirect cost rates and cognizant auditor.
c. In accordance with the provision 252.234-7001 Notice of Earned Value Management System, the offeror shall provide documentation that the Cognizant Federal Agency (CFA) has determined that the proposed Earned Value Management System (EVMS) complies with the EVMS guidelines in the American National Standards Institute/Electornic Industires Alliance Standard 748, Earned Value Management Systems (ANSI/EIA-748). If the offeror proposes to use a system that has not been determined to be in compliance with those requirements, the offeror shall submit a complrehensive plan for compliance with the guidelines in ANSI/EIA-748. See 252.234-7001 for requirements to be included in the plan.
