RUARK BLUFF EAST

STOCKTON PROJECT

1. General Information

1.1. Background: Stockton Lake is a flood control reservoir located on the Sac River in southwest Missouri, tucked into the foothills of the scenic Ozark Mountain range. The lake spans three county boundaries:

Cedar, Dade, and Polk. It is approximately 50 miles northwest of the metropolitan area of Springfield, Missouri, and approximately 130 miles south of Kansas City, MO. A map of Stockton Lake can be found on the Internet at: http://www.nwk.usace.army.mil/st/.

Stockton Lake provides flood protection for downstream areas and is part of a network of Corps of Engineer Lakes that help control flooding in the Missouri and Mississippi River basins. Stockton Lake encompasses approximately 25,000 acres of surface water. Federal land surrounding Stockton Lake totals 36,047 acres, of which 16,572 acres are leased to the Missouri Department of Conservation (MDC) for management. Land management practices used by the Corps of Engineers and MDC are engineered to preserve their natural value, providing benefits to the nation in areas of flood damage reduction, recreation, fish and wildlife management, hydroelectric power, and water quality improvement.

Eight parks around the lake are managed and maintained by the Corps of Engineers. These parks include roads, utility systems, campsites, beaches, boat ramps, picnic grounds, and playground areas. In addition to Corps-managed areas, the Corps also maintains active lease agreements with the Missouri Department of Natural Resources and private entities. The lessees provide a full range of marina services, restaurants, and camping to the public. The Government develops the QASP, and the Project Office administers the plan through Quality Assurance Evaluators (QAEs) which monitor Contractor performance using quality assurance procedures developed by the Government. Typical procedures might include random sampling, checklists, and customer complaints. This should not be considered an exhaustive list. A primary objective of Government Quality Assurance will be to determine the effectiveness of the Contractor’s quality control system.

1.11.2. Inspections. According to the Inspection of Services paragraph (paragraph a) in the Commercial

Items clause (52.212-4 Contract Terms and Conditions – Commercial Items), the Government reserves the right to inspect or test any services that have been tendered for acceptance. The Government may require re-performance of nonconforming services at no increase in contract price.

If re-performance is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming services.

1.11.3. The Contractor understands that the QASP is solely for the benefit of the Government in ensuring the Contractor completes its required work in accordance with this contract. Government officers shall never exercise supervision over the Contractor’s employees, and any defects noted shall be brought to the attention of Contractor’s designated representative. Government may direct the Contractor to perform the unsatisfactory services at no additional cost to the Government. Re-performance as directed by the Government shall be completed within two (2) hours. Failure of the Contractor to perform the work as specified, or to re-perform work as directed within the allotted time, may result in reduction of the contract price in proportion to the portion(s) of the work not accomplished. Amounts to be withheld will be determined by prorating the amount of services satisfactorily performed against the amount of services required. When the defects in services cannot be corrected by re-performance, the Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements, and (2) reduce the contract price to reflect the reduced value of the services performed. Payment will NOT be made for work not performed or not performed to standard.

1.11.5. If the Contractor fails to promptly re-perform the services or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may: (1) by contract, or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service, or (2) terminate the contract in whole or in part.
