If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)). ---------------------------------------------------------------- The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate). Union Rate Identifiers A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014. Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate. Survey Rate Identifiers Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier. Survey wage rates are not updated and remain in effect until a new survey is conducted. Union Average Rate Identifiers Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier. A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based. ---------------------------------------------------------------- WAGE DETERMINATION APPEALS PROCESS 1.) Has there been an initial decision in the matter? This can be: * an existing published wage determination * a survey underlying a wage determination * a Wage and Hour Division letter setting forth a position on a wage determination matter * a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to: Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor
200 Constitution Avenue, N.W. Washington, DC 20210 2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to: Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W. Washington, DC 20210 The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue. 3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to: Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W. Washington, DC 20210 4.) All decisions by the Administrative Review Board are final. ================================================================ END OF GENERAL DECISION

4.7.2 Verification Testing:
The Contractor will perform verification testing in each Functional Area that is cleaned. The purpose of verification testing is for the Contractor to demonstrate to the Government that surface areas meet the acceptable criteria defined in this scope of work. Also, the Government will be using a 3rd-Party Consultant to perform Quality Assurance (QA) testing as well and will compare verification test results submitted by the Contractor to the QA results obtained by the 3rd Party Consultant
All verification testing shall be wipe samples. All wipe samples shall be collected in accordance with the NIOSH Method 9100 - Lead in Surface Wipe. All wipe samples will be analyzed for lead, cadmium and chromium according to the EPA Method 6010C and shall be reported in units of micrograms per square foot (ug/ft2).
Verification results shall be provided to the Government within 48 hours of sample collection. Verification testing shall be conducted at a frequency of two (2) wipe samples per functional area or two (2) wipe samples for every 1,000 square feet of surface cleaned; whichever is less. The Contractor shall be responsible for all costs associated with re-work or additional cleaning of a functional area that has failed to meet the clearance criteria established by the Government.
Table 1 indicates what acceptability criteria will be applied to each Functional Area, but in general, support areas (such as the Control Room) will use a concentration of Lead less than 200 micrograms per square foot (200 ug/ft2) as the criteria. Other operational areas within the Plant will use a concentration of Lead less than 1,000 micrograms per square foot (1000 ug/ft2) as the criteria.
4.7.3 Safety
It is important to note that several of the surface areas to be cleaned are located in one of two large open galleries at heights in excess 70 feet from the main gallery floor. It is assumed that access to these areas may require the use of mechanized/powered equipment, scaffolding and work platforms. Any scaffolding or work platforms will require the Contractor to prepare a design for Government review and approval before any work will begin. Work platforms and scaffolding will be erected, used, inspected, tested, maintained, and repaired compliant with current USACE Safety manual and referenced regulations and standards.
4.7.4 Brief Description of Functional Areas to be Cleaned
NOTE: See Table 1 and Photo Log Attachment for additional description of each area.
ID# 1 – Control Room – Elev 708 The existing modular floor carpet located in the Control Room is assumed to have collected metal dusts and debris over an extended period of time. The Contractor shall remove and dispose of all carpet squares in the Control Room. The Contractor shall replace the carpet with new carpet squares. Government approval of carpet material is required.
The new carpet squares to be installed by the Contractor shall be:
Shaw 24"x24"Carpet Tile Style # / name: J0111 / CHANGE IN ATTITUDE TL Color # / name: 12205 / LIGHTEN UP
Due to the critical requirement of the facility to maintain Control Room operations, the Contractor will incorporate applicable precautions and engineering controls to ensure that the Control Room continues to operate as required and that the occupants are adequately protected during each work shift.
ID# 2 – Service Elevator No significant comments or notes. Standard metal floor of standard elevator cab.
ID# 3 to 7 – Stairwells All floor surfaces and handrails in multiple stairwells are to be cleaned. All stair and landing floors are unpainted, sealed concrete. All handrails are unpainted, galvanized metal. The dimensions of the stairs vary between 2.5 ft wide to 3.5 ft wide.
ID# 8 – Pump Turbine Gallery North and South Wall Corbels (crane rail ledges) Cleaning of 2-foot wide ledge (floor) surfaces approximately 76 feet high on the North and South sides of the Pump Turbine Gallery. Debris on ledges to be removed primarily consists of dust and flaked paint that has accumulated.
There are small grease spots and dried lubricant of a tar-like consistency.
ID# 9 to 13 – Various floor surfaces Floor surfaces in multiple areas are to be cleaned. All floors are unpainted, sealed concrete. The dimensions of the areas vary between 200 and 10,000 square feet (SF). Some areas are occupied by permanent mechanical equipment and machinery that obstructs portions of the floor. The Contractor shall implement protective measures to protect all Plant equipment and shall not damage any equipment or disrupt operations. Some areas are “tight” and will likely require hand cleaning methods or small tools.
ID# 14 – Generator Main Shaft Pits There are 6 Generator Main Shaft Pits accessible from the floor of the Mechanical Equipment Gallery on Elev 658.
The pit walkway floor is approximately 6 feet below the Gallery floor and is accessible by a short ladder. The pit walkway floor surfaces, including the inclined walkway leading to the Generator access door and handrails of each pit are to be cleaned. The pit walkway floors are unpainted metal diamond plate and unpainted, sealed concrete.
The handrails are unpainted galvanized metal.
ID# 15 – Air Handling Units 1, 2, 3, and 4 This work element does not include cleaning of ducts. Three of the Air Handling Units (AHUs) are identical. Each AHU has an access hatch that is approximately 18 inches square. This hatch opens to an interior compartment and allows access to the filters. The inside of this compartment contains visible dust that has accumulated over time.
The inside surface of each compartment is unpainted metal duct. The inside of each compartment is to be cleaned as thoroughly as possible without disassembling the AHU (such as, but not limited to simple hand cleaning with long handled brushes or other tools). The compartment is not large enough for a person to enter the compartment, but could possibly be considered to be a confined space if the Contractor’s personnel elect to “stick their head inside” the compartment to conduct cleaning.
AHU #1 is of a different configuration. AHU #1 has several small access panels where visible dust may have accumulated and may be able to be cleaned without disassembling the AHU. The Contractor shall coordinate with the Government to determine what amount of cleaning can be performed in AHU #1.
4.8 ITEMCLIN 2 – Paint Stabilization:
This ITEMCLIN shall include all costs for paint stabilization work for all of the functional areas described below.
