2. Page 3 of the Solicitation PDF file states – “Do not include Offeror’s name and address anywhere on the pages. For identification purposes, only the Offeror’s CAGE Code shall be shown in the footer of each page”. Please confirm that on the SF1449 we are supposed to include the name and address in Box 17A.

Yes

Excel sheet with CLIN Descriptions uploaded

6. Please confirm that the daily rates for latrine rentals will be used for anything less than 6 days. For example, on a latrine rented for 10 days the payment would be the weekly rate for the first 7 days and then the daily rate for the final 3 days. Second example – on a latrine rented for only 5 days the payment will be for 5 times the daily rate.

Correct

7. Page 5 of the Solicitation PDF File, Other Information, Paragraph 1 – Security of Storage Area. Also, Page 9 of the SOR, 2.5.1.5.1.2 states that the fence is optional and Page 27 of the SOR 7.4.1 states fencing is optional. We are requesting that you remove the requirement to fence the storage area and confirm that fencing is optional as states in the SOR. Fencing at PTA is challenging and not effective because you cannot dig down past 2 feet in the ground on the base for the post holes.

Fencing can be optional as long as there are signs saying that it is the contractor storage and to keep out. Make sure all latrines stored there are locked or the doors are faced in. Any damages will not be government responsibility.

8. Page 6 of the Solicitation PDF File, 4. Commencement, Prosecution and Completion of Work Ordered, paragraph (c) states that the Contractor shall be available from 7:30 am to 4:30 pm Monday through Friday.

Amended PWS/SOR to:

2.1.3.2 Hours of Operation. The Government's regular (normal) hours are from 0730 – 1630 hours, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor shall coordinate with Range Control at 808-969-2455 to conduct business outside of Government’s regular hours.

9. Page 6 of the Solicitation PDF File, 4. Commencement, Prosecution and Completion of Work Ordered, paragraph (c) please remove the 4th sentence that states – “The Contractor may be required to remove, cut, alter, replace or repair existing work as necessary to perform work”. This contract doesn’t have anything to do with construction, maintenance or repair work.

Will be removed

10. Page 9 of the Solicitation PDF File (5). Please provide specific information on what type of employee training certificates are required on environmental and spill response training.

PWS/SOR corrected to add the PTA Environmental POC:

2.5.5.6 PTA Hazardous Materials Briefing. Contractor shall schedule a PTA Hazardous Materials Safety Brief prior to initiation of work. Contractor shall schedule through Christine Phelps at 808-969-2515 (office), 808-551-6148 (cell), or email:

Christine.d.phelps.civ@army.mil , a minimum of 30 days prior to the desired briefing date.

All contractor personnel are required to have this briefing.

A certificate will not be provided upon completion; a roster will be sent to the COR for Contractors completion.

11. Page 9 of the Solicitation PDF File (6). Please provide information on the specific qualifications required for the Primary and Alternate Environmental Compliance Officer.

The Contractor shall use and store all materials, chemicals, and equipment used in the performance of services on the installation IAW with industry standards, local, State and Federal laws, and according to manufactures' recommendations. The Contractor shall be financially responsible for all fines and associated costs for hazardous waste management, transportation, and disposal of waste due to the Contractor's non-compliance. The Contractor shall submit Safety Data Sheets (SDS) for approval on all materials, five (5) days before delivery of the material, to the COR. The Contractor shall provide upon request from the COR all required data to meet environmental-mandated reporting requirements (e.g., air emission data, hazardous material storage/usage, herbicide/pesticide usage, solid/hazardous waste generation). 12. Page 13 of the Solicitation PDF File, 16. Safety Requirements (b), Page 10 of the SOR 2.5.3, and Page 16 of the SOR A010. Please remove the requirement for a safety plan. A safety plan was not required for the previous contract.

See note added to #13

13. Also, if a safety plan is required, please clarify the number of days after award we need to submit the plan. There are different day requirements in the various sections of the solicitation that mention a safety plan.

Updated PWS/SOR to: 2.5.3.1 Safety Plan. NA Deleted A010 and renumbered Deliverable Table

14. Statement of Requirement – RFIs

a. Page 2 list the areas where contract services are to be provided, several of these locations are outside of the 12 miles or greater from the back gate leaving PTA Cantonment as outlined in 8.4.2. Please confirm that the following locations which are more than 12 miles from PTA will be priced and paid as remote delivery and remote service charges. The locations are: Kawaihae Dock (K---Dock), Hilo International Airport, and Elison Onizuka Kona International Airport at Keahole Airport.

8.3 Removed “Remote”

The Contractor shall provide enclosed, individual portable latrines with an inside locking device, 60-gallon holding tanks to support use by fifteen (15) soldiers for 3 consecutive days, supplied with a minimum of eight (8) full rolls of toilet paper. Toilet paper shall be placed on a holder and not left on the ground or seat area, to prevent rolls from falling on to the ground or blowing out of the Latrine. For remote Areas see Technical Exhibit #1C Area Map – PTA Remote Locations.

Updated TE 1C Area Map for Remote Areas

b. Page 3, 2.1.3.2 Hours of Operation are listed as 0600 to 1630. On Page 6 of the Solicitation PDF File, 4. Commencement, Prosecution and Completion of Work Ordered, paragraph (c) 2nd sentence states that the Contractor shall be available from 7:30 am to 4:30 pm Monday through Friday. These hours of operation conflict. Please confirm which is the correct hours of operation. Hours of operation note – PTA does not allow utilization of a waste storage tank on site so waste has to be dumped at the County of Hawaii facility during the day. In order to make the 2:30 pm County of Hawaii Treatment Facility cut off our personnel have to leave the PTA site by 1 pm.

Conflict resolved. 2.1.3.2 Hours of Operation amended to Normal Business Hours of 0730 to 1630 The Contractor shall coordinate with Range Control at 808-969-2455 to conduct business outside of Government’s regular hours.

There is a possibility of a KTR provided holding tank stored on site, at the KTR storage at Puu Ahi this would need further discussion and cannot be authorized by the suspense of Friday, 6/17/22

c. Page 3, 2.1.3.2 Hours of Operation. In order to properly conduct business and service the contract, please confirm that all ordering/changes/contract information will be provided by 1 pm each day to the contractor so that they can review and discuss with government staff while they are still available in the afternoons.

Regular Government Business Hours amended to 0730 - 1630

d. Page 3, 2.1.4.1 – Please change this to twenty---four (24) hours. Twelve---hour notice for personnel support outside the normal hours of operation is not possible.

Amended: 2.1.4.1 The Contractor shall provide personnel support within twenty four (24) hours of notification outside the normal hours of operation as required, to support the Directorate of Public Works (DPW) mission. Prior to performance of services outside the locally established hours of operation, the Contractor shall request and obtain, in writing, approval from the KO. The Program Manager shall be available after normal hours to serve as the central point of contact for Contractor operations. Contractor personnel shall not be scheduled for overtime work.

e. Page 4, 2.1.4.1.1 – Please change this to twenty---four (24) hours. We cannot commit to perform in 12 hours. Twenty---four (24) hours is the minimum amount that is needed. Particularly with verbal orders, that often come during off business hours/weekends when minimal government support is available.

Amended: 2.1.4.1.1 The contractor shall provide the Program Manager name, phone number, and email address to receive all verbal or electronically sent communications for portable latrine service requests. The POC shall acknowledge receipt of the requests sent verbally or electronically within twenty four (24) hours, confirming request has been received, and the service requested will be scheduled in an acceptable time frame.

f. Page 4, 2.1.6.3 – Portable Latrines (Emergency Delivery) and Page 13 #5. Please change this to twenty---four (24) hours. We cannot commit to perform an emergency delivery within 12 hours.

Amended: 2.1.6.3 Portable Latrines (Emergency Delivery). The Contracting Officer will telephonically notify and send a confirmation email to the Contractor for emergency latrine(s). The Contractor shall deliver the latrine(s) within twenty four (24) hours after notification, to include weekends.

g. Page 4, 2.1.9 – Quality Control, Page 13 #2, Page 14 Section 4.2, and Page 15 A002.

Please take out the requirement for a quality control plan and QC inspectors. Quality control plans were not required on the past contract and the work performed under

Quality control plan and QU inspector is a requirement

h. Also, if a Quality Control Plan is required, please provide the number of days after contract award that the Plan is due. There are different day requirements in the various sections of the solicitation that mention a Quality Control Plan.

Five (5) business days prior to contract start.

i. Page 28, 8.1 – Portable Latrine Matrix. Please adjust this section to include that emergency delivery notifications will be provided 1 business day prior to the service start date.

8.1 states Requirements received by the contractor with less notice (3 days) will be subject to emergency delivery costs.

j. Page 28, 8.1.1 – Please change this section so that all GPC are paid 1008% up front.

Under the current contract over 80% of all GPC orders gets declined on first few attempts to run the card due to not being provided the correct card holders information or the S8 denies due to lack of funding. Also, once the unit has left PTA, collecting monies that are owed is extremely difficult and contracting is often unable to assist since they are GPC orders.

PWS amended to reflect hte 100% advanced payment

k. Page 29, 8.3 Gate Keys, 8.4.1 Portable Latrine Service Infantry Platoon Battle Course (IPBC), and 8.4.2 Portable Latrines Service Remote Areas – Please remove the requirement to have serial numbers on toilets. Toilet locations are not tracked by serial numbers they are tracked by quality of latrines as specific locations at PTA.

PWS 8.3 has nothing about serial numbers to remove.

8.4 amended

8.4.1 amended

8.4.2 amended

l. Page 29, 8.5. Portable Latrines Delivery/Pickup. Please provide the process that the contractor should use for reimbursement when Latrines are taken and relocated by the units and/or locks are broken on the latrines not in service and they become used.

When this has happened in the past the contractor has had to find the units and clean/repair them prior to them being able to be used again.

Government is not liable for any damages or latrine removal if contractor decides to not put fencing around the storage area.

If there is fencing and there’s damage, then the government would do an investigation and reimbursement is available after investigation.

m. Page 29, 8.5.5 Portable Latrines (Relocations) and page 13 #8. Eight (8) working hours after notification for a relocation is not possible. Please change this to twenty---four

(24) hours.

Amended 8.5.5 Portable Latrines (Relocation). The COR will telephonically notify and send a confirmation email to the Contractor requesting to relocate latrine(s), not to exceed the quantity stated in the delivery order. Relocation of the latrine(s) shall be within twenty four

(24) hours after notification, including weekends. Should the contractor require additional information for actual placement of the latrines, coordination shall be made with the COR prior to placement of the latrine. The Contractor will not be compensated for relocation costs for placing a latrine in the incorrect location.

n. Page 29, 8.6 Portable Latrine Cancellation. Please change this to a minimum of Twenty---Four (24) hours. Eight (8) hours it too short of a time period for cancellations. Often for large orders, latrines need to be pre---delivered 1 to 2 days in advance.

Amended 8.6 Portable Latrine Cancellation. The Government reserves the right to cancel a request within a minimum of twenty four (24) hours of the required date and time. If the latrines are cancelled on the day of delivery, prior to delivery, the unit will not be charged a delivery fee per each unit. If the latrines are delivered, the unit will pay delivery fee per each unit.

o. Page 30, 8.7.2 Ammunition or Trash Found in Portable Latrines. Often ammunition is not discovered until the load is at the County of Hawaii treatment facility and it goes through their screens into the treatment system. Once a piece of metal hits the County’s screen the load dump is stopped and we have to take the load back to PTA for cleaning. The County of Hawaii heavily scrutinizes waste loads from PTA. Please advise how the contractor is to be reimbursed for having to bring the load back to PTA for the ammunition to be cleaned out and then return the load to the County of Hawaii for dumping.

Waiting for response from legal team

p. Range control often requests that the contractor pickup and remove trash, rubbish (soda cans, packaging, etc.). Please confirm that the contractor is not required to remove any trash from the areas where the latrines are located on the range.

Confirmed. Contractor is NOT required to remove any trash from the areas.
