Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.
(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of Federal specifications, standards, and product descriptions can be downloaded from the ASSIST website at https://assist.dla.mil.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained from the address in paragraph (i)(1)(i) of this provision.
(2) Most unclassified Defense specifications and standards may be downloaded from the ASSIST website at https://assist.dla.mil.
(3) Defense documents not available from the ASSIST website may be requested from the Defense Standardization Program Office by--
(i) Using the ASSIST feedback module (https://assist.dla.mil/feedback); or
(ii) Contacting the Defense Standardization Program Office by telephone at 571-767-6688 or email at assisthelp@dla.mil.
(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers that exceed the micro-purchase threshold, and offers at or below the micro-purchase threshold if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) Reserved.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

C. The Technical Volume should be specific, clear, complete, and not exceed a 25-page limit. Submissions will be evaluated against the Technical subfactors defined below in this RFQ. The instructions below provide a detailed approach to accomplish/satisfy all subfactors. By submitting a quote, the offeror affirms that its organization will perform all requirements specified in the RFQ and Performance Work Statement (PWS).
1. Factor 1: Technical. The Government will evaluate the offer for completeness and reasonableness as it describes the offerors' approach to accomplishing the required services described in the PWS. USG will evaluate the offer for telling the story of who, what, where, and how the work will be performed. USG will evaluate the offer to demonstrate that the offeror clearly understands the nature and magnitude of the effort required to provide the required services in an overseas environment.
a. Subfactor 1: Phase-ln. The offeror will develop a 30-day phase-in plan to include medical clearance, security clearance, administrative, personal support services, secure housing, and transportation.
b. Subfactor 2: Management Plan. The offeror shall develop a management approach covering the primary team members. In addition, develop a plan with the detailed approach of the labor categories to meet the requirements of the PWS.
c. Subfactor 3: Quality Control Plan. The offeror shall develop a Quality Control Plan in accordance with the PWS and PRS. See PWS Para 1.6. Quality Control Plan.
2. Factor 2: Past Performance. Evaluation of Past Performance is on an acceptable/unacceptable evaluation measure.
a. Offeror shall submit similar work performed with the Federal Government that demonstrates recent and relevant past performance. Recent is defined as within the last five (5) years. Relevant is defined as work similar to the complexity and magnitude of the work described in the Performance Work Statement (PWS) related to this solicitation. A minimum of two contracts of related work is to be submitted with the proposal information.
b. If the offeror does not possess relevant past performance, the offeror shall submit a statement affirming that it does not possess relevant Past Performance.
3. Factor 3. Total Evaluated Price. The Price quote shall be prepared in accordance with these instructions, and the prices will be evaluated for price reasonableness in accordance with FAR 12.209. The Contracting Officer has determined that the items/services being procured are commercial in accordance with FAR 2.101.
a. The Lowest Price is Technically Acceptable. The total contract evaluated price shall consist of the sum of the proposed amount for all CLINs and Options. The FFP CLINS will be evaluated based on historical purchases for base and option years; a Not to exceed (NTE) plug-in value shall be added to the COST CLINS 0004, 1004, 2004, 3004, and 4004.
b. Attachment 2. The offeror shall complete Attachment 2 (Pricing Model) of the solicitation by inserting a fully-burdened unit price, rounded to the whole dollar, and a total extended price (unit price multiplied by the USG estimated quantity) for each Firm Fixed Price (FFP) Contract Line Item Number (CLIN) and submit with the Price quote. The total extended price for each FFP CLIN shall equal the fully burdened unit price.
c. For the purpose of the award of this Contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows:
i. The evaluation will consider the possibility that the option can be exercised at any time during any contract performance period, and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract when the option is exercised.
ii. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
iii. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
D. System for Award Management. The offeror acknowledges the requirement that a prospective awardee be registered in the SAM database before award, during performance, and through final payment of any contract resulting from this solicitation. The offeror may obtain information on registration and annual confirmation requirements via the SAM database accessed through SAM.GOV.
E. Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available" in accordance with AFARS Subpart 5132.702.
F. Army Contract Writing System (ACWS) Transition Information for Offerors
1. The Army Contracting Enterprise (ACE) is in the process of deploying new solicitation and contract writing software to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this Solicitation.
2. During this transition period, Offerors are hereby advised:
a. The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation (e.g. solicitation amendments and awards, if any). Due to this:
i. This solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office (e.g. requiring offer submission via the PIEE Solicitation Module vs. e-mail). Offerors should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the Contract Specialist or Contracting Officer.
ii. If the Contracting Office switches contract writing systems prior to award, documents you receive from the Contracting Officer or view on SAM.gov or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.
iii. A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the Contract Specialist or Contracting Officer.
b. The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, you, as the Offeror, may still be the first to spot such errors. Therefore, Offerors shall:
i. Notify the Contracting Officer immediately if any observed changes, removals, or additions affect your award eligibility, violate or alter existing quote/proposal terms, or could affect Contract performance post-award.
ii. Take special care to ensure all fill-in Clauses are populated and remain populated across documents received from the Contracting Office throughout the Solicitation and Award process.
iii. Contact the Contracting Officer listed on the first page of the solicitation or solicitation amendment for guidance if you notice or suspect any inadvertent change has occurred between document issuances.
c. The Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the Contractor. Any such modification will reconcile the award with the latest version of this solicitation reflecting deliberate action by the Contracting Officer (e.g. the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental offer terms.
d. In the unlikely event a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this solicitation, the Contracting Officer:
i. May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.
ii. Will incorporate the latest version of this Solicitation into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.
iii. Will ensure any action taken does not conflict with the stated offer evaluation and award methodology of this requirement.
Will issue a complete, properly-formatted award accurately reflecting this requirement and all applicable terms and conditions once systems return to normal.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO 52.212-2
Addendum to 52.212 Evaluation – Commercial Items
A. BASIS FOR AWARD
1. This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with FAR 13 as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS). The Government will select the quote with the lowest evaluated price determined fair and reasonable from among those meeting the acceptability standards for non-price factors.
2. Responsibility. A contract may be awarded to the Quoter who is determined responsible in accordance with FAR Part 9, as supplemented, whose quote conforms to the solicitation requirements (to include stated terms, conditions, representations, certifications, and all other information required) and is judged, based on the evaluation factors and sub-factors to represent the lowest price technically acceptable quote.
3. Responsiveness. Quoters are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or sub-factors. Failure to comply with the terms and conditions of the solicitation may result in the Quoter being ineligible for award. Quoters must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
4. Quote Evaluation. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
a. For the purposes of conducting evaluations, the Government will initially rank all proposals by the total price, to include all option period prices, as calculated in each Quoters completed CLIN Structure submitted with the Price volume. The Government evaluation team will then proceed with the simultaneous evaluation of the Price, Technical, and Past Performance volumes beginning with the lowest priced quote and proceeding with evaluations by ascending price, if necessary. If the lowest priced quote is determined fair and reasonable and has an acceptable rating for technical and past performance, evaluations may cease and award may be made to that Quoter as this represents the best value to the Government.
b. If the lowest priced quote is not rated “Acceptable” in technical and/or past performance, or is not determined fair and reasonable; the Government will move on to the next lowest priced quote and the Evaluation Team will evaluate that Quoter’s volumes simultaneously. If this quote is determined to be fair and reasonable, and has an acceptable rating for technical and past performance, evaluations may cease and award may be made to that Quoter without entering into discussions. However, the Government reserves the right to evaluate all quotes.
c. Noncompliance with the solicitation requirements may raise serious questions regarding your technical acceptability and/or pricing. Failure to include all information requested may adversely affect your evaluation.
