About this file
This file is a series of amendments (0001-0003) to a Basic Ordering Agreement (BOA) solicitation issued by the U.S. Army Contracting Command - Detroit Arsenal (ACC-DTA).
The BOAST (Basic Ordering Agreement Sustainment Track) program establishes BOAs for procurement of Class IX supplies as defined in DoD Joint Publication 4-09, including repair parts, components, kits, assemblies, subassemblies, and reparable and consumable items required for maintenance support of all Army equipment, excluding medical-peculiar repair parts. Class IX supplies are subdivided into nine categories: Air, Ground Support Materiel, Administrative Vehicles, Electronics, Tactical Vehicles, Missiles, Weapons, Special Weapons, Industrial Materiel, and Aircraft Engines. The BOA is valid for five years from the effective date of initial execution, with no government obligation to issue orders. Orders will be individual contracts issued via Request for Order Proposals (RFOPs) posted on SAM.gov, priced individually using FAR 15.4 contract pricing procedures, and executed on DD Form 1155 and Standard Form 26. Contractors must be registered in SAM.gov, acknowledge all applicable clauses, and maintain active SAM registration throughout the BOA period. Orders will generally be Firm-Fixed-Price unless otherwise specified. The on-ramp procedure allows continuous contractor participation, while off-ramp removal may occur for failure to maintain SAM registration, poor CPARS performance, or government discretion. Amendment 0003 extends the solicitation closing date to April 3, 2031, updates mandatory clauses including FAR 52.222-90 (DEI Discrimination) and FAR 52.244-6 (Subcontracts), and supersedes Sections I and J. Amendments 0001 and 0002 made administrative updates to align with Revolutionary FAR Overhaul (RFO) policy, deleting obsolete clauses and adding compliance-related provisions. Technical Data Packages are available through SAM with access controlled based on export control requirements and Distribution Statement markings. Payment is processed through Wide Area WorkFlow (WAWF) system. Solicitation: W912CH-26-R-0001; Contract Number: W912CH26R00010003; Product Service Code: 9999.

*** END OF NARRATIVE ***
Section C - Description/Specifications/Statement of Work
C.1 GENERAL. This BOA establishes the terms and conditions under which Orders may be placed for various Class IX supplies and is not a contract pursuant to FAR 16.703(a)(3). A Delivery Order issued pursuant to a BOA will become a binding contract at the time of the Government's acceptance of a Request for Order Proposal (RFOP) and award of a Delivery Order.
C.1.1 This BOA will be valid for up to five (5) years beginning from the effective date of the initial BOA execution. IAW DFARS 216.703(c), the period during which orders may be placed against a BOA may not exceed 5 years.
C.1.2 Only ACC-DTA is authorized to execute, modify, and undertake reviews of BOAST.
C.1.3 The Government is not obligated to order any specific quantity of supplies covered by this agreement during its term. Neither the Contractor nor the Government shall incur any liability for the non-issuance of Orders. No effort is authorized under this BOA. All costs for personnel, materials, and other expenses must be identified in each individual Order.
C.1.4 This Agreement will be subject to continuous review and revised as necessary to conform to the changing requirements of the FAR and other applicable statutes and regulations. BOAs shall be changed only by modifying the agreement itself and not by individual Orders issued under it. Modifying a BOA shall not retroactively affect Orders previously issued under it.
C.2 METHOD OF ORDERING. All requirements will be announced to BOA holders via Special Notices posted on the System for Award Management website at https://www.sam.gov/ . The Government intends to compete future requirements under this BOA to the fullest extent possible. However, the Government recognizes that certain requirements may be subject to limitations on competition, as permitted by the FAR and DFARS. Any limitations on competition will be documented in the RFOP and justified in accordance with applicable regulations.
C.3 REQUEST FOR ORDER PROPOSAL (RFOP). Each Special Notice will include an RFOP. The RFOP will detail all information necessary for offerors to prepare and submit a comprehensive proposal, including but not limited to:
C.3.1 Terms and conditions governing the specific order;
C.3.2 Applicable FAR and DFARS clauses and provisions;
C.3.3 Detailed requirements, including quantity, specifications, and delivery schedules;
C.3.4 Deliverables and reporting requirements;
C.3.5 Evaluation criteria for proposal assessment; and
C.3.6 Submission instructions and deadlines
C.4 PROPOSAL SUBMISSION. Contractors are responsible for monitoring SAM.gov for Special Notices and submitting proposals in response to RFOPs in accordance with the instructions provided within each RFOP.
Submission of a proposal does not guarantee the issuance of an Order.
C.5 EVALUATION. Specific evaluation criteria will be identified in each RFOP. Evaluation factors may include Price, Technical Capability, Past Performance, and/or other factors detailed in the applicable RFOP. Delivery Orders may be executed based on: evaluation of price alone; lowest price, technically acceptable (LPTA); or, best value tradeoff process.
C.6 ORDER ISSUANCE. The Government will review proposals received in response to each RFOP. Orders will be placed against the successful offeror's BOA in accordance with Section C.5.
C.7 ORDER TYPES. Orders placed under BOAST will generally be Firm-Fixed-Price (FFP) unless otherwise specified in the RFOP. Other Order types may be used when appropriate and justified. The contractor shall adhere to the prices proposed and agreed to in each individual Order issued against the BOA. Failure to reach agreement on price for any Order issued before its price is established is a dispute under the Disputes clause included in the BOA.
C.8 UNAUTHORIZED WORK. No work should commence until an Order is placed under BOAST. Any work performed prior to the issuance of an Order is done at the contractor's own risk.
C.9 ASSERTION OF RESTRICTIONS. Each Order will include applicable DFARS 252.227 clauses and restrictive markings as necessary to protect technical data. Contractors are responsible for adhering to all data rights and security requirements.
C.10 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (CPARS). Contractor performance will be assessed and reported through the CPARS in accordance with FAR Part 42.
C.11 MODIFICATIONS. Any modifications to Orders placed under BOAST will be processed in accordance with FAR Part 43.
C.12 NAICS CODE AND BUSINESS SIZE STANDARD. The North American Industry Classification System (NAICS) code and corresponding business size standard applicable to each Order will be determined and specified within the individual RFOP.
C.13 SMALL BUSINESS SUBCONTRACTING. Contractors may be required to submit a Small Business Subcontracting Plan as outlined in FAR 19.702-2, if applicable. The requirement for, and content of, such a plan will be specified in the RFOP.
C.14 REGULATORY COMPLIANCE.
C.14.1 This BOA includes clauses that may apply to future Order requirements. The RFOP will identify all required provisions and clauses applicable to that specific requirement by reference to Section J Attachments 0001, 0002, and /or 0003 as follows:
C.14.1.1 ATTACHMENT 0001, FAR Part 12_Acquisition of Commercial Items: Applies to acquisitions of commercial products and commercial services.
C.14.1.2 ATTACHMENT 0002, FAR Part 13_Simplified Procedures for Non-Commercial Acquisitions: Applies to acquisitions of supplies and services, including construction, research and development, and non-commercial items, where the aggregate amount does not exceed the simplified acquisition threshold (SAT).
C.14.1.3 ATTACHMENT 0003, FAR Part 15_Contracting by Negotiation: Applies to negotiated acquisitions, both competitive and noncompetitive.
C.14.2 The Government reserves the right to add additional clauses and provisions at the Order level as necessary to comply with applicable laws, regulations, and agency policies, or to address the specific requirements of individual Orders issued under this BOA. Any such additions will be included in the RFOP for that Order.
C.14.3 The version of any clause or provision incorporated into an individual Order will be the version in effect as of the date of that Orders award, regardless of the BOA establishment date. Changes to FAR, DFARS, or other referenced regulations occurring after the BOA establishment date will not automatically apply to previously awarded Orders.
C.15 ON/OFF-RAMP
C.15.1 On-Ramp Procedures. To maintain a competitive vendor base, the BOAST program will remain open on a continuous basis to allow new contractors and vendors to participate in BOAST. The On-Ramp process will consist of the following:
C.15.1.1 Notice of On-Ramp. The Government will publish a notice on SAM.gov as a Special Notice, announcing the On-Ramp opportunity.
C.15.1.2 Qualification for BOA Establishment. The Government will conduct a review to determine a Requestor's qualification for BOA establishment based on the following minimum requirements:
C.15.1.2.1 The Requestor must be registered and active in SAM.gov at the time of BOA establishment and throughout the BOA period.
C.15.1.2.2 The Requestor must acknowledge and accept all applicable clauses by completing all required representations and certifications in this BOA.
C.15.1.2.3 The Requestor must not be presently debarred, suspended, or proposed for debarment as verified in SAM.
gov.
C.15.1.2.4 This review is for the sole purpose of establishing the BOA pool. A formal, comprehensive determination of contractor responsibility in accordance with FAR Part 9 will be conducted prior to the award of any individual order.
C.15.2 Off-Ramp Procedures. A BOA holder may voluntarily request to be removed from the BOAST program at any time by submitting a written request to the Procuring Contracting Officer. The Government will acknowledge the request and process the removal. Additionally, in conjunction with the quarterly cycle, the Government reserves the right to review the status of all BOA holders and remove any from the program. Grounds for Government-initiated removal may include, but are not limited to:
C.15.2.1 Failure to maintain an active registration in SAM.gov.
C.15.2.2 Consistent poor performance, as documented in the Contractor Performance Assessment Reporting System (CPARS) or other official records.
C.15.2.3 A determination that it is otherwise in the Government's best interest.
C.15.2.4 For a Government-initiated removal, the Government will notify the BOA holder in writing. The Government's determination to cancel or not continue a Basic Ordering Agreement is a unilateral administrative decision. As such, this determination does not constitute a 'claim' as defined by, and is not subject to, the procedures of the Disputes clause at FAR 52.233-1.
C.16 TECHNICAL DATA PACKAGE INFORMATION
C.16.1 Technical Data Packages (TDPs) applicable to specific requirements will be released with future RFOPs and will be available through the System for Award Management (SAM) (https://SAM.gov) Special Notices. Access requirements for TDPs will vary depending on the individual order. Offerors are responsible for reviewing the RFOP for detailed instructions regarding TDP access, handling, and security.
C.16.2 To access the data through SAM:

Section H - Special Contract Requirements
H.1 ARMY CONTRACT WRITING SYSTEM (ACWS) TRANSITION INFORMATION FOR CONTRACTORS
H.1.1 The Army Contracting Enterprise (ACE) is in the process of deploying new solicitation and contract writing software to ACWS, this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this Contract.
H.1.2 During this transition period, Contractors are hereby advised:
H.1.2.1 The Contracting Office may use any combination of contract writing systems to generate distributable copies of this contract during its period of performance, as well as any subsequent modifications or Orders (if applicable). As a result:
H.1.2.1.1 Subsequent documents you receive may appear noticeably different than the original award or previous contractual documents from the same Contracting Office.
H.1.2.1.2 A change between contract writing systems may cause important information concerning contract terms and conditions to take on different formatting or appear in different parts of later documents issued.
H.1.2.1.3 Contractors shall ensure Customer Relationship Management (CRM) systems and personnel interacting with this contract are prepared to identify and respond appropriately to differences between document versions.
H.1.2.2 The Government does not intend to use the shift between contract writing systems to effect any changes to BOA terms and conditions. Therefore:
H.1.2.2.1 Contractors should view changes to terms or conditions between document versions as system-generated and potentially erroneous unless accompanied by narrative(s) designating such changes as deliberate and desired.
H.1.2.2.2 Contractors shall inform the Contracting Officer listed on the first page of the most recent document issued for guidance regarding any suspected or observed inadvertent or system-generated changes (e.g. noticing something missing in a new conformed copy).
H.1.2.2.3 The Government will correct any inadvertent or system-generated changes, additions, or omissions discovered by either party, via bilateral modification, at no cost to the Contractor.
H.1.2.2.4 The terms and conditions contained in the latest document reflecting deliberate action by the Contracting Officer (e.g. the last conformed copy of the BOA not affected by the observed issue) will take precedence until these problems are corrected.
H.1.2.3 In the unlikely event award information is corrupted or mutilated during system migration and replacement or re-issuance of this BOA is necessary for continued contract administration, the Contracting Officer will:
H.1.2.3.1 Issue a continuation BOA in accordance with DFARS 204.1601(c) and DFARS PGI 204.1601(c), carrying over all terms and conditions from the last-known version of this BOA accurately reflecting mutual agreement of the parties.
H.1.2.3.2 Incorporate the last-known version of this BOA and subsequent Orders accurately reflecting mutual agreement of the parties as an attachment to the replacement or continuation for future reference.
H.1.2.3.3 Ensure any such reissuance or continuance is properly reported to preserve the integrity of Contractor performance measurement data, if any (e.g. FAPIIS, CPARS).
