It is understood that, by submitting a Bid under this IFB, the Bidder agrees to supply one of the required part numbers unless the proposed part meets the conditions set forth in paragraph (b) below.
(b) Require Approval for Alternatives to the Source-Controlled Component or required Manufacturer's Part Number.
(1) If a firm manufactures an item which it believes to be totally equivalent to the required item(s), it may submit a Bid based on the equivalent item if the following conditions are met:
(i) Prior to receipt of this IFB, the firm must have received written U.S. Army TACOM approval of a test procedure on its non-listed item;
(ii) The firm must indicate in its Bid the date of the written U.S. Army TACOM approval, and the name and title of the approving official;
(iii) The firm indicates in its bid that it is in the process of having its item independently tested per the approved test procedure to demonstrate full physical, functional, and mechanical interchangeability of its part with an already approved part cited in this IFB, or that it is awaiting final U.S. Army TACOM engineering approval of the summary report furnished at the conclusion of independent testing; and
(iv) The firm must have secured final written approval of its part from U.S. Army TACOM engineering by the time of bid opening, (in the case of formally advertised acquisitions), or by the time of contract award, (in the case of negotiated acquisitions).
(2) Notwithstanding the foregoing, the Government expressly reserves to the Contracting Officer the right to waive the conditions set forth above in making an award when written approval from U.S. Army TACOM engineering of a non-listed part number can be obtained without delay in the anticipated date of award.
(3) When either of the foregoing conditions are met, the Government reserves the right to make an award for a non-listed item. In no other instance will award be made to any firm that does not agree to furnish one of the required part numbers listed in this IFB.
(c) Any firm that manufactures or regularly sells an item which it views as equivalent in all respects to one of the required component(s) or manufacturer's part number(s), but that has not initiated approved qualification testing in order to demonstrate that its part is totally equivalent to the required part, should contact the Contract Specialist listed on the first page of the IFB to inquire about getting qualification testing initiated.

L.10. HQ-AMC LEVEL PROTEST PROCEDURES
(a) Complete AMC Protest Procedures can be found at:

L.11. UNCLASSIFIED BID, MODIFICATION, OR REVISION/AMENDMENT SUBMISSION INSTRUCTIONS
(a) Bids, modifications, and/or revisions/amendments shall be submitted in accordance with A.3. Electronic Contracting. It is not anticipated that any requested bid, modification, or revision/amendment/amendment information will be classified.
(b) Submission due date. The Bidder must ensure its bid, modification, or revision/amendment in its entirety, reaches the required destination by the IFB closing date and time established in this IFB. All bids, modifications, or revision/amendments received after the specified submission time shall be treated as late and will be handled in accordance with FAR 52.214-7: Late Submissions, Modifications, and Withdrawal of Bids.
(c) Please note that when submitting your bid via e-mail, it may take time for the e-mail and any attachments/files to be scanned for viruses and transmitted to the Government. File size, network connection, connection type, and number of files are factors in the time needed to complete timely submission. Therefore, Bidders are strongly cautioned when submitting bids to allow ample time for completion.
Bidders should also take into account potential time needed to troubleshoot technical issues prior to the IFB closing date and time.
L.12. ARMY CONTRACT WRITING SYSTEM TRANSITION INFORMATION FOR BIDDERS
(a) The Army Contracting Enterprise (ACE) is in the process of deploying new IFB and contract writing software to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this IFB.
(b) During this transition period, Bidders are hereby advised:
(1) The Contracting Office may use any combination of contract writing systems to create and release documents related to this IFB
(e.g., IFB amendments and awards (if any)). Due to this:
i. This IFB may contain different bid submission instructions than other IFBs released by the same Contracting Office (e.g., requiring bid submission via the PIEE Solicitation Module vs. e-mail). Bidders should review all bid submission instructions contained in the IFB documents and direct any questions or concerns to the Contract Specialist or Contracting Officer.
ii. If the Contracting Office switches contract writing systems prior to award, documents you receive from the Contracting
Officer or view on SAM.gov or other forums may appear noticeably different than the initial IFB or previous IFBs or awards from the same
Contracting Office. This is normal and expected.
iii. A change between contract writing systems may cause important information concerning IFB response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Bidders shall review all documents carefully to locate this important information and direct any questions or concerns to the Contract Specialist or Contracting
Officer.
(2) The Government does not intend to use the transition between contract writing systems to effect any changes to IFB or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the
Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, you, as the Bidder, may still be the first to spot such errors. Therefore, Bidders shall:
i. Notify the Contracting Officer immediately if any observed changes, removals, or additions affect your award eligibility, violate or alter existing quote/bid terms, or could affect contract performance post-award.
ii. Take special care to ensure all fill-in clauses are populated and remain populated across documents received from the
Contracting Office throughout the IFB and award process.
iii. Contact the Contracting Officer listed on the first page of the IFB or IFB amendment for guidance if you notice or
9 10
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
suspect any inadvertent change has occurred between document issuances.
(3) The Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the
Contractor. Any such modification will reconcile the award with the latest version of this IFB reflecting deliberate action by the
Contracting Officer (e.g., the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental bid terms.
(4) In the unlikely event a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this IFB, the Contracting Officer:
i. May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.
ii. Will incorporate the latest version of this IFB into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.
iii. Will ensure any action taken does not conflict with the stated bid evaluation and award methodology of this requirement.
iv. Will issue a complete, properly formatted award accurately reflecting this requirement and all applicable terms and conditions once systems return to normal.
