REQUEST FOR INFORMATION (RFI)
The Prospective Bidders may submit RFI inquiries relating to the solicitation by email to the following: Cheley Auguste, Contract Specialist, email cheley.auguste@usace.army.mil and Brooke Patterson, Contracting Officer, email brooke.l.patterson@usace.army.mil. RFIs shall be submitted by 5:00 PM EDT, 1 September 2023. The interested offeror may submit any technical questions concerning this IFB at the earliest time possible to enable the Contracting Officer to respond. When submitting your RFI, please provide the project name and solicitation number in the email subject line. All Inquiries Must Be In Writing.
PRE-AWARD SURVEY SUBMITTAL REQUIREMENTS
Reference Specifications Section 00 50 05 for Pre-Award Survey Submittal Requirements. Award of this Contract will be made as a whole to the lowest responsive and responsible Bidder whose bid conforms to all requirements of the specifications. Subsequent to the bid opening, the apparent low Bidder shall submit Pre-Award Survey Information that demonstrates compliance with the requirements set forth in Specifications Section 00 50 05 are a precondition to receiving award.
MAGNITUDE OF CONSTRUCTION
The estimated value of the proposed work is between $10,000,000 and $25,000,000.
EVIDENCE OF AUTHORITY TO SIGN BIDS
Evidence of the authority of individuals signing bids to submit firm bids/proposals on behalf of the bidder is required except where the bid is signed and shows that it is so signed by: The President, Vice-President, or Secretary of Incorporated bidders; a partner in case of partnership; the owner in the case of sole proprietorships. Failure to submit with the bid satisfactory evidence of authority of all other persons may be cause for rejection of bid as an invalid or non-responsive bid.
ARITHMETIC DISCREPANCIES
a. For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by bidder:
1. Obviously misplaced decimal points will be corrected.
2. If there is a discrepancy between unit price and extended price, the unit price will govern.
3. Apparent errors in extension of unit prices will be corrected.
4. Apparent errors in addition of lump-sum and extended prices will be corrected.
b. For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends their bid to be evaluated on the basis of the unit prices and the totals arrived at by resolution of arithmetic discrepancies as provided above, and the bid will be so reflected on the abstract of bids.
c. These correction procedures shall not be used to resolve any ambiguity concerning which bid is low.

CONTRACTING OFFICER STATEMENT
Only a warranted Contracting Officer, acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer.
SUMMARY SCOPE OF WORK
The U.S. Army Corps of Engineers, Philadelphia District (NAP), intends to award one firm fixed-price construction contract for annual maintenance dredging of the Inland Waterway Chesapeake and Delaware (C&D) Canal federal navigation project which consist of performing dredging in Maryland and Delaware along the Inland Waterway C&D Canal and Upper Chesapeake Bay portion of the project. A summary of contract requirements is as follows:
a. Base work shall include dredging of the canal from Station 110+000 to Station 250+440. From Station 99+000 to Station 250+440 dredging will be required to a distance of 25 feet outside the channel limits where shoaling occurs along the channel edge within the authorized channel limits.
b. Option 1 will include dredging from Station 60+000 through Station 110+000 and the C&D canal basin.
c. Dredging will be required to a depth of 36’ MLLW (Datum) plus 1’ allowable overdepth within the contract work limits shown on the drawings from station 00+000 to station 250+000, with no side slopes delineated and/or paid for.
d. This is a contour dredging project.
e. All dredging (hopper, hydraulic, or bucket) is restricted during the period between April 1 and September
30 annually in order to minimize impacts to migratory fish.
The disposal area available for use under this contract is Pearce Creek Dredged Material Containment Facility (DMCF). The Government retains the right to direct disposal of material to a specific location within the specified disposal area at no additional cost to the government. The most recent maintenance dredging within the contract area was conducted under Contract No. W912BU21C0074 between October 2022 and March 2023.
Note: If there is any discrepancy between this Summary Scope of Work information and information elsewhere in the Specifications, the information in the Specifications takes precedence.

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. (a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
