14. DESCRIPTION OF AMENDMENT (continued)
a. REQUESTS FOR INFORMATION (RFI) WITH RESPONSES: RFI’s with responses, annotated Amendment No. 0004, are attached to this amendment.
b. SPECIAL CONTRACT REQUIREMENTS TABLE OF CONTENTS: Please delete the Special Contract Requirements Table of Contents in its entirety and substitute the revised page of the same title, annotated Amendment No. 0004, attached hereto.
c. SECTION 00 73 50 – SONAR TARGETS IN BORROW AREA B: Please add Section 00 73 50 to the contract specifications, annotated Amendment No. 0004, attached hereto.
d. Please indicate receipt of this amendment on Standard Form 1442 (SOLICITATION, OFFER, AND AWARD) as Amendment No. 0004. Failure to acknowledge all amendments may be cause for rejection of the bid.
RFI# Request for Information Response
Contract Drawing C‐402 Note 7: Is the Government aware of any hazards within Borrow Area B2010 that were not identified within the Contract Drawings?
The Government is not aware of any hazards within the borrow area. Sonar targets have been identified and included in Amendment No. 0004.
Spec Section 35 31 00 Paragraph 1.5.1 states that no additional compensation will be provided for dredge moves in the search for acceptable beachfill material.
The same paragraph suggests complex geologic conditions may be present in the Borrow Area. Depending on the dredge type, these impacts are likely and the risk is substantial. How should Bidders price this risk, where on most other projects, this risk would be shared under the DSC clause? It is up to the Bidder to determine the risk.
Spec Section 35 31 00 Paragraph 3.4 requires the Contractor to be responsible for Outfall maintenance for the duration of the contract. Please clarify if the Contractors should price this Outfall maintenance for the entire required contract period or just through completion of the beachfill operations.
As stated in the specifications, for the duration of the contract.
Per Amendment 0002 Government response to Question 11, Options 9, 10, and 11 will extend Dewey Beach an additional 3000’. As per total beach length and the optional quantities, this extension will be filled between 4 and 18 CY/LF.
Because the CY/LF is so minimal, please clarify whether this fill will be dune work only or will contain a beach template similar to the base work. The contract drawings do not indicate either. The cost impacts between the two fill methods are substantial.
See Response to RFI#1 under Amendment No. 0001. Base and option quantity at Dewey Beach will be contained in a single adjusted beach template. Length of adjusted template layout will be designed to contain a minimum of approximately 40 CY/LF, excluding end tapers.
Why was the KHV‐76 boring removed from the Contract Documents? KHV‐76 is one of the nearest locations to where the majority of the available face/qty can be obtained from. Does the Government have any soils information for KHV‐76 that can be shared to the Contractors?
Boring KHV 76 was removed because it is outside of the borrow area and the boring log or any laboratory analysis for KHV 76 is not available.
Amendment 0002, Government Response to Question 9: General survey/soil disclaimers aside, contactors should bid with the same assumptions. In a case where there are major vertical differences between soils information and hydrographic information, a request for clarification is warranted. Below is the original four‐part question in need of clarification of what surface to use as the primary surface:
Drawing C‐402 shows seabed contours of the Borrow Area B referenced to NAVD88. The logs of vibracores in and near the borrow area from O’Brien & Gere give mudline elevations for the cores which are also referenced to NAVD88. The elevations on logs do not match the survey even though both are referenced to the same elevation datum. Elevations on the logs are, in general, 5 to 10 feet above what is indicated by the survey (vibracores considered are KHV‐169 to ‐175, KHV‐178, BVC‐1 to ‐4).
a) Please explain the reason for these differences.
b) Please advise what surface to use as existing seabed (survey or vibracores).
c) If advised to use the survey, please advise if the top of vibracore elevation should be adjusted to match the survey surface.
d) If advised to use the vibracore surface, please advised if survey elevations should be adjusted to match the vibracore surface.
The bathymetric surveys shown on the borrow area plan is the most recent data available.
REQUESTS FOR INFORMATION with RESPONSES Solicitation No. W912BU-16-B-0001
RFI# Request for Information Response
Regarding UXO and Amendment 0002 Questions/Answers 13‐15: The Contractor is required to obtain Government approval for all MEC equipment, materials and procedures. If an MEC is found within the beachfill, it does not necessarily reveal that it was from the current projects beachfill material or from the current projects Borrow Area or solely due to Contractor failure of Government approved screening system/procedures, with no Government responsibility for its approved screening procedures, monitoring or system.
Each MEC Screen design, construction and implementation is reviewed and approved by the Government before putting the device into service and inspected timely per the Contract Documents.
a. Contractor personal will not handle MEC, so a Government supplied Technician or a Third‐Party technician is required. If a Third‐Party is required, can the Government please forward contact information for any known qualified interested organizations.
b. The Government response to question 13 states that the Contractor is responsible for locating all MEC items in the fill material. If an MEC is found on the beach, is the Government suggesting via the Q&A that the Contractor is to perform remediation along the beach searching for unknown MEC’s or would this be a variation to the Contract at that later date?
c. If a remediation program is required, please include that scope of work and requirements within the Contract Specifications with a separate bid line item to price.
d. Can the Government please clarify if the Government responses to Contractor questions are considered part of the Contract?
If MEC is found within the newly placed beachfill material, it will be assumed that it is from the current project and the Contractor will be responsible for it.
7a. The Contractor is responsible for providing a "qualified UXO" personnel if MEC is found in the fill material. The Contractor can go to www.naoc.org and you will find a listing of the majority of the UXO firms currently conducting business.
7b. The Government is stating that the screening requirements are in place to prevent any placement of MEC with the fill material. If the Contractor's equipment and procedures fail to ensure this during the course of the fieldwork then it is the liability of the Contractor to remediate the placed material of all MEC while abiding by all federal and state laws and regulations during the remedial work. All remedial efforts will be at no additional cost to the Government.
7c. The scope of any remedial work would be based on the extent of the fill material that is known to be or reasoned to be encumbered by MEC. The liability for the remedial work would be on the Contractor.
7d. The Government responses to Contractor's questions are included in the Amendments and are considered part of the contract.
Did the Government perform a magnetometer survey of the Borrow Area? If so, can you please provide the data?
Sonar targets in Borrow Area B have been added. See Amendment No. 0004. However, the full report will not be included.
We request the bid opening be postponed to June 15th to allow ample response and contractor review time.
Bid opening has been moved to June 10, 2016. See Amendment No. 0003.

Without physically checking these scatters of small features, typically less than 1.5’ in length, no way to confirm if material is natural or some sort of debris scatter. While it appears to be natural to me (no magnetics associated with this location), I suppose the possibility exists that this material could be unexploded ordinance?
