RFI# Request for Information Response
Please define the slopes of the contract borrow area. Does the hatched line on Sheet C‐402 identify the top or bottom of the slope limits?
Hatched line is limit of borrow area. Please reference Specification Section 35 31 00, Paragraphs 1.5.2 and 1.5.2.1.
Page C‐402 of the contract plans that “the maximum allowable depth for dredging shall not exceed ‐50’ NAVD 88”. Please clarify if material below this depth can be disturbed as long as a post dredge survey shows no removal below ‐50’.
Maximum dredging depth is as shown on Sheet C‐402 and as described in Specification Section 35 31 00, Paragraph
1.5.2.1. See Amendment No. 0002.
Please provide the maximum dredge depth of the borrow area within the borrow area permit.
Special Condition #5 in the Section 401 Water Quality Certificate from the Delaware Department of Natural Resources and Environmental Control (WQ‐471/15) states that the dredging depths authorized for the approved borrow area are 10 feet deeper than the surrounding bathymetry.
4 Please provide the boring log for KHV‐76.
Boring KHV‐76 has been removed. See Amendment No. 0002.
5 Please provide the sieve information for KHV‐76 and all of the BVC borings.
Boring KHV‐76 has been removed. See Amendment No. 0002 for additional sieve information.
6 Please provide XYZ data for the borrow area. XYZ data is not provided until after award. Bid as shown.
7 Please provide XYZ data for both beachfill areas. XYZ data is not provided until after award. Bid as shown.
8 Has this contract’s borrow area (B2010) ever been dredged?
Not to the Government's knowledge. See Amendment No. 0002.
Drawing C‐402 shows seabed contours of the Borrow Area B referenced to NAVD88. The logs of vibracores in and near the borrow area from O’Brien & Gere give mudline elevations for the cores which are also referenced to NAVD88. The elevations on logs do not match the survey even though both are referenced to the same elevation datum. Elevations on the logs are, in general, 5 to 10 feet above what is indicated by the survey (vibracores considered are KHV‐169 to ‐175, KHV‐178, BVC‐1 to ‐4).
a. Please explain the reason for these differences.
b. Please advise what surface to use as existing seabed (survey or vibracores).
c. If advised to use the survey, please advise if the top of vibracore elevation should be adjusted to match the survey surface.
d. If advised
See Paragraph 1.5.1 in Specification Section 35 31 00 and Note 2 on Sheet C‐402.
10 Please clarify NMFS observers requirements for this project.
There are no NMFS requirements under this contract. See Amendment No. 0002
Please confirm that it is the government’s intent for options 9, 10 and 11 to extend the length of the beach 3,000 feet. If this is the intent, please provide a sample cross section for the extension.
Yes, beach will be extended approximately 3000 feet.
Drawings will be provided after award.
When does the government intend to issue the Notice to Proceed? After bonds are received and approved, the Government intends to issue the NTP.
Amendment 1, Section 01 35 30 Paragraph 3.4 e: MEC’s cannot be handled by Contractor personnel. Please confirm that the OESS and Government supplied MEC personnel will handle any MEC’s found.
OESS and Government supplied MEC personnel will handle any MEC's found in the discharge screening devices.
When MEC is found with the fill material it is an indication of a failure(s) of the Contractor's screening system/procedures and it is their responsibility/liability to now locate all MEC items in the fill material with "qualified UXO" personnel per DDESB TP 18. These "qualified UXO" personnel are permitted to handle located MEC items as appropriate. The OESS will arrange for the disposal of the MEC items located by the "qualified UXO" personnel.
REQUESTS FOR INFORMATION with RESPONSES Solicitation No. W912BU-16-B-0001
RFI# Request for Information Response
Amendment 1, Section 01 35 30: Please confirm that all OESS/MEC personnel will be supplied by the Government and that the only training needed for Contractor personnel is the short course training/presentation which is given by a Government supplied OESS prior to work.
See above answer on OESS/MEC personnel. The MEC Safety and Recognition Training will be provided by the Government. Additional training will be required in the event of MEC being found with the fill material and "qualified UXO" personnel are required to locate and, most likely, centrally locate the MEC items for later disposal. This additional training would be specific to the site and would be based on the extent and breadth of the response required to ensure all MEC items potentially placed with the fill material are located and removed (linear footage, location {surf vs berm}, depth, cu yds of material, type(s) of MEC expected, required equipment, and etc.)
Amendment 1, Section 01 35 30: Regarding the Contractors responsibility, is the supplied DDESB Technical Paper 18 dated 1 September 2015 for the Contractors information only?
DDESB TP 18 dated 1 Sep 2015 is the most current document that provides the required qualifications for personnel performing MEC work under DoD auspices. Any Contractor personnel required to perform MEC work (i.e.
locating and stockpiling MEC from fill material) must meet the DDESB TP 18 requirements.
This project is currently scheduled to bid in one week on June 1st. We request the bid opening be postponed 2 weeks to June 15th to allow ample time to review government responses to outstanding questions that directly affect the dredging methodology and footprint of the project.
The Bid Opening will be postponed until June 3, 2016. See Amendment No. 0002.

Amendment No. 0002
Section 00 73 42 Page 162 orange plastic fencing. All Contractor personnel, vehicles and equipment shall remain outside the buffer zones. Absolutely no access is permitted within these zones. The Contractor shall be responsible for taking any additional action, as directed by the COR, to ensure adequate protection of the nests and chicks. Piping plovers and other state endangered birds have the potential to nest anywhere within the contract limits. The Contractor shall be prepared to take all necessary action to ensure protection of these species, regardless of the nesting location within the contract limits or overlapping buffer zone if outside of contract limits, in accordance with the specifications herein.
3.7.2.1 Establishing Buffer Areas
If a piping plover or other state endangered beach nesting bird is observed by a Federal or State Fish and Wildlife agency, the Corps of Engineers, or the Contractor, the Contractor shall immediately notify the project biologist, through the COR, to determine necessary protective actions, and a temporary buffer shall be established. Prior to 15 May, a temporary buffer of 300 meters shall be established around areas newly occupied by foraging adult plovers and other state endangered beach nesting birds, and plovers and other state endangered beach nesting birds displaying territorial behavior. From 15 May to 15 August, the temporary buffer shall be 1,000 meters. If nesting behavior (i.e. active scrapes, courtship or copulation) is confirmed, or if nests or chicks are found, a buffer sufficient in size to prevent disturbance to nesting birds and/or to protect unfledged broods will be established based on site-specific conditions and will remain in effect until the conclusion of breeding activity. If birds are not displaying any signs of nesting behavior (i.e., are likely to be non-nesting birds or spring migrants) or are no longer sighted after observations are conducted over one week, the temporary buffers will be removed. Once piping plover and other state endangered beach nesting birds nests have hatched and chicks are mobile (possibly as early as approximately 15 May), no construction shall take place within 1,000 meters of chick foraging areas until after the chicks have fledged.
All construction related activities (e.g., vehicle use, surveying, framing, equipment set-up, etc.) shall adhere to the appropriate buffer area restrictions. Buffer areas shall extend from the water's edge landward to the furthest seaward extent of the natural or man made feature which would prohibit piping plover chicks from traversing the area (e.g., dunes, boardwalk or bulkhead).
3.7.2.2 Surveying Operations
When conducting beach profile surveys, the Contractor shall be cognizant of nesting areas, and shall not enter any fenced-off areas for any reason unless authorized by the DNREC or the USFWS. If a sled is being used during the survey efforts, it shall remain below the water line at all times. The Contractor shall notify the Contracting Officer if a sled will be used during the surveying operations, prior to the start of survey operations.
3.7.3 Whale Monitoring
3.7.3.1 Avoidance
Dredges and vessels shall not intentionally approach whales closer than 100 yards when in transit. If listed species are present within a distance equal to 500 yards, then speed shall be reduced to 4 knots or less unless
Section 01 57 20 Page 11 precluded by safety considerations. Unless positively identified as another whale species, any large whale shall be considered a suspected right whale, especially if one has been recently sighted by the vessel, or if the vessel is in an area where right whales could be present. (Deleted)
3.7.3.2 Monitoring
Monitor for the presence of whales during all dredging activities in this contract. Record the presence of whales on the Daily Report of Operations form. Notify the Contracting Officer immediately following the sighting of a whale.
3.7.4 Sea Turtle and Atlantic Sturgeon Requirements
3.7.4.1 Protection and Inspection
Take all necessary actions to ensure protection of sea turtles and Atlantic sturgeon. Ensure that all employees are aware of the potential presence of protected species. The Government will provide the Contractor with pamphlets and ID cards to aid in the identification of sea turtles or Atlantic sturgeon that may be encountered during contract activities.
b. Dredges and vessels should not intentionally approach sea turtles closer than 100 yards when in transit. If listed species are present within a distance equal to 500 yards, then speed should be reduced to 4 knots or less unless precluded by safety considerations. Dragarms of hopper dredges shall not be operated while in the water column, to minimize potential impacts to sea turtles and Atlantic sturgeon. Operation should begin when the dragarm reaches the sediment and end before the dragarm is removed from the sediment. Inspect the dragarm for impinged sea turtles or Atlantic sturgeons by someone familiar with identifying these species each time the dragarm is brought to the surface. Notify the COR immediately if a sea turtle or Atlantic sturgeon is observed during dredging or found to be impinged on the dragarm. Remove the impinged animal and place it in cold storage until further direction is received from the Government. (Deleted)
In order to prevent sea turtles or Atlantic sturgeon from becoming entrained in the dredge, install screens with openings not to exceed 4-inches by 4-inches on dredge water intake ports that do not have MEC screens.
Inspect MEC baskets on the beach at a minimum of every 12 hours by someone knowledgeable about listed species identification. Photograph biological material that may be part of a sea turtle or sturgeon and retain it in cold storage until disposal can be discussed with the COR. Immediately notify the COR if any biological material is found that may be part of a sea turtle or sturgeon.
3.8 PREVIOUSLY USED EQUIPMENT
Clean all previously used construction equipment prior to bringing it onto the project site. Ensure that the equipment is free from soil residuals, egg deposits from plant pests, noxious weeds, and plant seeds. Consult with the USDA jurisdictional office for additional cleaning requirements.
3.9 MAINTENANCE OF POLLUTION, EROSION AND SEDIMENTATION CONTROL FACILITIES
Maintain all pollution, erosion and sedimentation control facilities required for use under this contract as long as the operations creating the
Section 01 57 20 Page 12 particular pollutant are being carried out or until the material concerned has become stabilized to the extent that pollution is no longer being created.
3.10 TRAINING OF CONTRACTOR PERSONNEL
The Contractor's personnel must be trained in all phases of environmental protection and pollution control. Conduct environmental protection/pollution control meetings for all personnel prior to commencing construction activities. Additional meetings must be conducted for new personnel and when site conditions change. Include in the training and meeting agenda: methods of detecting and avoiding pollution;
familiarization with statutory and contractual pollution standards;
installation and care of devices, vegetative covers, and instruments required for monitoring purposes to ensure adequate and continuous environmental protection/pollution control; anticipated hazardous or toxic chemicals or wastes, and other regulated contaminants; recognition and protection of archaeological sites, artifacts, wetlands, and endangered species and their habitat that are known to be in the area.
3.11 POST CONSTRUCTION CLEANUP
Clean up all areas used for construction in accordance with Contract Clause: "Cleaning Up". Unless otherwise instructed in writing by the Contracting Officer, obliterate all signs of temporary construction facilities such as haul roads, work area, structures, foundations of temporary structures, stockpiles of excess or waste materials, and other vestiges of construction prior to final acceptance of the work. The disturbed area must be graded, filled and the entire area seeded unless otherwise indicated. The area shall be restored to near natural conditions which will permit the growth of vegetation thereon.
3.12 MEASUREMENT AND PAYMENT
No separate measurement or payment will be made for the work specified in this section. Payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor, and payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations are solely the Contractor's responsibility.
All costs associated with this section shall be included in the costs of all the bid items.

Vibracore logs, and sieve curves are presented in Section 00 73 41, 00 73 42 respectively. The locations of vibrational cores, from which samples were extracted are shown on the drawings. These locations are in or near the limits established by the drawings for the specified borrow area.
The information depicted on the vibrational core logs represents the results of subsurface explorations made on the dates indicated and can only be considered as conditions existing at that time and at the specific location where retrieved. Due to complex geologic conditions within the coastal environment, boulders, cobbles, gravel, silt and clay seams may be encountered as well as sand. The beachfill must be composed predominately of sand as defined by ASTM D2487-06. Boulders, cobbles and coarse gravel defined by the same designation are prohibited from being part of the beachfill. Fine gravel will be limited to less than 10 percent of the beachfill. Manmade materials are also prohibited from being part of the beachfill. No additional compensation will be provided, for routine moves of the dredge(s) within the limits of the borrow area(s) shown; moves required to ensure compliance with these specification for beachfill content and/or to optimize production are routine.
Munitions and explosives of concern (MEC) may also be encountered in the borrow area. See Section 01 35 30 MUNITIONS AND EXPLOSIVES OF CONCERN (MEC) CONSTRUCTION SUPPORT for all requirements related to potentially encountering MEC in the borrow area.
Section 35 31 00 Page 4
