SUBJECT: Amendment No. 0003 to Request for Proposal Solicitation Package for SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SMALL CONSTRUCTION PROJECT INDEFINITE DELIVERY TYPE (SCPIDT) CONTRACT in NORTH DAKOTA.

TO: Prospective Offerors and Others Concerned
1. The specifications and drawings for subject project are hereby modified as follows (revise all specification indices, attachment lists, and drawing indices accordingly).
a. Specifications. (Descriptive Changes.)
(1) Section 00 22 00, page 13, paragraph 6.1, delete the text of this paragraph and substitute the following text:
“Submission Requirements
Part A:
Offerors are required to submit a price proposal for the Sample Project and provide the Overhead Rate and General and Administrative (G&A) expense rates and methods of allocating G&A expense of the construction entity. These rates and method(s) of allocation will become part of the awarded contract and will be binding on all task orders and modifications awarded during the basic ordering period of these contracts.
a. Part A of Tab 9 shall consist of the following items:
(1) SF 1442 and Completed Overhead Rate and G&A Expense Rate
Proposing Schedule.
(2) Completed Sample Project Abbreviated Bid Schedule
(3) Up to four pages documenting the plans and assumptions used in developing the pricing in the Sample Project Abbreviated Bid Schedule

b. Sample Project. The Offeror shall submit pricing for the Sample Project shown at Attachment 1 using the Sample Project Abbreviated Bid Schedule provided in Attachment 2 to this section. In addition to the completed pricing schedule, the Offeror will provide a written basis for their pricing as described in the Sample Project. The pricing will be evaluated for reasonableness, to include organization of information, assumptions made, documented understanding of scope, code and regulatory considerations, quality, and over-all project management.
Part B: Other Information.
a. Pre-Award Survey Information (Local Provision) (Sep 93).
In accordance with FAR Clause 52.228-15 PERFORMANCE AND PAYMENT BONDS, the following information should be submitted with each offer. Submission of this information will expedite the award process.
(1) Financial:
a. Name, address, fax number and e-mail address of the Offeror’s principal financial institution.
b. Name and phone number of individual (primary and alternate) at the financial institution to be contacted for information
(2) Bonding Information: Provide the name, address, regular phone number, fax number and e-mail address of the Offeror’s Surety. Provide the current bonding capacity of your firm.
Evaluation
Only Part A (G&A Rates and Sample Project Price) will be evaluated as part of the best value determination. Part B (Pre- Award Survey Information) will be utilized to facilitate award of the contracts to the successful offerors.
The Overhead and G&A Expense Rate and method(s) of allocation are of equal importance to the completed Sample Project Abbreviated Price Schedule. The G&A Expense rate will be evaluated for appropriateness and reasonableness. Lower overhead rates and methods of allocation that are more advantageous to the government will be evaluated more favorably.”
(2) Section 00 22 00, to the end of this paragraph, add the attachments “Attachment 1: Sample Project Description” and “Attachment 2: Sample Project Abbreviated Bid Schedule”, which are included in this amendment.
b. Specifications (New and/or Revised and Reissued). Delete and substitute or add specification pages as noted below. The substituted pages are revised and reissued with this amendment.

2. This amendment is a part of the proposing papers and its receipt shall be acknowledged on the Standard Form 1442. All other conditions and requirements of the request for proposal remain unchanged. If the proposals have been mailed prior to receiving this amendment, you will notify the office where proposals are received, in the specified manner, immediately of its receipt and of any changes in your proposal occasioned thereby.
a. Hand-Carried Proposals shall be delivered to the U.S. Army Corps of Engineers, Omaha District, Contracting Division, 1616 Capitol Avenue, Omaha, Nebraska 68102-4901.
b. Mailed Proposals shall be addressed as noted in Item 8 on Page 00 11 00-1 of Standard Form 1442.
3. Offers will be received until 2:00 p.m., local time at place of receiving proposals, 20 APR 2009.

ATTACHMENT 1
Sample Project Description.
1. Sample Project, Function, Location and General Scope
1.1 Function: The structure is to provide a climate-conditioned, interior, secure, document storage in a warehouse environment. The administrative area within the structure shall include a reception area with two adjacent office spaces and two adjacent restrooms.
1.2 Location: For the purposes of design, and construction, the structure is assumed to be in a location similar to Minot, North Dakota.
1.3 General Scope: The warehouse portion of the structure shall be at least 24,000
GSF. The administrative area encompasses an additional 8,000 GSF. Design and construct a concrete slab on grade, metal framed, steel skinned, warehouse use, light industrial structure. Provide complete design services by licensed engineer.
Contractor is responsible for all permits and compliance with all regulatory, engineering, and code requirements. The contractor shall include all “General Requirements” functions and services normally provided to an industrial user on a design build project of this type. The design submittals shall include a 30%, 90%, and a corrected- 100%, “For Construction” submittal.
1.3.1 Utilities are to be assumed to be within 50 feet of the structure within the hard surface road right of way which provides access to the site. The site is in an unsecured area in close proximity to a military installation. The interior eve height shall be at least 12’-4”. The building shall have two pairs of equipment doors on opposite ends of the structure. There shall be a total of three man-doors located one on each end between the equipment doors and one near mid-wall on another wall. The building mechanical and electrical systems shall be located to allow maximum utilization of the storage and administrative spaces.
1.3.2 The site is assumed to slope 6 feet across the building site and rise two feet from the access road to the warehouse structure floor. The driveways and parking areas shall maximize access to the building by 80,000# GVW trucks and shall include parking for 12 non-commercial vehicles. Utilities shall be cost-effective and meet the minimum code requirements. The finished site shall be prepared for grass seed with no additional landscaping. All hardscape surfaces shall be concrete.
1.3.3 All structural steel components shall be designed and installed in compliance with applicable codes, regulations and accepted engineering and construction practices.
1.3.4 The structure shall be insulated to provide cost effective heating and cooling of the warehouse space so as to allow a minimum interior temperature of 45 degrees F and a maximum of 90 degrees F.
1.3.5 The interior office areas shall be of light-gage metal framing with painted
GWB panels. Doors, windows, and hardware shall be intended and suitable for commercial / light industrial use. Equipment doors shall have motor operators.
1.3.6 The administrative areas and restrooms shall have resilient flooring.
1.3.7 Mechanical systems shall be selected based on overall cost effectiveness for the anticipated 15 year life of the structure. Electrical components shall be selected based on the same criteria as the Mechanical equipment.
1.3.8 Design and Construction duration is 270 calendar days from a hypothetical
Notice to Proceed date of 1 May 2009.
2. Basis for Pricing. Offerors may use up to 4 pages to document plans and assumptions that were used in developing the submitted pricing in the Sample Project Abbreviated Bid Schedule.

This solicitation is restricted to Service-Disabled Veteran-Owned Small Business contractors only.
Small Construction Project Indefinite Delivery Type (SCPIDT) Contract: Work will consist of a wide range of minor construction services at sites in North Dakota which will be administered by the Black Hills Area Office.
Projects will be incorporated into the Contract by Task Orders. (See Section 00 73 00) Performance time will consist of a two (2) year Basic Period and one (1) Option period of three (3) years or until the $14,000,000 cumulative limit is reached, whichever comes first. The maximum value of the contract is $14,000,000; this will be divided via competition and will not necessarily be split into two $7,000,000 contracts. The minimum guarantee amount for the base period is $10,000. There is no minimum guarantee amount for the option periods. There is no dollar limit to either the yearly amount or the task order amount.
Up to two (2) contracts may be awarded under this solicitation.
Requirements for performance and payment bonds will be applicable to the individual task order(s).
