Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
In the listing above, the "SU" designation means that rates listed under the identifier do not reflect collectively bargained wage and fringe benefit rates. Other designations indicate unions whose rates have been determined to be prevailing.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor
IA20080031 Page 8 Am #0003
200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
END OF GENERAL DECISION
Request For Information - MATOC
C1.01, Mechanical Excavation Option Question: On page C1.01 of the plan it refers to a ‘Mechanical excavation’ option. What is intended as a possible on-land disposal area as you describe it as a ‘Government approved landfill’? Is it not a necessity to look for a more environmentally friendly way to put the soil on land rather than dump it into the River? There is abundant farm land close by to utilize and return to farm land at completion.
Answer: The Corps has obtained all of the permits and environmental compliance documentation necessary to allow disposal of the dredged material into the Missouri River. If the contractor chooses to dispose of the material on land, the disposal site must be located outside of the designated floodway as designated on the effective Flood Insurance Rate Map (FIRM) for Harrison County (Panel #190143 0175A). If the contractor chooses to dispose of the material in the flood plain, the material shall not be piled any higher than 0.5 feet, and no material shall be placed in wetlands. In addition, the contractor must submit the location of the disposal area to the Contracting Officer's Representative (COR) per paragraph 1.3 of specification 02300A.
Section 02482, para. 3.2.5.3, Approval in approved fill areas.
Question: If a contractor has acquired permission to dispose of excavated material off-site adjacent to the project, but this area is in a flood plain. Since we are removing 1,000,000 cyd. of area from this flood plain, it would seem possible that we return a portion of it to the flood plain.
The adjacent property would be raised 1 to 2 feet to level the area and make it productive farm ground. Would a situation such as this be approved for a disposal?
Answer: The Corps' Floodplain Development Permit for this project states "Excess spoil material resulting from the excavation shall be removed from the flood plain or may be spread thinly (less than 0.5 feet thick) outside the floodway as designated on the Harrison County FIS. The spoil material shall not be placed in an area that is, or could be classified as a regulated wetland."
Based on this statement, it would be acceptable for a contractor to dispose of the spoil on the farmland he has obtained permission to spoil on as long as it is outside the designated floodway and he does not pile the dirt any higher than 0.5 feet. Anything different would require a new floodplain development permit from the IDNR, and that process could take 3 to 5 months with no guarantee of obtaining the permit. We would also need to verify that no wetlands would be filled.
In addition, the contractor must submit the location of the disposal area to the Contracting Officer's Representative (COR) per paragraph 1.3 of specification 02300A.
Section: 007200, Clause 52.244-2 "Subcontracts" Question: Are there any restrictions on subcontracting with other firms or teams which are part of the short list of approved bidders?
Answer: Presently there is no short list or pool for this solicitation so there are no restrictions for the overall contract or Task Order No. 0001. The pools from previous MRRP contracts do not apply to this solicitation. Please refer to Section 002200 on how proposals with subcontracts should be structured. Once the contracts are awarded to the pool of prime contractors, each task order will contain FAR Clause 52.244-2 "Subcontracts". Paragraph (d) of the clause will contain the names of the prime contractors and primary subcontractors, if applicable. Prior to entering into subcontracts with the contractors listed in the clause, consent of the contracting officer is required. This is to ensure fair competition. If a prime contractor includes a subcontractor with some enforceable agreement in the original proposal and a contract is awarded, that shall be considered consent of the contracting officer for that prime contractor to enter into subcontracts with that particular subcontractor. No further consent will be required.
Question: On previous backwater excavations, large amount of buried trees were encountered.
Is there any additional information available regarding the subsurface conditions within the backwater area?
Answer: The Corps has no specific information regarding the existence or location of buried trees, however the project area was once part of the Active Missouri River channel, so buried trees may be encountered during construction.
Question: Dredging in the chute on the optional bid items requires a minimum bottom width at grade level. Would the USACE accept an equal cross-sectional area for channel flow, rather than the design trapezoid, i.e. higher on the edges and lower in the middle?
Answer: Any proposed section change would need to be submitted to be verified with hydraulic modeling. However, it is not likely that the COE would accept any proposed chute profile that does not maintain the proposed channel invert or results in a higher energy loss section. A deeper invert is not acceptable as it does not meet the environmental objectives of the project.
