Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

In the listing above, the "SU" designation means that rates listed under the identifier do not reflect collectively bargained wage and fringe benefit rates. Other designations indicate unions whose rates have been determined to be prevailing.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

IA080031 Page 8 Am #0002

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

END OF GENERAL DECISION

Questions & Answers Multiple Award Task Order Contract (MATOC) for Construction

Missouri River Recovery Program 23 May 2008

SECTION: 002200, Paragraph 1.1 QUESTION: If a prime contractor will be working with subcontractors, where will they name these subcontractors?

ANSWER: Subcontractors will need to be addressed in Tabs 1 & 2 of the proposal and in the subcontracting plan. Note the subcontracting plan is only required by large businesses. Tab 3 of the proposal should address management of subcontractors for Task Order No. 0001.

SECTION: 002200, Paragraph 1.1.1 QUESTION: Should contractors list just the equipment they own or the equipment they are able to lease, team, etc.?

ANSWER: The contractor should list all equipment available for their use on this contract. A contractor who owns all equipment necessary to complete projects may be evaluated more favorably than a contractor who must rely on leasing or subcontractors.

However, enforceable agreements or a demonstrated history of working with subcontractor will be considered.

SECTION: 002200, Paragraph 1.2.1 QUESTION: If a company has several superintendants available to manage the projects, should they submit qualifications for the best or most qualified superintendent that will actually work the project?

ANSWER: Submit qualifications/resumes for any superintendents who may work on the task orders. Designate a superintendent who is anticipated to be the primary.

SECTION: 002200, Paragraph 1.4.2 QUESTION: If a contractor submits an unreasonably low priced proposal, is there a threshold or regulation that helps determine that is “unreasonably” low?

ANSWER: There is no threshold or regulation that governs. It is a discretionary determination. The Contracting Officer will determine the reasonableness of the price by comparing it to other proposals and the Independent Government Estimate.

SECTION: Langdon Bend, Section 31- Berm Embankment and Earthwork, Paragraph

1.5.4 Haul Roads, Page 13.

QUESTION: Will the access road to the project be closed during construction?

ANSWER: The access road landward side of the levee at Langdon Bend will be closed to the public during construction of the wetland project.

SECTION: General QUESTION: What do other task orders under the MRRP awarded prior to 30 September 2008 look like (i.e. size, location, HUBZone/Unrestricted)?

ANSWER: Acquisition strategies have not been approved for upcoming projects, but several additional task orders are anticipated. There are two emergent sandbar habitat projects just downstream from Gavins Point Dam. There are also several chute and backwater projects in the Nebraska/Iowa stretch of the river anticipated.

SECTION: General QUESTION: How will we address escalating fuel costs? Is there an economic price adjustment clause?

ANSWER: Task orders will be firm fixed-price so all costs are the contractor’s responsibility. The prices bid on Task Order No. 0001 are not locked in for any other task order. The duration of the task orders generally will not exceed 365 days. There is no economic price adjustment and no credit will be requested if a proposal projects higher fuel costs than actual prices.

SECTION: General QUESTION: Once a pool has been established under each MATOC, what selection criteria will be used for each task order?

ANSWER: Task orders will be awarded based on either low bid or best value basis.

Each solicitation will state the evaluation criteria. The most likely criteria for best value will be schedule and/or work plan.

SECTION: General QUESTION: Are contractors that have been awarded a contract under a MATOC required to submit a proposal on each task order?

ANSWER: No, contractors are not required to submit a proposal on each task order.

However, if a contractor consistently declines to submit proposals, the option to extend the contract may not be exercised.

SECTION: General QUESTION: Will old proposal submitted under the previous MRRP MATOCs be available as a “samples” for contractors?

ANSWER: No, these proposals are considered proprietary information and will not be made available.

SECTION: General QUESTION: When submitting proposals, should a contractor tailor their information to only Task Order No. 0001 or the overall needs of the Missouri River Recovery Program?

ANSWER: Schedule, management of subcontractors, and pricing should be specific to Task Order No. 0001. The rest of the proposal should reflect the overall capabilities and qualifications for the entire contract scope.

SECTION: General QUESTION: Will pricing of unsuccessful proposals released to the entire pool once the task order has been awarded?

ANSWER: Yes, after a task order has been awarded the identity and total price of each contractor in the pool who submitted a proposal will be released. This is a change from the procedure in the previous contracts.
