# Question Response

Contractor Needs clarity on the distribution of the past performance questionnaires. Is "attachment 2" submitted with the contractors proposal for the project of their choice when referencing past performance?

Reference Contracting Division letter, dated July 9, 2012 signed by Kent Tamai, Contracting Officer (page Evaluation -15). Questionnaires should be submitted to the address as stated in the letter.

2 Can ACASS reports be used in lieu of some past performance? Contractor is getting resistance from the Navy on submitting past performance evals on the company. Yes

Evaluation Page 4 states that “information provided from potential subcontractors (not included in the joint venture) will not be considered or evaluated.” If we were to submit as the prime contractor, and include a subcontractor on our team who carries the majority of relevant experience, will the subcontractor’s information be considered or will it only be considered in the case that a joint venture formed?

Proposals will be evaluated in accordance with the solicitation.

5 What locations (Countries/States) are included in the Pacific Ocean Region?

Hawaii, Alaska, Japan, Korea, Guam, American Samoa, Commonwealth of the Northern Mariana Islands, the Freely Associated States including Repubic of Palau, Federated States of Micronesia and Republic of the Marshall Islands.

6 Given the proposal deadline extension to 11/15/12, what is the new deadline for reference questionnaires? It currently states August 1. The proposal due date (see amendment AM-0002).

Can an Offeror for the Solicitation be a small business concern that is owned by a non-profit entity? Solicitation Provision 52.212-3(a) defines “small business concern” to mean “a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria and size standards in 13 CFR part 121 and size standards in this solicitation.” Federal Acquisition Regulation Part 19, Section 1, which implements the acquisition-related sections of the Small Business Act, defines “concern” to mean “any business entity organized for profit (even if its ownership is in the hands of a nonprofit entity) with a place of business located in the United States or its outlying areas and that makes a significant contribution to the U.S. economy through payment of taxes and/or use of American products, material and/or labor, etc. “Concern” includes but is not limited to an individual, partnership, corporation, joint venture, association, or cooperative.”

Any question regarding small business concern(s) should be referred to the Small Business Administration.

11 Does the definition of “concern” as set forth in Part 19, Section 1 apply to Solicitation Provision 52.212-3(a)?

Any question regarding small business concern(s) should be referred to the Small Business Administration.

Are there any stated criteria for determining whether a small business concern is “independently owned and operated” pursuant to the definition of “small business concern” set forth in Solicitation Provision 52.212-3(a).

Any question regarding small business concern(s) should be referred to the Small Business Administration.
