9. Additional Facts and/or Information to support the justification.
Background:
The Dredge Yaquina is a U.S. flagged vessel owned by the federal government. The vessel is currently fully inspected under authority of the U.S. Coast Guard. Requirements for maintaining certificates authorizing the operation of this vessel in U.S. territorial waters include those contained in 46 CFR Subchapter I. The components requiring repairs aboard the dredge Yaquina are constructed in conformance with these requirements as certified by US Coast Guard letter E2-1100131.
Justification:
Use of non-OEM technicians and parts which may not conform to the testing requirements stated above, necessarily voids approval until such time as the non-OEM parts or material have been tested and examined with satisfactory results by a competent inspection organization as authorized by the U.S. Coast Guard.
Impact:
This equipment requiring repair by OEM technicians are mission critical and involves the safety of human life and high value government assets. The potential impact to the government if these system fail may result in ship becoming inoperability. This will result in a loss of production at a rate of $95,000 per day. For this reason, it is necessary for the equipment to be serviced at this time by OEM authorized technicians. This ensures all equipment will operate correctly and maintain the manufacturer’s warranty.
Alternatives:
There are no practical alternatives. The OEM technicians identified above are the only available sources having the proprietary knowledge and information relating to the work items identified above. No other known sources can fulfill the Government’s requirement.
Market research was conducted in an effort to increase competition. However, only authorized OEM technicians have been found that possess the required proprietary information relating to the identified work being performed.
Only services performed by the OEM technicians can be considered for this maintenance due to proprietary equipment information possessed only by the OEM. A dynamic small business search did not reveal any alternative authorized sources of service.
10. Technical / Requirements Certification: I certify that the supporting data under my cognizance which is included in this abbreviated J&A is accurate and complete to the best of my knowledge and belief.
