BID SCHEDULE No. 1 (Contract)

NOTES PERTAINING TO THE CONTRACT LINE ITEM SCHEDULES (FOR THREE YEAR ORDERING

PERIOD):

1. The purpose of this acquisition is to obtain multiple Indefinite Delivery Indefinite Quantity contracts against which task orders for horizontal construction, renovation, repair, and incidental design may be placed. The term of the contracts will be for a Three Year Ordering Period.

2. See Section 01 00 04, OUTLINE OF THE TASK ORDER PROCESS, for use of CLINs in pricing Task Orders, and for pricing of materials, equipment, subcontracts and other costs not covered by applicable CLINs, after contract award. As this is an indefinite quantity contract, these unit prices are subject to adjustment under the Variation in Estimated Quantity Clause.

3. Contract Line Item Numbers (“CLINS” or “CLIN” for a single item) 0001 through 0003 are applicable to all Task Orders issued during the first twelve month period of the Contract. CLINS 0004 through 0006 are applicable to all Task Orders issued during the second 12 month period of the Contract. CLINS 0007 through 0009 are applicable to all Task Orders issued during the third 12 month period of the Contract. The total maximum value of the Women-Owned Small Business (WOSB) Set-Aside IDIQ/MATOC in support of horizontal construction, renovation, repair, and incidental design requirements in Alabama, Florida, Mississippi, and Georgia is $1,900,000. The Government anticipates awarding Multiple Task Order Contracts. There is no guarantee that the awardees will receive more than the minimum obligation, which is $1,000 per contract.

4. The unit prices for the sub-items under CLIN 0001, (Year One), 0004 (Year Two), and 0007 (Year Three), shall represent the cost to the prime contractor for those sub-items, not including the prime's General and Administrative Overheads ("G & A", "Home Office", etc., as applicable) and not including "Profit" or "Fee", and "Bond". Prices for labor shall include all burdens, such as but not limited to: labor taxes and insurance; health, morale and welfare; direct retirement costs; other applicable fringe benefits and a small tools allowance. Do not include subcontractors' markups to the prime contractor in the labor rates.

5. The unit prices for CLINS 0002 (Year One), 0005 (Year Two), and 0008 (Year Three), "Professional Design Services", shall include all costs to the Prime Contractor, not including the prime's General and Administrative Overheads ("G & A", "Home Office", etc., as applicable) and not including "Profit" or "Fee", and "Bond". The rates per man-hour shall include all costs, such as direct salary costs, all insurance, taxes, workmen's compensation and other benefit costs, all A/E firm overheads, profits and other costs per man-hour of professional services. No additional costs/markups from an A/E firm to the contractor per man-hour on any CLIN sub-item price will be allowed.

Bidding Schedule No. 1 - Page 5 of 5

6. The percentages for sub-items "AA" under CLINS 0003 (Year One), 0006 (Year Two), and 0009 (Year Three), shall consist of the prime contractor's percentage markups for "General and Administrative Expenses", to be applied to total labor, equipment, supplies, materials, and subcontracts for a Task Order. After award of a contract, Subcontractors' markups on direct job costs will be included in their proposed prices, or will be negotiated separately, if a negotiated Task Order. Profit and Field Office Overhead will be negotiated on a Task Order basis.

7. Labor rates in effect at the time a task order is issued shall remain in effect for the duration of performance of that task order.

8. Prices are binding for the entire contract (Three Year Ordering Period).

9. Wage Rate Decisions will be determined on a Task Order basis. The Contracting Officer will make no adjustment in contract price, other than provided for elsewhere in this contract, to cover any increases or decreases in wages and benefits as a result of-

(1) Incorporation of the Department of Labor's wage determination applicable at the exercise of the option to extend the term of the contract;

(2) Incorporation of a wage determination otherwise applied to the contract by operation of law; or

(3) An increase in wages and benefits resulting from any other requirement applicable to workers subject to the Davis-Bacon Act.

SECTION 00 11 00

PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

1.0 GENERAL REQUIREMENTS

1.1 This is a Federal Acquisition Regulation (FAR) Part 15, competitive, women-owned small business (WOSB), one-step, best value, source selection. Competing Prime Construction Contractors, hereinafter referred to as the “Offeror”, shall submit a proposal that includes the required submission information indicated below to demonstrate the Offeror’s past performance and capabilities to perform the work described in this solicitation. In addition, each competing Offeror shall also include in their proposal its price and other administrative information described below. By submission of a proposal, the Offeror accedes to all the terms of this RFP.

The Government reserves the right to reject any and all offers.

2.0 WHO CAN SUBMIT

2.1 Any responsible, interested party that is a women-owned small business (WOSB) firm may submit a proposal. Joint Ventures (JV) are allowed to submit a proposal on competitive women-owned small business (WOSB) set-asides; however, the JV agreement packages or email notifications of bid submittal by the JV must be received by SBA prior to proposal due date.

Furthermore, the JV agreement must be approved before award of any resulting contract. It is highly encouraged for JVs to submit JV agreements as soon as practicable to ensure compliance with established regulations as well as advise their assigned SBA Business Opportunity Specialist (BOS) of the interest in submission on this solicitation.

2.2 Any design firm that participated in preparation of this solicitation, whether as a Government contractor or as a subcontractor to a Government contractor, is not eligible to participate in this solicitation as a prime contractor or a design subcontractor due to a conflict of interest. The Government considers such firms to have an unfair competitive advantage, and therefore will not consider such firms.

3.0 PROPOSAL SUBMISSION REQUIREMENTS

3.1 Submit the electronic proposal package (including Bid Bonds) to the U.S. Army Corps of Engineers via the DoD Secure Access File Exchange (DoD SAFE), which provides a time stamped notification to the Government when a file is uploaded. Physical copies of bid bonds will not be required to be submitted unless otherwise requested by the Contracting Officer at a later date. Interested Offerors must contact Ms. Chanda Strenth at Chanda.D.Strenth@usace.army.mil to obtain a unique “request code” needed for each offeror to upload their proposal. Once offerors receive this code, they will be allowed to upload their proposals from 01 February 2021 at 09:00 am up to 11 February 2021 by 2:00 pm CST. A timely proposal is the one time-stamped by DoD SAFE before the deadline established above. The Government must receive your proposal no later than the time and date specified in Block 13 of the SF 1442. Any and all amendments to the solicitation shall be acknowledged by completion of Block 19 of the SF 1442.

3.3 To effectively and equitably evaluate proposals, the Source Selection Evaluation Board (SSEB) must receive information, in the order described below, that clearly describes an Offeror's capabilities to successfully execute the construction project as required by this RFP. It is therefore an Offeror’s responsibility to submit proposal information that is fully responsive to the submission requirements of this section. Offerors are responsible for organizing material sequentially under tabs and numbered pages as set out below to facilitate evaluation. Materials that are not properly organized may easily be overlooked during evaluations, possibly affecting an Offeror’s rating. Offers should be concise, addressing only the information outlined in this section.

4.1 There are three separate volumes required in response to this solicitation. Volume I includes two (2) non-priced evaluation factors that will be evaluated.
