52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Offers will be evaluated by performing a comparative evaluation in accordance with FAR 13.106-2(b)(3) to determine which response represents the “best” as a whole. Comparative Evaluations is the act of comparing two or more offers or proposal in response to the RFQ.
Quotes are first evaluated to ensure all RFQ submission requirements are met. If the RFQ submission requirements have not been met, the Contracting Officer shall deem the offeror non-responsive.
Comparative evaluations of quotes may be conducted by performing a direct comparison of one offer with another in a uniform manner. The comparison of quotes to one another is to determine which quote provides the best benefit to the government.
The government reserves the right to consider a response that offers more than the minimum and select that response if it provides a benefit to the government.
The government has the discretion to accept other than the lowest priced offeror that provides additional benefits.
The government also has the discretion to make an award based on whether the lowest priced of the quotations/offers having the highest past performance rating possible represents the best benefit to the government and Best Value Continuum.
The following factors shall be used to evaluate offers:
Technical and past performance, when combined, are approximately equal to cost or price.
“Technical and past performance, when combined, are significantly more important than cost or price.” AMENDMENT 01
Factor 1: Technical Approach and Understanding of the Work
Contractor’s will receive a technical rating based on the strengths, deficiencies, weaknesses, risks, and uncertainties of the offeror’s technical submittal as identified in the Instructions to Offerors.
This factor considers whether the Offeror demonstrates an understanding of the complexity and magnitude of requirements set forth in the Performance Work Statement. At a minimum, the quote shall include a brief narrative (conceptual work plan) that clearly demonstrates an understanding of the requirements of the solicitation. The narrative shall address how the Offeror will perform, develop, and implement the work plan. It shall not exceed four pages.
SUBMISSION REQUIREMENTS:
Conceptual Work Plan – The contractor shall develop a work plan that clearly describes the contractor’s approach to successfully completing the requirements of the Performance Work Statement. Within the work plan, at a minimum, the contractor shall include the following:
1. Contractor’s approach to performing the work within the period of performance identified for each lake. How does the contractor intend on completing mowing services at all three lakes in 25 calendar days if the grass height at all lakes is considered excessive (3 to 5 feet on average)?
Identify all equipment and labor that will be used on these Letters of Instruction. Identify each calendar day the contractor would be performing work to complete these Letters of Instruction within the period of performance.
2. Contractor’s approach to performing the work within the period of performance identified for each lake. How does the contractor intend on completing mowing services at all three lakes in 25 calendar days if the grass height at all lakes is considered average (1 to 3 feet on average)?
Identify all equipment and labor that will be used on these Letters of Instruction. Identify each calendar day the contractor would be performing work to complete these Letters of Instruction within the period of performance.
3. Identify if non-slope rated mowing equipment will be used and the areas the contractor intends to use this equipment. The contractor may attach maps that references these locations.
4. Identify all equipment that the contractor has in reserve that could be available for immediate use in the event of equipment failure.
5. Identify how the contractor intends to ensure quality control activities are completed throughout the duration of the period of performance and services are performed in accordance with the Performance Work Statement. Address how rework will be prevented and how rework will be managed when required.
6. Contractor’s approach to maintain communication with Government designated personnel throughout the contract service period.
Factor 2: Past performance
Past Performance Questionnaire (PPQ) forms provided in the solicitation shall be completed and submitted in Submission. They will be evaluated to assess the degree of confidence the Government has in an Offeror's ability to supply products and services that meet users' needs based on a demonstrated record of recent and relevant work similar to the work described in this solicitation. To be considered recent, for a particular contract or combination of contracts, services must have been and/or are currently being provided at any time within the last three (3) years from the date of issuance of this solicitation.
Contracts that are not considered recent will not be evaluated for relevancy.
The Contracting Officer shall deem an offeror nonresponsive if the offeror fails to submit a PPQ IAW 52.212-1(b)(10) and evaluation criteria in 52.212-2. If for any reason the contractor does NOT have recent or relevant past performance, they are still required to submit a PPQ with a brief narrative explaining “No Recent or Relevant Past Performance”. An offeror that submits a PPQ that is deemed neither recent nor relevant will be treated as “NEUTRAL”. Offerors should submit at least 2 PPQs but no more than 3 PPQs for evaluation.
The Government reserves the right to evaluate past performance based on such information as the Contracting Officer’s knowledge and previous experience with the item or service being purchased, customer surveys, or other reasonable basis, without the existence of a formal database.
Factor 3: Price
The Government will perform a price analysis after completion of technical evaluations. Price analysis will be performed in accordance with FAR 13.106, to determine completeness, reasonableness, balance, and understanding of the work. Price will not be rated but will be a factor in making the final best value determination for award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
