QUESTION SET 2
5/6/2016 11:27 AM
QUESTION: I’ve got another question that I’m hoping you can clear up. On page 65 the following paragraphs read (I bolded):
“Teaming arrangements and Joint Ventures between Offerors are allowed under 13 CFR 121, 124, or 126 guidance and other applicable laws and regulations, if required, to provide the full depth and breadth of experience and capability required under this solicitation and resulting contracts.
If the Prime contractor proposes Subcontractors as "team members," the "team members" shall be identified by business size and name. The Government will not evaluate the capability of any contractors that are not included in the Joint Venture agreement. Joint Ventures must include a copy of the legal Joint Venture signed by an authorized officer from each of the firms comprising the Joint Venture with the chief executive of each entity identified. Incomplete proposals will not be considered.”
In particular I’m finding the bolded sentences can mean two different things. It’s primarily the second sentence and it’s really only confusing because of how it follows the first sentence. The first sentence is clear and what we would normally do when proposing with a team. When we propose with team members we clearly delineate the team and, when describing personnel and projects, etc. we make it clear who represents what team member/firm. The second sentence almost seems to imply that if we are proposing with a team we MUST form a joint venture. Would you please clarify?
ANSWER: The solicitation preparation guidance, Section L, has been revised. Joint Venture and teaming arrangements are considered different entities. A firm can elect to submit a proposal as either a Joint Venture, Teaming Partner, or an independent contractor.
