Notes:
a. Other Sources. The Government may contact sources other than those provided by the Offeror for information related to past performance. These other sources may include telephone interviews with organizations familiar with the Offeror’s performance, Government personnel with personal knowledge of the Offeror’s performance capability, and any other sources of relevant past performance information.
b. Neutral Ratings. The Government will assign a “neutral” (technically acceptable) rating to an offer which, through no fault of its own, has no past performance history (for example, a new business). However, an offeror who simply neglects to include any relevant past performance information its proposal will be deemed “technically unacceptable.”
c. Relevancy. Past performance which is similar in size and scope to this project may be considered to be more advantageous to the Government. Thus, the Government will take into consideration the age and relevance of past performance information and the offeror’s overall performance record. If any performance issues are identified, the Government will consider the number, type and severity of the problems and the effectiveness of corrective actions taken.
d. Teaming Partners. The Government recognizes that completion of a project is often a team effort. Thus, offerors are encouraged to submit past performance information for major subcontractors to help demonstrate that the team they select to perform this project has an acceptable record of past performance.
FACTOR 4: PAST PERFORMANCE OF OFFERORS IN COMPLYING WITH
CLAUSE 5 2.219-8
(a) All offerors are to provide:
(i) a description of the offeror’s performance, over the past three calendar years, in complying with the requirements of FAR 52.219-8, Utilization of Small Business Concerns, including description and available documentation of the methods employed to promote small business utilization and the internal methods used to monitor such utilization. Provide a narrative informing how your company has historically promoted the usage of SBs as subcontractors (how your firm has made SB subcontracting opportunities available for SBs). Inform how your company has historically monitored SB usage (how your firm has reviewed SB subcontracting practices/opportunities). (Monitoring refers to keeping track of the amount of SB subcontracting, it does not refer to monitoring the performance of SB subcontracts.)
01000-19
Clause 52.219-8 says in part, that the firm receiving the Government contract (both small or large businesses), agrees to make the “maximum practicable opportunity” to include SBs, VOSBs, SDVOSBs, HUBZone SBs, SDBs, and WOSBs in your subcontract efforts.
01000-20
Part III. EVALUATION OF OFFEROR PROPOSALS
1. ELIGIBILITY FOR CONTRACT AWARD. In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.
2. SOURCE SELECTION USING THE LOW-PRICED, TECHNICALLY
ACCEPTABLE PROCESS. An evaluation for acceptability will be performed on each proposal in accordance with FAR 15.101-2(b)(3). The proposal that provides the lowest price and is otherwise technically acceptable in all factors will be selected for award. To be considered technically acceptable, no technical factor in the proposal may be determined to be unacceptable. The failure of a proposal to meet any of the acceptability standards for non-cost factors will result in a technically unacceptable rating and preclude award.
3. BASIS OF AWARD. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors. Technical acceptability will be determined first. Then, only the technically acceptable offers will be evaluated for price and an award made.
4. EVALUATION OF THE PRICE PROPOSALS
a. Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness.
They may also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.
b. The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on either a CLIN, element, or total price basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion.
5. EVALUATION OF THE TECHNICAL PROPOSAL. The Technical Proposal will be evaluated based on the criteria identified in the individual attachments for the non-cost/non-price factors.
6. GENERAL TECHNICAL CRITERIA
a. Material omission(s) may cause the technical proposal to be rejected as unacceptable.
b. Proposals which are generic, vague, or lacking in detail may be considered unacceptable.
The offeror’s failure to include information that the Government has indicated should be included in the proposal may result in the offer being found deficient.
01000-21
c. The Government cannot make award based on a deficient offer. Therefore, receipt of an
“UNACCEPTABLE” rating for any factor will make the offer ineligible for award, unless the Government elects to enter into discussions with that Offeror and all deficiencies are remedied in a revised proposal.
(If checked, the following provision applies:)
7. FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

1.7 CONTRACTOR PERFORMANCE EVALUATIONS
In accordance with the provisions of Subpart 36.201 (Evaluation of
Contractor Performance) of the Federal Acquisition Regulation (FAR), construction contractor’s performance shall be evaluated throughout the performance of the contract. The United States Army Corps of Engineers (USACE) follows the procedures outlined in Engineering Regulation 415-1-17 to fulfill this FAR requirement. For construction contracts awarded at or above $100,000.00, the USACE will evaluate contractor’s performance and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), which is now a web-based system. After an evaluation (interim or final) is written up by the USACE, the contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. Accessing and using CPARS requires specific software, called PKI certification, which is installed on the user’s computer. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. The certification software could cost approximately $110 - $125 per certificate per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.csd.disa.mil/. If the Contractor wishes to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.

The ENG 3180's shall be updated weekly as payrolls are submitted. After making copies for their files, the Contractor is required to submit the originals of each week’s payrolls to the Resident Office. Before final payment, the Contractor shall provide the completed ENG 3180’s to the Contracting Officer's Representatives.
