The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other elements considered.
The following elements shall be used to evaluate offers:
Lowest Price Technically Acceptable
1. BASIS FOR CONTRACT AWARD: This is a competitive best value source selection acquisition conducted in accordance with Federal Acquisition Regulation (FAR) Part 13 and elements of FAR Part 15, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror who is deemed responsible in accordance with the FAR, whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable offer. Trade-offs between cost/price or any non priced element is not permitted.
Unreasonably high/unrealistically low, unbalanced, inaccurate or incomplete price proposals may be the grounds for eliminating a proposal from competition. The Government will evaluate proposed prices for reasonableness using price analysis techniques in accordance with FAR 15.404-1(b)(g).
2. The Government intends to award one contract as a result of this solicitation. Offers received for less than the stated number of items listed in the Bid Schedules may be considered ineligible for award. As set forth in FAR 52.215-1 (f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions).
Formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required. Contracting officer may conduct comparative evaluations of offers. Evaluation of other factors, such as past performance (13.106-2(b) (3)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination may be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. EVALUATION CRITERIA: The following specific criteria listed below must be addressed in the proposal:
Each criteria will be evaluated on a pass/fail basis with an assigned rating of “Acceptable” or “Unacceptable”. The proposals will be evaluated under the following Elements:
