1. Will there be a Pre-Bid Meeting or Site Visit?

Answer: NO

2. The attachments listed on FedBizOps extend from Attachment I through Attachment XII, however

Attachment IX (Nine) is missing. Is there an Attachment IX?

Answer: Yes,

3. Per SCA regulations and Executive Order 13495 we must provide “first right of refusal” and honor current seniority and vacation benefits of the SPOs to be retained on the current contract. Can you provide the Seniority Dates of the incumbent guard force for this purpose?

Answer No seniority dates will be provided. Please Reference FAR Clause 52.222-17 Non-displacement of Qualified Workers.

4. Are FAR 52.222-41 and FAR 52.222-43 applicable to this contract?

Answer: Yes

5. Attachments VI and VII list a CBA and MOU from 2010-2013 with the International Guards Union of America Local #106 under Wage Determination 2005-0226. However there is no listing covering the current contract year of 2015 and going forward into 2016. Can we receive a copy of the current Wage Determination/CBA or MOU?

Answer: The current Wage Determination is Attachment VIII. The most current CBA is Attachment VI.

6. Paragraph C.6 Mission Support Requirements and C.6.1 Mission Support Duties refers to “non-guard” personnel to “perform road block, sweeps, evacuation, posted support and velocity enrollment… or duties where an armed guard is not required.” These non-guard positions are not referred to in the CBA or Wage Determination. Yet due to the dollar values involved and funding provisions in this contract, these positions are subject to the Service Contract Act. What Occupation Code and Title under the included Wage Determination 2005-2512 Revision No. 20 dated 7/8/2015 or the current CBA would these “non-guard” positions be classified? Are these personnel in the Union Local?

Answer: the services under C.6 can be performed under occupation code 11000 – General Services and Support Occupations – Occupation code 11210 Title – Laborer, or under 01000 Administrative Support and Clerical Occupations – 01111 – General Clerk I

These positions will not be considered as “guard” positions, and should not be covered under the CBA currently in place. Only personnel that are armed and fully trained in accordance to Army Regulation AR190-56 are considered as contract security guards (CSG). The current CBA is an agreement between the guard personnel and the contractor.

7. Paragraph C.6.2 refers to the Mission Support Duties being performed by “unarmed/part-time guard force” also referred to earlier and elsewhere in the PWS as “non-guard personnel”. Are these uniformed positions wearing the same uniforms, less the firearms and non-lethal weapons such as expandable batons and pepper spray, as being worn on the armed guard uniforms?

Answer: – Security guard uniforms as outlined in the PWS will not be required for non-guard personnel performing services under C.6, badges identifying the contractor personnel as contractor personnel shall be worn by all contractor employees while on duty.

8. The solicitation lists the Transition Period (also referred to as the Phase-In Period) as January 1-31, 2016 and shown in CLIN 0001. In the PWS paragraph C.1.20 it also says the Contractor needs to “ensure continuity of operations, no loss of operations, and the ability to conduct and comply with all requirements described in this PWS”. During this period is the current incumbent contractor, or the incoming new contractor after award, responsible for performing the normal work such as maintaining the Patrol, Access Control, and Mission Support duties while the transition between companies is in progress?

Answer:– The current contractor (incumbent) is responsible for the regular day to day contract requirements till the end of their performance period. The phase in period allows the incoming contractor to assess how the services are being performed and what the incoming contractor will need and have in place when they take over the services outlined in the PWS. The incoming contractor will have to work with the current contractor and the current contractor employees in a manner that does not interfere with the incumbent contractor’s daily operation.

9. In paragraph C.3.3 while discussing the GFE, the PWS states “The Government will provide the Contractor with hand held radios for Contractor vehicles. The Contractor will be responsible for safe guarding Government furnished hand held radios. The installation and maintenance of vehicle radios into their patrol vehicles must be coordinated through WSMR Information Management (IM) office…” Who provides the vehicle mounted radios, the Government or the Contractor? If the Contractor, what are the required specifications to be compatible with the government designated frequencies, such as encryption capabilities, trunking capabilities, etc.?

Answer: – The Government under the GFE will provide the radios for the contractor provided vehicles. It shall be the contractor’s responsibility to have these government furnished radios installed into the vehicles. It is also the contractor’s responsibility to provide the hardware (brackets, screws) to install the government provided radios. The Government will also provide the hand held radios for contractor use.

10. Paragraph C.4.3.1 Vehicle Fuel, states “The contractor shall be responsible for all vehicle fuel costs associated with the vehicles used in the performance of this contract. The government has provided an estimated amount of miles traveled and gallons of fuel historically used, using fuel efficient vehicles. The contractor may use these figures as a means to estimate their fuel needs for their proposals but it remains the contractor’s responsibility to ensure they understand the fuel usage requirements of this contract and they understand the vast area they are required to provide the security services in the PWS so they can provide an accurate cost for their fuel usage. The government will not make any fuel use adjustments once contract has been awarded. Historically, for the period of Apr 2012 – Mar 2013 of performance, 544,259 miles were incurred and 40,062 gallons of fuel were consumed.” Later in Paragraph C.4.3.2 Fuel Pumps it goes on to say “The Contractor will not be allowed to use the government Petroleum, Oil & Lubricant (POL) fuel pumps located at WSMR. Contractor can use the Army and Air Force Exchange Services (AAFES) fuel pumps located at the main cantonment area at WSMR or Holloman Air Force Base. Contractor can also obtain fuel from commercial sources located at San Antonio, Socorro, Alamogordo, and Tularosa, New Mexico.” All of these fueling options are located at considerable distances from Stallion Range Center and the North Range locations the Contractor is responsible for. Does the

544,259 miles historical period of April 2012 – March 2013 given include mileage driven to and from these commercial locations to refuel the 15 trucks required?

Answer: - No

11. Is it permissible to perform light vehicle maintenance, such as tire replacement, oil changes, headlight replacement, etc. on the installation at Stallion Range Center?

Answer: – Yes, the contractor can perform light vehicles maintenance in the parking lot next to as mentioned in the question. The government will not provide a building, shelter, tools or equipment to perform the maintenance being described. Contractor must also remove any set up they use to perform the maintenance at the end of each working day. Contractor shall not store any non-working or wrecked vehicles on government property. A protective plastic or fluid resistance covering shall be placed on the ground to prevent any soil contamination and Contractor shall adhere to the environmental requirements when performing this light vehicle maintenance.

12. In Paragraph C.4.6.2 Duty Service Pistol it states “Security guards shall be equipped with 9mm semi-automatic weapon and 40 rounds of ammunition while on duty. Guards and supervisors shall carry three magazines with 10 rounds in each magazine and be carried in the appropriate magazine holder on the duty belt. One magazine with 10 rounds shall be loaded in the weapon.” Is it permissible to supply the pistol with 15 round magazines so there would be 15 rounds loaded in the weapon and two magazines on the belt with a total of 30 rounds (45 rounds total)?

Answer: – Yes

13. Since this work occurs on a Federal Installation, is the contractor responsible to pay the New Mexico Gross Receipts Tax, or will you issue a Federal exemption from this tax?

Answer: The contractor’s proposal must include New Mexico Gross Receipt Tax.

14. Since this is a fairly complex effort, perhaps I missed it in the materials, but will there be a Site Visit or Pre-bid meeting for this effort?

Answer: There will be no site visit.

15. I am contacting you in regards to a couple questions on the above solicitation number. I am just curious as to when the NLT date is for turning the proposal in? Also, I am assuming that this is still the pre-solicitation, correct?

Answer: The closing date for this requirement is 30 October 2015. This is the only solicitation that will be posted.

16. There is a CBA included in the packet that doesn't show the any rate adjustments since 1 October 2012.

The 2012 rate is more than the Wage Determination. Was there a new CBA negotiated after the last bid in 2013, if so can the new CBA be uploaded?

Answer: This is the only CBA in place.

Due to the fact that your response to this question is critical for our proposal preparation (as to the due date) it is greatly appreciated if your office will provide an immediate response to this request for consideration.

Answer: – Fuel adjustments will only be made if there are compelling circumstances the contractor can clearly justify.

22. The PWS is watermarked ‘draft’ is this truly a draft and not a final PWS?

Answer: This is the final PWS, the ‘draft’ water mark has been deleted and re-uploaded.

23. Please explain the CLINs line labeled “armed guard – incumbent” (within phase-in-period) what is to be priced here?

Answer: The current contractor (incumbent) is responsible for the regular day to day contract requirements till the end of their performance period.
