Q7: The following forms are included in the solicitation (IV-G3-2, IV-G3-3, IV-G3-4), which I believe are to be used by the contractor if awarded the contract. If that is not the case can you inform me as to how they are to be used. Also, the form found on page 2 of 15(requirements document)- Do you have any guidance as to the proper way to fill it out for submission?
A7: The referenced attachments (IV-G3-2, IV-G3-3, IV-G3-4) are mandated for inclusion into the contract by the Defense Transportation Regulation and are meant to be used during performance of the contract.
A7(cont.): The form on page 2 cannot support the CLIN structure required, a separate format will be provided for vendors along with this solicitation amendment to provide their pricing information, which is what page 2/15 is meant to capture.
Q8: Regarding government furnished containers, how they will be relocated from one contractor to the other if the same contractor doesn't have both inbound and outbound contracts? Who would be responsible and who will bear the expense if they have to be relocated?
A8:
k. The contractor will report, store and, when directed by the ordering officer, reposition government-owned HHG containers. When repositioning is ordered, the contractor will load the GOCs on vehicles and deliver them to the site identified by the ordering officer.
(1) The outbound contractor, when directed by the ordering officer, will pick up and store empty GOCs from other local carrier or government facilities within the contract area of performance. When the contract is awarded to different contractors, storage of the GOCs is the responsibility of the outbound contractor unless otherwise directed by the ordering officer. The storage of containers contemplated under this contract means, at a minimum, that containers, if not stored within a building, will be stored in a manner to protect from precipitation, ground water or other moisture.
(2) GOC Report. The contractor will submit a GOC report (a local form or for Air Force Installations, AF Form 384, Government-Owned Container Control Record). The report will be submitted to the ordering officer 15 days after the contract start date and thereafter on the first workday of each month (CDRL 0005, Report of Government- Owned Containers). The contractor will keep an accurate, up to date count of all GOCs.
(3) Serviceable/Unserviceable Containers. The contractor will not commingle serviceable or unserviceable containers. After inspection by the ordering officer, these two categories of containers will be segregated. The ordering officer and contractor will mutually agree upon the inspection and disposition schedule. Unserviceable containers will be disposed of at no cost to the government.
(4) The new outbound contractor will pick up the serviceable empty GOCs from the previous contractor(s) not later than 30 calendar days after commencement of the contract.
(5) There are no costs to the government for any of the above described work.
Q9: Claims liability. Page IV-G-14 of the solicitation indicates liability limits for FRV loss and damage at $6.00 NWT/not to exceed $75,000. Page IV-G6-10 indicates liability limits for FRV loss and damage at $4.00 NWT/not to exceed $50,000. Please clarify loss and damage limits of liability.
A9: This was a clerical error in the solicitation. The liability of $6.00 NWT/not to exceed $75,000 applies to both Page IV-G-14 and Page IV-G6-10.
Q10: Solicitation does not specify contract’s area of performance. Please specify contract’s area of performance.
A10: (a) The Government will consider all areas of performance described in paragraph (b) as including the Contractor's facility, regardless of geographical location.
(b) The Contractor shall perform services within the following defined areas of performance, which include terminals identified therein:
Georgia counties of:
Appling, Bacon, Brantley, Bryan, Bulloch, Candler, Chatham, Effingham, Evans, Jeff Davis, Liberty, Long, McIntosh, Pierce, Tattnall, Toombs, Wayne.
The frequently used air and surface transportation terminals listed below include but are not limited to:
Air Terminals: Delta Airline Terminal, Travis Field, Chatham County, GA Surface Terminals: AFB Freight System; American Freightways; Old Dominion Freight Line; Overnight Transportation Company; Roadway Express; Tarus Inc. and Yellow Freight Systems. All systems are located in Chatham County, GA.
Q11: Proposal instructions indicate Volume I, CLIN Price Schedules be submitted in MS Word. Are these documents to be re-created in MS Word or are use of .pdf price schedules provided in solicitation acceptable if filled out, scanned and pasted into MS Word document?
A11: Oversight, should read MS Word, Excel, or .pdf pages from solicitation. Pricing Schedule format to be posted with this Q&A. The method described in Q11 would be considered acceptable.
Q12: We are only bidding on one CLIN Schedule. Are we required to submit other Schedules with “No Bid” indicated?
A12: Yes, that method would satisfy the following requirement from page 2 of the solicitation: “Offers interested in competing for a limited number of schedules should so indicate, in order to prevent their proposal from being evaluated as incomplete and therefore unresponsive.”
Q13: Will you advice (sic) where the Representations and Certifications in Volume I Tab B is found?
A13: As found on page 1: “Offers shall include a copy of the provision at 52.213-3, Offer Representations and certifications - - Commercial Items, with their offer. This provision must be completed by the offeror, but a template of this provision can be found at the following address:
https://www.acquisition.gov/content/part-52-solicitation-provisions-and-contract-clauses#i1060550
Q14: Will this bid contain a standard form 1449 to fill out or all of the prices should just be done on the word document?
A14: The Pricing Schedule format is to be posted with this Q&A. This solicitation was not issued under a SF (Standard Form) 1449. Instructions to offerors are provided in the addendum to provision 52.212-1 beginning on page 5 of the solicitation. The requirement for a completed SF 1449 on page 7 is erroneous and will be removed in this solicitation amendment.
Q15: Will our current SAM registration be sufficient for satisfying Volume I, Tab B as to our Representation and Certifications? This is normally the requirement for Reps and Certs for all other DPM Contracts for all branches of service.
A15: Current SAM registration fulfills the representation and certification requirements.
Q16: There is nowhere for us to sign and fill in the info necessary in the 1449.
A16: This requirement is not solicited on a SF 1449. Proposal format is included in the Instructions to offerors which are provided in the addendum to provision 52.212-1 beginning on page 5 of the solicitation. The requirement for a completed SF 1449 on page 7 is erroneous and will be removed in this solicitation amendment.
Q17: I do not see where it states the area of performance. In other words, is there only one area and if so, what are the counties within the state of Georgia that are included?
A17: (a) The Government will consider all areas of performance described in paragraph (b) as including the Contractor's facility, regardless of geographical location.
(b) The Contractor shall perform services within the following defined areas of performance, which include terminals identified therein:
Georgia counties of:
Appling, Bacon, Brantley, Bryan, Bulloch, Candler, Chatham, Effingham, Evans, Jeff Davis, Liberty, Long,McIntosh, Pierce, Tattnall, Toombs, Wayne.
The frequently used air and surface transportation terminals listed below include but are not limited to:
Air Terminals: Delta Airline Terminal, Travis Field, Chatham County, GA Surface Terminals: AFB Freight System; American Freightways; Old Dominion Freight Line; Overnight Transportation Company; Roadway Express; Tarus Inc. and Yellow Freight Systems. All systems are located in Chatham County, GA.
Q18: Conflict in the following from the PWS…
14. Claims. The provision of full replacement value (FRV) to all DoD customers provides for the replacement, repair, or payment for the non-depreciated value of lost or damaged items. The liability limits for FRV are the greater of $5,000.00 per shipment or $4.00 times either the net weight of the HHG shipment or the gross weight of UB shipment, in pounds, not to exceed $50,000.00. For detailed claims and liability procedures, see Attachment G6.
Also from Attachment G6…
2. Liability Limits for Loss or Damage:
a. The contractor is liable to the member/employee, or to the Service that contracted for the shipment, for loss and/or damage that occurs to the member/employee’s personal property while it is in the custody of the contractor. Liability on all shipments, whether domestic or international, must be determined IAW the Carmack Amendment to the Interstate Commerce Act, (Title 49, United States Code, Section 14706, Liability of Carriers Under Receipts and Bills of Lading) unless a specific provision herein establishes a different rule or procedure
b. When a claim is filed directly with the contractor within 9 months of the delivery date, the contractor ’s maximum liability on all shipments must be the greater of:
(1) $5,000 per shipment, or
(2) $4.00 times either the net weight of the HHG shipment or the gross weight of the UB shipment, in pounds, not to exceed $50,000.
(cont…) USTRANCSOM has updated the claims and liability sections to increase the liability to $6.00/lb with a maximum of $75,000 per shipment. Will the PWS and Attachment G6 be updated to be included prior to the due date for proposals?
A18: This was a clerical error in the solicitation. The liability of $6.00 NWT/not to exceed $75,000 applies to both Page IV-G-14 and Page IV-G6-10.
Q19: Under Estimated Quantities it states Bidders must complete the “Bidder's Guaranteed Daily Capability”, which must equal or exceed the Government’s minimum acceptable daily capability, for all items within an area of performance for which they submit bids. Failure to do so will render the bid non responsive, however, these amounts are already filled in by the government?
A19: The estimates are provided for pricing information and order of magnitude. Bidders must confirm that they can meet the government estimate by confirming their daily capability.
Q20: Items 0012, 0027 and 0023 do not list a “not to exceed” distance in the item description nor an estimated annual quantity, therefore there is no way to submit a bid for these items. This item is normally tied to Q19.
A20: We don’t request these items to be performed.
File details come from the government source that posted it.
