SUMMARY OF CHANGES

SECTION 00 10 00 - SOLICITATION

SECTION 00 21 13 - INSTRUCTIONS TO BIDDERS

The following have been modified:

BASIS FOR AWARD

EVALUATION & BASIS FOR AWARD

The KO will make a single contract award by written or electronic notice, within the time for acceptance specified in the bid or an extension, and to the responsible bidder whose bid, conforming to the invitation, will be most advantageous to the Government, considering only price and the price-related factors included in the invitation. Award will not be made until all required approvals have been obtained and the award otherwise conforms to FAR Part 14.103-2.

1- Determination of Responsibility

a. Per FAR Part 14.408-2, Responsible Bidder – Reasonableness of Price, the Contracting Officer will determine that a prospective contractor is responsible in accordance with FAR Subpart 9.1.

b. To be determined responsible, a prospective Contractor must – Have adequate financial resources to perform the contract, or the ability to obtain them;

Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

Have a satisfactory performance record;

Have a satisfactory record of integrity and business ethics;

Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors);

Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

2- Price and Price-Related Factors

a. Price, FAR Part 14.408-2 – the KO will determine that the prices offered are fair and reasonable before awarding the contract.

b. Price-Related Factors, FAR 14.201-8 – the following Price-Related Factors shall be evaluated prior to award as applicable: Changes made, or requested by the bidder, in any of the provisions of the IFB, if the change does not constitute a ground for rejection under FAR Part 14.404.

As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (06) months of the Offeror's last year price to the Offeror's total price. Offeror shall not submit a price for the potential six month extension of services period. The Government may choose to exercise the Extension of Services at the end of the performance period (Ordering Periods), utilizing the rates of that performance period.

3- Evaluation of Bids

a. For award purposes, the Government will evaluate bids by adding the total price for all five

(05) ordering periods to determine the lowest priced bid.

b. A written notice of award or acceptance of bid mailed or otherwise furnished to the successful bidder within the time for acceptance specified in the solicitation shall result in a binding contract without further action by either party.

INSTRUCTIONS TO BIDDERS

INSTRUCTIONS TO BIDDERS

1- Point of Contact (POC) –

a. Contract Specialist (KS) – Israel Gutierrez, israel.gutierrez1.civ@mail.mil Telephone: 210-466-2196

b. Contracting Officer (KO) – B. Dean Angell, burrel.d.angell.civ@mail.mil Telephone: 210-466-2187

2- Competition Requirements – this procurement is a 100% 8(a) competitive set-aside acquisition for

3- Type of Contract –

The Government will award an Indefinite Delivery Indefinite Quantity Contract (IDIQ). Estimated quantities and/or the work to be performed are described herein as Contract Line Items (CLINS). These quantities are approximate and are provided only for the contractor's information to assist in preparation of bids. They are not guaranteed and the actual quantities may be less or more than shown. Variations in these estimated quantities shall not be justification for or request for additional payment.

Additionally, all work under this contract will be ordered by issuance of Task Orders (TO). A TO (written notification) utilizing SF 1155 will be provided to the contractor prior to the initial date of service for the work.

The TO shall list those items and quantities from the bid schedule that are to be performed. The quantities are not to exceed each line item per TO. Any changes to either the TO line item quantity or schedule will be made by issuance of a written modification to the order. The contractor is authorized to only perform the line items provided for and funded by the individual TO.

4- Bid Preparation Instructions and Contents – These instructions are designed to ensure the submission of necessary information to provide clear understanding and the comprehensive evaluation of bids. In the Sealed Bidding procedures, price will determine the “Apparent Low Bid;”

however, the submission of a low bid does not in and of itself determine responsibility of a bidder or a fair and reasonable price. Therefore, it is necessary to require additional information in order for the KO to make an award to the lowest, overall priced, responsible bidder. See Basis for Award

5- Bid Submission

The Solicitation (up to and including this and any future solicitation amendments, if any) will constitute the Offeror’s complete “bid” for the subject requirement. Bids shall be submitted prior to the bid opening time identified in Block 13 of the SF1442, which is 1:00pm CST 10 March 2020.
