PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

3-353rd Regiment Battalion Fort Polk, LA

PART 1

GENERAL INFORMATION AND PROGRAM MANAGEMENT

1.0 General. This is a non-personal services contract to provide support of the U.S. Army 3-353rd Regiment Battalion located at Fort Polk, Louisiana. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The following provisions shall apply to the performance of work under this contract.

1.1 Introduction. The Contractor shall provide the required personnel, equipment, supplies, facilities, transportation, tools, materials, supervision and other items and non-personal services necessary to perform 353rd Regiment Battalion requirements as defined in this Performance Work Statement (PWS) except for those items specified as Government Furnished Property (GFP) and services. The Contractor shall perform in accordance with (IAW) the terms and conditions of the contract and the requirements and standards of this PWS and contract.

1.2 Background. Tiger Support services for the 353rd Regiment Battalion entails providing realistic, collective training experience at the Brigade Combat Team (BCT) level with the primary objective of training light infantry, air assault, rangers and other units.

The 3rd Battalion, 353rd Armor Regiment has conducted Security Force Assistance Course (SFAC), Train, Advise and Assist Command (TAAC), Leaders Regional Aligned Assistance Course (LRAAC), and Joint Security Force Assistance Course (JSFA) at Fort Polk and/or at the unit’s home station location in order to prepare headquarters units and individuals on the skills they need to effectively understand how to support advising teams for operations, joint operations, and enable mission success in meeting the Combatant Commander (CCDR) Security Force Assisting or Security Cooperation (CCDR SFA/SC) requirements.

Commonly among all courses, they are given instruction and practical exercise in interpersonal communication skills including: using an interpreter, cross-cultural communication, negotiating techniques, leader engagements, building rapport and understanding human behavior. They also receive functionally-based SFA and advisement training, with a focus on engagements with Host Nation Security Force (HNSF) role players recruited from host nation (HN); many of the role players are simulating the same occupation they previously held in their respective country. The soldiers conduct multiple engagements with the cultural role players, giving them a chance to practice their skills in a realistic environment.

In addition, these courses provide language training, as well as an in-depth familiarization of the culture, history, and environment of the area to which they are deploying. The courses then culminate with scenario based exercises which involves the training of a HNSF and leader engagements with cultural role players, while putting their newly acquired skills to the test in a realistic joint environment. Due to the unique nature of being the Army’s only Advise & Assist Battalion, some of the course curriculum are designed solely for the courses taught within the battalion and are not strictly governed by Army doctrine. Rather, they are a conglomeration of doctrine, multi-source documents, and experience combined and tailored to fit every unit’s training needs.

1.3 Scope. This PWS identifies the Tiger Support requirements of the 353rd Regiment Battalion and provides the Contractor with information concerning the concept, expectations and performance requirements of the 353rd Regiment Battalion Tiger Support Contract (TSC).

1.3.1 The 3RD BN, 353RD REGT provides an advanced unit training environment for ARMY FORSCOM, U.S.

Army, Pacific (USARPAC), U.S. Army, Joint Special Operations Command (JSOC), U.S. Army Reserve (USAR), Army National Guard (ARNG), U.S. Marine Corp (USMC), USMC AIR, U.S. NAVAL, NAVAL AIR, U.S. AIR FORCE, and AIR COMBAT COMMAND (ACC) forces.

1.3.2 Security Force Assistance Course (SFAC)/Train, Advise & Assist Command (TAAC). The 3rd BN, 353rd REGT typically conducts up to a combined twelve (12) SFACs/TAACs. Typical standard course designs are based on seven (7) consecutive calendar days. The SFAC is a Program of Instruction conducted at the unit level and scheduled according to unit needs. For complex processes, the Contractor shall construct detailed flowcharts and identify the critical and major process or task within each SOP, utilizing the definitions identified in the Contractor’s QC Plan. All SOPs shall be submitted to the ACO and COR for review within 30 calendar days after the commencement of the Phase-in period unless otherwise stated in the PWS. Updates shall be provided yearly to the

COR.

1.7 Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance and the minimum acceptable defect rate(s).

1.7.1 Contract Discrepancy Report (CDR). All Government discovered Contractor non-conformances shall be documented at the time of discovery. When the Contractor's performance is unsatisfactory, a CDR will be issued.

The Contractor shall reply in writing within five work days from the date of receipt of the CDR, giving the reasons for the unsatisfactory performance, corrective action taken, and procedures to preclude recurrence.

1.7.2 CDR documentation will, at a minimum, include the contract, reference to the specific contract requirement, the specific deficiency to the requirement, where it was discovered, the date and time it was discovered, focal point for the Contractor who was notified and suspense date for Contractor response. Non-conformances shall be classified in one of three categories: level I (Minor), level II (Major) or level III (Critical).

1.7.2.1 Level I (Minor) nonconformance is defined as a nonconformance that is not likely to materially reduce the usability of the supplies or services for their intended purpose, or is a departure from established standards having little bearing on the effective use or operation of the supplies or services. Minor nonconformance usually can be corrected on the spot, where no further corrective action (CA) response is necessary, and can be issued to the Contractor either through a verbal or written Contract Discrepancy Report (CDR). However, even verbal CDRs are still required to be documented by the Government. The COR may issue Verbal Level I CDRs directly to the appropriate level of Contractor management if the ACO included such authority in the COR’s designation letter.

When CORs are designated the authority to issue verbal level I CDRs, the CORs will notify the ACO when the CDR is issued and document those CDRs in their monthly reports. Written CDRs will be signed and issued by the ACO.

1.7.2.2 Level II (Major) nonconformance is defined as a nonconformance, other than critical, that is likely to result in failure of the supplies or services, or to materially reduce the usability of the supplies or services for their intended purpose. Deficiencies that are recurring (a number of level I nonconformance documented by the Government) or for a non-responsive Contractor indicating a trend or failure of the Contractor’s quality control can also be classified as a level II CDR. The ACO will issue all level II CDRs in writing to the appropriate Contractor management level in order to emphasize the seriousness of Contractor’s failure to comply with requirements and the possible contractual remedies for failing to take appropriate CA. The written CDR shall require the Contractor to develop a Corrective Action Plan (CAP) which identifies the root cause, CA for the root cause, CA for the specific nonconformance and the date the CA will be completed.

1.7.2.3 Level III (Critical) nonconformance is defined as a nonconformance that is likely to result in hazardous or unsafe conditions for individuals using, maintaining, or depending upon the supplies or services; is likely to prevent performance of a vital agency mission; is for a repeated or uncorrected level II CDR; or is for a non-responsive Contractor to a level II CDR. Critical non-conformances shall result in the issuance of a written CDR to the Contractor requiring the development of a CAP by the Contractor which identifies the root cause, CA for the root cause, CA for the specific nonconformance and the date the CAs will be complete. The MICC contracting office director or deputy director will issue all level III CDRs with a cover letter on MICC contracting office letterhead to Contractor senior management in order to emphasize the seriousness of Contractor’s failure to comply with requirements and the possible contractual remedies/consequences for failing to take appropriate CA.

1.8 Recognized Federal Holidays. All government offices will be closed, except for minimum personnel required for in-house operations, during Federal holidays. Except as otherwise specified, the Contractor shall not schedule routine work on Federal holidays. When a scheduled service is required less than three times per week and the schedule for that work falls on a Federal holiday, the Contractor shall accomplish the work on the workday following or preceding the holiday. Notice of training occurring over Federal holidays will be provided in advance.

Except as otherwise specified, routine work shall not be scheduled on holidays or holidays observed in lieu thereof.

1.9 Hours of Operation. Unless otherwise stated, the Contractor is responsible for conducting business between the hours of 0730 to 1700 Monday thru Friday except Federal holidays or when the government facility is closed due to local or national emergencies, administrative closings or similar government directed facility closings. The Contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce is essential.
