Addendum to Evaluation - Commercial Product and Commercial Services

Miscellaneous text in this section has been modified to:

Addendum to FAR 52.212-2 Evaluation Commercial Items

(a) The Government will use a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement. The Government intends to award a single contract resulting from the solicitation, to the Offeror who is deemed responsible in accordance with the FAR, as supplemented, whose proposal conforms to the solicitation requirements (to include all stated terms, conditions, and all other information required by the solicitation), provides the lowest priced, technically acceptable response to satisfy the requirements of the solicitation and the PWS. The following factors shall be used to evaluate offers:

Factor 1: Mission Capability

Factor 2: Price

Factor 3: Past Performance

Basis for award - Lowest Price Technically Acceptable (LPTA):

a. The Government will evaluate the Offeror's proposals strictly in accordance with this solicitation and will not assume that performance will include areas not specified in the Offeror's submission. The Government intends to evaluate proposals and award one (1) contract without negotiations; therefore, the offeror's initial proposal should contain its best terms from a technical standpoint. However, in accordance with (IAW) FAR Part 15.203, should discussion become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and competitive range "comprised of all the most highly rated proposals, unless the range is further reduced for purposes of efficiency pursuant to FAR Part 15.204-1(b).

b. The Contracting Officer shall make a determination of responsibility in accordance with the standards of FAR 9.104. In order to be determined responsible, a prospective contractor must meet all standards of FAR 9.104. Award shall be made to the responsible offeror whose proposal is deemed Technically Acceptable and offers the lowest price which the Contracting Officer determined to be reasonable.

1.0. Evaluation Criteria:

1. The Government will use the criteria set forth below to evaluate and select the awardee. The Offeror's proposals will be evaluated under the following evaluation factors:

Factor 1: Mission Capability

Subfactor 1a: Phase-in Approach

Subfactor 1b: Management Approach

Subfactor 1c: Staffing Approach

Factor 2: Price

Factor 3: Past Performance

1.1. Volume I - Factor 1 - Mission Capability: The Government's technical evaluation team will evaluate the technical capability subfactors on an acceptable or unacceptable basis. Offerors must receive Acceptable ratings in each subfactor and any subfactor that is rated unacceptable will result in the overall Mission Capability factor being determined Unacceptable. Factor 1 and subfactors a, b, and c will receive one of the adjectival ratings defined in the table below.

Non-Price Factor Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal meets the requirements of the solicitation and the PWS.

Unacceptable Proposal does not meet the requirements of the solicitation and the PWS.

The Offeror's Mission Capability provided a sound and feasible Mission Capability Approach that addressed all applicable requirements which include the following:

a. Phase-in Plan. i. The Offeror provided a realistic phase-in plan that satisfies the phase-in requirements of the PWS, which ensures the Offeror is able to successfully execute the tasks in the PWS at the completion of the thirty (30) day phase-in period.

b. Management Approach. The Offeror proposed an acceptable management plan that included the following:

i. The Offeror provided an organizational chart which identifies the management structure, roles, and responsibilities of the proposed management team. The management plan adequately identifies all members of its team, to include management, key personnel, and any utilization of subcontractors.

ii. The management plan ensures adequate management and oversight of contract performance on Fort Bragg.

iii. The management plan ensures the Offeror's ability to successfully accommodate fluctuating workloads, minimize personnel turnover, and recruit and retain qualified and experienced personnel.

iv. Mission-Essential Contractor Services Plan addressed the following: Challenges associated with maintaining essential contractor services during an extended event, such as a pandemic that occurs in repeated waves; The time lapse associated with the initiation of the acquisition of essential personnel and resources and their actual availability on site; The components, processes, and requirements for the identification, training, and preparedness of personnel who are capable of relocating to alternate facilities or performing work from home;

Any established alert and notification procedures for mobilizing identified "essential contractor service" personnel; and The approach for communicating expectations to contractor employees regarding their roles and responsibilities during a crisis.

c. TStaffing Approach. he Government will evaluate the Offeror's staffing approach on an acceptable or unacceptable basis. To be rated acceptable, the Offeror must submit an Un-priced Staffing Matrix that clearly demonstrates how the proposed staffing plan will meet all performance requirements and hours of operation identified in TE3. The staffing plan must show that the Offeror's proposed labor categories, qualifications, labor hours, and coverage methods are sufficient to perform the ID Card services, including how the Offeror will maintain performance during absences such as leave, training or illness. A proposal will be rated unacceptable if the staffing plan fails to show how the Offeror will maintain continuous performance in accordance with the PWS.

1.2. Volume II - Factor 2 - Price. The price submission will not be scored or rated. The techniques and procedures described in FAR Part 15.404-1(b) are the primary means by which the Government will assess price reasonableness. To be eligible for award, an Offeror's price proposal must be complete, and its price must be determined fair and reasonable, balanced, and complete and accurate.

a. Reasonableness. The existence of adequate price competition is expected to support a determination of reasonableness. Other price analysis techniques in accordance with FAR 15.404-1(b) may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government-obtained information, additional information in accordance with FAR 15.402(a)(2) may be required from the Offeror to support the proposed price.

b. Unbalanced Pricing will be evaluated in accordance with RFO FAR 15.404-6, as applicable, to assess potential performance risk which could result in unreasonably high prices.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of price analysis techniques. Offers that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.

c. Complete/Accurate. The Government will evaluate offerors price proposals to ensure that they are compliant with the price volume submission instructions in the solicitation and that they are mathematically accurate. The Government will evaluate whether the Offeror provided the proposed prices for all CLINs in the Pricing Schedule for the Phase-In, Base Period, Option Period 1, Option Period 2, Option Period 3, and Option Period 4, and whether the Offeror provided the total price for the phase-in and base period plus (4) option periods (CLIN Totals table). The Government will cross-walk the Offeror's proposed priced labor matrix with its un-priced labor matrix submitted in support of to ensure correlation between the two Factor 1 matrices. When evaluating price, the Government reserves the right, without entering discussions, to de-conflict or correct situations involving clerical errors, minor mathematical errors, rounding discrepancies or obvious misplacement of decimal points where there is a negligible impact on price.

d. The price evaluation will include the optional six (6) month extension in accordance with FAR 52.217-8, Option to Extend Services. The Government will evaluate this option by adding one-half of the Offeror's final option period price to the Offeror's total price. Evaluation of options does not obligate the Government to exercise the option(s).

e. The Total Evaluated Price. The total evaluated price will include the price of the phase-in period, base period, and all option periods (to include the option to extend services in accordance with FAR 52.217-8). (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the Offeror's total price for the purpose of evaluation will include the phase in and base period, 1st option, 2nd option, 3rd option and 4th option and 1/2 of the 4th option. Offerors are not required to enter a price for the six-month period. Unbalanced Pricing may be evaluated in accordance with FAR 15.404-6(a), as applicable, to assess potential performance risk for unreasonably high prices. The total evaluated price will include the price of the phase-in period, base period, and all option periods (to include the option to extend services in accordance with FAR 52.217-8).

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer ( or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
