PERFORMANCE WORK STATEMENT

Englebright Grounds Maintenance Services Dated: 16 June 2025

Part A - General Information:

The work required under this contract provides for Grounds Maintenance services at Englebright Lake. The Contractor shall be responsible for all costs related to performing this contract.

Services shall be performed at various locations within the Englebright project boundaries, Nevada County and Yuba County, CA. All work, materials and equipment shall be subject to the approval of the Contracting Officer Representative (COR). The Government shall determine the actual start date. Once started, work shall be completed as directed by the Contracting Officer or his/her authorized representative(s).

In the event that any part of, or the entire Park is permanently or temporarily closed, the segments of this contract pertaining to that area may not be required and therefore not utilized.

The number of facilities may vary. Contractor shall not perform work in closed areas or facilities not in use and shall not be compensated for work not accomplished.

This contract consists of a Base Year and four (4) Option Years.

1. All work completed under this contract shall be performed on the days as requested by the COR. A business day is considered Monday through Friday. No work shall be conducted on days other those scheduled without prior approval from the COR. Work completed for this contract shall be accomplished between the hours of 8:00 a.m. to 4:30 p.m. Monday through Friday and not including any holidays without prior authorization from the COR.

2. Work site locations are listed as followed:

3. Pre-work Conference: A pre-work conference between the Contractor, his/her representatives, supervisors, workers, etc. and the COR shall be scheduled prior to the start of any work at the respective sites. Contractor shall submit to the COR, all required reports, plans, permits, licenses, and other items outlined in this contract.

Part B – Contractor Responsibilities:

1. General Information: The Contractor shall provide all labor, equipment, materials and supplies necessary to perform all Ground Maintenance Services at Englebright Lake.

2. Safety and Health Requirements: The Contractor shall comply with the latest version of EM 385-1-1 (including interim changes), U.S. Army Corps of Engineers (USACE) Safety and Health Requirements Manual. See USACE website for more details at www.usace.army.mil/Safety-and-Occupational-Health/. The Contractor will be provided access to a copy of EM 385-1-1.

A copy of EM 385-1-1 is located at the Park Office and is available online. The Contractor shall http://www.usace.army.mil/Safety-and-Occupational-Health/ http://www.usace.army.mil/Safety-and-Occupational-Health/ comply with all pertinent provisions of the California State Health Code, Cal-OSHA, and Yuba and Nevada Counties Codes. An observed Contractor violation of safety requirements/equipment shall be grounds for the Government to stop work. Work shall not continue until the violation is corrected.

Area Safety: The work to be performed shall be within the boundaries of public recreation areas and the attention of the Contractor and his employees is directed to the need for extreme caution and care while driving and/or operating equipment in these locations. The Contractor and employees shall comply with all state and local traffic. Contractor and/or contract employees shall not park in any reserved or restricted parking areas except as approved in advance by the

COR.

Safety Equipment: Appropriate personal protective equipment (PPE) will be identified in an Activity Hazard Analysis (AHA) and must be worn at all times while providing services.

General employee safety equipment includes safety toe shoes (open-toed shoes are prohibited), safety glasses, hard hats, hearing protection, and work gloves. Appropriate personal flotation devices shall be worn at all times while aboard any vessel. Safety equipment and gear should meet or exceed industry standards. The equipment used by the Contractor for the specified service shall be in satisfactory operating condition and maintained. The Government reserves the right to require the Contractor to discontinue the use of unsatisfactory equipment and to require that such equipment be replaced with acceptable equipment to maintain contract compliance. The decision of the Contracting Officer as to serviceability of the equipment shall be final. A vessel inspection shall be completed prior to the commencement of work under this contract.

3. The contractor is liable for all damage to property, equipment, and landscape features in performance of this work. Any such damage shall be immediately reported to the COR and repaired at the contractor's expense.

4. Blowing and Cleaning Firebreaks: This service is not guaranteed and shall only be accomplished at the request of the COR. If the service is requested, the Contractor shall begin work within one week after receiving awarded contract. Firebreak locations are identified in Appendix A. Firebreak widths vary, but they are typically eight feet wide or more. The firebreaks shall be cleaned down to bare mineral soil. Down trees on fire breaks will be chain sawed and bucked into burn piles.

5. Grass and Weed Cutting Service: At the request of the COR, the Contractor shall cut grasses and weeds in requested areas at a per Acre cost. The Contractor shall provide all personnel, materials, supplies, and equipment, including boat transportation. The vegetation shall be cut to a height not less than two (2") inches and not more than four (4") inches. Vegetation shall be cut completely down to the ground surface at all herbicide spray zones locations around picnic tables and fire rings. The COR shall specify the dates of any additional services as needed. Minimum requested service will be 21,780 Square feet or 0.5 acres. Service by shall not exceed 10 acres.

6. Option Task: Recutting of Grass and Weed Cutting/Square Feet: At the request of the COR, the Contractor shall cut grasses and weeds in requested areas at a per Acre cost. The Contractor shall provide all personnel, materials, supplies, and equipment, including boat transportation.

The vegetation shall be cut to a height not less than two (2") inches and not more than four (4") inches. Vegetation shall be cut completely down to the ground surface at all herbicide spray zones locations around picnic tables and fire rings. The COR shall specify the dates of any additional services as needed. Minimum requested service will be 0.5 acres. Service shall not exceed 10 acres.

7. Option Task: Downed Tree service: Downed tree removal within designated service areas.

This is an optional CLIN and will be exercised on an as-needed basis, up to a maximum of ten

(10) trees. Work will be performed at a pre-negotiated cost per tree, not to exceed a total of ten

(10) trees The intent is to mitigate potential hazards created by fallen trees, ensuring safe access for personnel and campers. This task encompasses the removal of already downed trees that pose a hazard. No standing live trees will be cut down. Work will focus on clearing downed trees from trails, Fire Breaks, Campground Access Areas, other areas requiring clear passage for personnel and campers. Downed trees will be removed using chainsaws and other hand tools.

Chipping is not authorized. Removed trees will be sectioned and physically removed from the impacted area. Debris will be put into piles for onsite staff to dispose of in a manner consistent with environmental regulations.

8. The Contractor shall provide all personnel, materials, supplies, and equipment, including vessel transportation. Some work areas are accessible by boat only. The Contractor shall have a boat of sufficient power and size to service these areas. Appropriate personal flotation devices shall be worn at all times while aboard any vessel or while performing work next to or over water. The vegetation shall be cut to a height not less than two (2") inches and not more than four (4") inches. Vegetation shall be cut completely down to the ground surface at all herbicide spray zones locations around picnic tables and fire rings. At the direction of the COR, the initial cutting and chain sawing shall be accomplished during a one-week period between 01 April and 01 May. The COR shall specify the dates of any additional services as needed.

A. Narrows Recreation Area. Weed-eat around the base of each sign in the recreation area.

Weed-eat the level areas around the Narrow’s lower parking lot, Narrows’s middle parking lot and Narrow’s Upper parking lot and the entire picnic areas all the way to the dam. Weed-eat ten feet (10') both sides of the stairway from the lower parking lot up to the park office. Weed-eat around the display area near the waterborne restroom that is contained within the wooden fencing. Weed-eat both sides of restroom. Starting from the women's side of the water-borne restroom, weed-eat the level picnic area to ten feet (10’) beyond last bench. Down trees along roadside shall be cut into manageable pieces (6) shall be fed into a woodchipper. Blow off roads and parking lots of debris, using blowers to blow debris off roadways and parking areas.

B. Englebright Dam Road. Weed-eat around base of each sign and car counter on Englebright Dam Road. Weed-eat ten feet (10’) on both sides of roadways from Mooney Flat Road to Narrows Boat Ramp. Downed trees along the roadside shall be cut into manageable pieces. Use blowers to blow debris off roadways and parking areas.

C. Park Office. Weed-eat the entire hillside below the office from the far end of chain-link fence to the Narrows waterborne restroom. This includes the area surrounding the propane storage tank, Park Office Back yard all the way to overlook and around Gate House. Weed-eat around the light pole and twin power poles on the hill next to the covered parking area.

D. Maintenance Yard. Weed-eat all gravel and dirt roadways when weeds are present. Weed-eat ten feet (10') both sides of all gravel dirt roadways, including the road to the water treatment plant, Sniper Lane all the way down to Englebright Dam Road. Weed-eat a ten-foot (10') perimeter around concrete landings, sign shed, concrete shed, water treatment plant and water storage tank. Weed-eat the entire island around pump house and boat trailer storage area. Weed-eat a ten-foot (10') perimeter around the Maintenance Shop compound (chain-link fenced area).

Downed trees along the roadside shall be cut into manageable pieces.

E. Joe Miller Recreation Area. Weed-eat around the base of each sign in the recreation area.

Weed-eat five feet (5') on each side of the Joe Miller launch ramp, behind the guardrails, around fee station, around life jacket loaner station and on each side of the stairway between lower Joe Miller Lower and Middle parking lots, middle walkway, and Joe Miller launch ramp. Weed-eat fifteen feet (15') behind the guardrail at the lower Joe Miller parking lot and three feet (3').

Weed-eat ten feet (10') around the exterior water well fence. Weed-eat the triangular area located between the Joe Miller lower parking lot entrance road, the launch ramp road, and the Joe Miller restroom. Downed trees along the roadside shall be cut into manageable pieces. Use blowers to blow off debris from roadways and parking area.

F. Marina Drive Road. Weed-eat around base of each sign, car counter, life jacket loaner station, rescue throw ring station, fee machine, retaining wall, and Park Bench on Marina DR Road.

Weed-eat ten feet (10’) both sides of Roadways from Mooney Flat Road to Joe Miller Boat Ramp. Downed trees along the roadside shall be cut into manageable pieces. Use blowers and blow off debris from roads and parking lots.

G. Mooney Flat Road. Weed-eat twenty feet (20’) around base of each USACE Corps signs on Mooney Flat Road.

H. Fishing Access Trail. Weed-eat two feet (2’) on each side of the Fishing Access Trail, Bridges and stairs, starting from the Joe Miller boat launch ramp and ending at the Narrows launch ramp.

Use backpack blowers to blow debris off trail.

I. Boat-In Campgrounds - Group A: The following boat-in campgrounds shall be mowed and/or weedeated entirely. Clear a six foot (6’) wide trail from the shoreline to each restroom. Clear a ten foot (10’) wide strip along the shoreline. Downed trees inside campgrounds and fire breaks shall be chain sawed into manageable pieces and placed into brush piles or stacked for firewood.

Using backpack blowers to blow debris off trails, tent pads, tables and restrooms, within the area of the firebreak as indicated below:

1. Rocky Bluff Weed-eat the entire area and chain saw downed trees into manageable pieces within the fire break down to the shoreline.

2. Longs Point Weed-eat the entire contiguous campground area, from the shoreline to ten feet (10’) beyond any picnic table, tent pad, fire ring and portable restroom.

3. Singles Point Weed-eat the entire contiguous campground area, from the shoreline cliff to ten feet (10’) beyond any picnic table, tent pad, fire ring and portable restroom. Weed-eat three feet (3’) on each side of the trail between Singles Campground and Shadyside Campground, chain saw downed trees into manageable pieces.

4. Shadyside Weed-eat the entire contiguous campground area, from the shoreline cliff to ten feet (10’) beyond any picnic table, tent pad, fire ring and portable restroom. Weed-eat a six-foot (6’) wide trail from the campsites to the shoreline, chain saw downed trees into manageable pieces.

5. Buck's Beach Weed-eat the entire area within the fire break down to the shoreline, chain saw downed trees into manageable pieces.

6. Dixon Hill Weed-eat six feet (6’) around one restroom, chain saw downed trees into manageable pieces. Clear a six foot (6’) wide path from the shoreline to the restroom. Clear a ten foot (10’) wide strip along the shoreline.

7. Point Defiance Weed-eat around two restrooms; includes internal access trails and pathways to shoreline, chain saw downed trees into manageable pieces. Weed-eat twenty feet (20’) on all sides of the picnic shelter. Clear a six foot (6’) wide path from the shoreline to the restroom.

Clear a ten foot (10’) wide strip along the shoreline.

8. Lower Missouri Bar Weed-eat six feet (6’) around one restroom, chain saw downed trees into manageable pieces. Clear a six foot (6’) wide path from the shoreline to the restroom. Clear a ten foot (10’) wide strip along the shoreline.

9. Missouri Bar Weed-eat six feet (6’) around two restrooms, chain saw downed trees into manageable pieces. Clear a six foot (6’) wide path from the shoreline to the restroom. Clear a ten foot (10’) wide strip along the shoreline.

10. Sunnyside Weed-eat six feet (6’) around one restroom, chain saw downed trees into manageable pieces. Clear a six foot (6’) wide path from the shoreline to the restroom. Clear a ten foot (10’) wide strip along the shoreline.

J. Boat-In Campgrounds - Group B: Hogback, Bonanza and Long's Cove. The boat-in campgrounds indicated below shall be mowed and/or weed-eated as follows: Weed-eat the entire contiguous area of each campsite to include cutting ten feet (10’) beyond any tent pad, picnic table and fire ring. Weed-eat a ten-foot (10’) wide zone around each portable toilet. Weed-eat all campground trails that link campsites, portable restrooms, and paths to the shoreline, to a width of six feet (6’). Downed trees inside campgrounds shall be chain sawed into manageable pieces for brush piles or stacked for firewood.

K. Boat-In Campgrounds – Group C: Boston Bar and Upper Boston Bar. The boat-in campgrounds indicated below shall be mowed and/or weed-eat as follows: All campground sites at Boston Campground weed-eat the entire campsite to include weed-eating down to the low water line of the shoreline below each site and. Boston and all Upper Boston Campground shall be mowed and/or weed-eated as follows: Weed-eat the entire contiguous area of each campsite to include cutting ten feet (10’) beyond any tent pad, picnic table and fire ring. Weed-eat a ten-foot (10’) wide zone around each portable toilet. Weed-eat all campground trails that link campsites, Five Oaks Nature Trail (.03) miles, portable restrooms, and paths to the shoreline, to a width of six feet (6’). Downed trees inside campgrounds, fire breaks and trails shall be chain sawed into manageable pieces for brush piles or stacked for firewood.

l. Boat-In Campgrounds - Group D: Rice's Crossing. Weed-eat the parking lot turn-around area, gate, signs, and CXT restroom. Weed-eat a six-foot wide path on the two trails that lead down to the water.

2. Permits: The contractor shall, without any additional expense to the government provide all of the necessary/required licenses or permits for the completion of this contract. The contractor shall comply with all Federal, state, county and municipal laws, codes, and/or regulations in connection with the performance of specified work.

3. Safety: All work shall be performed in accordance with safety requirements set forth in the Corps of Engineers Safety Manual, EM 385-1-1, entitled Safety and Health Requirements Manual, 30 November 2014. Copies are available at the request of the contractor. The Army Corps of Engineers, Sacramento District Safety office will approve all Safety Plans.

4. Environmental Protection: In addition to the safety requirements, the contractor will also comply with Environmental Protection requirements.

5. Licensing: Prior to starting work, the Contractor shall submit a copy of current qualified contractor's license, business licensing, registration with state, county, and local Business Administrations and/or any licenses required to comply with Federal, state, and local laws. The above shall be submitted to the COR at the pre-work conference.

6. Equipment: All equipment shall have all safety features intact and in operating condition. All equipment must be suitable for use on the described project and is subject to the approval of the

COR.

7. Report: A man-hour exposure report shall be submitted to the COR prior to the completion of the contract.

8. The contractor is liable for all damage to property, equipment, and landscape features in performance of this work. Any such damage shall be immediately reported to the COR and repaired at the contractor's expense.

9. All waste material generated in performing of this contract shall be removed from government property and disposed of at an approved waste disposal site. The contractor shall comply with all Federal state and local guidelines as they pertain to the proper excavation, removal, and disposal of waste material generated during the performance of this contract specifications.

10. Contractor Furnished Supplies and Materials: The Contractor shall furnish all supplies and materials to be consumed or incorporated in the execution of this contract. The Contractor shall be responsible for maintaining an adequate supply of materials each working day as necessary for performing the project as described.

11. Personnel:

A. Minimum Manpower Requirements -The Contractor shall provide an adequate number of fully qualified personnel to perform the specified project safely, properly and efficiently within the time constraints of this contract.

B. Quality Control - The Prime Contractor is responsible for ensuring that all work performed under this contract, including that performed by subcontractors, is in accordance with the specifications. To accomplish this, the Contractor will appoint in writing, subject to the approval of the COR, a Quality Control Inspector (QCI).

Part C – Government Responsibilities:

1. Inspection:

A. Government Quality Assurance - The government shall monitor the Contractor’s services through scheduled, unscheduled, and in some cases, 100% inspections of the project as described.

2. Invoices and Payment Information:

a. Invoice: Invoices for payment shall be submitted upon completion of tasks as outlined in the Payment Schedule of this contract. Invoices will be verified by the COR before payment can be authorized. Invoices shall be submitted to:

Part D – Security AT-OPSEC

1. General Security requirements and guidance: The security requirements described below apply to all contract personal Including employees of the prime contractor) and all subcontractor employees supporting the performance requirements of this contract. The contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designed Government representative (Contracting Officer Representative (COR) Requiring Activity (RA) representative, or Contracting Officer if a COR or other RA representative is not appointed. Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and actives and security awareness training contributes to those efforts. The Department of Defense DOD and Army security training requirements specified below, if applicable, are performance requirements, all applicable contract personal shall complete initial training within 30 days of contract award or the date new contract personal being performance on the contract. Within 5 business days from the completion of training, the contractor shall provide written documentation email or memorandum to the government representative. The documentation shall include the names of contract personnel trained and which training they completed, the contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition FPCON measures, Random Antiterrorism Measures commonly referred to as RAMs, and Health protection Condition HPCON measures. The Contractor us responsible for meeting performance requirements during elevated FPCON and HPCON levels in accordance with applicable RA plans and procedures, this includes identifying mission essential and on mission essential personnel. In addition change, the government may implement security changes that affect contract personnel. The contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identify in local polices or procedures.

2. Antiterrorism AT Level Training. All contract personnel requiring routing access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level 1 awareness training. Online AT Level 1 awareness training is available at https://jko.jten.mil/

3. Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshall Directorate of Emergency Services Security Office using the National Crime Information Center Interstate Identification index and Terrorist Screening Database. Contract personal shall comply with all personal identity verification requirements specified in installation facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provides access to government owned property shall comply with key and lock control procedures of the RA.

4. Suspicious Activity Reporting training (e.g IWATCH, CorpsWatch, or see something, say something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious actively to the project manager, security representative or law enforcement entity.

5. Pre-screen candidates using E-Verify Program. Contractors shall comply with requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at https://e-verify.gov/ to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible of enforcing labor and requirements to include eligibility for employment under the under United States immigration laws n accordance with FAR 22.102-1(i). An initial list of verified eligible candidates shall be provide to the COR no later than 3 business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form 1-9, employment eligibility verification and submit to the contracting officer to become part of the official contract file.
