EXECUTIVE SUMMARY
EXECUTIVE SUMMARY
All administration and future task orders under this IDIQ SATOC will be issued by U.S. ARMY

The Government intends to award up to one Indefinite-Quantity, Indefinite-Delivery (IDIQ) Single Award Task Order Contract (SATOC) for Munitions and Explosives of Concern (MEC) Support, Fort Ord, California within the South Pacific Division. The objective of this solicitation is to award to a small business one IDIQ contract with a five year ordering period. The government intends to award one IDIQ contract, however the government reserves the right to award more, less, or none at all. The maximum capacity for all contract(s) awarded will be $9,000,000.00. The Government also intends to award one (1) task order from this solicitation immediately following the IDIQ contract award. The performance of work will be authorized by issuance of task orders by a duly warranted Government Contracting Officer.
Remedial actions are ongoing in support of closure of the Former Fort Ord. Support to the Fort Ord Base Realignment and Closure (FO-BRAC) office during remedial actions related to the cleanup and closure is required. These remedial efforts are expected to be variable based on BRAC program priorities in the next 5 years. Therefore, an Indefinite Delivery/Indefinite Quantity (IDIQ) contract is considered the optimal process to address these requirements.
The Former Fort Ord is in the remedial design and remedial action phase of the remediation CERCLA process. Fort Ord was placed on the Superfund list in February 1990 and investigation and cleanup actions have been ongoing since.
The requirements are to provide UXO technical support, annual surface monitoring and reporting, license maintenance, munitions security guarding, and homeless encampment cleanup.
All work performed by the Contractor shall be designed and implemented in a manner that complements earlier investigations. The Contractor will be responsible for all aspects of the work to achieve environmental acceptance of work completed.
2. Task orders will be awarded against the basic IDIQ contract using the ordering procedures discussed in FAR 16.5. Task orders will be Firm-Fixed Price (FFP).
3. The ordering period shall commence upon the date of award and will continue for a period of five years. The labor rates in effect at the time of the contract award are effective through the life of the contract.
4. When requests for task order proposals are issued, offeror must provide sufficient detail with regard to labor categories and hours, material, and other direct costs to allow an evaluation of the proposed cost.
5. The USACE Sacramento Contracting Office will remain the Procurement Contracting Office and no other agency can make changes to the Base Contract. Other USACE offices, upon authorization from the USACE Sacramento may issue task orders. The USACE Sacramento Contracting Office may also transfer task orders to other USACE offices for administration authority.
6. The minimum guaranteed amount for the awardee shall be $5,000.00. The minimum guaranteed amount will be paid out only if the successful IDIQ holder is not awarded a task order for the amount of the minimum guarantee or greater within the ordering period of the contract.
7. In the event of any inconsistency between the IDIQ contract and any task order, the terms and conditions of the IDIQ contract shall prevail.
8. Contractor Manpower Reporting: Contractor manpower reporting is applicable at the task order level.
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for USACE a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/

SUBJECT TO AVAILABLE FUNDS
Please note: In accordance with AFARS 5132.702(a)(ii), this is a high priority project with a high probability that the requirement will not be canceled, and will be funded in the FY in which it is advertised. As such this requirement will be advertised prior to funding becoming available to the U.S. Army Corps of Engineers.
The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. The preliminary notice does not commit the Government to an extension.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five
(5) years.
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAR 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at http://www.sba.gov/content/table-small-business-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
