(1) In lieu of submitting cost or pricing data, offerors may submit a written request for exception by submitting the information described in the following subparagraphs. EVALUATION CRITERIA

Section 00 22 00 - Supplementary Instructions

INSTRUCTIONS TO OFFERORS

INSTRUCTIONS TO OFFERORS AND EVALUATION CRITERIA

1. OVERVIEW

This solicitation is for the Design-Build/Design-Bid-Build SATOC for the Building 225 Roof Replacement project at Hill AFB, UT. This solicitation utilizes a two-phase source selection process requiring two separate proposal submittals. The Phase One proposal consists of only non-price technical factors. The Government shall select approximately 3-5 of the most highly qualified offerors from Phase One who will be given the opportunity to submit a Phase-Two proposal that consists of price and technical factors. In accordance with FAR 15.306 the Government does not intend to conduct discussions during either phase of this solicitation, but reserves the right to do so if discussions appear to be in its best interest.

2. BASIS OF CONTRACT AWARD

2.1 ELIGIBILITY FOR CONTRACT AWARD

In accordance with the requirements of Part 9 of the Federal Acquisition Regulation (FAR), no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

2.2 SOURCE SELECTION USING THE “BEST VALUE” TRADE-OFF PROCESS

The Government, during Phase Two, will select the offer that represents the best value to the Government by using the tradeoff process described in FAR Part 15. This process permits tradeoffs between price and technical (“non-price”) factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

2.3 THE TECHNICAL EVALUATION FACTORS

The Government will evaluate each offeror’s technical proposal based on how well the proposal addresses each of the evaluation factors, listed below, and on how well the offeror has performed on related projects through the evaluation of the past performance information provided from references or obtained from other sources. Each of the evaluation factors will be evaluated by the Government and an adjectival rating and risk rating will be determined by consensus of the Government evaluation board for all technical factors other than past performance. The Past

Performance factor will be evaluated by the Government to determine a Performance Confidence Assessment rating.

The evaluation factors correlate directly to the main organizational tabs identified in the proposal submission instructions.

Phase One Proposal

(1) Factor 1: Experience and Capability

(2) Factor 2: Technical Approach

(3) Factor 3: Past Performance

Phase Two Proposal - To be included with the amendment initiating phase two.

(4) Factor 4: Technical Approach

(5) Factor 5: Performance Capability

The Source Selection Authority will consider only the Phase One proposals during Phase One, however both the Phase One and the Phase Two proposals and all the relative strengths and weaknesses will be used in determining the best value to the Government in Phase Two.

2.4 RELATIVE IMPORTANCE OF TECHNICAL EVALUATION FACTORS AND OF

PRICE TO THE TECHNICAL EVALUATION FACTORS

All non-priced evaluation factors, when combined, are significantly more important than cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). If competing technical proposals are determined to be essentially equal, price could become the controlling factor.

The Technical Evaluation Factors are listed below in descending order of importance:

Phase One Factor 1 – Experience and Capability is the most heavily weighted factor.

Factor 2 – Technical Approach is weighted less than Factor 1.

Factor 3 – Past Performance is weighted less than Factor 2.

Phase Two Factor 4 – Technical Approach Factor 5 – Performacne Capability Phase Two criteria details will be supplied once we are that point in the acquisition. *Note:

Phase One criteria will also be used in the ultimate award decision.

3. GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

INSTRUCTIONS TO OFFERORS FOR PHASE ONE PROPOSALS ARE PROVIDED IN

PHASE ONE. THE INSTRUCTIONS TO OFFERORS FOR PHASE TWO WILL BE

PROVIDED AFTER PHASE ONE DURING PHASE TWO.

3.1 GENERAL INSTRUCTIONS – PHASE ONE

3.1.1 The offeror’s conformance with the specified format and submission requirements will be considered during the technical evaluation. Failure to comply with the formatting and/or submission requirements may be seen as indicative of the type of problems that could be expected during contract performance. Lack of conformance may therefore result in a higher risk assessment, in addition to any other impacts on the evaluation. Material omission(s) may cause the technical proposal to be rejected as unacceptable. However, in accordance with FAR 52.215- 1, the Government may waive informalities and minor irregularities in proposals. For example, a failure by a proposed key subcontractor to submit a properly executed letter of commitment may be considered as increasing risk, but will not be considered a proposal deficiency.

3.1.2 Technical proposals which do not provide the specified information in the specified location in accordance with the submission instructions may receive a lower rating. The Government is under no obligation to search for information that is not in the specified location.

3.1.3 Proposals which are generic, vague, or lacking in detail may receive a lower rating.

Responses that are essentially blanket offers of compliance are not adequate substitutes for the detailed and complete technical information necessary to establish that an offeror can meet US Government needs. The proposal submission instructions are written to give prospective contractors, where feasible, an indication of the level of detail desired by the Government. The offeror’s failure to include information that the Government has indicated should be included may result in the proposal receiving a lower rating and/or being found deficient if inadequate detail is provided.

3.1.4 Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit three pages in response to an item with a two page limitation, the information on the first two pages would be evaluated but the information on the third page would not be evaluated. If an offeror were to submit a fold-out sheet (e.g. 11”x17”) in response to a one-page limitation where fold-out sheets were not authorized, only the information that could reasonably have been submitted on one 8-1/2 x 11 inch sheet would be evaluated. If an offeror were to submit three 8- 1/2 x 11 inch pages in response to a one not-to-exceed 11 x 17 inch page limitation, only the information that could reasonably have been submitted on one 11 x 17 inch sheet would be evaluated. If an offeror submitted alternates that were not requested (e.g. key subcontractor), the information will not be evaluated.

3.1.5 The degree of risk to the Government inherent in the offeror’s technical proposal will be a consideration under every evaluation factor.

3.1.6 A “deficiency” is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. “Weakness” means a flaw in a proposal that increases the risk of unsuccessful contract performance. A “significant weakness” is a proposal flaw that appreciably increases the risk of unsuccessful contract performance.

3.1.7 The Government cannot accept an offer with a deficiency in its technical proposal. The term “acceptable” is therefore used in this context to describe a technical proposal that does not contain a deficiency and thus could be accepted by the Government, notwithstanding any weaknesses or significant weaknesses in the proposal. Additionally, multiple significant weaknesses in a proposal may be considered a deficiency.

3.1.8 The Government cannot make award based on a deficient offer. Therefore, a rating of “Unacceptable” under any factor will render the offer ineligible for award, unless the Government elects to enter into discussions with that offeror and all deficiencies are remedied in a revised proposal.

3.1.9 Failure of a proposed key subcontractor to furnish authorization for the Government to discuss its past performance with the offeror will not be considered a proposal deficiency.

However, the Government will not be able to disclose to the offeror any details pertaining to their performance problems that may impact their overall rating.

3.1.10 The Government will utilize a Combined Technical/Risk Rating for some technical factors or subfactors other than past performance. Other technical factors or subfactors other than past performance will receive a rating of either “Acceptable” or “Unacceptable”. The specific Phase One factors and/or subfactors which will receive Combined Technical/Risk Ratings versus “Acceptable” or “Unacceptable” ratings are identified below.

As indicated above and in accordance with Tables 3 and C-1 of the DoD Source Selection Procedures, the evaluation team will assign either Combined Technical/Risk Ratings or an “Acceptable” or “Unacceptable” rating to each of the technical factors and subfactors other than the Past Performance factor. For any factors that contain subfactors, the Government will take into consideration the ratings for each subfactor to determine an overall Combined Technical/Risk Rating at the factor level. The Combined Technical/Risk Ratings, Acceptable/Unacceptable Ratings and their descriptions are in the tables below. Any rating of “Unacceptable” will result in the offer being unawardable unless remedied through discussions.

Unacceptable Proposal does not meet the requirements of the solicitation.

3.1.11 Past Performance Evaluation. The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each offeror's demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. The past performance evaluation will focus on three elements: the recency, relevance and quality of the offeror’s past performance information.

3.1.12 In accordance with Table 4 of the DoD Source Selection Procedures, the Government will assign an adjectival rating commensurate with the level of relevancy of the offerors’ past performance submission. The adjectival past performance relevancy ratings and their descriptions are in the table below.

THE PHASE-ONE TECHNICAL PROPOSAL

4.4.1 Tab 1 of the Technical Proposal: Preface

4.4.1.1 Prime Contractor/Key Subcontractor Introduction

4.4.1.1.1 The Offeror is required to propose a specific project team including key subcontractors for evaluation in response to this Request for Proposals. For purposes of this procurement, the terms “key subcontractors” are used to refer only to the prospective subcontractors whose qualifications, experience, and past performance will be evaluated by the Government as part of the source selection process. For reasons of efficiency, not all of the subcontractors critical to successful post-award contract performance have been included in this group. In order to streamline the proposal submission and evaluation process, please limit your submission to the information specifically requested. Information pertaining to other subcontractors not designated as “key” by the Government will be considered excess and may not be evaluated.

4.4.1.1.2 For the purposes of this procurement, a key subcontractor is defined as any subcontractor performing “key” major work elements for which capability information is required to be submitted for evaluation as part of the Offeror’s Phase-One technical proposal.

The Government has designated the following major work elements as “key”:

- Architect-Engineer Design

- Registered Roofing Consultant (RRC)

4.4.1.1.3 Any changes to key subcontractors in your Phase 2 proposal from your Phase 1 proposal will not be allowed.

4.4.1.1.4 Any subcontractors and outside associates or consultants required by the Contractor in connection with the services covered by the contract will be limited to individuals or firms that were specifically identified and agreed to during negotiations. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these subcontractors, associates, or consultants.

4.4.1.1.5 Provide a brief introduction narrative. Identify and provide the name, DUNS number, address, point of contact e-mail address, and a brief description of the role and authority of each firm that will be involved in performance of this contract at the prime contractor and key subcontractor level. If the proposed prime contractor is a Joint Venture, describe the relationship, role, and authority (to include management authority) of each firm. (Note: If a proposed firm has branch offices, provide information for each individual branch office that will perform work under the contract with its own workforce.) List the major work elements to be self-performed by the offeror’s in-house work force, the major work elements to be performed by each key subcontractor, and any other major work to be subcontracted to other contractors. The submission is limited to two (2) 8-1/2”x11” pages for narrative. In addition to the narrative, the offeror shall submit commitment letters from each of the key subcontractors stating that they will be dedicated to providing their applicable services to the prime contractor for each task order placed against this SATOC.

4.4.1.1.6 The Government will not evaluate the Preface - Prime Contractor/Key Subcontractor Introduction. The purpose of this narrative is to provide a brief introduction for information purposes; however, if applicable, the government reserves the right to consider it throughout the evaluation of the other factors.

4.4.2. Tab 2 of the Technical Proposal: Factor 1 – Experience and Capability:

4.4.2.1 Prime Contractor / Key Subcontractor Example Projects Demonstrating Experience and Capability.

4.4.2.1.1 The offeror shall, submit “example projects” (either commercial, institutional or Government) that demonstrate the prime’s and key subcontractor’s experience working on projects of similar scope, complexity, and magnitude to that of the Summary of Work, draft specifications, and draft drawings attached to this solicitation and capability to successfully perform under the resulting contract.

4.4.2.1.2 The offeror must provide a narrative to explain how the experience and capabilities shown by the example projects are relevant to the draft specifications and drawings attached to this solicitation and show the contractor’s and key subcontractor’s understanding of the risks, work requirements, and approach necessary to successfully complete the resulting contract.

4.4.2.1.3 In doing so, the offeror shall submit at least three (3) but not more than six (6) example projects of similar scope, complexity, and magnitude as the the Summary of Work, draft specifications, and draft drawings attached to this solicitation that individually or collectively demonstrate the following characteristics of the prime contractor and key subcontractors. The narrative shall include the following information:

(1) The offeror’s experience and capabilities as a prime contractor to successfully perform the resulting contract. Explain how the experience and capabilities shown by the example projects are relevant to this project and show the contractor possesses an understanding of the risks and requirements and approach necessary to successfully act as the prime contractor for the resulting contract.

(2) The offeror’s design-build management capability. Explain how the experience and capabilities shown by the example projects are relevant to the Summary of Work, draft specifications, and draft drawings attached to this solicitation and show the contractor’s and/or key subcontractor’s possess an understanding of the risks, and requirements and approach necessary to successfully manage the design-build requirements of the resulting contract.
