The contract specialist will be in the Building Lobby 20 minutes prior to the closing time to accept hand-carried offers.

Offerors who desire to hand-deliver their offers at an earlier time must coordinate with the contract specialist in advance in order to arrange to be met in the Building Lobby by Contracting Division personnel.

Please ensure that all courier and delivery personnel are aware of these procedures.

CONTRACTOR RESPONSIBILITY, PREAWARD SURVEY:

In order to determine a contractor's responsibility for purposes of contract award in accordance with FAR Part 9, the contractor is required to provide a statement regarding previous experience and past performance in performing comparable work, information related to the business organization, financial resources, and/or plant to be used in performing the work (see Section 00 22 00, Preaward Survey Information). All offerors will complete and return the Preaward Survey as part of the Price/Cost proposal. Failure to submit the Pre-award Survey in conjunction with the price proposal will not of itself render the offer unacceptable.

Determination of Contractor Responsibility will be completed in accordance with FAR 9.104-1.

If the contractor or subcontractor does not already have sufficient resources demonstrated in the completed Preaward Survey, acceptable evidence of "the ability to obtain" the required, adequate resources (all of the resources discussed in FAR 9.104-1) normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award to rent, purchase or otherwise acquire the needed facilities, equipment, other resources, or personnel.

The Pre-award Survey as a tool used by the Government in determining responsibility of the offeror is submitted as part of the Price/Cost proposal and is separate from the technical proposal's response to the technical evaluation criteria found later in this section. Some of the information required from the offeror for completion of the Preaward Survey and the technical proposal may be duplicative but it is necessary that the information be provided in full in both places and that the Price/Cost proposal and the Technical proposal be separate documents. DO NOT state, for example, in the technical proposal, "See Price/Cost proposal for past performance information".

PREPARATION OF SUBCONTRACTING PLAN:

(a) See FAR 52.219-9, Section 00 70 00, of this solicitation. Subcontracting Plans will be developed considering only the subcontracts actually to be awarded. Subcontracting Plans are required from other than small businesses if the contract price is over $1,500,000; they are not required from small business firms regardless of the contract price.

(b) For information on the evaluation of subcontracting plans, see Army Federal Acquisition Regulation Supplement, Appendix DD.

(c) Submit questions on the Subcontracting Plan requirements and further instructions on submission of Electronic Subcontracting Reporting System (eSRS) as required by FAR 52.219-9 through the bidder inquiry system.

(d) The Corps of Engineers highly encourages all bidders/offerors to meet the recommended subcontracting goals as follows:

Small Businesses 20%

Small Disadvantaged Businesses 5%

Women-Owned Small Businesses 6%

HUBZone Small Business 3%

Veteran-Owned Small Business 3%

Service Disabled Veteran Owned Small Business 3%

The goals are calculated as a percentage of the TOTAL SUBCONTRACTING DOLLARS, NOT THE TOTAL

CONTRACT AMOUNT.

INDIVIDUAL SURETIES IN SUPPORT OF BID BONDS:

Bidders/offerors utilizing individual sureties in support of a bid bond shall include a Standard Form (SF) 28 (Affidavit of Individual Surety), accompanied by a pledge of acceptable assets from each person acting as an individual surety, and include these with the SF 24 (Bid Bond), and the bid itself (see clause titled "Pledges of Assets," FAR 52.228-11).

Pledges of acceptable assets shall be in the form of (1) evidence of an escrow account and/or (2) a recorded lien on real estate. If this is an IFB, failure to provide pledges of acceptable assets, with the bid, in the specified form, accompanied by a properly executed SF 24 and SF 28, will render the bidder nonresponsible and thus ineligible for award. If this is an RFP, failure to provide required documentation described herein may cause the offeror to be deemed "unacceptable".

ACCEPTANCE OF OFFERS:

A written award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

System for Award Management (SAM) Registration:

It is a requirement that any and all contractors that intend to do business with the government must be registered in the System for Award Management (SAM) database. No contract may be awarded by the government to any contractor who is not registered in SAM. If your company is not registered in SAM, you must register in order to be eligible for any government award.

The following link provides access to the SAM website:

SECTION 00 22 00 - SUPPLEMENTARY INSTRUCTIONS

The following have been modified:

SUPPLEMENTARY INSTRUCTIONS

SOLICITATION SECTIONS PERTAINING TO OFFEROR’S SUBMISSION AND EVALUATION

PROPOSAL BASIS OF AWARD

GENERAL SUBMISSION REQUIREMENTS AND

INSTRUCTIONS, EVALUATIONS,

AND CONTRACT

AWARD

1. OVERVIEW.

a. This solicitation is for the Marysville Ring Levee (MRL) Phase 2A South in Marysville, California. The Contracting Officer will award to the responsible offeror that represents the lowest-price, technically-acceptably proposal, considering all non-price factors described herein.

b. The Government does not intend to conduct discussions or to request revised proposals. However, the Government reserves the right to conduct discussions if it deems such to be in its best interest in accordance with FAR 15.306 and FAR 52.215-1(f)(4).

2. BASIS OF AWARD.

2.1. ELIGIBILITY FOR CONTRACT AWARD

In accordance with the requirements of Part 9 of the Federal Acquisition Regulation (FAR), no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met.

This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

For purposes of this RFP, an “offeror” may include a group of two or more entities that have formed a “contractor team arrangement,” as described in FAR 9.601. In the case that entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently proposed contractor team arrangement, may be considered as a part of the evaluation of the offeror’s proposal, subject to limitations required in the solicitation. An offeror that relies upon the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that offeror under this RFP. As part of their proposal, the offeror must provide a contractor team arrangement signed by all parties, identifying the legal names of all entities and describing the nature of each entity’s relationship (teaming/partnering, joint venture, etc.)

and its role on this project.

2.2. SOURCE SELECTION USING THE LOW-PRICE, TECHNICALLY-ACCEPABLE (LPTA) METHOD

The Government will select the offer that represents the best value to the Government by using the Lowest Price Technically Acceptable (LPTA) method described in FAR Part 15. The Government shall evaluate the lowest‐price offeror first. Should that offeror’s proposal be found to be technically acceptable in all non‐price factors, the Government shall stop evaluations and make direct award to said offeror, assuming their price is found to be fair and reasonable. Should the proposal not be technically acceptable in all non‐price factors, the Government shall evaluate the next lowest‐price offeror. This process will repeat until a technically acceptable offeror is found.

2.3. EVALUATION OF THE PRICE PROPOSAL

a. Price to the Government will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The lowest proposed price will be analyzed for reasonableness.

It may also be analyzed to determine whether it reflects a clear understanding of the requirements; and is consistent with the offeror’s Technical Proposal. Additionally, the lowest offer will be analyzed for unbalanced pricing.

b. Information required to be submitted in the Price Proposal volume in addition to the executed SF 1442 with acknowledgement of amendments and the completed pricing schedule will be used to determine the offeror’s eligibility for contract award in accordance with paragraph 2.1 above (for example, the offeror’s representations and certifications; the bid guarantee; and the offeror’s pre‐award survey information).

2.4. THE TECHNICAL EVALUATION FACTORS

a. The Government will evaluate each offeror’s technical proposal based on the extent it meets the requirements for the solicitation as indicated in the three factors described below. Each of the evaluation factors will be evaluated by the Government and an acceptability rating will be determined by consensus of the Government evaluation board for the technical factors.

b. The evaluation factors correlate directly to the main organizational tabs identified in the proposal submission instructions.

(1) Factor 1: Experience & Capability

(2) Factor 2: Technical and Management Approach

(3) Factor 3: Past Performance

2.5 GENERAL TECHNICAL EVALUATION CRITERIA

a. Technical proposals which do not provide the specified information in the specified location in accordance with the submission instructions may be found to be unacceptable. The Government is under no obligation to search for information that is not in the specified location.

b. Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit three pages in response to an item with a two page limitation, the information on the first two pages would be evaluated but the information on the third page would not be evaluated. If an offeror submitted alternates that were not requested (e.g. key subcontractor), the information will not be evaluated.

c. The Government cannot make award based on an unacceptable offer. Therefore, a rating of “Unacceptable” under any factor will render the offer ineligible for award, unless the Government elects to enter into discussions with that offeror and the revised proposal is found to be acceptable.

d. Technical Ratings:

Technical Acceptable/Unacceptable Ratings

3. GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS FOR A DESIGN- BID - BUILD

PROPOSAL.

3.1 GENERAL INSTRUCTIONS.

3.1.1 Media, Page Size, Margins, Fonts, and Page Limitations.

Submit only the hard-copy paper documents and electronic files specifically authorized elsewhere in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc. Do not include links to information on websites in lieu of incorporating the information physically into the proposal. Except where another size is specifically authorized for a specific submission, use only 8 1/2” x 11” paper. Use at least 1 inch margins, which may include headers and footers. Do not justify the right margin. Ensure that all text and graphics are clearly legible. Do not use a font size smaller than 10, unusual font styles such as script, or condensed fonts. For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. Where authorized, a foldout sheet will count as one page. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are excluded from page limitations.

3.1.2 Proposal Binding.

The preferred method for assembling proposals is a method that enables the rapid insertion or deletion of pages such as three ring binders. Ensure recommended capacity is not exceeded and that pages turn freely. Do not use spring clamps, spiral binding systems, or heat binding systems.

3.1.3 Conditioning of Offer.

Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal volumes. Inclusion of any standard company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the offer is unacceptable and thus ineligible for award. Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of the offer; see “Inquiries”, located in Section 00 21 16, for points of contact. Notwithstanding the above, the Offeror must clearly describe in the proposal cover sheet submitted with the price volume any exceptions, within the offer, to the contractual and/or technical terms and conditions of the solicitation.

3.1.4 Restrictions on Offeror-Provided Information.

“Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can nonetheless be provided to the Government as part of the Offeror’s technical proposal. Offerors that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark the information in accordance with FAR 52.215-1, “Instructions to Offeror – Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data”. Files shall not contain classified data.

3.2 GENERAL PROPOSAL PREPARATION.

The proposal shall be submitted as summarized below and as required by the specifications.

The price volume includes the signed offer and the Offeror’s proposed line-item prices and overall price. The technical volume includes all required information relating to the “non-price” evaluation factors. The two volumes must be submitted as separate, physically distinct volumes. Both volumes must be received at the location shown in Block 8 of Standard Form 1442, not later than the date and time specified in Block 13 of Standard Form 1442. The information in the two volumes is evaluated separately and independently. Therefore, all information intended by the Offeror to be evaluated as part of the price volume must be contained within the price volume. All information intended by the Offeror to be evaluated as part of the technical volume must be submitted as part of the technical volume. Do not merely cross-reference similar material between the technical and price volumes.

3.2.1 Marking of Proposal Volumes.

Mark each volume as either the “Price Volume” or the “Technical Volume”. In addition, mark the outside front cover of each volume with the project title and location, solicitation number, name and address of the Offeror, and volume copy number. (Markings which identify the Offeror are not required on either the back cover or on the spine/binding.)

3. FACTOR 3 – Past Performance

4.3 Tab 1 of the Technical Proposal: Factor 1 –Experience & Capability

4.3.1 Submission Requirements

Offeror shall provide the information requested below to demonstrate the required experience and capability to construct permanent seepage cutoff walls using the Deep Mixing Methods required for this contract. Keep in mind that the contract requires that the Offeror self-perform the Deep Mixing Methods portion of this contract scope. Therefore, only submit information that supports proof of the required experience and capability.

a. Self-Performance Plan for this Contract: State how the Offeror intends to self-perform the cutoff wall portion of this contract. For example, if the Offeror intends to use its own employees so state. If the Offeror is a partnership entity or a joint venture entity then state whether the partnership entity has its own employees that will perform the cutoff wall portion, but if the Offeror intends that a partner entity or joint venture entity will perform the cutoff wall portion with that entity’s employees so state.

b. Self-Performance of Example Projects: For the entity or entities that will self-perform any part of the cutoff wall portion of this contract, submit a minimum of two but no more than three example projects demonstrating the self-performance experience of the entity or entities that will be self-performing the cutoff wall portion of this contract. Only submit example projects where the cutoff wall work was self-performed by the same entities. If an entity underwent a change in form, for example if there was a prior merger, or change in legal form, then the burden is on the Offeror to prove that the current entity should be credited with the former entity’s experience. However, an entity’s current or former officer’s or employees experience and capability separate and apart from the entity’s experience will not be imputed to the entity. For example, if the President of the Offeror entity has personal experience self-performing work with a former employer, the Offeror entity will not be allowed to take credit for the President’s personal experience with the former employer. If the Offeror is a corporation it should only submit examples where the corporation self-performed the cutoff wall portion of the example project. For another example, if the Offeror is a joint venture and only one of the joint venture partners is intending to self-perform the cutoff wall portion of this contract, then the Offeror should only submit example projects were the cutoff wall scope of those example projects was self-performed by that entity.

c. Separate Example Projects: Submit example projects that are for distinct different sites. A project example will be considered as only one example project even if there were multiple cutoff walls performed at the same site. However the example may include all of the cutoff wall work for that site so long as the cumulative scope was performed at the same site regardless of whether the work was performed under multiple contracts or task orders.

d. Deep Mixing Methods: State the methodology utilized for each example project. Only submit example projects for construction of a permanent seepage cutoff wall constructed using Deep Mixing Methods (DMM) classified as either: Wet Rotary Shaft (WRS), Wet Rotary End (WRE), Wet Rotary and Jet End (WJE), or Wet Vertical Panel (WVP); as described in the Federal Highway Administration Design Manual: Deep Mixing For Embankment and Foundation Support. Methods that do not use mechanical soil cutting or mixing are NOT acceptable. Levee work is not a requirement to be acceptable so the work need not be on an embankment and can be on a non-embankment site.

However, each example project must be a permanent vertical seepage cutoff wall using a Deep Mixing Method.

e. Time of the Example Projects: Only submit example project work that was completed within the last 10 years from the date of this solicitation. Do not submit example projects that are not complete or substantially complete. For this purpose, “substantially complete” means that only the punch list items remains for project’s acceptance or that the majority of the elements of the project have been turned over to the customer for beneficial occupancy.

f. Cutoff Wall Materials: Only submit example projects where the cutoff wall work was soil-cement-bentonite (SCB) or soil-cement.

g. Cutoff Wall Maximum Depth: Submit at least two example projects where the maximum cutoff wall depth was no less than 60 feet deep.

h. Cutoff Wall Surface Area: Submit at least two example projects where the cumulative project cutoff wall surface area was no less than 60,000 sq. ft.

i. Cutoff Wall Thickness: Submit at least two example projects where the average cutoff wall thickness was not less than 24 inches (as measured by the minimum width of the soil mixing apparatus).

j. Hydraulic Conductivity: Submit at least two example projects where the hydraulic conductivity of the cutoff wall was no greater than 1 x 10-6 cm/sec.

k. Unconfined Compressive Strength: Submit at least two example projects where the unconfined compressive strength of the cuttoff wall was no less than 30 psi at 28 days.

The following minimum information shall be provided for each example project submitted. Start with “1” for the first example project and number consecutively.

o Contract Number and Awarded Prime Contractor Name: Provide contract number assigned by the Procuring Contracting Office and the name of the Prime Contractor that was awarded the contract.

o Title and Location: Title and location of project or contract.

o Month and Year Project Work Commenced and Month and Year Project was Substantially Completed.

o Project Owner: Project owner or user, such as a government agency or installation, an institution, or corporation or private individual.

o Point of Contact: Provide name of a person associated with the project owner or the organization that is very familiar with the project and the Offeror’s performance.

o Point of Contact Telephone Number: Include area code and email address.

o Provide copies of project records (e.g., page(s) from the project cutoff wall specifications, plans, as-builts, or other documentation) that reasonably verifies satisfaction of each of the requirements needed for acceptance in requirements f – k, stated earlier; e.g., cutoff wall materials (f), cutoff wall maximum depth (g), etc.

Formatting and Other Restrictions.

Start the information for each example project on a new page. There is no page limit for copies of the actual page(s) of the project records for the example projects; for example for the example cutoff wall specifications, plans, as-builts, and other documents.

4.3.2 Evaluation Criteria

This is how the Government will evaluate the Offeror’s submission for Factor 1.

The Government will evaluate the example projects submissions for Factor 1 as discussed below.

a. Self-Performance Plan for this Contract. The Government will evaluate the proposal and identify the the entities within the Offeror’s organization team that will self-perform the cutoff wall portion of this contract.

b. Self-Performance of Example Projects. The Government will only accept and give credit for example projects where the cutoff wall portion of the example project was self-performed by the entities identified in evaluation step (a).

c. Separate Example Projects. Example projects that are for distinct different sites will be treated as separate examples for consideration and acceptance.

d. Deep Mixing Methods. Only example projects for construction of a permanent seepage cutoff walls constructed using Deep Mixing Methods (DMM) classified as either: Wet Rotary Shaft (WRS), Wet Rotary End (WRE), Wet Rotary and Jet End (WJE), or Wet Vertical Panel (WVP); as described in the Federal Highway Administration Design Manual: Deep Mixing For Embankment and Foundation Support will be acceptable. Methods that do not use mechanical soil cutting or mixing are NOT acceptable. Levee work is not a requirement to be acceptable.

e. Time of the Example Projects. Only example project work that were substantially completed within 10 years from date of this solicitation will be acceptable.

f. Cutoff Wall Materials. Only example projects where the cutoff wall work was soil-cement-bentonite (SCB) or soil-cement will be acceptable.

g. Cutoff Wall Maximum Depth. To be acceptable at least two example projects where the maximum cutoff wall depth was no less than 60 feet deep must have been submitted and accepted.

h. Cutoff Wall Surface Area. To be acceptable at least two example projects where the cumulative project cutoff wall surface area was no less than 60,000 sq. ft. must have been submitted and accepted.

i. Cutoff Wall Thickness. To be acceptable at least two example projects where the average cutoff wall thickness was not less than 24 inches (as measured by the minimum width of the soil mixing apparatus) must have been submitted and accepted.

j. Hydraulic Conductivity. To be acceptable at least two example projects where the hydraulic Conductivity of the cutoff wall was no greater than 1 x 10-6 cm/sec must have been submitted and accepted.

k. Unconfined Compressive Strength. To be acceptable at least two example projects where the unconfined compressive strength of the cuttoff wall was no less than 30 psi at 28 days must have been submitted and accepted.
