As written the scope of work is very unclear. Are we to include the cost of developing a new staging area, installing additional fencing, relocating the Contracting Officer's Office (and we assume the contractor's facilities), moving onsite equipment to a new area and then moving everything back to its original area on the project? And, relative to Option 3, what is the meaning of the last sentence in paragraph 1.5.1.1 that reads "Payment also includes full compensation for all cost associated with mobilization (60 percent) and demobilization (40 percent)"? Are we to duplicate our bid price for CLIN 0001 in addition to the costs for other work specified in CLIN 3001 for each of the 5 occurrences?

1-1 Government Response. Please reference Section 00 70 00, DFARS 252.236-7004 on page 68 of 75 which addresses Payment for Mobilization and Demobilization. The risk for discovery of cultural resources is higher in the Sacramento Valley including Hamilton City. In the event of a cultural resource discovery, the Government may exercise this option to require the contractor to move from one portion of the project site to another at the contractor's proposed price. Most small business contractors cannot justify the cost to employee a full time person that is qualified to serve as a SSHO on this project. And if they do, and that person resigns the position or is dismissed, the contractor most certainly would have to replace that person with an independent contractor or a person hired through an employment service company. Will USACE accept a SSHO that is not on the contractor's payroll?

The second sentence of the third paragraph of this section stages that "The contractor must perform additional pre-construction sampling and testing of the borrow sites to further define their suitability for use on this project."

However, the specification does not state how many samples are to be taken. We request that the frequency of sampling in the borrow areas be defined. Because the number of samples and tests may not be quantifiable at this time we suggest that a CLIN be added to pay for each sample taken and tested.

1-1 Government Response. Section 31 00 00 - 11, para. 2.2.1 states, "The Government has performed limited testing... The contractor must perform additional testing... to further define their suitability for use on this project." This intent is to require the contractor to take the tests necessary to determine suitability.

When will the decision be made as to when the borrow material is usable or not? The specification for embankment material (first paragraph of this specification) is very restrictive. The contractor will bear a lot of risk if the quality of the borrow material is inconsistent and the material is not approved until placed in embankment and tested.

If the contractor encounters pockets of unusable material that were not identified by the specified sampling program he and the Government will not know that until after the material is placed in the embankment and the QC tests are complete. That could entail removal of previously placed embankment and open up the subject of how to dispose of the unusable material.

We request that the specification be changed to allow for the embankment material to be accepted based on the results of the testing performed in the borrow areas.

We request that the specification define the minimum size, or quantity, of contiguous borrow area the contractor would have to excavate. Also, the excavation of pockets of material would result in a lot of additional work to re-grade the areas to drain properly.

Just paying for the additional excavation under the CLIN for Observation Trench Excavation would not be justifiable because the type of equipment and the productivity would most likely be much different than the planned work. In lieu of paying for the additional excavation by modification you could add a CLIN for "Over-excavation of Observation Trench".

Assuming through no fault of the contractor, if the Government's geotechnical engineer determines that the prepared subgrade is not appropriate for supporting the new fill, will the work required to correct the condition, and then re-compact and re-test the subgrade, be paid for as a change given that there is no pay item for such work?

• 31 11 00 – 1.4 IRRIGATION SYSTEMS and -3.6 IRRIGATION SYSTEMS REMOVAL In the specifications and on Plan Sheets C-101 through C-113 reference is made to existing irrigation systems that have to be removed in their entirety. Given that there is no possible way for a bidder to estimate the size, length, and depth of the existing irrigation systems we request that the Government more clearly define this work and how it is to be paid for.

A typical detail for the work is needed to define the excavation and backfill limits depending on the size of the pipe encountered. We also believe that the Government should add a CLIN to quantify the excavation and backfill quantities so that the contractor can be fairly compensated for the actual work completed.

As of today, August 2, 2017, we have not received answers to any RFIs. In accordance with FAR, Offerors shall be provided adequate time to review the RFI responses and finalize an approach based on the answers. In order to minimize risk to the Government, we respectfully request that the government postpone the proposal due date 14-calendar days from the day all RFIs are answered. This will provide time for Government answers, as well as allowing Offerors time to review and adjust proposals based on changes resulting from RFI answers.

One thing that is confusing is the definition of a "Day". If the contractor's crew is actively working and the Contracting Officer stops that crew during the work shift for 4 hours until the CO orders the work to resume is that a day or a partial day or not day at all under this CLIN?

Another possibility is that a "day" for the purposes of this CLIN is intended to be for a 24 hour period in which the CO has ordered that no work is to be performed at all.

The time frame stated only allows offerors 6 working days to review and adjust to RFI answers, request subcontractor bids, receive competitive quotes, wrap-up the cost estimate, and prepare and ship the package, due on August 15, 2017, in light of this, we would respectively request a 14-day extension for this proposal to allow a more realistic and reasonable time frame for preparation and shipping of the proposal.

1-1 Government Response. Please refer to the response for Inquiry ID 7091140. For most solicitations we issue, the FAR requires that solicitations be issued for a minimum of 30 days. Mission requirements as well as the scope, size and complexity of the project factor into the determination as to whether or not a solicitation should be issued for greater than 30 days. We consider these aspects well in advance of issuing the solicitation as the FAR requires that every acquisition have an acquisition plan. Considering those aspects of this project, we have determined 30 days to be reasonable. Historically, we close ProjNET for submission of new inquiries 10 days prior to proposal due date. Generally speaking, we have found great success with these timeframes. While we are sensitive to the pressures offerors are under to submit timely proposals, in this case, we have determined that it is not in the Government's best interest to extend the proposal due date at this time. We interpret this statement that these borrow areas (assuming that the required testing demonstrates that these materials are satisfactory) are to be depleted in their entirety before utilizing the Floodplain Borrow Area. Please verify whether this interpretation is correct. If not correct, please clarify the intent of this note.
