1.5 GENERAL SAFETY REQUIREMENTS
1.5.1 General
For information regarding specific Safety Requirements see Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS. Refer to EM 385-1-1, Contract Clauses, and the Occupational Safety and Health Act (OSHA) Standards for Construction 29 CFR 1926; General Industry Standards 29 CFR 1910; and the National Fire Protection Association Codes are applicable to this
01 00 00 - 4 contract. In case of conflict the most stringent requirement of the standards is applicable.
1.5.2 The Prime Contractor's Superintendent
The Prime Contractor's superintendent must take an active role in enforcing the safety requirements by participation in safety conferences, hazard analysis (see below), tool box meetings, walk-through inspections, correction of violations, etc., and including that of the subcontractor's work.
1.5.3 Violations
If recurring violations and/or gross violation indicate that the safety performance is unsatisfactory, corrective action must be taken as directed, and at the discretion of the Contracting Officer the retention or some part thereof will be withheld from the progress payment until corrective action has been completed.
1.6 SECURITY
The project location may be particularly subject to vandalism. Materials left on-site are done so at the Contractors' risk, and if lost, at the Contractor's expense. Provide security for all the work. Particularly, construct and maintain the signs, including but not limited to, those necessary for Public Safety and Traffic Control, as specified in Section 6 of the General Provisions. Replace those signs damaged or destroyed due to vandalism at no additional expense to the Government.
1.7 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
1.7.1 Monthly Anticipated Adverse Weather Delays
The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

Upon execution of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.
Refer to ER 415-1-15.
Flow conditions in the Sacramento River will not be considered as adverse or unusually severe weather and no time extension to the contract will be granted to the Contractor for this circumstance.
1.7.2 Operations During the Flood Season
Construction activities are permitted during the flood season (November 1 to April 15), weather permitting.
1.8 EQUIPMENT DATA FORM
Furnish CESPK FORM 450 for all necessary equipment to perform work requiring adjustment of contract price and must submit these forms with the modification proposals. A sample form is at the end of this section.
1.9 HOURS OF OPERATION
Construction activities on weekdays Monday through Friday, including equipment warm-up, will be limited to daylight hours but not earlier than 7:00 A.M. and not later than 7:00 P.M. Construction activities on Saturdays, including equipment warm-up, will be limited to daylight hours, but not earlier than 8:00 A.M. and not later than 6:00 P.M. The Government must be given 48 hours notice prior to working on any Saturday.
Construction activities on Sunday are limited to daylight hours for scheduled maintenance only, but not earlier than 9:00 AM and not later than 6:00 PM. Construction activities are not permitted on Federal holidays. A list of Federal holidays for any given year can be found at:
https://www.opm.gov/policy-data-oversight/snow-dismissal-procedures/federal-holidays Submit requests for work hour variations a minimum 10 working days prior to the desired change to Contracting Officer and thier represtative for approval. Work hours are the discretion of the local jurisdiction therefore additional limits on hours operations may be imposed during this construction event. The Contractor will be notified a minimum of 10 working days prior to such changes.
1.10 BID ITEM OVERRUN
Throughout the contract (at a minimum, every five calendar days), monitor placement or installation of unit price items (if any) with respect to the original estimated quantities shown in the contract. If placement or
01 00 00 - 6 installation indicates a possible overrun with respect to the original estimated quantities shown in the contract, immediately provide written notification to the Contracting Officer with revised total estimated quantities.
1.11 WARRANTY OF CONSTRUCTION
(a) Performance Bond.
(1) It is understood that the Contractor's Performance Bond will remain effective throughout the life of all warranties and warranty extensions.
(2) In the event the Contractor or his designated representative fails to commence and diligently pursue any work required under the Warranty of Construction Section of the Technical Provisions within a reasonable time after receipt of written notification pursuant to the requirements thereof, the Contracting Officer has a right to demand that said work be performed under the Performance Bond by making written notice on the surety. If the surety fails or refuses to perform the obligation it assumed under the Performance Bond, the Contracting Officer must have the work performed by others, and after completion of the work, make demand for reimbursement of any or all expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.
(3) Warranty repair work which arises to threaten the health or safety of personnel, the physical safety of property or equipment, or which impairs operations, habitability of living spaces, etc., will be handled by the Contractor on an immediate basis as directed verbally by the Contracting Officer or his authorized representative. Written verification will follow verbal instructions. Failure of the Contractor to respond as verbally directed will be cause for the Contracting Officer or his authorized representative to have the warranty repair work performed by others and to proceed against the Contractor as outlined in the paragraph b. above.
(b) Pre-Warranty Conference. Prior to contract completion and at a time designated by the Contracting Officer or his authorized representative, meet with the Contracting Officer to develop a mutual understanding with respect to the requirements of SECTION 00 73 00 SUPPLEMENTARY CONDITIONS, Paragraph, WARRANTY OF CONSTRUCTION, of this specification. Communication procedures for Contractor notification of warranty defects, priorities with respect to the type of defect, reasonable time required for Contractor response, and other details deemed necessary by the Contracting Officer or his authorized representative for the execution of the construction warranty will be established/reviewed at this meeting.
In connection with these requirements and at the time of the Contractor's quality control completion inspection, the Contractor will furnish the name, telephone number and address of a licensed and bonded company which is authorized to initiate and pursue warranty work action on behalf of the Contractor. This single point of contact will be located within the local service area of the warranted construction, will be continuously available, and will be responsive to Government inquiry on warranty work action and status. This requirement does not
01 00 00 - 7 relieve the Contractor of any of his responsibilities in connection with Section 00 73 00 SUPPLEMENTARY CONDITIONS, Paragraph, WARRANTY OF
CONSTRUCTION.
(c) Equipment Warranty Identification Tags. Provide warranty identification tags on all equipment installed under this contract.
(d) Contractor's Response to Warranty Service Requirements. The following warranty service requirements are applicable to this contract.
Following notification by the Contracting Officer or the Contracting Officer's Representative, respond to a warranty service requirement identified by the Contracting Officer's Representative in accordance with the "Warranty Service Priority List" of this program. This list prioritizes warranty work into the categories:
First Priority 1A Perform on site inspection to evaluate situation, determine course of action, initiate work within 24 hours and work continuously to completion or relief.
Second Priority 1B Perform on site inspection to evaluate situation, determine course of action, initiate work within 48 hours and work continuously to completion of relief.
Third Priority All other work to be initiated within 5 work days and work continuously to completion or relief.
The "Warranty Service Priority List" must be compiled by the Contractor and approved by the Contracting Officer.
Should parts be required to complete the work and the parts are not immediately available provide the Contracting Officer's Representative with firm written proposals for emergency alternatives and temporary repairs for Government participation within 12 hours after arrival at the job site, and provide emergency relief until the required parts are available on site for the Contractor to perform permanent warranty repair. Include a firm date and time that the required parts must be available on site to complete the permanent warranty repair. The Contracting Officer's Representative will evaluate the proposed alternatives and negotiate the alternative considered to be in the best interest of the Government to reduce the impact of the emergency condition. Alternatives considered by the Contracting Officer's Representative will include the alternative for the Contractor to "Do Nothing" while waiting until the required parts are available to perform permanent warranty repair. Negotiating a proposal which will require Government participation and the expenditure of Government funds must constitute a separate procurement action by the using service.
1.12 NON CONTRACT WORK
Do not perform any work or erect any structure for third parties, landowners or otherwise, within the limits of the rights-of-way without prior approval of the Contracting Officer.
1.13 DAMAGE TO ROADS
Preserve and protect all existing private or project access or right-of-way roads. At the completion of work and prior to the Contractor leaving the project, he must restore to pre-project conditions all such roads and
01 00 00 - 8 provide documentation of Haul Road Repairs. Repairs must include replacement of base rock and/or surface treatment as required. Refer also to paragraph PROTECTION OF TRAFFIC in section 01 50 00 TEMPORARY
CONSTRUCTION FACILITIES AND CONTROLS.
1.13.1 Documentation Regarding Potential Damage to Access Routes
1.13.1.1 Preconstruction Access Road Survey
Complete and submit a Preconstruction Access/Haul Road Survey including digital video and digital photographs of all public, private, and project access or right-of-way roads. Submit two copies of the survey, the digital video, and the digital photographs before the start of construction operations. Video must be digital format.
1.13.1.2 Post-Construction Access Road Survey
After completion of construction of the project, submit a Post-Construction Access/Haul Road Survey including digital video and digital photographs of the same area where Preconstruction digital video and digital photographs were taken. Submit two copies of the survey, the digital video, and digital photographs.
1.14 SPECIAL SURVEY PROCEDURES
1.14.1 Survey Services
Perform all survey services in accordance with EM 1110-1-1005. This publication can be downloaded from: EM_1110-1-1005.pdf
1.14.2 Survey Supervision and Scheduling
Submit a Preconstruction Quantity Survey Plan of the proposed preconstruction quantity survey. All survey services must be performed by or under the direct supervision of a person licensed to practice surveying in the State of California. Prior to commencement of survey work, submit in writing the name and license number of the person who will perform the required surveys. Keep field notes in accordance with DM 4-805-10. The accuracy of the survey must be third order or better.
1.14.3 Personnel Plan
Plan stating the specific personnel names, license numbers, and specific tasks of those who will be performing the Preconstruction Survey Cross Sections, plus the procedures to be followed in conducting the Preconstruction Survey Cross Sections.
1.14.4 Special Survey Conditions - Preconstruction Survey Cross Sections
Survey cross sections along the entire length of the construction site, including all borrow areas planned to be used, and submit Preconstruction Survey Cross Sections before construction begins. Use these Preconstruction Survey Cross Sections to reflect existing ground before any construction activities begin and when measuring pay quantities for clearing and grubbing, topsoil stripping, excavation, riprap, and embankment fill, and grass seeding and erosion control. Use the Preconstruction Survey Cross Sections for measurement of work specified in SECTION 31 00 00 EARTHWORK. Survey cross sections perpendicular to the Construction Reference Line. Survey the cross sections within 2 feet of the locations
01 00 00 - 9 specified herein. Take the Preconstruction Survey Cross Sections at 50 foot intervals along the Construction Reference Lines shown on the drawings. Perform a profile survey of the top of the levee. Use this survey to show the elevations of the top of the levee shown on the plan and profile sheets.
Cross sections along the Construction Reference Line must extend from 25 feet landward of the landside levee toe, across the Construction Reference Line, and continue out to a point at least 25 feet waterward of the waterside toe of the levee.
Elevations must be taken at inflection points but at not more than 10 feet intervals. Horizontal and vertical accuracy must be to the nearest 0.1 foot. Horizontal locations must not deviate from the alignment of the cross section line by more than 1 foot. All cross sections must be plotted as viewed in the downstream direction. The survey data must be provided to the Contracting Officer on IBM-formatted CD ROM disks containing survey control and cross section points defined in the form of north and east coordinates and their elevations (i.e. X, Y and Z). Horizontal control must be referenced to the California Zone II, North American Datum (NAD) of 1983. Vertical control must be the National Geodetic Vertical Datum (NGVD) of 1929. Survey data must be provided in english units in either Microstation V8i 3D design file format (*.DGN), or AutoCAD 2013 or newer format (*.DWG). All data collected as part of the survey and all data used in the generation of digital terrain model surfaces (including, but not limited to point files and landxml files) for comparison to post construction surveys and generation of quantities must be included in the submittal.
Provide 2 CD/DVD of the electronic survey data files (including, but not limited to, CADD files, point data, etc.), and 2 sets of the cross section data, plotted as viewed in the downstream direction, with a 20 horizontal X 10 vertical grid, on a standard ANSI D size drawing sheet, at a scale of 1:10, horizontal and vertical. Preparing any needed layout drawings.
Black line prints from PDF files are acceptable.
If the results of the Preconstruction Survey Cross Sections show significant (15 percent or more) erosion than on the contract drawings, meet with the Contracting Officer to resolve the differences and use the Preconstruction Survey Cross Sections results to adjust designs as necessary.
1.14.5 Post Construction Surveys
Each post construction survey must be of the same scope as its corresponding preconstruction survey. Survey cross sections must be taken at the same interval and locations and must cover the same extents as the preconstruction survey cross sections. All data collected as part of each survey, used to generate quantities, and generated in the preparation of the submittal must be provided to the government.
1.15 SPECIAL CONSTRUCTION CONDITIONS
1.15.1 Points of Contact for River Discharge Data
The site is subjected to regulated discharges on the Sacramento River.
Contact the following individual with the U.S. Bureau of Reclamation to obtain flow forecasting information for planning construction activities.
The forecasts are updated monthly toward the middle of the month and
01 00 00 - 10 provide monthly average values. Daily flows are subject to variability in response to changing water demands.

1.15.2 River Gaging Stations
Water surface elevation data is available for the stream gages operated by the Department of Water Resources. Obtain data from the California Department of Water Resources, California Data Exchange Center (CDEC) web site http://cdec.water.ca.gov. River forecasts available on the CDEC Website address is http://cdec.water.ca.gov/rivforecasts.html
The Government does not guarantee the reliability or accuracy of the hydrographs and will assume no responsibility for any deductions, conclusions, or interpretations that may be made from them. Undertake any such studies that are deemed necessary to assess the reliability and accuracy of the information presented in the hydrographs.
1.15.3 Groundwater
Groundwater at the site is expected to be near the same level as the Sacramento River water surface except when there is a rapid rise or decrease in the river, where the groundwater level will eventually follow by some unknown period of time.
1.15.4 Project Security and Public Safety
Require all visitors to abide by all construction site safety requirements. Notify the Contracting Officer 48 hours before the commencement of any physical activities on the site. Site security and the protection of equipment and materials is the responsibility of the Contractor for the duration of the contract.
1.15.5 Cooperation With Others
Provide a weekly update of planned construction activities and traffic operations for distribution by the Government to local agricultural stakeholders and landowners within and adjacent to the project site.
Annual harvest operations from late summer through the end of October are expected to produce significant agricultural equipment and truck traffic immediately adjacent to the project site including along designated haul/access routes. Stay within the designated haul/access routes as shown on the drawings. The designated haul/access routes are not project exclusive and the construction operation must not interfere with others.

1.15.5.1 Agricultural Spraying
The agricultural land surrounding the project is subject to spraying of different chemicals by multiple application methods (i.e. land based or aerial spraying) throughout the year. Coordinate with the Agricultural Spray contact provided below for agricultural spray schedules, locations, and buffer zones of applied spray. Plan and adjust work activities

1.15.5.2 Other Government Contractors
Other Government Contractors will be working in the vicinity of the project site and will require access to the land on the waterside of the setback levee. These other Contractors will be performing orchard removal and regular spraying for weed control purposes in the areas waterward of the Limits of Work shown in the Drawings. Coordinate with these other Government Contractors and gauranteee their access through the project site to their features of work.
1.16 MEETINGS
There may be other meetings required by this contract or unforeseen circumstances not indicated below.
1.16.1 Preconstruction Meetings
Arrange a preconstruction meeting as specified in Contract Clause 52.236-26 Preconstruction Conference.
1.16.2 Weekly Coordination Meetings
Schedule, prepare and distribute agenda and administer the weekly coordination meeting throughout of the project. The purpose of these meetings is to review the actual progress and planned activities for the upcoming two weeks. The weekly progress meeting will address the status of the SWPPP, Environmental concerns, RFI's and Submittals. The meeting is to be facilitated by the Contractor's CQCM, and attended by the superintendent, SSHO, USACE Engineering and construction field personnel, and any partners or sponsors who would like to attend. Meeting attendes will be coordinated with the Contracting Officer's Representative.
1.16.3 Contractor Quality Control Coordination Meeting
See section 01 45 00 QUALITY CONTROL regarding the obligation to set up the Quality Control Coordination Meeting.
1.16.4 Preconstruction Safety Conference
See SECTION 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS Paragraph titled Site Safety and Health Officer (SSHO) regarding the obligation to set up the Preconstruction Safety Conference and hold safety meetings.
1.17 WATER
Water and associated equipment required for dust control must be supplied by water trucks.

1.18 UTILITIES
Plan to accommodate the relocation, removal, or raising of known electrical utilities by Pacific Gas & Electric (PG&E) concurrently with setback levee construction. All PG&E relocations are expected to occur within the first half of the contract period of performance. Immediately notify the Contracting Officer in writing of any unidentified utilities encountered that may interfere with construction operations, within the construction limits. Identify the location of discovered utilities that were not shown on the plans and not visible as of the date of this contract. Notify the Contracting Officer at least 30 days in advance of the date on which work will be started which requires the removal or relocation of such unidentified utilities or private improvements. Care must be taken to preserve and protect any such improvements from injury or damage during construction operations. Construction operations which cause damages to personal property, utilities, public lands or interference of services must be fully reimbursed by the Contractor. Should such damage be found to have been caused without the Contractor's fault or negligence an equitable adjustment in the amount due under the contract will be made under the applicable CONTRACT CLAUSES.
1.18.1 Pacific Gas and Electric (PG&E)
Prior to commencing any work in the vicinity of the PG&E 10" natural gas transmission pipeline, provide to both the Government and PG&E an equipment list detailing data on all equipment planned to be operated in the vicinity of the pipeline. Depending on the equipment planned for use, more stringent coverage requirements than those given on the Drawings may be imposed by PG&E over their pipeline. Compliance with more stringent requirements, should they be necessary, is mandatory.
1.19 DESIGNATED BORROW SITES
Embankment fill and random fill, as defined in section 31 00 00 EARTHWORK, must be acquired from the designated Borrow Areas A, B, C, D, and E and the GCID Intake Facility Borrow Area shown on the drawings to the maximum extent possible. Once those borrow areas are depleted, fill material may be acquired from the designated Floodplain Borrow Areas, as shown on the Drawings.
1.20 COMMERCIAL BORROW SITE
In the case that the designated borrow sites defined in section 31 00 00 EARTHWORK and as shown on the Drawings do not provide adequate amounts of borrow for completion of the project, locate a reliable commercial borrow site, and secure Import Fill, as defined in section 31 00 00 EARTHWORK, as needed for the project. Comply with requirements defined in the plans, specifications, and contract documents in the selection and use of the commercial borrow site and materials. Comply with all applicable local, state, and federal regulations in the selection and use of the borrow site and activities associated with removal of borrow material.
Prior to beginning construction work submit a Borrow Source Plan to the Contracting Officer. Include the location of borrow site(s), as well as copies of borrow site current and valid NEPA/CEQA documentation, applicable Federal, State and Local permits. Provide certification to the Contracting Officer that the borrow material is free from contaminants and is suitable for use on the project. Prepare and submit the Borrow Source Plan at no additional cost to the Government.

1.21 COMMERCIAL DISPOSAL SITE
Locate a reliable commercial disposal site, and secure a disposal site as needed for the project. The disposal site must be in compliance with the requirements defined in the plans, specifications, and contract documents.
Disposal site and disposal activities must be in compliance with all applicable local, state, and federal regulations.
Prior to beginning construction work submit a Disposal Site Plan to the Contracting Officer. Include the location of disposal site(s), as well as copies of disposal site current and valid NEPA/CEQA documentation, applicable Federal, State and Local permits. Prepare and submit the Disposal Site Plan at no additional cost to the Government.
1.22 HAUL ROUTE PLAN
Submit a Haul Route Plan prior to beginning work. This plan must include offices, material storage areas and structures and the access routes to these areas. Indicate haul routes from the sites to major highways. Show all required traffic signs, special limits, warning devices, lighting and other such safety devices required by EM 385-1-1, OSHA, local cities and CALTRANS (on state roads), and any required permits for use of public roads from local and state agencies. Provide alternate routes in the plan for when interferences block designated haul routes. Revise and resubmit the plan if the haul routes being used are not as shown on the plan.
Require all visitors to abide by all construction site safety requirements. Notify the Corps Contracting Officer 48 hours before the commencement of any physical activities on the site. Work for sections such as Demolition, Grading, Tree Removal and other sections with excavations must be coordinated with this plan.
PART 2 PRODUCTS
2.1 GOVERNMENT FURNISHED MATERIALS
The Government will provide an CD at the preconstruction conference that contains the following:
a. One set of electronic CADD drawing files in the specified software and format, revised to reflect all amendments,
b. A submittal register data file in comma separated value (CSV) format for import into the Resident Management System (RMS).
c. Informational copies of the contract specifications and drawings, the original solicitation drawings and specifications, plus all amendments in Portable Data Format (PDF).

Payment items for the work of this contract for which contract job payments will be made are listed in the BID SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, must be included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed must constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, submittal procedures, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
1.2.1 Mobilization and Demobilization
1.2.1.1 Payment
Payment will be made for Contract Line Item Number (CLIN) 0001 "MOBILIZATION AND DEMOBILIZATION" which price will include costs associated with mobilization and demobilization, as defined in Special Clause PAYMENT FOR MOBILIZATION AND DEMOBILIZATION, including but not limited to: staging areas, drilling, general prep work, field offices and for all other work covered by these specifications. Measure the topsoil stripping for payment by use of the average end area method. The basis of measurement will be a survey of the area after clearing and grubbing and prior to topsoil stripping, and a second survey of the same area after the completion of the topsoil stripping.
Measurement must include the temporary stockpile and spreading/re-use of the stripped material. Over excavation and topsoil stripping performed for

1.3.8.3 Unit of Measure

1.3.9 Observation Trench Excavation
1.3.9.1 Payment
Payment will be made for CLIN 0012 and 1012 "OBSERVATION TRENCH EXCAVATION" which price will include costs associated with providing all labor, equipment, tools, supplies, and incidentals necessary to excavate the OBSERVATION TRENCH EXCAVATION as specified in section 31 00 00 EARTHWORK and as shown on the Drawings.
1.3.9.2 Measurement
Measure the Observation Trench Excavation for payment by use of the average end area method. The basis of measurement will be a survey of the area after clearing, grubbing, and stripping and prior to the excavation of the Observation trench and a second survey of the same area after the excavation of the Observation trench. Survey cross sections must be taken in sufficient numbers to account for geometric changes in the cross sections but not less than 100-foot increments measured along the levee alignment. For areas where lines and grades are shown on the plans, measurement will be limited to those lines and grades.
1.3.9.3 Unit of Measure
Unit of measure: cubic yard.
1.3.10 Embankment Fill
1.3.10.1 Payment
Payment will be made for CLIN 0013 and 1013 "EMBANKMENT FILL" which price will include costs associated with providing all labor, equipment, tools, supplies, and incidentals necessary to construct the new EMBANKMENT FILL, including filling the Levee Embankment and Ramps, as specified in section 31 00 00 EARTHWORK and as shown on the Drawings. No separate payment will be made for construction/removal of temporary access ramps for the convenience of the Contractor or for the transport, temporary stockpile, or blending of soils used as embankment fill material.
1.3.10.2 Measurement
Measure the Embankment Fill for payment by use of the average end area method. The basis of measurement will be a survey of the area after clearing, grubbing, and stripping and after the excavation of the observation trench (where applicable) and prior to placement of the Levee Embankment and Ramps, and a second survey of the same area after the placement of the Levee Embankment and Ramps.
