1.5. CRITERIA: Department of Transportation's hazardous materials regulations at 49 CFR Parts 171-
2. BACKGROUND
The Lakeside Mobile Home Park was acquired as part of a dam safety project for neighboring Success Dam. Fifty seven (57) mobile homes (aka trailers) were acquired by the Government along with the land associated with the trailer park. Residents of the park have been relocated, the trailers, including associated abandoned household goods, garbage, and rubbish, must be cleared from the property so that it can be utilized as part of the Success Dam project.
3. DESCRIPTION OF WORK AND SERVICES
Task 0 –Determination of Lead-Based Paint, Asbestos, Household Chemicals. The Contractor will survey each trailer for the presence of lead-based paint, asbestos, and household chemicals that require special disposal. The Contractor will provide the results of this survey to the Government.
Household chemicals that require special disposal will be removed and disposed of properly prior to trailer removal.
Task 1 –Mobile Home Removal. Remove all mobile homes and associated goods, garbage, and rubbish from the property in compliance with all local, state, federal laws, EM 385-1-1, and Chapter 3 of the Tulare County Code. A mobile home unit or trailer unit constitutes not only the structure but any rubbish, garbage, trash, or non-natural debris in a surrounding zone that is defined as within fifteen (15) feet of the structure in any direction. Should there be overlapping fifteen foot surrounding zones for two adjacent trailers, the surrounding zone comprising a unit will constitute one half of the distance between the structures within the area of overlap. Removal costs will reflect salvage value. Salvaged materials will be owned by the contractor.

The Contractor will disconnect all utilities (verify that electric power, water, and natural gas are shut off prior to work) and remove the fifty seven vacated mobile homes from the Lakeside Mobile Home Park.
The contractor shall coordinate with the appropriate utilities companies to the extent necessary to cap off the existing above-ground utilities infrastructure. Utilities will be capped and sealed and left in a safe condition.
On-site demolition/modifications will be minimal, and conducted only to allow for a mobile home removal; i.e. to the extent practicable, mobile homes will be removed from the site intact and demolished/disposed of offsite. Site will be free from loose debris resulting from trailer removals. If liquid spills occur, ground will be remediated according to federal, state, and local laws. The Contractor will comply with all applicable federal, state, and local laws, ordinances, and regulations with respect to the care, handling, storage, shipment, resale, export, disposal, or other use of the material removed. In addition to the above requirements, the contractor will comply with the requirements of EM 385-1-1, 2014, and Chapter 3 of the Tulare County Code .The Contractor will hold the Government harmless from any and all debts, liabilities, judgments, costs, demands, suits, actions, or other claims of any nature arising from or incident to the handling, use, storage, shipment, resale, export, or other disposition and use of the hazardous property purchased. It is probable that lead based paint and/or asbestos are present within some mobile home units; the Contractor represents, warrants, and certifies to the United States Government that they will use and ultimately dispose of any hazardous materials or property removed as stipulated under applicable federal, state, local, and international laws and regulations. The Contactor will comply with the Department of Transportation's hazardous materials regulations at 49 CFR Parts 171-180. The contractor shall comply with Tulare County’s established recycling regulations, which define what material may be recycled from building demolition, and which landfills are approved for recycling and disposal of materials. The Contractor, or his/her authorized agent, certifies on the shipping document, based on his/her own examination, that the materials are properly classified, described, packaged, marked, and labeled and are in proper condition for transportation in accordance with the hazardous materials regulations.
Service hours shall be limited to the normal daylight working hours, Monday through Saturday.
Compliance with the limited hours would minimize short-term construction noise effects on sensitive receptors to less than significant.
Transportation of material off-site for disposal/recycling shall be directed eastbound on State Route 178 towards Ridgecrest in order to avoid the more congested westbound State Route 178 into Bakersfield.
Task 2 - Progress Reporting. Contractor to inform the Contracting Officer Representative (COR) via email of a mobile home removal within two business days.

When the Government has caused the Contractor to perform in an unsatisfactory manner, the COR will forward a written notice to the responsible organizational element requesting corrective action be taken.
C. When the Contractor is not meeting the limits of satisfactory performance, a CDR will be issued to the Contractor. The seriousness of the failures should govern whether to issue CDR at the end of the period, or as soon as the limits of satisfactory performance are exceeded.
D. When a CDR is issued for a service, the COR will direct re-performance at no additional cost to the Government.
E. If the Contractor does not achieve satisfactory performance by the end of the next period or agreed suspense date, another CDR will be issued and the COR will direct re-performance again at no additional cost to the Government.
F. A third CDR will be the cause for a Cure Notice. However, the Contracting Officer may issue a Cure Notice or Show Cause letter at any time he/she deems appropriate.
