QUESTIONS AND ANSWERS
Questions and Answers to W91238-16-Q-0004 Success Lake Trailer Removal
1. Our company thinks that it is unsafe to remove any of the trailers as units to be towed and/or trailered elsewhere on a public roadway as stated on the RFP so that we can perform the least amount of work “on-site”. Can the mobile-home trailers be demolished onsite and loaded into high-side covered end dumps and disposed of properly since this would be the safest and most efficient way to remove these units?
a. Per the PWS, onsite demolition should be minimal. The Government recognizes that some of the trailers are so derelict that they will not stay in one piece if picked up, but on-site demolition should be kept to a minimum.
2. Has the gov’t performed a hazardous survey on these mobile-home trailers or properties and all affected structures that are a part of this demolition SOW? If there are surveys, can we please have a copy so that we can price out the proper abatement that needs to be done prior to the demolition?
a. The Government has not performed a survey. This amendment added a requirement to the PWS for the Contractor to perform this survey and to provide the survey results to the Government.
3. Does the Government provide any documentation, i.e. Titles tax releases’, for disposal purposes?
a. The Government does not have clear titles on ALL the trailers, however USACE Office of Counsel and Contracting Officer have agreed that, along with the extensive passage of time and lack of habitation, the cashed relocation checks by the former residents constitute an executed contract with the Government and thus Government ownership. SPK has obtained the cleared checks for all relocations (i.e. all trailers)
4. SOW mentions hazardous materials, what kind of hazardous materials are present?
a. Please see the answer to #2
5. Does the Government have analysis on any suspected hazardous materials?
a. Please see the answer to #2
6. Can demo be don’t on site or do the home have to be removed prior to demolition?
a. Please see the answer to #1
7. Does the contractor have to remove the concrete sidewalks/driveways as part of the contract?
a. No, only the mobile home unit and/or trailers, all debris within 15 feet and service to utilities (cap, seal and leave in safe condition)
8. Will periodic billing be allowed?
a. Invoices can be submitted what a Contract Line Item Number (CLIN) is complete. Interim payments will be based on % of completion, which will be reviewed and approved by the Government. Invoices may be submitted no more than twice a month.
9. Are photos available showing the structures?
a. No.
10. Are there photos showing the foundations of the structures?
a. No
11. Do the units have furniture in them? Will others remove this furniture?
a. “Furniture” is a broad term. Some trailers may be empty but it should not be assumed that all will be in that condition. Anything that has been left in the units must be removed by the Contractor.
12. When is the question cutoff date?
a. Questions will not be accepted after the 28th of December.
13. Can you send details on each unit, as in 1. Pictures; 2. Make, model and year; 3. Single or double wide.
a. This information is not available.
14. Do the concrete slabs have to be moved?
a. Please see answer to question 7.
15. Does the septic system tanks have to be pumped, crushed, and back filled?
a. No
16. Does the outhouse building have to be demolished including slabs, septic system?
a. No.
17. Do we have to remove the existing utility poles?
a. No.

REVISED PWS
Performance Work Statement Revised 22 December 2015
1. PROJECT DATA
1.1. PROJECT TITLE AND LOCATION: Removal of Vacated Mobile Homes, Lakeside
Mobile Home Park, Success Dam Safety Assurance Project (DSAP), Success Dam, California
1.2. AUTHORIZATION: Flood Control Act of 1944 (Public Law 78-534, Chapter 665, Section 10, page 901), December 22, 1944.
1.3. SCOPE: The contractor will remove the fifty seven (57) vacated mobile homes, including the contents within and surrounding loose materials, from the Lakeside Mobile Home Park.
Removal will be by towing, trailer, or other method(s) that comply with applicable federal, state, and local requirements and EM 385-1-1. After removal, the contractor will salvage and/or dispose of the trailers per the Section 3 below. Salvaged materials will be owned by the contractor. On-site demolition/modifications will be minimal, and conducted only to allow for a mobile home removal.
1.4. DRAWINGS TITLES: Lakeside Mobile Home Park Site Plan
1.5. CRITERIA: Department of Transportation's hazardous materials regulations at 49 CFR Parts 171-180
2. BACKGROUND
The Lakeside Mobile Home Park was acquired as part of a dam safety project for neighboring Success Dam. Fifty seven (57) mobile homes (aka trailers) were acquired by the Government along with the land associated with the trailer park. Residents of the park have been relocated, the trailers, including associated abandoned household goods, garbage, and rubbish, must be cleared from the property so that it can be utilized as part of the Success Dam project.
3. DESCRIPTION OF WORK AND SERVICES
Task 0 –Determination of Lead-Based Paint, Asbestos, Household Chemicals. The Contractor will survey each trailer for the presence of lead-based paint, asbestos, and household chemicals that require special disposal. The Contractor will provide the results of this survey to the Government. Household chemicals that require special disposal will be removed and disposed of properly prior to trailer removal.
Task 1 –Mobile Home Removal. Remove all mobile homes and associated goods, garbage, and rubbish from the property in compliance with all local, state, federal laws, EM 385-1-1, and Chapter 3 of the Tulare County Code. A mobile home unit or trailer unit constitutes not only the structure but any rubbish, garbage, trash, or non-natural debris in a surrounding zone that is defined as within fifteen (15) feet of the structure in any direction. Should there be overlapping fifteen foot surrounding zones for two adjacent trailers, the surrounding zone comprising a unit will constitute one half of the distance between the structures within the area of overlap.
Removal costs will reflect salvage value. Salvaged materials will be owned by the contractor.
The Contractor will disconnect all utilities (verify that electric power, water, and natural gas are shut off prior to work) and remove the fifty seven vacated mobile homes from the Lakeside Mobile Home Park. The contractor shall coordinate with the appropriate utilities companies to the extent necessary to cap off the existing above-ground utilities infrastructure. Utilities will be capped and sealed and left in a safe condition.
On-site demolition/modifications will be minimal, and conducted only to allow for a mobile home removal; i.e. to the extent practicable, mobile homes will be removed from the site intact and demolished/disposed of offsite. Site will be free from loose debris resulting from trailer removals. If liquid spills occur, ground will be remediated according to federal, state, and local laws. The Contractor will comply with all applicable federal, state, and local laws, ordinances, and regulations with respect to the care, handling, storage, shipment, resale, export, disposal, or other use of the material removed. In addition to the above requirements, the contractor will comply with the requirements of EM 385-1-1, 2014, and Chapter 3 of the Tulare County Code .The Contractor will hold the Government harmless from any and all debts, liabilities, judgments, costs, demands, suits, actions, or other claims of any nature arising from or incident to the handling, use, storage, shipment, resale, export, or other disposition and use of the hazardous property purchased. It is probable that lead based paint and/or asbestos are present within some mobile home units; the Contractor represents, warrants, and certifies to the United States Government that they will use and ultimately dispose of any hazardous materials or property removed as stipulated under applicable federal, state, local, and international laws and regulations. The Contactor will comply with the Department of Transportation's hazardous materials regulations at 49 CFR Parts 171-180. The contractor shall comply with Tulare County’s established recycling regulations, which define what material may be recycled from building demolition, and which landfills are approved for recycling and disposal of materials.
The Contractor, or his/her authorized agent, certifies on the shipping document, based on his/her own examination, that the materials are properly classified, described, packaged, marked, and labeled and are in proper condition for transportation in accordance with the hazardous materials regulations.
Service hours shall be limited to the normal daylight working hours, Monday through Saturday.
Compliance with the limited hours would minimize short-term construction noise effects on sensitive receptors to less than significant.
Transportation of material off-site for disposal/recycling shall be directed eastbound on State Route 178 towards Ridgecrest in order to avoid the more congested westbound State Route 178 into Bakersfield.
Task 2 - Progress Reporting. Contractor to inform the Contracting Officer Representative (COR) via email of a mobile home removal within two business days.
4. SUBMITTALS

9. PERFORMANCE EVALUATION MEETING
A. The issuance of a Contract Discrepancy Report (CDR) may be cause for the scheduling of a meeting among the Contractor, Contracting Officer (KO), and the Contracting Officer’s Representative (COR). A mutual effort will be made to resolve all problems identified. The Government will prepare written minutes of the meeting.
The Contractor, KO, and the COR will sign minutes of the meeting(s).
B. Should the Contractor not concur with the minutes, they will state in writing to the
Contracting Officer within ten calendar days any areas to which they do not concur, explaining the reasons for non-concurrence. The Contracting Officer will review and consider the reasons submitted for the Contractor’s non-concurrence and make a decision. The Contracting Office will notify the Contractor of the decision in writing within ten calendar days.
10. REMEDIAL ACTIONS
A. The COR will verbally advise or give a written inspection report to the Contractor of discrepancies the first time they occur and ask the Contractor to correct the problem.
A notation will be made on the COR checklist of the date and the time the deficiency was discovered and the date and time the Contractor was notified.
B. If the Government created any of the discrepancies, these will not be counted against the Contractor’s performance. When the Government has caused the Contractor to perform in an unsatisfactory manner, the COR will forward a written notice to the responsible organizational element requesting corrective action be taken.
C. When the Contractor is not meeting the limits of satisfactory performance, a CDR will be issued to the Contractor. The seriousness of the failures should govern whether to issue CDR at the end of the period, or as soon as the limits of satisfactory performance are exceeded.
D. When a CDR is issued for a service, the COR will direct re-performance at no additional cost to the Government.
E. If the Contractor does not achieve satisfactory performance by the end of the next period or agreed suspense date, another CDR will be issued and the COR will direct re-performance again at no additional cost to the Government.
F. A third CDR will be the cause for a Cure Notice. However, the Contracting Officer may issue a Cure Notice or Show Cause letter at any time he/she deems appropriate.
Depending on the overall performance of the Contractor, an unsatisfactory reply to the Cure Notice should require a Show Cause letter to be issued, followed by consideration of termination of the contract.
