PROCUREMENT ACQUISITION

BASIS OF AWARD,

GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS,

EVALUATIONS, AND BASIS OF AWARD

1. OVERVIEW.

1.1. This is a “Single Phase Lowest Priced Technically Acceptable Request for Proposals” solicitation for Hamilton City Flood Damage Reduction and Ecosystem Restoration Project, Glenn County, California. The Contracting Officer will award a firm fixed-price contract to the responsive and responsible Proposer whom the Source Selection Authority determined had the lowest priced technically acceptable proposal, conforms to the solicitation, is fair and reasonable, and proposes the lowest overall price.

1.2. Overview of the Source Selection Process. The Lowest Price Technically Acceptable (LPTA) source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Proposals are evaluated for technically acceptability but not ranked using the non-cost/price factors.

1.3 Offeror’s are advised that the Government intends to make awards on the basis of initial technical acceptable proposals without conducting discussions with offeror’s, but reserves the right to conduct discussions if determined by the Source Selection Authority to be necessary [see FAR Part 14.501(a)]. Therefore, the initial proposal should contain the offeror’s best terms from a technical and price standpoint.

2. BASIS OF AWARD.

The contract resulting from this solicitation will be awarded to the lowest priced offeror who submits a technically acceptable proposal. Technical acceptability is based upon the two non-priced (technical) factors: Experience and Capability and Past Performance.

2.1. ELIGIBILITY FOR CONTRACT AWARD

In accordance with the requirements of Part 9 of the Federal Acquisition Regulation (FAR), no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective prime contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

2.2. THE TECHNICAL EVALUATION FACTORS:

a. The Government will evaluate the technical proposal that is deemed lowest price first and if the offeror is deemed technically acceptable, the Government will not evaluate any other proposals. If the lowest priced proposal is deemed “Not Technically Acceptable”, then the next lowest priced offeror will be evaluated. The technical evaluation is based on how well the proposal addresses each of the two evaluation factors, listed below and further described in the Technical Proposal Volume. Each of the evaluation factors will be evaluated by the Government and an adjectival rating of “Acceptable” or “Not Acceptable” determined by consensus of the Government evaluation board. There are no relative weights assigned to the factors.

b. The evaluation factors correlate directly to the main organizational tabs identified in the proposal submission instructions in the Technical Proposal Volume. However, any information contained in the technical proposal can nonetheless be considered by the Government in its evaluation under any factor.

These has identified the Technical Factors and they are:

FACTOR 1 – EXPERIENCE AND CAPABILITY

FACTOR 2 – PAST PERFORMANCE

2.3. GENERAL TECHNICAL EVALUATION CRITERIA

a. The evaluation shall be conducted in accordance with FAR Subpart 15.101-2 -- Lowest Price Technically Acceptable Source Selection Process. For this procurement, only one technical proposal may be submitted by each bidder. Bidders should submit a proposal that is complete without the need of additional explanation or information.

The Government shall make a final determination regarding a proposal's acceptability solely on the basis of the proposal as submitted. The Government may proceed without requesting further information from any offeror;

however, the Government may request additional information from bidders of proposals that have been found to be Unacceptable.

b. Technical Proposals will be rated at the factor level and will be evaluated in terms of Acceptable or Unacceptable. If any factor is found deficient, the proposal will be determined Unacceptable. The initial technical proposal may have limited Unacceptability and therefore eligible for discussions, if no award is made without discussion. However, an initial proposal that contains one or more unacceptable factor will be considered unacceptable and will be eliminated from further consideration.

c. If discussions are held with bidders whose proposals are considered Unacceptable and a request for proposal revisions are requested, the revised proposal will be re-evaluated in accordance with the criteria in the solicitation.

After completion of discussions and evaluation of any revised proposals, the proposal shall be determined as acceptable or unacceptable. If determined unacceptable, a notice of unacceptability will be forwarded to the bidder upon completion of the proposal evaluation and final determination of unacceptability.

d. The offeror’s conformance with the specified format and submission requirements will be considered during the technical evaluation. Failure to comply with the formatting and/or submission requirements may be seen as indicative of the type of problems that could be expected during contract performance. Lack of conformance will result in a Unacceptable rating, in addition to any other impacts on the evaluation. Material omission(s) may cause the technical proposal to be rejected as unacceptable.

e. Technical proposals which do not provide the specified information in the specified location in accordance with the submission instructions may be deemed Unacceptable. The Government is under no obligation to search for information that is not in the specified location.

f. Proposals which are generic, vague, or lacking in detail will be deemed Unacceptable. The proposal submission instructions are written to give prospective Prime Contractors, where feasible, an indication of the level of detail desired by the Government. The offeror’s failure to include information that the Government has indicated should be included will result in the proposal being “Unacceptable” if inadequate detail is provided.

g. Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit three pages in response to an item with a two page limitation, the information on the first two pages would be evaluated but the information on the third page would not be evaluated. If an bidder were to submit a fold-out sheet (e.g. 11”x17”) in response to a one-page limitation where fold-out sheets were not authorized, only the information that could reasonably have been submitted on one 8-1/2 x 11 inch sheet would be evaluated. If a offeror were to submit three 8-1/2 x 11 inch pages in response to a one not-to-exceed 11 x 17 inch page limitation, only the information that could reasonably have been submitted on one 11 x 17 inch sheet would be evaluated. If a offeror submitted alternates that were not requested the information will not be evaluated.

h. The degree of acceptability to the Government inherent in the offeror’s technical proposal will be a consideration under every evaluation factor except past performance.

i. The LPTA evaluation of each offeror’s proposal will determine if each technical factor is technically acceptable with a rating of acceptable or unacceptable. An “acceptable” rating will be assigned to a proposal that has satisfied all of the requirements of the technical evaluation factors set forth in the solicitation. An “unacceptable” rating will be assigned to a proposal that has not satisfied one or more requirements of the technical evaluation factors set forth in the solicitation. The technical proposal will be evaluated to ensure the contractor possesses the technical experience necessary to perform the work adequately described in the Statement of Work and attachments within the Period of Performance. The awardee will be the firm whose proposal is the lowest price of all of the technically acceptable proposals.

j. Failure of a proposed key person or sub-contractor to furnish authorization for the Government to discuss its past performance with the offeror will not be considered a proposal deficiency. However, the Government will not be able to disclose to the offeror any details pertaining to their performance problems.

k. Past Performance Evaluation. The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements The past performance evaluation considers first each offeror’s demonstrated recent and relevant record of performance that meet the contract’s requirements. Second a performance confidence assessment rating is assigned for each offeror after evaluating the bidder’s recent past performance, focusing on performance that is relevant to the contract requirements. Past Performance can include offerors past or current contracts (including Federal, State, Local Government and private industry of similar project requirements).

1. Past Performance Ratings

Acceptable:

Substantial, Satisfactory and Limited Confidence Rating will be considered as Acceptable. Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable:

A No Confidence Rating will be considered as Unacceptable. Failure to meet criteria defined in the Acceptable rating above.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined in the context of “unknown” shall be considered “acceptable.”

2.4. EVALUATION OF THE PROPOSAL

a. When applicable, the Price Evaluation Preference for HUBZone Small Business Concerns will be applied. The Price Evaluation Adjustment for Small Disadvantaged Businesses will not apply to this procurement as it is currently suspended for Department of Defense.

b. Information required to be submitted in the Price volume in addition to the executed SF 1442 with acknowledgement of amendments and the completed pricing schedule will be used to determine the bidder’s eligibility for contract award in accordance with paragraph 2.1 above (for example, the bidder’s representations and certifications; the bid guarantee; the offeror’s pre-award survey information; and the offeror’s small business subcontracting plan). The Government may enter into exchanges with offerors about such information without it constituting discussions, subject to applicable FAR limitations; FAR 28.101-4, Noncompliance with bid guarantee requirements; and 52.219-9, ALT II, Small Business Subcontracting Plan.

3 GENERAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS.

3.1.3 Conditioning of Proposal or Bid.

Do not include exceptions to the terms and conditions of the solicitation in either the technical or bid price volumes.

Inclusion of any standard company terms and conditions that conflict with the terms and conditions of the solicitation may result in a determination that the proposal/bid is unacceptable and thus ineligible for award.

Resolve questions about the terms and conditions or technical requirements of the solicitation prior to submission of the proposal/bid; see “Inquiries”, located in Section 00 21 16, for points of contact. Notwithstanding the above, the bidder must clearly describe in the proposal cover sheet submitted with the bid price volume any exceptions, within the proposal/bid, to the contractual and/or technical terms and conditions of the solicitation.

3.1.4 Restrictions on Bidder-Provided Information.

“Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can nonetheless be provided to the Government as part of the offeror’s technical proposal. Bidders that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must clearly mark the information in accordance with FAR 52.215-1, “Instructions to Offeror – Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data”. Additionally, the offeror must also complete and return the “Representations and Certifications” in Section 00 45 00 of the solicitation. If the offeror is a Joint Venture, all participants must separately complete both annual representations and certifications and Section 00 45 00.

Tab 7 of the Price Proposal: Pre-Award Survey Information.

a. The contracting officer is required to make an affirmative pre-award determination of the prospective contractor’s responsibility in accordance with the mandatory requirements of Part 9 of the Federal Acquisition Regulation (FAR) and its supplements. 5.3 DETAILED SUBMISSION REQUIREMENTS AND EVALUATION CRITERIA FOR THE

TECHNICAL PROPOSAL

5.3.1 Preface – Prime Contractor/Key Subcontractor Introduction

a. The Offeror is required to propose a specific project team including key subcontractors for evaluation in response to this Request for Proposals. For purposes of this procurement, the terms “key subcontractors” are used to refer only to the prospective subcontractors whose qualifications, experience, and past performance will be evaluated by the Government as part of the source selection process. For reasons of efficiency, not all of the subcontractors critical to successful post-award contract performance have been included in this group. In order to streamline the proposal submission and evaluation process, please limit your submission to the information specifically requested.

Information pertaining to other subcontractors not designated as “key” by the Government will be considered excess and will not be evaluated.

b. For the purposes of this procurement, a key subcontractor is defined as any subcontractor performing “key” major work elements for which capability information is required to be submitted for evaluation as part of the Offeror’s technical proposal. The Government has designated the following major work elements as “key”:

i.Earthwork construction effort ii.Quality Control testing of earthwork and concrete construction iii.Concrete outlet works construction effort

c. The Offeror’s attention is directed to the clause in Section 00 73 00 titled “Key Personnel and Subcontractors”. In accordance with this clause, any post-award changes to the key personnel and/or key subcontractors in the accepted proposal will require Contracting Officer approval.

d. Provide a brief introduction narrative. Identify and provide the name, DUNS number, address, point of contact email address, and a brief description of the role and authority of each firm that will be involved in performance of this contract at the prime contractor and key subcontractor level. If the proposed prime contractor is a Joint Venture (i.e., mentor protégé), describe the relationship, role, and authority (to include management authority) of each firm.

(Note: If a proposed firm has branch offices, provide information for each individual branch office that will perform work under the contract with its own workforce.) List the major work elements to be self-performed by the offeror’s in-house work force and by each key subcontractor. The submission is limited to two (2) 8-1/2”x11” pages for narrative.

e. The Government will not evaluate the Preface - Prime Contractor/Key Subcontractor Introduction. The purpose of this narrative is to provide a brief introduction for information purposes.

5.3.2 Tab 1 of the Technical Proposal: Factor 1- Prime Contract/Key Subcontractor Example Projects Experience and Capabilities

5.3.2.1. General

a. The information provided under this tab will be used to evaluate the experience and capability of the offeror and proposed key subcontractors. The resumes and example projects will provide the primary basis for acceptability for the Government’s evaluation of the offeror’s qualifications and experiences.

b. The Government is especially interested in relevant experience in levee construction and quality control testing.

The examples can either be commercial or institutional. The Key Elements are:

i. Levee construction;

ii. Quality control testing of levee and concrete construction;

iii. Concrete closure and outlet structure construction.

iv. Sequencing/Phasing

5.3.2.2. Prime Contractor/Key Subcontractor Example Projects Demonstrating Experience and Capability

a. The offeror is required to submit “example projects” for each of the four (4) below capability areas that demonstrate the prime’s and/or key subcontractor’s experience and capability to successfully complete the example project. Each offeror must submit example projects (Prime contractor and key subcontractor) with a minimum of two (2) example projects but no more than three (3) example projects demonstrating experience in the key elements listed below. Example projects are a requirement for the prime and key subcontractor.

Each offeror’s example projects shall include:

1. Two (2) example projects, but no more than three, demonstrating the offeror’s construction/project management experience and capability as a prime contractor on a similar project and scope;

2. Two (2) example projects, but no more than three, demonstrating the experience and capability of the firm (prime or subcontractor) that will be performing the majority of the levee construction effort;

3. Two (2) example projects, but no more than three, demonstrating the experience and capability of the firm (prime or subcontractor) that will be performing the majority of the concrete outlet works construction effort.

4. Two (2) example projects, but no more than three, demonstrating the experience and capability of the firm (prime or subcontractor) that will be performing the quality control testing for levee and concrete construction.

b. Do not submit construction projects that are not either complete or substantially complete. (For this purpose, “substantially complete” means that only punch list items remain for project acceptance or that the majority of the elements of the project have been turned over to the customer for beneficial occupancy.)

c. Only submit projects where construction began after 1 May 2005. Projects older than that will not be evaluated.

d. “Similar scope” is defined as a similar quantity (in cubic yards) of levee constructed and tested for construction quality control. Partial reconstruction of an existing levee after degrade and installation of a cutoff wall is considered to be levee construction.

e. Any prescribed page and formatting limitations shall be strictly adhered to and enforced by the Government. The Government may not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions. Examples: If an offeror were to submit four example projects in response to a requirement for three example projects, only the first three example projects will be evaluated and the information on the fourth project would not be evaluated.

f. Provide a Summary Matrix that indicates which submitted example project(s) demonstrates the experience(s) and capability(ies) of which firm (i.e. prime, subcontractor) will perform the capability area identified in paragraph 2.a above.

g. Formatting and Other Restrictions.

(1) Start the information for each example project on a new page. The submission is limited to Twenty (20) 8-1/2” x 11” pages for Factor 1.

(2) Use the “Project Information Form” which follows for submitting the example projects. Use of an alternate format could result in a lower rating if all of the specified information is not provided. (Note:

Do not submit a group of related jobs as one project unless all of the work was done under the same contract, or for indefinite delivery contracts, under one task order.)

PROJECT INFORMATION FORM

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.

Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements.
