Refer to EM 385-1-1, Contract Clauses, and the Occupational Safety and Health Act (OSHA) Standards for Construction 29 CFR 1926; General Industry Standards 29 CFR 1910; and the National Fire Protection Association Codes are applicable to this contract. In case of conflict the most stringent requirement of the standards is applicable.

1.5.2 The Prime Contractor's Superintendent

The Prime Contractor's superintendent must take an active role in enforcing the safety requirements by participation in safety conferences, hazard analysis (see below), tool box meetings, walk-through inspections, correction of violations, etc., and including that of the subcontractor's work.

1.5.3 Violations

If recurring violations and/or gross violation indicate that the safety performance is unsatisfactory, corrective action must be taken as directed, and at the discretion of the Contracting Officer the retention or some part thereof will be withheld from the progress payment until corrective action has been completed.

1.5.4 Fire Prevention

Cutting or welding will be permitted only in areas that are or have been made fire safe. Where possible, all combustibles must be located at least 40 feet horizontally from the work site. Where such location is impracticable, combustibles must be protected with fire blankets and/or protective welding screens to prevent slag from running out of the work area. Other fire prevention precautions must be in accordance with the latest National Fire Codes.

1.5.4.1 Inspections

All construction sites are subject to fire and safety inspections without notice. Any violation of fire and safety standards may result in a work stoppage at the expense of the Contractor.

1.5.5 Recordkeeping and Accident Reporting Requirements

On all contract operations, record and report all accident exposure and experience incident work. This includes exposure and experience of the prime contractor and sub-contractor(s). As a minimum these records must include exposure work-hours and a log of occupational injuries and illnesses (OSHA Form 300 or state equivalent as prescribed by 29 CFR 1904 ). Refer to EM 385-1-1, 01.D.04.

1.5.6 Security

The project location may be particularly subject to vandalism. Materials left on-site are done so at the Contractors' risk, and if lost, at the Contractor's expense. Provide security for all the work. Particularly, construct and maintain the signs, including but not limited to, those

01 00 00 - 5 necessary for Public Safety and Traffic Control, as specified in Section 6 of the General Provisions. Replace those signs damaged or destroyed due to vandalism at no additional expense to the Government.

1.6 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.6.1 Monthly Anticipated Adverse Weather Delays

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

1.10 WARRANTY OF CONSTRUCTION

(a) Performance Bond.

(1) It is understood that the Contractor's Performance Bond will remain effective throughout the life of all warranties and warranty extensions.

(2) In the event the Contractor or his designated representative fails to commence and diligently pursue any work required under the Warranty of Construction Section of the Technical Provisions within a reasonable time after receipt of written notification pursuant to the requirements thereof, the Contracting Officer has a right to demand that said work be performed under the Performance Bond by making written notice on the surety. If the surety fails or refuses to perform the obligation it assumed under the Performance Bond, the Contracting Officer must have the work performed by others, and after completion of the work, make demand for reimbursement of any or all expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.

(3) Warranty repair work which arises to threaten the health or safety of personnel, the physical safety of property or equipment, or which impairs operations, habitability of living spaces, etc., will be handled by the Contractor on an immediate basis as directed verbally by the Contracting Officer or his authorized representative. Written verification will follow verbal instructions. Failure of the Contractor to respond as verbally

01 00 00 - 7 directed will be cause for the Contracting Officer or his authorized representative to have the warranty repair work performed by others and to proceed against the Contractor as outlined in the paragraph b. above.

(b) Pre-Warranty Conference. Prior to contract completion and at a time designated by the Contracting Officer or his authorized representative, meet with the Contracting Officer to develop a mutual understanding with respect to the requirements of SECTION 00 73 00 SUPPLEMENTARY CONDITIONS, Paragraph, WARRANTY OF CONSTRUCTION, of this specification. Communication procedures for Contractor notification of warranty defects, priorities with respect to the type of defect, reasonable time required for Contractor response, and other details deemed necessary by the Contracting Officer or his authorized representative for the execution of the construction warranty will be established/reviewed at this meeting.

In connection with these requirements and at the time of the Contractor's quality control completion inspection, the Contractor will furnish the name, telephone number and address of a licensed and bonded company which is authorized to initiate and pursue warranty work action on behalf of the Contractor. This single point of contact will be located within the local service area of the warranted construction, will be continuously available, and will be responsive to Government inquiry on warranty work action and status. This requirement does not relieve the Contractor of any of his responsibilities in connection with Section 00 73 00 SUPPLEMENTARY CONDITIONS, Paragraph, WARRANTY OF

CONSTRUCTION.

(c) Equipment Warranty Identification Tags. Provide warranty identification tags on all equipment installed under this contract.

(d) Contractor's Response to Warranty Service Requirements. The following warranty service requirements are applicable to this contract.

Second Priority 1B Perform on site inspection to evaluate situation, determine course of action, initiate work within 48 hours and work continuously to completion of relief.

Third Priority All other work to be initiated within 5 work days and work continuously to completion or relief.

The "Warranty Service Priority List" must be compiled by the Contractor and approved by the Contracting Officer.

Should parts be required to complete the work and the parts are not immediately available provide the Contracting Officer's Representative with firm written proposals for emergency alternatives and temporary repairs for Government participation within 12 hours after arrival at the job site, and provide emergency relief until the required parts are

01 00 00 - 8 available on site for the Contractor to perform permanent warranty repair. Include a firm date and time that the required parts must be available on site to complete the permanent warranty repair. The Contracting Officer's Representative will evaluate the proposed alternatives and negotiate the alternative considered to be in the best interest of the Government to reduce the impact of the emergency condition. Alternatives considered by the Contracting Officer's Representative will include the alternative for the Contractor to "Do Nothing" while waiting until the required parts are available to perform permanent warranty repair. Negotiating a proposal which will require Government participation and the expenditure of Government funds must constitute a separate procurement action by the using service.

PART 3 EXECUTION

3.1 INSTALLATION

Where existing fence fabric must be cut, Contractor must either splice the fabric vertically and roll up to one side or make two vertical splices and completely remove the portion of fabric necessary to do the work. When replaced, the fabric must be overlapped a minimum of one foot using new fabric and metal ties with a maximum of 6 inch spacing.

Fence must be installed to the lines and grades indicated. The area on either side of the fence line must be cleared to the extent indicated.

Line posts must be spaced equidistant at intervals not exceeding 2010 feet.

Terminal (corner, gate, and pull) posts must be set at abrupt changes in vertical and horizontal alignment. Fabric must be continuous between terminal posts; however, runs between terminal posts must not exceed 500 feet. Any damage to galvanized surfaces, including welding, must be repaired with paint containing zinc dust in accordance with ASTM A780/A780M.

3.2 EXCAVATION

Post holes must be cleared of loose material. Waste material must be spread where directed. The ground surface irregularities along the fence line must be eliminated to the extent necessary to maintain a 1 inch clearance between the bottom of the fabric and finish grade.

02 82 10 - 4

3.3 POST INSTALLATION

3.3.1 Posts for Deer Fence

Posts must be set plumb and in alignment. Except where solid rock is encountered, posts must be set in concrete to the depth indicated on the drawings. Where solid rock is encountered with no overburden, posts must be set to a minimum depth of 18 inches in rock. Where solid rock is covered with an overburden of soil or loose rock, posts must be set to the minimum depth indicated on the drawing unless a penetration of 18 inches in solid rock is achieved before reaching the indicated depth, in which case depth of penetration must terminate. All portions of posts set in rock must be grouted. Portions of posts not set in rock must be set in concrete from the rock to ground level. Posts set in concrete must be set in holes not less than the diameter shown on the drawings. Diameters of holes in solid rock must be at least 1 inch greater than the largest cross section of the post. Concrete and grout must be thoroughly consolidated around each post, must be free of voids and finished to form a dome. Concrete and grout must be allowed to cure for 72 hours prior to attachment of any item to the posts. Group II line posts may be mechanically driven, for temporary fence construction only, if rock is not encountered. Driven posts must be set to a minimum depth of 3 feet and must be protected with drive caps when being set. For high security fences, fence post rigidity must be tested by applying a 50 pound force on the post, perpendicular to the fabric, at 5 feet above ground; post movement measured at the point where the force is applied must be less than or equal to 3/4 inch from the relaxed position; every tenth post must be tested for rigidity; when a post fails this test, further tests on the next four posts on either side of the failed post must be made; all failed posts must be removed, replaced, and retested at the Contractor's expense.

3.4 BRACES AND TRUSS RODS

Braces and truss rods must be installed as indicated and in conformance with the standard practice for the fence furnished. Horizontal (compression) braces and diagonal truss (tension) rods must be installed on fences over 6 feet in height. A center brace or 2 diagonal truss rods must be installed on 12-foot fences. Braces and truss rods must extend from terminal posts to line posts. Diagonal braces must form an angle of approximately 40 to 50 degrees with the horizontal. No bracing is required on fences 6 feet high or less.

3.5 DEER FENCE FABRIC

Deer fence fabric must be installed on the side of the post indicated.

Fabric must be attached to terminal posts with wire fabric connections using 12.5 gauge post clips. The fabric must be installed and pulled taut to provide a smooth and uniform appearance free from sag, without permanently distorting the fabric square or reducing the fabric height.

Fabric must be fastened to line posts at approximately 15 inch intervals and fastened to all rails and tension wires at approximately 12 inch intervals. Fabric must be cut by untwisting and removing pickets.

Splicing must be accomplished by weaving a single picket into the ends of the rolls to be joined. The bottom of the installed fabric must be 1 plus or minus 1/2 inch above the ground. For high security fence, after the fabric installation is complete, the fabric must be exercised by applying a 50 pound push-pull force at the center of the fabric between posts; the use of a 30 pound pull at the center of the panel must cause fabric deflection of not more than 2-1/2 inches when pulling fabric from the post side of the

02 82 10 - 5 fence; every second fence panel must meet this requirement; all failed panels must be resecured and retested at the Contractor's expense.

3.6 GATE INSTALLATION

Gates must be installed at the locations shown. Hinged gates must be mounted to swing as indicated. Latches, stops, and keepers must be installed as required. Slide gates must be installed as recommended by the manufacturer. Padlocks must be attached to gates or gate posts with chains. Hinge pins, and hardware must be welded or otherwise secured to prevent removal. For farm style fencing, standard metal gate assemblies with frame and fittings necessary for complete installation or wood gates must be furnished as shown.

3.7 GROUNDING

Fences must be grounded on each side of all gates, at each corner, at the closest approach to each building located within 50 feet of the fence, and where the fence alignment changes more than 15 degrees. Grounding locations must not exceed 650 feet. Each gate panel must be bonded with a flexible bond strap to its gate post. Fences crossed by powerlines of 600 volts or more must be grounded at or near the point of crossing and at distances not exceeding 150 feet on each side of crossing. Ground conductor must consist of No. 8 AWG solid copper wire. Grounding electrodes must be 3/4 inch by 10 foot long copper-clad steel rod.

Electrodes must be driven into the earth so that the top of the electrode is at least 6 inches below the grade. Where driving is impracticable, electrodes must be buried a minimum of 12 inches deep and radially from the fence. The top of the electrode must be not less than 2 feet or more than 8 feet from the fence. Ground conductor must be clamped to the fence and electrodes with bronze grounding clamps to create electrical continuity between fence posts, fence fabric, and ground rods. After installation the total resistance of fence to ground must not be greater than 25 ohms.
