1.4 CONTRACTOR WORK REQUIREMENTS

The dredging and placement areas are accessible to the general public; the Government will not undertake to exclude the public or restrict public access to the dredging or placement areas during the work. The Contractor shall be solely responsible for protection of the public at all times for the duration of work performed as a part of the contract and fully comply with the provisions of OSHA safe working practices and the Safety and Accident Prevention requirements of these specifications. The Contractor shall employ the use of signs, barricades, barriers, flagmen, and any other devices and measures required to ensure public and worker safety at the dredging and placement areas at all times. Unless directed otherwise, the Contractor may perform the scheduled dredging and material placement work 24 hours a day, 7 days a week; however, the Contractor will not be allowed to operate plant or equipment within 150 feet of the boardwalk or private residence, housing and other occupied beachfront areas from 11:00pm to 7:00am. During actual dredging and material placement operations, the Contractor shall ensure adequate monitoring of operations by competent employees at the placement areas and contact with the dredge by monitoring personnel is maintained at all times.

1.4.1 Order of Work - Beach Placement

The Contractor shall perform all required beach fill placement operations as indicated in the plans.

1.4.2 Hopper Dredge Seasonal Restriction

Seasonal restrictions of dredging operations will apply for this contract.

No hopper dredging shall occur between the dates of 01 September and 14 November.

1.4.3 Access to Work Site

The Virginia Beach Resort Beach is served by an all weather surfaced road network. The Contractor's equipment and vehicular access into the work area between Atlantic Avenue and the beachfront will be available through the concrete ramp public right-of-ways at 2nd Street, 14th Street, 20th Street, 37th Street, and 57th Street and the unimproved public right-of-ways at 68th Street and 79th Street. The area in the vicinity of 37th Street and 57th Street is authorized as a location of a secured lay down and office/storage area for the Contractor subject to government approval; however, other areas as noted may be used for access-egress of the Contractor's plant. The Contractor shall prepare, as a part of the Progress Schedule and Safety Plan, the proposed methods for gaining access to the workplace by these rights-of-way that do not unnecessarily impact convenient and safe access to and from the beach by the public. Access and egress to the work area is the responsibility of the Contractor and are subject to permit approvals required by the City of Virginia Beach. All roads approved for the Contractor's use shall be maintained throughout construction and restored to as good condition as existed prior to their use. The Contractor shall keep all roads free of mud and other debris resulting from his operations. The Contractor's vehicles shall pull off the road and come to a complete stop when meeting emergency vehicles and vehicles with flashing lights. All temporary construction shall be removed and the affected area restored to its original condition.

All costs for the use of existing transportation facilities, for the construction of temporary facilities, and for maintenance, repair, removal

SECTION 01 14 00 Page 5 and restoration shall be borne by the Contractor.

1.4.4 Access-Egress Restrictions and Beach Activities for Special Events

The Contractor shall confirm beach activity dates with the City of Virginia Beach. The following activities may impact contractor work to the extent specified:

a. Holiday of Lights. The Holiday of Lights celebration and displays on the boardwalk and beach will start approximately a week before Thanksgiving and run to December 30. Vehicles will enter the boardwalk on 2nd Street and exit the display at 34th Street. Numerous lighted displays will be on the beach and near the boardwalk. Related wiring and anchorage for the displays will be in the work areas, but also near the boardwalk. These locations will be clearly identified and must be avoided by the Contractor during the scheduled work. Vehicular traffic will be on the boardwalk and the general public may be in proximity to the lighted displays on the beach; accordingly, the Contractor's work and saftey plans shall clearly address these hazards and method(s) for protecting the public during the work. While the work area will be reduced, it is expected that beach placement may continue in this area during the Holiday of Lights. The Contractor shall work closely with the Holiday of Lights presenter to minimize impacts to both beach placement and Holiday of Lights displays.

b. 2024 Polar Plunge. This activity involves large groups of persons swimming for charity. The exact dates have not been set, however; it is anticipated for the month of February. This activity occurs south of the beach placement area (2nd to 8th street), however, expect crowds on the Boardwalk and traffic in the resort area to be larger than normal.

c. Yuengling Shamrock Marathon, March 15 to 17. This activity involves the internationally known Yuengling Shamrock Marathon 2024 to be run on 17 March with other races occurring 16 and 17 March. There will be live bands and entertainment throughout the weekend. Races occur on the Boardwalk and City streets and should have relatively little direct impact to work areas. Some tents may occur on the Beach in the vicinity of 28th to 33rd street, however; activities should be confined to areas adjacent to the boardwalk. While the work area may be reduced, it is expected that beach placement may continue in this area during the weekend. The Contractor shall work closely with the City to minimize impacts to both beach placement and Yuengling Shamrock Marathon. Expect large crowds on the Boardwalk and some street closings; traffic in the resort area will be much larger than normal.

1.4.5 Contracting Officer Directed Stand By Time

During the contract period, the Government reserves the right to issue stand by orders to the Contractor at a cost and in a number as bid by the Contractor on the Base Bid Schedule Item for this requirement. If the Contracting Officer directs that work be placed in a standby status, the Contractor shall cease all dredging, beach fill operations, and CIDMMA placement activities and secure the dredge plant in a mooring location acceptable to the Contracting Officer and beach plant and equipment off the beach in the approved Staging Area. The Contracting Officer will give the Contractor a minimum 72 hour notice before work is to be placed on standby status. When in standby status, work will not be moved from the

SECTION 01 14 00 Page 6 designated location unless approved by the Contracting Officer.

1.4.6 Designated Marine Plant Anchorage and Equipment Working Area Restrictions

The City Dredge Operations Facility (CDOF), Lake Rudee and Croatan Point are designated for marine plant anchorage, storage, maintenance, refueling, and routine or major repairs to marine plant and equipment that cannot be performed from the beachfront during this contract. The Contractor shall submit a Marine Plant Anchorage and Equipment Working Area Plan for approval, indicating all proposed plant anchorage and other scheduled activities at the CDOF, Lake Rudee or Croatan Point. The Plan shall be coordinated with the CDOF and include the proposed plant and scheduled activities and be coordinated with the Activity Hazard Analysis and Safety Plan. The Contractor must comply with all rules and regulations governing use of the CDOF and all costs for use of the facility are the responsibility of the Contractor.

Lake Wesley (inside Rudee Inlet to the Southeast of Lake Rudee) will not be allowed for storage, maintenance, refueling, or repairs to marine plant and equipment, or for any other non-emergency purpose.

The use of Lake Wesley will only be allowed for anchorage of plant that, due to size and height restrictions, cannot reasonably be stored at the CDOF, Lake Rudee or Croatan Point. If it becomes necessary for the Contractor to request anchorage of plant or to perform other non-emergency functions in Lake Wesley, the Contractor must verify the CDOF, Lake Rudee and Croatan Point are unavailable or otherwise unsuitable for use and shall obtain written permission from the Contracting Officer's Representative at least 48 hours in advance of the use of Lake Wesley.

Prior to commencement of dredging, submit a Marine Plant Anchorage and Equipment Working Area Plan indicating all work activities proposed for marine plant anchorage, storage, maintenance, refueling, and routine or major repairs to marine plant and equipment that cannot be performed from the beachfront during this contract.

1.4.7 Noise Control and Abatement

The Contractor shall employ the use of properly installed and maintained mufflers, silencers, and manufacturer's recommended sound suppressors on all plant, machinery, and equipment used on this work. The use of sound signals such as whistles, horns, or bells shall not be used if two-way radio communication can accomplish the required function. During the time between 11:00pm and 7:00am, the Contractor shall plan and schedule work to minimize operations of plant and equipment on the beach and in the vicinity of the boardwalk, in Lake Wesley, and in other waterways near populated areas. Auditory alarms from the backward use of plant on the beach during this period will not be allowed except to meet safe working practices as prescribed by OSHA. Accordingly, the Contractor shall operate plant in a forward mode and limit beach fill operations to the maximum extent practical during this time. The Contractor shall not use sound signals, with the exception of those signals required for vessel operations by the U.S. Coast Guard, during the time between sunset and sunrise.

1.4.8 Beach Lighting

When night work is performed, all on-beach lighting associated with the

SECTION 01 14 00 Page 7 project shall be limited to the immediate area of active construction only. Such lighting shall be shielded, low-pressure sodium vapor lights directed to the maximum extent practical away from populated areas where applicable and to avoid excessive illumination of the water.

From May 1 through November 15, orange or yellow filters shall be placed over vehicle headlights of the Contractor's plant and equipment used on the beach at night to the extent that it does not conflict with OSHA and USACE Occupational Health and Safety regulations, standards, or technical guidance or otherwise jeopardize or threaten human safety.

1.4.9 Protected Species Surveys

Depending on funding availability and the time of year, a survey vessel conducting side scan sonar for the presence of protected species may be on site collecting data within 100 meters of the dredge and/or relocation trawler. USACE staff will notify the Contractor when the survey vessel is intended to be on site.

1.4.10 Early Morning Sea Turtle Nest Surveys

From May 1 through November 15, early morning crawl surveys for sea turtle nesting activity will be performed by Back Bay National Wildlife Refuge (on Sandbridge Beach) or the Virginia Aquarium (VAQ) Stranding Response Program (on Virginia Beach). The Contractor shall coordinate and allow safe, unimpeded egress within the active construction zone, and construction equipment work will be briefly halted within the immediate area of an active early morning crawl survey as the surveyor(s) pass.

1.4.11 Coordination with Other Contractors

During the period of this contract, other contracts may be in force for the construction of other features of work on or adjacent to the work being accomplished under this contract. The Contractor shall arrange his plant, and shall schedule and perform this work, so as to effectively cooperate with all other contractors and Government agencies. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other contractors.

Should there be any conflict between these limits, the Contractor shall immediately notify the Contracting Officer of the conflict, and the Contracting Officer's decision shall be final.

1.5 Notification Of Beach Fill Operations

The Contractor shall maintain a current register of planned beach fill operations indicating where the beach fill operations will be on a given day, including street locations for the beach fill operations and the pump out facility, and their daily projected locations along the beach fill placement area for the duration of the contract. The register shall be updated daily and provided with the Daily Report of Operations in a format approved by the Contracting Officer for ready release to the public.

1.6 PHYSICAL DATA

1.6.1 Physical Conditions Information

The physical conditions indicated on the drawings and in the specifications are the result of site investigations and surveys.

Information and data furnished or referred to below is furnished for the

Contractor's information; however, it shall be expressly understood that the Government will not be responsible for any interpretation or conclusion drawn from this information or data by the Contractor.

1.6.2 Site Related Weather Conditions

The locations of the work are in open ocean waters and along the Virginia Beach oceanfront; accordingly, the Contractor shall anticipate that severe weather conditions may occasionally interfere with the progress of work.

The area is tidal with a mean range of tide of approximately 3.42 feet based on NOS observations at the Virginia Beach Fishing Center. Currents are normally not of a sufficient velocity to interfere with dredging operations; however, offshore winds and other natural weather events may lead to shoaling hazards. The Contractor is responsible for understanding the hazards likely to arise from the weather conditions during the dredging period. Complete weather forecasts, records and reports may be obtained from the National Weather Service in Wakefield, Virginia, telephone (757) 899-4200, Menu selection service or operator assisted as applicable.

1.6.3 Time Extensions For Unusually Severe Weather

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default: (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.6.4 Schedule

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
