SUMMARY OF WORK

PART 1 GENERAL
1.1 DESCRIPTION OF CRANEY ISLAND DREDGED MATERIALS MANAGEMENT AREA
The Craney Island Dredged Material Management Area (CIDMMA) is a 2,500 acre confined dredged material disposal site located at the north end of the town of Portsmouth near Norfolk, Virginia. CIDMMA serves as a long-term disposal site for material dredged from the rivers, channels and ports in the Norfolk Harbor area. By 2010, the site had received over 253 million cubic yards of dredged material. The heights of the dikes are being raised to increase the site’s storage capacity. The site is divided into three large storage cells that are contained by compacted soil dikes that average 30 to 40 feet high. The top of the dikes serve as roadways and are interconnected. The site is a peninsula that is approximately 2 miles wide times 2 miles long that extends into the Norfolk Harbor. The south end includes access roads, the USACE office, and the Contractor’s laydown yard. Access to the site is limited and must be approved by the site’s USACE office. A permanent crew of USACE personnel maintain the roads, dikes and associated structures. The facility is a known nesting area for protected birds during the March 1 through August 31 period which may cause delays and relocation of work at no cost to the Government. Repair and/or rehabilitation of shoreline stabilization structures that are equal to or greater than 48 feet from the shoreline may require time of year restrictions subject to regulatory permits as determined by the Contracting Officer.
1.2 WORK COVERED BY CONTRACT DOCUMENTS
1.2.1 Project Description
The project consists of refurbishing the existing bulkhead at Craney Island Dredged Material Management area (CIDMMA). Annually, the bulkhead accommodates a large number of marine vessels consisting primarily of dredging equipment such as hydraulic and mechanical dredges, scows, barges and survey vessels. The Bulkhead's fender system is the interface between the vessel and the bulkhead. During the berthing of a vessel, the fender system is meant to act as a buffer in absorbing or dissipating the impact energy of the ship without causing permanent damage to the ship or the bulkhead. Once the vessel is successfully berthed and moored to the bulkhead, the fender system continues to provide the interface between ship and shore and transmits the environmental loads (wind, waves, and current) on the ship to the structure. Over the last few years, a large number of fender timber pilings and cross braces have been significantly damaged or destroyed, while the bulkhead structure remains functioning and in good condition. In order to successfully serve its purpose, bulkhead's fender system needs to be entirely replaced in-kind to continue to safely support vessels, plant, and equipment calling on the facility, but minimize damage to the fender system itself.
SECTION 01 11 00 Page 3
1.2.2 Location
The bulkhead is located at the southeastern end of CIDMMA. The exact location is shown on the plans. The USACE office is at the south-west corner of the site at: 4599 River Shore Road, Portsmouth, VA 23703 and can be contacted at 757-201-7605. Access to the site is limited by fencing and access gates and requires USACE approval.
1.2.3 Sequence of Construction
The demolition and construction of the fender system shall be performed in two phases. The northern portion of the bulkhead shall be completed first.
The contractor shall have access to the northern 2/3 of the bulkhead for equipment and operations while completing the northern half. The remaining 1/3 of the bulkhead shall remain open for Craney Island operations. After completion of the northern half of the bulkhead, the contractor shall start construction on the southern half of the bulkhead. The contractor shall have access to the southern 2/3 of the bulkhead for equipment and operations while completing the southern portion. The northernmost 1/3 of the bulkhead shall remain open for Craney Island operations.
1.3 TRANSPORTATION FACILITIES
The Facility is served by a secondary unpaved roads around the perimeter with two connecting cross roads. Road(s) within the Facility that the Contractor proposes to be used shall be subject to prior approval of the Facility authorities. Haul and connecting roads used by Contractor shall be maintained throughout construction and shall be restored to as good condition as existed prior to their use. The Contractor shall also construct, subject to approval, such temporary haul roads and bridges as may be deemed necessary for conducting his work. Any such temporary construction shall be removed and the affected area restored to its original condition before demobilization from the site.
All costs for the use of existing transportation facilities, for the construction of temporary facilities, and for maintenance, repair, removal and restoration shall be borne by the Contractor. The condition of the construction access route roadways shall be documented in writing and supplemented with pictures and video. The report shall be submitted to the Contracting Officer prior to starting the construction. Any existing roads, structures, or utilities damaged by moving equipment and materials to the construction site and during construction shall be repaired and/or replaced by the Contractor at no additional cost to the Government.
1.3.1 Use of Roads
Hard-surfaced paved and unpaved roads from major and primary municipal roads serve the exterior side of the site. The movement of all vehicles shall be confined to the roads designated and shall comply with traffic regulations. The Contractor shall keep all roads clear of all obstructions and free of mud and other foreign materials resulting from operations.
The Contractor's vehicles shall at no time follow a vehicle closer than 50 feet, and all vehicles shall pull off the road and come to a complete stop when meeting emergency vehicles, or vehicles with flashing lights.
Speed limits and traffic controls shall be observed.
1.3.2 Tracked or Cleated Vehicles
Tracked or cleated vehicles shall not be moved over surfaced roads except at the immediate site of the area where they are to be used.

The Contractor shall submit Construction Manpower and Equipment Report daily using Resident Management System (RMS 3.0). The report shall include manpower and equipment for the general and subcontractors.
1.10 PROFIT
For modifications to this Craney Dike Construction contract, profit must be calculated using the Weighted Guidelines method.
1.10.1 Weighted Guidelines
Weighted guidelines method of determining profit shall be used on any
SECTION 01 11 00 Page 7 equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:
Factor Rate Weight Value
Degree of Risk 20% Relative difficulty of work 15% Size of Job 15% Period of performance 15% Contractor's investment 05% Assistance by Government 05% Subcontracting 25% Total 100%
1.10.2 Weighted Values
Based on the circumstances of each procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.
1.10.2.1 Degree of Risk
Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items will have, generally, a higher weighted value than the unit price items for which quantities are provided. Other things to consider: the portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, the amount of labor included in costs, and whether the negotiation is before or after performance of work.
1.10.2.2 Relative Difficulty of Work
If the work is most difficult and complex, the weighting should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk. Some things to consider: the nature of the work, by whom it is to be done, where, and what is the time schedule.
1.10.2.3 Size of Job
All work not in excess of $100,000 shall be weighted at .12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from .12 to .05.
1.10.2.4 Periods of Performance
Jobs in excess of 24 months are to be weighted at .12. Jobs of lesser duration are to be proportionately weighted to a minimum of .03 for jobs not to exceed 30 days. No weight where additional time not required.
1.10.2.5 Contractor's Investment
To be weighted from .03 to .12 on the basis of below average, average, and above average. Things to consider: amount of subcontracting, mobilization payment item, Government furnished property, equipment and
SECTION 01 11 00 Page 8 facilities, and expediting assistance.
1.10.2.6 Assistance by Government
To be weighted from .12 to .03 on the basis of average to above average.
Things to consider: use of Government owned property, equipment and facilities, and expediting assistance.
1.10.2.7 Subcontracting
To be weighted inversely proportional to the amount of subcontracting.
Where 80 percent or more of the work is to be subcontracted, the weighting is to be .03 and such weighting proportionately increased to .12 where all the work is performed by the Contractor's own forces.
1.11 BLASTING AND FIRES
Blasting and fires will not be permitted on this project.
1.12 CONTRACTOR QUALITY CONTROL RESPONSIBILITY
The Contractor is fully responsible for the management and supervision associated with Quality Control of all construction work included in this contract. The Government is responsible for Quality Assurance by reviewing all Contractor documentation and work has been completed to meet contract requirements.
1.13 LIQUIDATED DAMAGES
Refer to contract clause LIQUIDATED DAMAGES - CONSTRUCTION (FAR 52.211-12) in Section 00 70 00 Conditions of the Contract.
1.14 PERFORMANCE BOND
The Contractor's Performance Bond shall remain effective throughout the construction period.
a. In the event the Contractor fails to commence and diligently pursue any construction warranty work required, the Contracting Officer will have the work performed by others, and after completion of the work, will charge the remaining construction warranty funds of expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.
b. In the event sufficient funds are not available to cover the construction warranty work performed by the Government at the Contractor's expense, the Contracting Officer will have the right to recoup expenses from the bonding company.
c. Following oral or written notification of required construction warranty repair work, the Contractor shall respond in a timely manner.
Written verification will follow oral instructions. Failure of the Contractor to respond will be cause for the Contracting Officer to proceed against the Contractor.
d. Refer to contract Clause 52.228-15 PERFORMANCE AND PAYMENT BONDS - CONSTRUCTION (FAR 52.228-15) in Section 00 70 00 Conditions of the Contract.
SECTION 01 11 00 Page 9
1.15 DAMAGE TO THE WORK
The responsibility for damage to any part of the permanent work shall be as set forth in contract Clause PERMITS AND RESPONSIBILITIES (FAR 52.236-7) of Section 00 70 00 Conditions of the Contract. However, if, in the judgement of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES (FAR 52.243-4) in Section 00 70 00 Conditions of the Contract will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as noted herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.
Refer to contract Clause PERMITS AND RESPONSIBILITIES (FAR 52.236-7 in Section 00 70 00 Conditions of the Contract.
1.16 PROTECTION OF EXISTING CONDITIONS AND NEW WORK
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements," the Contractor shall:
a. Perform excavation, transportation, and construction operations in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Perform excavation, transportation, and construction operations in such a manner to prevent injury and damage to new work. Repair or replace portions of new work which have been altered during construction operations, at no additional cost to the government.
c. Repair or replace portions of existing conditions which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing surfaces and vegetation adjacent to the new work shall be in a condition equal to or better than that which existed before new work started.
1.17 PRE-BID SITE VISIT
Prior to the submission of bids, bidders are highly recommended to visit the project site location to become familiar with the project requirements.
This contract includes a Government led site visit during the solicitation period. Failure to visit the project site will not disqualify a bid;
however, the bidder is required to comply with the terms and conditions of the resultant Contract by reason of such failure. A failure to inspect the site shall not constitute grounds for a claim after Contract award.
SECTION 01 11 00 Page 10
1.18 WARRANTY
The Contractor shall provide a minimum of one-year warranty on the materials and workmanship from the date of the Government's acceptance of the work.

SECTION 01 14 00 Page 3
1.6 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE
1.6.1 Costs
Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a Contractor or subcontractor at any tier shall be based on actual cost data when the Government can determine both ownership and operating costs for each piece of equipment or equipment groups of similar serial and series from the Contractor's accounting records. When both ownership and operating costs cannot be determined from the Contractor's accounting records, equipment costs shall be based upon the applicable provisions of EP 1110-1-8, Volume 2, "Construction Equipment Ownership and Operating Expense Schedule", Region II. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply.
For retrospective pricing, the schedule in effect at the time the work was performed shall apply.
1.6.2 Rentals
Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36 substantiated by certified copies of paid invoices. Rates for equipment rented from an organization under common control, lease-purchase or sale-leaseback arrangements will be determined using the schedule except that rental costs leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees are allowable. Costs for major repairs and overhaul are unallowable.
1.6.3 Data
When actual equipment costs are proposed and the total amount of the pricing action is over $25,000, cost or pricing data shall be submitted as specified in FAR 15.408, Table 15-2, Section I titled "General Instructions, Part A". By submitting cost or pricing data, the Contractor grants to the Contracting Officer or an authorizing representative the right to examine those books, records, documents and other supporting data that will permit evaluation of the proposed equipment costs. After price agreement the Contractor shall certify that the equipment costs or pricing data submitted are accurate, complete and current.
1.7 ENVIRONMENTAL LITIGATION
If the performance of all or any part of the work is suspended, delayed, or interrupted due to an order of a court of competent jurisdiction as a result of environmental litigation, as defined below, the Contracting Officer, at the request of the Contractor, shall determine whether the order is due in any part to the acts or omissions of the Contractor or a subcontractor at any tier not required by the terms of this contract. If it is determined that the order is not due in any part to acts or omissions of the Contractor or a subcontractor at any tier other than as required by the terms of this contract, such suspension, delay, or interruption shall be considered as if ordered by the Contracting Officer in the administration of this contract under the terms of the "Suspension of Work" clause of this contract. The period of such suspension, delay, or
SECTION 01 14 00 Page 4 interruption shall be considered unreasonable, and an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) as provided in that clause, subject to all the provisions thereof. The term "environmental litigation" means, a lawsuit alleging that the work will have an adverse effect on the environment or that the Government has not duly considered, either substantively or procedurally, the effect of the work on the environment.
1.8 PARTNERING
In order to most effectively accomplish this contract, the Government is willing to form a cohesive partnership with the Contractor. This partnership would strive to draw on the strengths of each organization in an effort to achieve a quality project done correctly, within budget, and on time. This partnership would be bilateral in make-up and partnership will be totally voluntary. Any cost associated with effectuating this partnership will be agreed to by all parties and will be shared equally with no change in contract price.

1.1 SUMMARY
This section describes how Line Items will be measured and paid for when making progress payments for this Craney Island (CI) Bulkhead Refurbishment construction contract. Work to be measured is described in the applicable specification sections listed for each Line Item.
Measurement procedures for payment, required quantity surveys and/or procurement documentation and payment restrictions are also described in applicable specification sections. Allocate costs for work not specifically mentioned to the Line Item most closely associated with the work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items. The lump sum prices and payments made for each item listed shall constitute full compensation for furnishing all plant, labor, materials and equipment; and performing any associated Contractor quality controls, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
The terms "Contract Line Item Number (CLIN)" and "Line Item" are interchangeable herein (e.g. CLIN 0001 is the same as Line Item 0001).
The term "CLIN" is a contracting term used in the Quality Control System (QCS) payment system.

1.3 LUMP SUM PAYMENT ITEMS
Payment items for the work of this Craney Island (CI)contract for which contract lump sum payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or lump sum item, are included in the listed job item most closely associated with the work involved. The lump sum price and payment made for each item listed
SECTION 01 22 00.00 10 Page 2 constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
Progress payments for lump sum CLINs will be made in accordance with the Payments listed Under Fixed-Price Construction Contracts clause of Section 00 72 00 CONTRACT CLAUSES. Submit a Schedule of Values within 20 calendar days of Notice to Proceed (NTP) for Government approval. An unbalanced schedule will be returned for revisions. 1.3.1 Payment for Line Item No. 0001 - Full Mobilization and Demobilization
This pay item includes all costs connected with the mobilization and demobilization of all of the Contractor's equipment, as defined below, which will be paid for at the contract lump sum price for this item (exclusive of work included in line items 0002 d 0003). Sixty percent (60%) of the lump sum price will be paid to the Contractor upon completion of his mobilization to the work site. The remaining forty percent (40%) will be paid to the Contractor upon completion of a full demobilization at the end of the contract. In the event the Contracting Officer considers that the amount in this item, sixty percent which represents mobilization and forty percent which represents demobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer may require the Contractor to produce cost data to justify this portion of the bid. Failure to justify such price to the satisfaction of the Contracting Officer will result in payment of actual mobilization costs, as determined by the Contracting Officer, at the completion of mobilization, and actual demobilization costs, as determined by the Contracting Officer, at the completion of demobilization. The determination of the Contracting Officer is not subject to appeal.
1.3.1.1 Mobilization

c. Construction of access to the construction area.
d. All costs for any other associated work that is necessary in advance of the actual project including establishment of project management and coordination.
e. To support the preparation of the specification required documentation specified as being due before actual construction work can start at the site including, but not limited to, a quality control plan, SECTION 01 22 00.00 10 Page 3 work plans as required by individual specifications, a progress schedule, an accident prevention plan; an activity hazard analysis, and an environmental protection plan.
1.3.1.2 Demobilization
A full demobilization shall include all work required for a final closeout of the project including, but not limited to, permanent transportation of personnel, equipment, and materials from the job site, decommissioning of temporary facilities, and cleanup of all work areas. Except for the new construction areas, all sites shall be returned to their original condition as found at contract award and as determined by the Contracting Officer. Full demobilization should only occur when the Contractor, in agreement with the Contracting Officer, is leaving the site with no expectation that work remains to be completed under the current contract.
