“All costs associated with the mobilization and demobilization of 12,000 feet of pipeline (additional to the lengths required in other Bid Items), exclusive of Payment Item 0001, to the designated mobilization point in the James River.”

f. PROJNET comment and response are listed below for information purposes only:

Bidder Inquiries and Corresponding Government Responses from PROJNET are hereby incorporated:

Inquiry ID: 7778446

Would the Owner please consider pushing the due date for questions back to Jan. 15th and the bid date back to Jan. 29th to allow the contractors more time to investigate the project area?

Government Response to Inquiry ID: 7778446:

The ability to ask questions and/or provide comments in PROJNET ended on 11 January 2019.

Please monitor amendment changes to the solicitation in Federal Business Opportunities to determine if the bid opening date has changed.

Bidder Inquiry ID: 7780353 Reference - River Miles 27 to 90.8 "Dredging is not permitted during the period 15 February through 30 June of any year".

Reference - River Miles 0 to 27 "Dredging is not permitted during the period 15 February to 15 June of any year.

Question - Is it to be assumed that no dredging work will be performed until June 15th of 2019 at the earliest due to the environmental windows?

Government Response to Inquiry ID: 7780353:

In general, that is correct. No overboard disposal is allowed in the Lower James River between February 15th through June 15th of any year to protect anadramous fish populations and shellfish. No overboard disposal is allowed in the middle James River between February 15th through June 1st at Goose Hill Shoal and February 15th through June 30th of any year at the remaining shoals along the middle James River to protect anadramous fish.

Work can presume after June 1st on Goose Hill Shoal, after June 15th at Tribell and Rocklanding Shoals, and after June 30th at Dancing Point - Swann Point Shoal and Jordan Point to Windmill

Point and Harrison Bar Shoal.

Bidder Inquiry ID: 7780356 Question - Does the Owner have any idea at this time as to which bid items would be awarded in the first years work?

Government Response to Inquiry ID: 7780356:

At this time, it is not certain which bid items and quantity amounts will be exercised during the first year of the Contract. Specification Section 35 20 40, Historical Bank Height Information, from previous James River Task Order Dredging Contracts, is provided as part of the specifications for reference.

Bidder Inquiry ID: 7780404 Would the Owner consider scheduling an on-site meeting to take any interested contractors for an on-site inspection of the Upland Placement Site at Richmond Deepwater Terminal?

This could greatly benefit everyone involved in order to get a better understanding of the current conditions and the proposed work involved.

Government Response to Inquiry ID: 7780404:

Interested Contractors may visit the Upland Placement Site at Richmond Deepwater Terminal, however, no formal site visit will be arranged.

Bidder Inquiry ID: 7780483 Plan Drawings Sheet 3 of 13. Is the only work to be performed and priced for bid items 0011, 1011, & 2011 listed in the notes 1 - 3, along with Erosion & Sediment Control Notes 1 - 13?

Government Response to Inquiry ID: 7780483:

In addition to notes on plan drawing sheet 3 of 13, for the work to be performed and priced for bid items 0011, 1011, & 2011, please refer to Specification Section 31 00 00, Earthwork and Specification Section 31 11 00, Clearing and Grubbing.

Referencing Specification Section 31 00 00, Earthwork, paragraph 1.2 Criteria for Bidding, sub-paragraph c. for the Richmond Deepwater Terminal Upland Disposal Site, please assume that dike crest elevations will not be required to be raised. However, all existing slopes shall be restored to grade as indicated in the specifications and project plans, prior to placement of dredged material in the facility.

Bidder Inquiry ID: 7780534 Sec. 35 20 23 Pg. 11. Reference - "Contractor designated acceptance sections shall be for contiguous areas, the full width of the channel, identified by station numbers, and shall not exceed three acceptance sections for the entire James River Channel dredging area".

Question - Please consider allowing an acceptance section for every 15,000 lf of proposed dredged shoals. Allowing only 3 acceptance sections for 90+ miles of river is not nearly enough.

Government Response to Inquiry ID: 778053:

To clarify, the total number of acceptance sections indicated is intended for each channel segment being dredged within the task order issued, not the entire James River Channel dredging area. Change and clarification to acceptance section specification language will be provided by amendment.

Bidder Inquiry ID: 7780626 Reference - "The Contractor shall have the placement location marked in the field by a certified professional engineer or surveyor licensed in the Commonwealth of Virginia".

Question - How does the Owner want the placement area marked? Are you wanting the four corners marked with buoys?

Government Response to Inquiry ID: 7780626:

The placement area shall be marked in accordance with Specification Section 35 20 23, Paragraph 1.6 Layout of Work and Surveys.

Bidder Inquiry ID: 7780641 Sec. 35 20 23 Pg. 22. Reference - "Access to all upland placement sites will be gained through transiting the James River waterway via barge and mooring adjacent to upland placement site".

Question - Will the Owner allow the Contractors to have access to the Richmond Deep Water Terminal Placement Site via road access? If not, is there a road or path from the waterway in which the Contractors will be able to access from the waterway?

Government Response to Inquiry ID: 7780641 The Norfolk District has authorization for entry from the City of Richmond onto the placement site to include access from the waterway. The Norfolk District does not have road access which is currently owned by Vulcan Materials Company. An exhibit of the Richmond Deepwater Terminal Placement area showing typical water access and pipeline route will be provided by amendment. The Contractor may coordinate with Vulcan Materials Company as appropriate, for road access.

Bidder Inquiry ID: 7780646 Question - Is it known which upland placement sites will be used during the duration of the three year project?

Government Response to Inquiry ID: 7780646 It is currently anticipated that only the Richmond Deepwater Terminal upland placement site will be used in support of this three year contract.

Bidder Inquiry ID: 7780648 Sec. 31 00 00 Pg. 7. Reference - "Test offsite soils brought in for use as backfill....."

Question - Is it anticipated that the Contractor will need to bring in off site material for DA work?

Government Response to Inquiry ID: 7780648

It is currently anticipated that offsite material will not be required to satisfy earthwork requirements associated with the Richmond Deepwater Terminal Upland Placement Site.

Bidder Inquiry ID: 7780652 Does the work at the Richmond Deep Water DA require raising any of the levees? If so, what is the anticipated cubic yardage of material to raise the levees?

Also, if the levees are to be raised, please send out plan drawings showing cross sections of the existing grade along with the required grade.

Government Response to Inquiry ID: 7780652 For the Richmond Deepwater Terminal Upland Disposal Site, please assume that dike crest elevations will not be required to be raised. However, all existing slopes shall be restored to grade as indicated in the specifications and project plans, prior to placement of dredged material in the facility.

Bidder Inquiry ID: 7780654 Sec. 31 11 00 Pg. 5. If clearing and grubbing are required at the DA's, will the contractor be allowed to burn the debris inside of the DA?

If burning is not allowed, will the Contractor be allowed to leave the debris inside the DA or would the debris need to be hauled off to an off site location?

Government Response to Inquiry ID: 7780654 The Norfolk District prohibits all controlled burning inside of their dredge material placement areas. Ensuring positive drainage to the spillways is not obstructed, the Contractor may bury debris inside the upland area and/or haul the material offsite to a landfill.

Bidder Inquiry ID: 7780672 Reference - "Sand /gravel from Richmond Harbor dredging shall remain Government Property”.

Question - Do you have any borings that detail this location? We are curious as to the degree of gravel found at this location.

Government Response to Inquiry ID: 7780672 The Government does not have any current boring logs of the maintenance dredge material for this location.

Bidder Inquiry ID: 7781595 Sec. 35 20 30 Pg. 2. Reference - The station numbers listed for Richmond Deepwater Terminal to Hopewell are 92+00 to 910+00. However the plan drawings (James River Richmond Deepwater Terminal to Hopewell Project Condition Survey) show the station numbers going from Station 542+00 to 911+00. The River miles appear correct, which makes me assume the station numbers are incorrect.

Question - Is this a mistake on the station numbers? If so, can you please correct this?

Government Response to Inquiry ID: 7781595

Referencing Specification Section 35 20 30, Table of River Miles James River, the current listed station numbering for Richmond Deepwater Terminal to Hopewell 92+00 to 910+00 is correct.

Specification Section 01 15 00 James River Shoal Location Drawings, paragraph 1.3 Exhibit Drawings, provides for a partial condition survey (Exhibit Map 5B) of Richmond Deepwater Terminal to Hopewell. The limits of that most current condition survey ranged from station number 542+00 to 911+00.

Bidder Inquiry ID: 7781599 Reference - Bid form Could you please include the station numbers on bid items 4, 5, & 6 so the Contractors can have a better understanding about which areas are included in the pricing. There appears to be some conflicting information when looking over the plan drawings and "Table of River Miles James River"

Government Response to Inquiry ID: 7781599 It is the Government’s opinion that the bid items are clearly indicated, and that additional detail and clarification is provided in Specification Section 01 22 00, Measurement and Payment.

Bidder Inquiry ID: 7782198 Question - I did not see any information in the specifications regarding payment and performance bonds. Could you please either note where this can be found or send out this information if it is not already included in the specs.

Government Response to Inquiry ID: 7782198 Please refer to solicitation document titled ‘A.07.23_W91236-19-B-0002_FINAL.pdf’. Blocks 12A, 12B, and 18 of standard form 1442 indicate requirement for performance and Payment bonds. In addition, clause 52.228-15, Performance and Payment Bonds—Construction, is included by reference on page 33 0f 49.

Bidder Inquiry ID: 7783071 Sec. 01 57 20 Pg. 13. Reference - "During active dredging operations at Upper James River shoals, between the time period of July 1 through October 31st, the Contractor shall perform water quality monitoring for dissolved oxygen".

Reference - National Marine Fisheries Service Endangered Species Act Section 7 Consultation Biological Opinion / Pg. 9 / 3.5 / (3) / "The Corps is required to monitor dissolved oxygen levels from July 1st to October 31st during dredging activities".

Question - Who will be responsible for monitoring the dissolved oxygen levels during the duration of this project? The Contractor or the Corps?

Government Response to Inquiry ID: 7783071 Specification Section 01 57 20, paragraph 3.5.4 Water Quality Monitoring (Dredging), indicates that during active dredging on the Upper James River between the periods of July 1st through October 31st of any year, it is the Contractor's responsibility to perform water quality monitoring for dissolved oxygen.

Bidder Inquiry ID: 7784724 Reference - "The Contractor will efficiently pump dredged material at distances as far as 22,000 feet as directed by Task Orders".

Evaluation - You detail in the referenced spec that the contractor could pump upwards of 22,000 feet. However you only require the Contractor to bring 10,000' in the base bid mobilization/demobilization 0001, with an additional 10,000 feet in bid item 0002 mobilization/demobilization of additional pipeline. This equates to a total of 20,000 feet of pipeline.

Question - How much pipeline should the contractor expect to have on-site at max for this project; 20,000 feet or 22,000 feet? If it is 22,000 feet, then please revise bid item 0002 to reflect bringing an additional 12,000 feet on-site.

Government Response to Inquiry ID: 7783071 Noted. The Contractor should anticipate to bring a maximum of 22,000 feet to the project site.

Clarification will be provided by amendment.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
