ATTACHMENT 11
Performance Requirement
1. Quality Assurance Surveillance Plan (QASP): The government will develop a QASP to monitor the contractor work. The government will monitor contractor performance and make deductions when the deviations are greater than the maximum allowable listing in the Performance Requirements Tables.
2. Evaluation: As a minimum, the contractor's performance will be evaluated annual, additional evaluations may be prepared any time during the contract performance when determined to be in the best interest of the Government. The format for the evaluation will be DD Form 2626, and the contractor will be rated either "Outstanding," “Above Average”, "Satisfactory”, “Marginal”, or "Unsatisfactory" in the areas of Contractor Quality Control, Timely Performance, Effectiveness of Management, Compliance with Labor Standards, and Safety Standards. The Contractor will be advised on any unsatisfactory rating, either in an individual element or in the overall rating, prior to completing the evaluation; all contractor comments will be made a part of the official record.
3. Performance Requirements: Performance requirements for work performed under this contract are set forth below and in the Performance Requirements Tables.
3.1. The existence of some deficiencies in services provided does not necessarily deem the contractor's overall performance unsatisfactory. Unsatisfactory or unacceptable levels of performance for each service are set forth in the Performance Requirements Tables. These acceptable quality levels (AQLs) specify the minimum acceptable level of performance for each service in terms of the maximum amount of deficiencies. Whenever two (2) or more AQLs are specified for a service, failure to meet one will be considered an unsatisfactory level of quality for the service.
3.2. Whenever the Government's Quality Assurance Inspections indicate that AQLs have not been met, a citation will be issued either orally or in writing by the COR. The contractor shall take immediate action to correct his quality control program and shall notify the COR of his actions within one work day. If all corrective actions cannot be completed within one work-day, the contractor shall furnish daily reports on their status until they have been completed.
4. Deductions for Deficient Work. Deductions from the contractor’s scheduled earnings will be made for services that have been cited as not clearly meeting the standards set forth in the Performance Requirements tables or any other portion of this contract. Each documented defect represents a loss to the Government. This loss is defined as the contract bid price or applicable portion thereof for each service. Deductions for documented defects will be made in accordance with the following procedures.
4.1. For each service found deficient that required the Government to perform the work with its own forces, the deduction shall be made in an amount equal to the Government’s cost.
4.2. For each service found deficient that required the Government to hire another contractor to perform the work, the deduction shall be made at the contract price paid plus any additional cost incurred by the Government to prepare, solicit and administer the second contract.
4.3. For each service found deficient and not re-performed, the deduction shall be made based on the COR’s estimate of the contractor’s cost to re-perform the work.
