1. This is a full and open procurement. In accordance w ith Federal Acquisition Regulation (FAR) 19.1307, this project requires the HUBZone 10% price evaluation.
2. The estimated magnitude of this requirement is betw een $25,000,000 and $100,000,000.
3. The NAICS Code is 237990, w hich has a small business size standard of $39.5 million.

SCOPE OF WORK
This project includes deepening of the upstream approach to the locks in the north canal at the Soo Locks complex in Sault Ste. Marie, Michigan in order to eventually accommodate the construction of a new Poe sized lock in the place of the existing Davis and Sabin Locks. The channel will be deepened to 29 feet below Low Water Datum plus 1 foot of required overdepth and 1 foot of allowable overdepth. The removal of both bedrock and overburden material will be required. The contractor will have the option to use mechanical means or blasting to remove the bedrock. Vibration monitoring will be required to ensure nearby structures such as the lock walls, highway and railroad bridges are not affected. Material will be taken by the contractor to an upland disposal site directly adjacent to the work area. Access to the deepening site is limited and is mainly accessible by water.

Section 00 21 13 - Instructions to Bidders
INSTRUCTIONS
INSTRUCTIONS, CONDITIONS & NOTICES TO BIDDERS
1. INTENT
The intent of this solicitation is to award one (1) Firm Fixed-Price construction contract for the New Soo Lock Upstream Channel Deepening.
2. BASIS OF SELECTION OF AWARD
A. Award shall be made to the lowest priced bidder who is determined to be responsive and responsible.
See Federal Acquisition Regulation (FAR) clause 52.214-19, Contract Award—Sealed Bidding— Construction, for more information.
B. Pursuant to FAR 52.217-5, the Government will evaluate offers for award purposes by adding the price for the option to the total price for the basic requirement. Evaluation of the option will not obligate the Government to exercise the option. The option may be exercised within 120 calendar days after notice to proceed.
3. EVALUATION OF SUBDIVIDED ITEMS:
Item Nos. 0005 and 0006 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its subitems. See section 00 73 00 – Supplementary Conditions VARIATIONS IN ESTIMATED QUANTITIES-
SUBDIVIDED ITEMS.
4. SITE VISIT
As indicated in FAR 52.236-27 SITE VISIT (CONSTRUCTION) – ALTERNATE I, an organized site visit will be conducted on October 10, 2019 for the purpose of allowing prospective contractors to physically inspect and determine the characteristics at the project work area. Please refer to the FAR clause 52.236-27 Alt I, Site Visit (Construction) incorporated by full text in this solicitation, for information pertaining to the scheduled site visit.
5. REQUESTS FOR INFORMATION
A. Prospective Bidders should submit questions concerning this Solicitation through the Bidder Inquiry function in ProjNet at www.projnet.org/projnet October 22, 2019. This is the Corps of Engineers’ standard platform for receiving and responding to questions and requests for information.
B. All questions and all responses will be visible to all registered users who sign into the system for this solicitation.
C. To submit and review bid inquiry items, bidders will need to be a current registered user or self-register into the system. To self-register, go to the aforementioned web page and click on the BID tab.

IMPORTANT NOTICE REGARDING REGISTRATION IN SAM
Effective June 29, 2018 vendors creating or updating their registration can have their registration activated prior to the approval of the required notarized letter. 10. AMENDMENTS
Acknowledgement of each amendment by the Bidder must be made in the space provided on the SF 1442, or by returning a signed copy of the amendment by the time set for receipt of bids. Explanations or instructions given in a form other than an amendment to the solicitation shall not be binding. Questions (on a non-attribution basis) and answers shall be furnished to all prospective bidders via the web site.
11. SMALL BUSINESS SUBCONTRACTING PLAN
As indicated in Clause 52.219-9 SMALL BUSINESS SUBCONTRACTING PLAN (DEVIATION 2018- O0018, and 2019-O0005)--ALTERNATE I, the apparent low bidder, if the company is not a small business concern, will be directed to submit a subcontracting plan for evaluation and approval as a condition of award of any contract pursuant to this solicitation. The goals and requirements of the approved plan shall be incorporated into the contract. Failure to submit a subcontracting plan that conforms with the requirements identified in the clause shall make the bidder ineligible for the award of a contract.
12. NOTICE TO BIDDER: Use of Class I Ozone-Depleting Substances
A. In accordance with Section 326 of P.L. 102-484, the Government is prohibited from awarding any contract which includes a specification or standard that requires the use of a Class I ozone-depleting substance (ODS) identified in Section 601(a) of the Clean Air Act, (42 U.S.C 767a(a)), or that can be met only through the use of such a substance unless such use has been approved, on an individual basis, by a senior acquisitions official who determines that there is no suitable substitute available.
B. To comply with this statute, the Government has conducted a best effort screening of the specifications and standards associated with this acquisition to determine whether they contain any ODS requirements. This requirement has no relationship to ODSs.
C. If the bidder possesses any special knowledge about any other ODSs required directly or indirectly at any level of contract performance, the U.S. Army would appreciate if such information were surfaced to the Contracting Officer for appropriate action. To preclude delay to the procurement, the bidder should provide any information as soon as possible after release of this IFB and prior to the submission of bids to the extent practicable. It should be understood that there is no obligation on the bidder to comply with the request and that no compensation can be provided for doing so.
NOTE: Failure to comply with the above instructions may result in an bidder not being eligible for award.
CONTRACTOR QUALIFICAITONS
A. In accordance with Federal Acquisition Regulation (FAR) Subpart 9.1—Responsible Prospective Contractors, no contract will be awarded unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must –
1. Have adequate financial resources to perform the contract, or the ability to obtain them;
2. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
3. Have a satisfactory performance record;
4. Have a satisfactory record of integrity and business ethics;
5. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them;
6. Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
7. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
B. In accordance with FAR 9.106 Preaward Surveys, the Government may request financial, organizational, and planning documentation from a prospective contract awardee as necessary to determine compliance with the project requirements, capability of performing the work, and general responsibility for award of a federal contract. Survey information may include equipment lists, banking records, references, preliminary schedules, naval architecture certifications, resumes, certifications and qualifications of personnel and suppliers, and other information as applicable to the project. Failure to respond to a pre-award survey may prevent the Government from awarding a contract to a prospective contractor.
C. SUBCONTRACTING PLAN: In accordance with FAR 19.702 any large business must agree that small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts with small business, veteran-owned small business, servicedisabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns. The apparent low bidder, if a large business, shall submit a subcontracting plan within 10 calendar days of request.

52.214-19 CONTRACT AWARD--SEALED BIDDING--CONSTRUCTION (AUG 1996)
(a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government, considering only price and the price-related factors specified elsewhere in the solicitation.
(b) The Government may reject any or all bids, and waive informalities or minor irregularities in bids received.
(c) The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.
(d) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. (2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.
52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. (c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Chippewa County, Michigan.
52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT-- CONSTRUCTION MATERIALS UNDER
TRADE AGREEMENTS (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “designated country construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American -- Construction Materials Under Trade Agreements” (Federal Acquisition Regulation (FAR) clause 52.225-11).
(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers. (1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. An offer based on use of the foreign construction material for which an exception was requested-- (i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be twenty (20) percent of the bid price or three million dollars ($3,000,000), whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
